Examination and Perfection of Consumer Public Interest Litigation System

Abstract:Consumer public interest litigation system embodies the vision of fully protecting consumers’ interests, but its implementation is not satisfactory. Therefore, in theory, it is necessary to compare and analyze of the legislative and adjudicative experience of consumer public interest litigation in representative countries of the two extraterritorial legal systems, so as to explore their common characteristics. On this basis, by examining the existing procedural rules in China, this paper examines the key issues in the implementation of consumer public interest litigation from an open perspective, such as the relatively narrow scope of suitable plaintiff, the imperfect pre-litigation procedure, the need to transform the court’s authority, the need to refine the claim for damages, and the need to innovate the mechanism of liability for compensation. Then, based on the problem, this paper puts forward some institutionalized and standardized suggestions, such as diversification of litigation subjects, setting up pre-prosecution procedures, adjusting the powers of courts, properly accepting claims for damages, reasonably calculating and distributing damages, exploring the mechanism of limited liability for damages and the “claim procedure” linking damages with compensation.
