Abstract:This essay, with the theory of microeconomics, believes that transaction cost, maximum, equilibrium and efficiency are the basic concepts as to the jurisprudence of economic analysis. We can get this conclusion through the analysis of jurisprudence of economic analysis represented by Coase, Posmer etc. This essay explains the meanings and functions of these basic concepts in microeconomics and jurisprudence of economic analysis. This essay points out that there is no jurisprudence of economic analysis without the concept of transaction cost. “Maximum, “economic man are the premises to analyze the law with the economic method. Equilibrium analysis is the fundamental way of analyzing the relationship of the policy makers. Game theory is the proper way to analyze the non-market system and insufficient competition market such as law. And efficiency is the ultimate orientation of jurisprudence of economic analysis.

Abstract:Yoram Barzel was a Chicago trained price theorist who became a foundational contributor to the literature on property rights and transaction costs. In this commemoration I outline the academic path he took, but then concentrate on the set of transformative ideas he had that led to 'the theory of economic property rights'. It was Yoram's belief that such a theory is the ground floor for the study of the organization of economic activity, and therefore, should be used to understand the structure and form of law, institutions, firms, and all other forms of organization.

Abstract:Geoff Harcourt was esteemed for the quality of his prolific scholarship. He was a pioneering post-Keynesian economist who specialized in capital theory. But he also wrote on many other theoretical areas as well as contributing to policy debates and writing intellectual biographies. In addition to his published work, he made a remarkable contribution as a teacher and mentor, encouraging, supporting and guiding countless students and colleagues. His contributions to economics and public policy are therefore far more than the work he wrote himself. Generous, collegiate, encouraging and sympathetic, he was an outstanding person as well as a great economist.

Abstract:John Kenneth Galbraith, a notable economist, has left deep imprints upon the political and intellectual history of the 20th century America. This paper tries to reveal the social and moral concerns inherent in, and to a large extent peculiar to, the Galbraithian economics, which were meant to bear upon politics. The author focuses his attention on the political involvement of Galbraith from early 1950s through mid 1970s, with the intention of showing how Galbraith, whether as a devoted insider of the political power or as a critical outsider of it, has remained loyal to his own good sense and his integrity as an independent and critical intellectual. He has thus set up a good example of associating sound scholarship with political activism.

Abstract:In this paper,we briefly reviewed Steven D.Levitt's contribution to the economics of crime.Hiring the so-called"Natural Experiment"method,Lev- itt tested many classical hypothesis in this area pioneered by G.S Becker,name- ly:differentiating deterrence effect of punishment from incapacity effect,identif- ying police's reduction effect on crime,the effect of prison on crime,and legaliza- tion of abortion on long-run crime reduction.From the methodology of natural ex- periment,Levitt's work have provided so many enlightening experiments,which would benefit the test of hypothesis both in the economics of crime and traditional economic theory profoundly.Levitt's research also shadowed a lot of hints over the involvement of experimental method in economics.However,the validity of Levitt's conclusions and their application in real life still deserved further discussion.

Abstract:It is well known that the principle of wealth maximization and the cost-benefit analysis are Judge Richard Posner's core concept and basic method in his theoretical system of law and economics.Based on most of Judge Posner's aca-demic writing and this speech draft, discussed some important theoretical issues in the economic analysis of law, such as the relationship of economics of law and legal pragmatism, the intrinsic difficulty of wealth maximization principle, the theory lim-itation of one dimensional view on law and economics, and the necessity of pragmatic consideration in Chinese judge's judicial decisions.So, in China, we might have more need a new economic analysis of law that starting from the perceptive of inter-action and based on cost-benefit analysis in the future.
Alchian, Buchanan, and Coase: A Neglected Branch of Chicago Price Theory

Abstract:Abstract This paper suggests that there exists a neglected third branch of Chicago price theory, which includes Armen Alchian (1914–2013), James Buchanan (1919–2013), and Ronald Coase (1910–2013). While this branch shares characteristics that are common to the other branches of Chicago price theory, there are two fundamental contributions of this branch that distinguishes it from the others in the Chicago price theory tradition. The first contribution is the application of the logic of choice in discovering alternative institutional arrangements. That is, individuals will engage in exchange not only within a given institutional arrangement, but will also engage in exchange behavior to foster more preferable institutional arrangements that further the particular goals of the exchanging parties. The second contribution is the notion that the provision of markets is an entrepreneurial activity. We argue that this Alchian, Buchanan, Coase approach to price theory provides not only a bridge between the “Old” Chicago School and the “New” Chicago School but also an alternative development of the Chicago School. Our paper, while building on the joint insights of Alchian, Buchanan, and Coase, is focused on Coase’s development of this approach, and clarifying his contribution. By drawing the economist’s attention to transactions costs, Coase more than any other economist of the twentieth century brought institutional analysis to the foreground by stressing the role they play in ameliorating or exacerbating conflicts in a world of positive transactions costs.

Abstract:Since the seminal article on social cost was published by Ronald Coase in the 1960 issue of the Journal of Law and Economics,1 tremendous strides have been made in legal scholarship incorporating economics and, in particular, in relating legal institutions to the pattern of resource allocation in the advanced economies. US legal scholars and economists have given the lead in this development, but Britain is now following hard on their heels not least via the Centre for Socio-Legal Studies, Wolfson College, Oxford. Economists have been appointed to tenured positions in many US law schools and even in a few British law schools and research centres specializing in law and economics have been established, for example, at Chicago, Emory, Columbia, Miami, Pennsylvania, and University College, London. Leading textbooks by Posner2 and Hirsch3 have been published in law and economics and several innovative specialist journals have achieved academic and commercial success.4 Moreover, conventional law journals now publish articles which contain substantial inputs of economics.5 In many ways, this developing interest in law and economics has signalled the emergence of a new institutional economics which has led the subject back from the wilderness of abstract theory and from the more extreme applications of positivist econometrics.

Axiomatic Formulation of the Optimal Transaction Cost Theory in the Legal Process through Cobb-Douglas Optimization

Abstract:In a legal dispute, parties engage in a series of negotiations so as to arrive at a reasonable settlement. The parties need to present a fair and reasonable bargain in order to induce the WTA, willingness to accept of the plaintiff and the WTP, willingness to pay of the defendant. Cooperation can only be attained when the WTA of the plaintiff is less than or equal to the WTP of the defendant. From an economic perspective, the legal process can considered as market place of buying and selling claims. High transaction costs decrease the reasonable bargain, thereby making cooperation more appealing to the defendant. On the other hand, low or zero transaction costs means the reasonable bargain is only dependent on the expected gain from winning at trial and the settlement benefit thereby making cooperation more appealing to the plaintiff. Hence, we need to find a way of adjusting the number of settlements with the number of trials in order to maximize the social utility value. This paper uses Cobb-Douglas optimization to formulate an optimal transaction cost algorithm considering the confinement of a generalized legal framework.

Abstract:We study the Tullock contest model with loss aversion and endogenously formed reference points. In a contest with n possibly heterogeneous players and convex effort costs, we establish sufficient conditions for a unique Nash equilibrium in pure strategies. Subsequently, we analyze the impact of loss aversion on players' spending behavior, probability of winning, and rent dissipation.

Abstract:Jan Tinbergen was the first Nobel Prize winner in Economics and one of the most influential economists of the 20th century. This book argues that his crucial contribution is the theory of economic policy and the legitimation of economic expertise in service of the state. It traces his youthful socialist ideals which found political direction in the Plan-socialist movement of the 1930s for which he developed new economic models to combat the Great Depression. After World War II he was able to synthesize that work into a theory of economic policy which not only provided a lasting framework for economic policy around the world, but also secured a permanent place for economic experts close to government. The book then turns to an examination of his attempt to repeat this achievement in the development projects in the Global South and at the international level for the United Nations.

Abstract:Abstract This introduction considers the highly influential contribution of Douglass C. North to economic history and institutional economics, as it developed from the 1960s until his death in 2015. It sketches the evolution of his arguments concerning the roles of institutions, organizations and human agency. North's conception of the economic actor became progressively more sophisticated, by acknowledging the role of ideology and adopting insights from cognitive science. Eventually, he abandoned the proposition that institutions are generally efficient, to propose instead that sub-optimal institutional forms could persist. A few noted criticisms of North's work are also considered here, ranging from those which are arguably off the mark, to others that retain some force. The contributions to this memorial issue are outlined at the end of this introduction.

Abstract:Economic theory has provided an estimable intuition in understanding the perplexing ideologies in law, in the areas of economic law, tort law, contract law, procedural law and many others. Most legal systems require the parties involved in a legal dispute to exchange information through a process called discovery. The purpose is to reduce the relative optimisms developed by asymmetric information between the parties. Like a head or tail phenomenon in stochastic processes, uncertainty in the adjudication affects the decisions of the parties in a legal negotiation. This paper therefore applies the principles of aleatory analysis to determine how negotiations fail in the legal process, introduce the axiological concept of optimal transaction cost and formulates a numerical methodology based on backwards induction and stochastic options pricing economics in estimating the reasonable and fair bargain in order to induce settlements thereby increasing efficiency and reducing social costs.

Abstract:Abstract In this essay, we honour the memory of Oliver Williamson by reflecting on Chiles and McMackin's 1996 Academy of Management Review article ‘Integrating variable risk preferences, trust, and transaction cost economics’. The article, which built on Williamson's work in transaction cost economics (TCE), went on to attract attention not only from the authors’ home discipline of management and organisation studies, but also from other business disciplines, the professions and the social sciences. After revisiting the article's origins and core arguments, we turn to selectively (re)view TCE's development since 1996 through the lens of this article, focusing on trust, risk and subjective costs. We cover conceptual and empirical developments in each of these areas and reflect on how our review contributes to previous debates concerning trade-offs implicit in relaxing TCE's behavioural assumptions. We conclude by reflecting on key points of learning from our review and possible implications for future research.

Where high market shares and concentration were once thought to induce market power and cooperative behavior and thus higher prices, they are now presumed by many to be symptomatic of the greater efficiency (and hence lower prices?) of the leading firms. Abstract:A contest's organizational structure or mechanism is often determined by the organizer's goal. While most contest organizers are interested in maximizing the effort expended by the contestants, some are interested in maximizing social welfare. We examine the corresponding contest mechanisms using a Tullock contest (standard and winner‐pay) combined with the yardstick approach, which in some cases can achieve both goals simultaneously. Two cases are considered. The first is the yardstick approach that takes the form of a payoff scheme in a standard Tullock contest where the contestants (winners or losers) are reimbursed according to the average effort of the other n−1 contestants. In the second, the yardstick approach is introduced into a winner‐pay contest, in which the winner pays the average cost of the other contestants' efforts.
