Abstract:Chinese sociologists have made two contributions to the property rights studies of contemporary Chinese society. One contribution is that they have revealed that the property rights contracts of rural collective assets are based on principles of fairness—the principle of survival,the principle of equality to community members, the principle of taking land's boundary as delimitation, and the principle that benefits belongs to investors. The other contribution is that they have discovered that the rules of property rights delimitation are diverse and uncertain in China, and the clients often rely on their own might to choose rules and to advocate their rights. The first contribution can help us understand the logic of social construction of "collective ownership", but lacks logical inference in the end. The other contribution is a challenge to a conclusion of the game theory of evolution—the local confirmity affect of institutional evolution, however, the challenge needs more empirical evidence to be rigorous.
The Level of Decentralization and Property Rights Protection––a Sociological Analysis of Property Rights

Abstract:Economists have used the mechanism of interjurisdictional competition to explain how decentralization affects the degree of property rights protection. This fails however to account for another significant question: In China, can the local decentralization from the provincial level to the prefectural (county) level be more effective in protecting the private property rights of investors, especially when goods and production factors cannot flow freely among regions? The social perspective of property rights can help answer this question. In this study, we find that within the governance structure of decentralization, the mechanism of vertical constraints is more significant than the mechanism of interjurisdictional competition in protecting the private property rights of investors. However, the effectiveness of the vertical constraints mechanism depends on the resistance costs of discontented investors. Decentralizing to the prefectural level, in comparison to the provincial level, lowers these resistance costs for investors while strengthening the mechanism of vertical constraints, thereby improving the degree of property rights protection for private investors.

Abstract:Based on the framework of new institutionalism,the paper defined the concept and history of public hospital′s attributes,dividing such hospitals into those built based on poverty alleviation and those on social identity priority.Considering the attributes of the public goods provided by public hospitals,the diversity of their investment,and attributes of their value production process,this paper probed into their property right arrangement.It is emphasized that such hospitals should enhance their key property right feature of public ownership,and on such basis their relationship with government and corporate governance establishment can be discussed.

Abstract:The property relations between private schools and their owners are the property relationships between them.And the confusion of property right is a great hidden danger to the development of private schools in China.Private schools in countries of continental legal system fall usually into the type of contributions and take the form of a corporation body in property system.While in countries of Anglo-American law system,private schools are run in two modes—contributions or investments—and adopt different managing ways.The type of contributions adjusts in the form of community trust,while the type of investment is the same as a corporation.Private schools in China mainly belong to the type of investments which are almost the same as invested private schools in England and American and should be classified into corporation management.

Abstract:The institutional reform of land property rights is confronted with various challenges from all aspects of the economic and social lives in the current stage.The original property reform theory does not agree with the current practical requirement of land use and management.How to fully reflect the political,social,organizational and juristic nature of land property right in the newly-formed concepts of land property reform and its institutional innovation,and further provide a trajectory for future reforms in China,are the main purposes of our theoretical research.It needs to combine together the theories of economics and sociology to analyze related issues.The four-level-social-analysis framework proposed by Williamson provides a good logic to link property right with resource allocation,sociology with economics.Through such a logic,a comprehensive analysis on the nature and the assessment of Chinese land property can be achieved,which can further provide a theoretical basis for the trajectory choice of the current land property reform.The analysis offers scientific references for the new-round of land property reform in China.

Abstract:Who is the owner of the assets? It is not a laughing matter. In the rural area of China,both the individual farmer and the rural household could be regarded as the owner of assets (double-level owner system). Corresponding to the ownership by the working people adopted by Constitution,the laws and regulations optionally adopts the terms such as the collective economic organizations of village,township or town,the villagers' committee,the sub-committee of villagers,other forms of rural collective economic organizations in a village,and even the government in township or town level. Under current legal system,there is a familiar conception in Chinese suo you zhi (the system of ownership) which is quite different to the original words used by Karl Marx and F. Engels in Manifesto of the Communist Party,one of their greatest works. Under such circumstances,the law would be doomed to be a political proclamation rather than a purified and exercisable law on property rights; and therefore,the boundary between one's rights to another's would hardly be distinguishable.

Abstract:Property change does not absolutely affect corporate performance directly,but by two forces: privatization and control right change.The empirical research on China list companies showed that the two forces of property change not only affected corporate performance directly,but also affected corporate performance indirectly by improving corporate governance mechanism.In the direct aspect,privatized change ruined corporate performance while control right change improved performance.In the indirect aspect,the property change improved corporate governance structure according to governance theory and governance rules.However,the advanced governance structure did not improve but decreased corporate performance on the contrary.Therefore, researchers and corporations need to think further about the question how to change property and establish corporate governance system.

Abstract:In the course of institutional change of government-dominated supply of China's state-owned commercial banks, state utility is an important variable, property rights structure is a key factor. This paper draws a brief conclusion by institutional analysis: Firstly, state utility function has transferred from control preference to efficiency preference with the development of economy and change of circumstance. Secondly, that the reform of state-owned banks before 2003 had little effect is due to unchanged monopoly of state-owned property rights. Thirdly, joint-stock reform of state-owned commercial banks is logical on condition of state utility and system transfer.

Abstract:The case of China seems to present a counterexample to the literature on economic institutions as its private enterprises have achieved spectacular growth despite poor protection of private properties and difficulties in accessing external finance. In this study, we address this apparent puzzle by investigating the impacts of property rights protection and access to external finance on the reinvestment decision. Using the instrumental variable estimation to address the endogeneity issues, we find that property rights protection is more important for the reinvestment decision than the access to external finance.

Abstract:Allocation of control rights between the owner of assets and the owner of human capital is an important part of an institution arrangement within a firm, but unfortunately there are widespread controversies about this subject in the literatures. Basing on some studies on control rights, this paper divides control rights into crucial rights of control and general rights of control, and illustrates the allocation of them. Our study explains the allocation of crucial control rights within firms as a response to the risks of external effects, and points out that the allocation of general control rights depends on the marginal equilibrium of cost and benefit of exerting crucial control rights.

Abstract:This paper examines how ownership type and institutional environment affect firm taxation. Using a sample of Chinese-listed firms from 1999 to 2006, we find that private firms enjoy a lower effective tax rate than local state-owned enterprises. In addition, the preferential taxation of private firms is associated with local government incentives to promote local economic growth. We find that private firms located in regions with a lower level of privatization receive preferential tax treatment. Our results also suggest that decentralization and interjurisdictional competition lead to financial interdependence between local governments and private firms.

Abstract:There are major differences between state ownership and the ownership in traditional civil law in the aspects of the nature of right,creation of powers and functions,way of exercise and legal protection as it has separated itself from the theoretical framework and legislative structure of traditional real right and ownership.In accordance with the public property law theory,the state-owned property stipulated in the Real Right Law can be categorized into state-owned natural resources,state-owned property for public use,state operated assets and so on,which possess the attributes of state-owned public property and state-owned private property.With a duality of public right and private right,the state ownership is a special mixed legal relationship jointly regulated by public law and private law.The construction of state ownership should surpass the traditional boundary of private law.The prospective Civil Code in China should provide general provisions on property right and take the state ownership to be an important property right stipulated in a specialized chapter or part.

Abstract:Dividing ownership is the result of mechanization of residences. Divisional ownership of building reflects the state of such right, and accepted by scholars and practical circle. Such rights are scientific and reasonable. Although the divisional ownership of building is a type of property rights, it cannot be operated by general rules of ownership and co-ownership. As a new type of property rights, it should be stipulated separately in property law. Such right, however, should not include the right of membership. The object of divisional ownership of building should not limit to buildings but extended to common properties of the housing estate.
