Abstract:The 1996 Criminal Procedure Law aimed to bring major changes to China’s criminal trial procedure by adding more adversarial components into trials and providing more protection to criminal defendants. Nevertheless, its effectiveness has been questioned continuously by scholars. Based on students’ evaluations of online criminal trials, this study was designed to explore public opinions on China’s criminal trial procedure. In addition, comparisons between mainland students and Hong Kong students, and between law students and non-law students were explored to examine potential differences between two legal systems and between students with different educational background and training. Data showed that the majority of students were satisfied with the three-phase trial procedure and the performance of major players in court. Nevertheless, they also identified a number of problems, all dovetailed with previous scholarly studies. Despite some nuanced differences, cross-group comparisons between the mainland sample and the Hong Kong sample and between law students and non-law students produced largely similar results.

Abstract:Public cases with major social impact in recent years reflect issues in China's authentication system.Lack of public credibility in authentication opinions,lack of right to know and right to act of on the part of clients,and reluctant attitude of public security and judicial authorities towards court appearance of authentication appraisers,all these issues are hindering the perfection of China's authentication system.We should take the opportunity of amendments to Law of Criminal Procedure,with the guidance of proper legal principle,in an effort to perfect relevant system concerning authentication opinions used as scientific evidence.

Abstract:The initial verdict of XU Ting case is a judgment of strict legalism.The reason that it evolves into a public event is the joint attacks of some lawyers,scholars and the public.The retrial verdict applies the special mitigation system which is stipulated in clause 63 of Criminal Law of China and reduces the initial sentence of life imprisonment to five years imprisonment,with the same facts and same crime which is affirmed in the initial verdict.Although the retrial verdict meets the expectations of the public,it has damaged judicial authority immeasurably.Besides,it shows the terrible consequence of untied discretion power.In fact,the crux of the case does not lie in judiciary,but in legislation.Therefore,the special mitigation system can not provide us a feasible scheme for solving the cases alike.Only by establishing regular constitutional review can we completely solve the problem of judicial injustice which derives form legislation injustice.

Abstract:In the academia,the character of judicial committee has a dispute.There are different conclusions from different research angles.From a historical angle,the administrative color of judicial committee has historical reason.From a realistic angle,judicial committee is a factual trial organization undertaking judicial function only in China.From a should-be angle,judicial committee shouldn't be the third trial organization other than sole-judge bench and collegial bench.Although the judicial committee will still exist and operate within some time,it should be cancelled finally.

Abstract:With the arrival of the Internet Age and the increasing power of the media,online live broadcasts become a new landscape in the criminal trial.Online live broadcasts provide us with important data for analyzing China's criminal trial mode when the transparency of China's criminal trial is not adequate.The questionnaire survey shows that most people involved in the survey affirmed online live broadcasts as a new way of procedure disclosure.At the same time,many people pointed out some defects of online trials,such as too simple cases,too many factors of formalism.We can attempt to improve online criminal trial by normalizing the initial procedure,selection standards and specific rules of online live broadcasts.The survey explores some key ways of reforming China's current criminal trial mode from some profile,which include promoting the equal adversaries between the procurator and the accused,keeping witnesses being testified on court,protecting the rights of the accused.

On the Trial Mode Centralized on Files and Notes

Abstract:There is a trial mode centralized on the files and notes existing in Chinese criminal trial.In this trial mode,the public prosecutors dominate and control the whole hearing in trial by reading the files and notes,and the trial of court becomes into a procedure of reviewing and affirming the files and notes,thus not only the admission of the prosecution' evidences is not reviewed,but also the proving force of these evidences is preferred.As a result,the modern rule of criminal evidence loses basis for its existence,and the trial proceeding of court can' t play the role that it should do,and the mechanism and culture in which judgments are reached by trial in court couldn' t come into form.If we don' t discard this trial mode centralized on the files and notes,any judicial reform to exert the function of trial in court will not fred a room for existence.
Discussion on the Application and Improvement of Criminal Trial by Default in China

Abstract:With the promulgation of the new Criminal Procedure Law, China has established the criminal trial by default system. This is a key step in the development of our country’s Criminal Procedure Law, which provides an institutional guarantee for solving the current difficulties in our country’s judicial practice and cracking down on corruption crimes. Starting from the basic connotation of the system of criminal trial by default, this paper discusses the necessity and rationality of establishing the system of criminal trial by default in China. Obviously, the system of Criminal Trial by Default has just been established in China, and there are some problems in many places. It is necessary to conduct further research. Therefore, through the analysis of the relevant content of the system of criminal trial by default in the current Criminal Procedure Law of our country, this paper summarizes the shortcomings in the legal construction of the system of criminal trial by default in the emerging stage of our country, and puts forward relevant suggestions for improvement, with a view to building a more perfect system criminal of trial by default.

Abstract:From the amendment of criminal procedure law in 1996 on,many obvious changes emerged in criminal judicial practice including defense,compulsory measures,method of trial and the implementation of the innocence assumption,which reflected both the advantages and limitations of the amendment to some extent.However,new challenges face the theory of criminal procedure such as guarantee mechanism of the procedure law enforcement,judicial remedy for the right to defense,and formalistic trial proceedings.In addition,conflicts between Chinese legal culture and occidental one should not be ignored though unprompted reform of criminal justice is in process of expandedness.The success in criminal judicial reform shall be acquired by establishing the remedy mechanism for the rights,advancing systematic reform,and transforming the procedural conception regarding criminal lawsuit.

Abstract:"Ma Xi-wu-styled trial"(an informal,mediation-like trial conducted by Judge Ma Xi-wu) was a specific historical product and no wonder was affirmed at that time.Now its re-advocacy indeed has peculiar reasons which will be detailed in this paper.However,this author maintains that as a trail mode,limited by its own features and notions,Ma Xi-wu-styled trial has already lost general and practical meanings and is away from the development of Chinese society.While reflection of the trial mode now will conduce to reestablishing and strengthening multi-styled alternative dispute resolution,China's civil litigation reconstruction in the primary stage of rule of law should focus on litigation and stress the legitimacy of trial procedures so as to accelerate the transformation of Chinese society.

Abstract:Criminal jurisprudence in China is faced with double missions: one is to modify and reform the theoretical structure,the other is to enhance our perception of issues and problems.Therefore,it is necessary to do trans-culture study on criminal jurisprudence.There are some experience distilled from the development of western criminal law systems,such as interpretation of criminal law by judges, emphasis on the objectivism of criminal law,diversified methodologies and analysis of both system and issues,while there are various problems in the development of criminal jurisprudence in China.Multiple ways are possible to make reform on the future China's criminal jurisprudence theory,including emphasizing on the objectivism of criminal law,constructing a layered system of criminal theory,insisting on substantive criminal theory and improving analysis of current issues.
An Empirical Study on Operation of Chinese Criminal Procedure Law

Abstract:Based on data collected from China Law Year Book and practice in one district in east of China from 1997 to 2007,this paper conducts an empirical study on the operation of current Chinese Criminal Procedural Law.Although there are some variations,the data from the district demonstrates all the characteristics demonstrated by China Law Year Book,that is,very low rate of non—prosecution and non— guilty decision,low percentage of defendant appeal and high rate of affirmation of original judgment in second instance trial and trial supervision procedure,which strengthens the conclusion that Chinese criminal process is decided by criminal investigation. A process decided by investigation procedure means once a case is transferred by the investigative organ to be reviewed and prosecuted,it is very likely to be convicted.Most of the first instance trial just reviews and verifies the evidence collected in the investigation procedure.Such process is different from the "trial—center" criminal procedure of western countries.Such process has some advantages,such as encouraging investigative organs to find out the truth of the case by all means and to screen out most of the suspects in the early stage of criminal process to save procedural resources and make suspects get rid of criminal proceedings earlier.However,it does have some disadvantages.It makes investigative organs under great pressures to collect guilty evidence, which would infringe the human rights of the suspects.Moreover,it also makes the public trial a "rubber stamp" to the investigation procedure and cannot revise errors made in investigation. Current judicial reform chooses trail procedure as the breakthrough,and the investigation procedure seems quiet by comparison.This approach of reform is wrong.To be successful in criminal judicial reform,we must start from investigation procedure.The reform of investigation procedure is too ambitious a topic for this paper to look into.But the decision made by the investigative organ at the end of the investigation is the turning point of criminal proceeding.Establishing effective supervision of this turning point is the key to Chinese criminal process.
Construction and Reflection of Chinese Criminal Trial Instance System

Abstract:There are two fundamental values that are regarded significant in constructing trial instance. One is the legitimacy of judgment, and the other is the finality of judgment. These two values are respected not only in continental countries, but also in Anglo-American countries. The identity of the two legal systems is that the first instance procedure is constructed to pursue the value of legitimacy, which is regarded as the basis of the value of finality. In doing so, the two legal systems entitle parties with series of rights, so that a judgment may obtain legitimacy not only from finding the truth, but also from protecting common values as well as procedural justice. There are also differences between the two systems. Firstly, the first instance judgment is the final judgment in Anglo-American countries to obtain finality, but parties are entitled with broad opportunities to appellate review, while in the continental system, the third instance judgment is final. Secondly, the appellate procedure of the Anglo-American system is with a supervising style, which means that the appellate court only review the form of the first instance trial process, and leave the fact finding completely to first instance judges. However, the appellate procedure of the continental countries is a hybrid of supervising and retrial. That is, the second instance procedure is usually a retrial procedure, and the third instance procedure is a supervising one. Following the model of continental countries, the second instance is the final judgment in China. Chinese first instance is to absorb dissatisfaction and obtain legitimacy, but due to the inadequacy of parties' rights, the legitimacy of a criminal judgment may come only from finding the truth, but not from protecting human rights and other important values. More over, the second instance does not function well in pursuing the value of legitimacy either. Consequently, even though the value of finality is emphasized on, it is a mansion based on unstable bases. In practice, although the finality of a criminal judgment is no longer a problem, the legitimacy problem is still salient. Consequently, to improve China's criminal trial instance system, we should pay more attention to the legitimacy of the first instance, and make the effective judgments truly final.

Abstract:Concentrated trial has become the common choice of the countries from two genealogies of law,but showing diverse forms in operation.Extracting the "common factor" from the different patterns of many countries can acquire essential elements constituting concentrated trial,while extracting the "personality" of its essence will provide the classification basis and a new thinking perspective for studying the types of concentrated trial.At the early stage of the enforcement of the new Civil Procedure Law,it's imperative to study the domestic problems and native environment of China,and from multiple aspects such as value,theory,norm and practice,we may explore or cultivate the mode of concentrated trial with "common factor" as well as adapting to the need of China's society,so as to ensure the coordinated and interactive relationship between litigious right and adjudicative power,issues and specific procedural periods,and correct some existing problems in the reform of civil judicature such as unitary participant and interests orientation,blind transplant of foreign systems,and declaration of provisions.

Abstract:Due to the limitations and constraints of the research methods and perspectives,China's criminal procedure studies are facing an unprecedented challenge.In order to overcome the academic difficulties and usher a prosperous criminal procedure law study,researchers on criminal procedure law should not only commit to improving the traditional research methods,but also introduce into it the social science research methods which mainly focus on extracting the viable legal theories from the empirical facts.To this end,we should proceed from China's own legal problems,and extract some theoretical concepts and categories which are of some explanatory power to those problems;we should give up the perfunctory study attitudes of "praise the western legal system" and "criticize China's legal system",and try to find something regularities from a number of experiences and lessons learned from the process of transplanting western legal system into Chinese legal system;we should try to find some theories and disciplines from China's own judicial reform,so as to not only find those systems of true and real vitality,but also advance and bring forward China's domestic legal theory;and finally,we also should redress the wrong tendency of emphasizing too much on the introduction of western concepts and theories of evidence,and try to summarize some evidential rules form China's judicial philosophy,legal history and legal practice,so as to create and bring about our own theory of evidence.

Abstract:The implementation of the simplified trial of general criminal cases improved the efficiency of procedure, however because of the lack of accessorial system and the understanding bias, many obstacles exist in the practice and the procedural rights and substantial interests of the accused are often out of guarantee. Some problems appeared technical reflect the balance and choice between the impartiality and the efficiency. The ongoing practice of simplified trial should be ameliorated with the advance of the evidence discovery system, the legal aid system and the criminal law.

Abstract:A full review is required by the criminal procedural law as a basic principle to identify the appellant and his/her crime in the criminal trial of second instance, which was established on judicial activism and factualism and was justifiable then. However, with the change of society, judicial activism is weakened and factualism is doubted. Holding of the review in judicial practice also proves unsatisfactorily. The conflict between the full review and other judicial values and the trend of judicial reform further indicates its incompatibility. In consideration of the uniqueness of social and judicial settings in China, improving rather than abolishing the institution is our wise option.

Abstract:The 1996 amendment of the criminal procedure law has achieved certain success while left behind some problems resulting in large numbers of incontrollable breaches of legal procedure in practice. On the background of continuously deepening the reform and opening up, and increasingly concerning the situation of the human rights and judicial reform, China shall amend its criminal procedure law again from aspects of safeguard of lawyer's rights, compulsory measures, witness's appearance in court, inquisition by torture, plea bargaining, and criminal composition etc.
