Abstract:The legal term "fundamental rights" has been well recognized in international treaties and legislations. The present study investigates the stipulations on fundamental rights in the four versions (1954, 1975, 1978, and 1982) of and four Amendments (1988, 1993, 1999, and 2004) to the Constitution of the People's Republic of China (PRC) from a sociosemiotic perspective. The findings in this study indicate that the provisions in the Constitution are crafted in such a manner that the dominant social and political participants employ them to maintain their ruling position and promote social and economic developments. In the successive versions and Amendments to the PRC Constitution, the evolution of the provisions on fundamental rights not only demonstrates the development of fundamental rights in China, but also illuminates the underlying mediation mainly among the Chinese government, the Communist Party of China (CPC), and Chinese people. The connotation and validity therein is constructed through communication and competition among various participants. It is therefore argued that the status quo of fundamental rights in China is the result of mediation among the relevant participants under the impact of the social and economic development. The State and the CPC are thus suggested to loosen their grips to promote Chinese people's participation in the mediation process with more attention to the social and economic reality. This study also implies that the definition of a legal term is constrained by other sign systems and hence the importance of an understanding of terminological dynamicity.

Abstract:By exploring the meaning construction of Chinese citizenship stipulated in Chinese legislation and its interaction with social identities and human nature in the Chinese society, the present study investigates the nature and evolution of the conception of Chinese citizens through three selected cases from Chinese legislations, which illuminate that Chinese citizens are essentially persons with independent personalities defined by the rights and obligations stipulated in legislation. This conception is further strengthened by the entitlement to private properties and equality before law. This conception of Chinese citizenship is concrete and meaningful in the sense that it is underpinned with reference to social identities as person, people and personality in Chinese legislations. The reference of the conception to human being constitutes the essence of Chinese legislation. The meaning construction of Chinese citizenship is indeed a dynamic process engineered in the social and cultural process. The findings on the evolution of the construction of Chinese citizenship in Chinese legislation suggest that the formation of legal identity through legislation varies greatly in different countries. Nevertheless, the realization of the conception of citizenship will necessarily be backed up by social identities as person, people and personality, which will be further strengthened and expanded by the legitimating of private properties and equality before law. Citizenship is achieved by social participants through mediation engineered within the social and cultural process.

Abstract:For lack of authentic interpretation of the fundamental right in China, there are crises about administrative legality a-roused by banning begging, restricting outdoor visible indoor advertisement, and etc. Considering China＇ s national conditions, we cannot copy western constitutionalism experience, and can only create a “behavior freedom outside in the right”, which is used to protect those behavior neither received legal restrictions also not protected by law. This kind of freedom can only binding the state power weakly. According to the academic interpretation on the text of Chinese constitution, State has the power to regu-late behavior freedom outside in the right, but may not regulate those behavior which do not have negative externalities and neces- sity to be regulated. In order to ensure the regulatory power not to be misused, regulatory authority have the obligation to provide the public with convincing reasons, ensure that there are no “most people prejudice”and “minority prejudice”.

Abstract:Human dignity has long been introduced into the Constitution of the PRC as a fundamental right, but its restriction on the government acts is far from being satisfactory. By way of analyzing the case of exposing the prostitutes before the public in Shenzhen, a southern city in China, this paper endeavors to interpret the 38th clause of the Constitution in the perspective of normative jurisprudence and demonstrate the defensive function of human dignity while it is deemed one of the basic rights. It is expected that these ideas may devote a little bit to the improvement of China’s constitutional democracy.

Abstract:As a western political tradition,constitutionalism was introduced into China in the late Qing Dynasty.Since Liang Qichao's pioneering endeavor for constitutionalism and his proposal to establish a constitutional government in China within 20 years,constitutionalism quickly appeared in the official vocabulary,and became subjected to heated debate among the court and the commonalty.At the end of the Qing Dynasty and the beginning of Nanjing Republic government,the roadmap of constitutionalism was made known and aroused much disagreement.While constitutionalism was characteristically compatible with stable political situation but not the radically changing one,it was a big challenge to Chinese political wisdom to adopt a constitutional government during the turbulent period in China.

Abstract:This article will focus on the recent constitutional developments in China along two paths. One is the official path initiated by the Supreme People's Court's judicial interpretation for the Qi Yuling case in 2001, which opened up the possibility, met with enormous enthusiasm, for the judicial application of the 1982 Constitution. The other is the unofficial, populist path symbolized by the Sun Zhigang incident in 2003, when the public, for the first time since 1989, expressed strong protest largely via the internet against the mischief of a local government. The article will review the key constitutional developments achieved along both lines and will examine the causes of their successes or failures. Finally, it will point out the inherent limitations in a populist path toward constitutionalism when pursued within an institutional structure where governments at various levels view the Constitution more as a threat to the status quo pertaining to a small minority than as a protection of basic rights for all.

Abstract:Does China have a constitution? That depends on the way in which the word ‘constitution’ is understood. It is commonly thought that China did not have a written constitution until 1908, when the last dynasty enacted the Outline of Imperial Constitution (qinding xianfa dagang), but this does not mean that traditional China was not governed by basic rules and norms. As I argued previously, the Confucian cultural tradition that dominated China for over 2,000 years was centred on the fundamental moral precepts of humanity (ren) and righteousness (yi), around which an elaborate body of rules on rites, ceremonies, etiquette, and other aspects of human behaviour was developed.1 Taken together, they formed a vast normative system of ‘propriety’ (li, sometimes translated as ‘rites’),2 which stood for a set of customs, conventions and procedures to be practiced in daily life for the purposes of cultivating moral virtue, directing and containing human passions, and preserving a well-ordered society. Indeed, these rules were collected in a dense Book of Rites (Li Ji) and enforced by generations of the Confucian gentry, to various degrees of efficacy. To that extent, the traditional China did have a constitution – even a written constitution, if ‘constitution’ is meant to be a set of fundamental rules that govern society.

Abstract:It is known in the world that labor right is one of the fundamental human rights. ″Citizens have the right to work″ is provided in all the previous Chinese constitutions. As a constitutional right, there are differences between the labor right under the legal relation of constitution law and the workers’ right under the legal relation of labor law. Therefore, it is essential in understanding to avoid the theoretical fallacy caused by logical converse deduction, which defines the meanings of labor right from the angle of legal relation of labor law, so as not to confuse the said two legal concepts.There are different understandings regarding the nature of labor right in Chinese jurisprudential circles and some countries and regions where the continental law system is adopted. Comparison with the labor right provisions in Germany, Japan and Taiwan (China) shows that discrepancies result from those in the normative form of the constitutional text, the purpose of labor right, etc. On the other hand, however, the understandings of the nature of labor right tend to converge. China’s labor right should present the dual nature of negative rights and social rights by constitutional interpretation in the transitional period.It is easier to reveal the connotation and function of labor right from another viewpoint of protection by ″integrated approach″:oriented typology of the State’s obligations. The typology of the State’s obligations consists of the obligation to respect, the obligation to protect and the obligation to fulfill, and fulfillment obligations include the obligation to facilitate and the obligation to provide. In case labor right is infringed in realistic life, it is very significant to analyze accordingly the obligations borne by the State.In current China, it is urgent to form a right balance system and reconstruct the mutual constitutionalistic recognition of social fairness and harmonious development through labor right, which embodies two horizontal levels-equal protection of property right and labor right, and strengthening of equality between the employer and the employees, and two vertical levels-increasing the number of representatives of laborers’ interest in policy-making and enhancing basic laborer capacity.

Abstract:In the establishment of western welfare states,the concepts of citizenship and citizen social right have been a dominant theme of social policies of major developed countries after World War II.The author emphasize that implementation of social right is the most important way to maintain social justice in market economy.While establishment of the minimum livelihood guarantee system,enforcement of free compulsory education,and increasing coverage of social insurance beneficiaries imply an expansion of social right of Chinese people,it is not based on citizenship,but on factors like status,occupation and economic capacity.As a result,the effect of social right in promoting social equality is minimized.In fact,differentiated welfare itself is a source of social inequality.The advancing of building a harmonious society provides possibilities of further expanding social right in China.Reform the Hukou system and equalizing the provision of basic public services by the government are two main approaches to expanding citizen social rights in China;both of which require an active response from and adjustment in the public governance system,institutional reform and innovation at various levels of policy-making as well.

Abstract:The article is devoted to a comprehensive analysis of the fundamental components of the state constitutional system of the People’s Republic of China and its evolution. Based on the analysis of the works of famous foreign and domestic Chinese scientists, the traditions of the political system of the People’s Republic of China using general scientific and special methods (dialectical, comparative, logical, system-structural, functional, analysis and synthesis methods), the main characteristic features of the Constitution of the People’s Republic of China in the 2018 edition were studied years, related to changes in the state and social system of China during the second half of the 20th century, especially with the processes of the second decade of the 21st century. In particular, the essence of the system of organization of state power according to the 1982 Constitution of the People’s Republic of China, amendments and changes to the norms of the constitutional legislation of the People’s Republic of China at various stages of its history, forms of state organization, contours of the system of higher and local state authorities of the People’s Republic of China, the sphere of competence of individual state authorities in the People’s Republic of China, their specific functions, which have a certain purpose, aimed at meeting the relevant needs of the state as a system. In addition, the main elements of the political system, including the structure of the party system, and state policy regarding national minorities are analyzed. Conclusions are made about the main stages of the history of the development of the Constitution of the People’s Republic of China, the influence of the official ideology of Marxism and Maoism, the socialist system as the basis of the People’s Republic of China, the place of the Communist Party of China in the state and political system of the country. The issue of the socialist approach to the rights and responsibilities of the citizen, the lack of a real state guarantee of the declared right to work and the significant limitation of the realization of the right to education, the single right to social security in old age on a nationwide scale, is highlighted. The exceptional place of state property in the economy of the People’s Republic of China, the evolution of the form of state government, the principle of popular sovereignty as the core principle of the organization of political power is shown, and the counter-liberal and radical changes of 2018 associated with the strengthening of the power of the President of the People’s Republic of China are characterized.

Abstract:Our daily life sees the frequent infringement of citizen's fundamental rights among private individuals. With the absence of common laws and regulations, can the judge mete out judgment in accordance with Constitution in such cases? Hereby we have the issue of application of constitution in private law sphere. The traditional constitutional theory holds that the fundamental rights are the citizen's rights against government. And constitutional rights have no effect over the disputes among private citizens. However, with the changes in economic conditions and social structure, more and more cases have appeared in which the fundamental rights are subjecting to violations among private individuals. To deal with such situations, the German Federal Constitutional Court turns the fundamental rights into an abstract objective order of values, in that way the constitutional rights are given dual characteristics. An issue arising from such a practice is a controversy between ″direct effect theory″ and ″indirect effect theory″ regarding the way the judge makes application of the constitution. However, all countries have been extremely cautious and strict in application of constitution in private law sphere. Specifically speaking, in judicial process of protecting the fundamental rights, the judge must make a clear differentiation of the relations between constitutional rights and civil rights, which mainly present themselves in the following three areas: first, the difference in the legal relations to be adjusted; second, the difference in tendencies towards the key components of rights; and third, difference in targets of rights obligations and ways of their realization. In light of the current situation in China, however, studies are still needed of the rationality of direct application of constitution in private law. From the point of comparative law, the issue was not put forward in western countries until a fair maturity of constitutional practices and theories was achieved;next, the lawful order in the West depends on the formations and maturity of a civil society; furthermore, it is not conform to the intrinsic requirement of China's current political system. Finally, technical problems remain in the judge's direct application of constitution in private law area. Under such circumstances, it is advisable to render fundamental rights functional in private law relation by way of constitutional interpretation and realize indirect application through value infiltration. Meanwhile, the general clauses in private law can be seen as a cut-in point for fundamental rights. Judges are also required to give full display to judicial initiatives.

Abstract:Constituent power and the Basic Norm are the two sides of the boundary tablet that marks the intellectual province of constitutional law.Without reference to constituent power,constitution will have to base its validity exclusively on the Basic Norm which is but a pure fiction of formalism.By introducing the concept of constituent power into constitutional studies,one may easily identify the Common Program as the legitimate Founding Constitution of PRC and specify the founding time of PRC.The dichotomy of"constituent power"and"constituted power"provides us a powerful conceptual tool with which we can form a clear picture of Chinese political structure,locate the constitutional moments of China,and explicate the paradoxical nature of the"reformative constitution."We can also look ahead into the future of a constitutional government,with a qualified guardian of the Constitution chosen by the people.

Abstract:In the PRC Constitution in force,there exists the term or clause of "personal dignity" without the expression of "human dignity" or "individual dignity" which could be mentioned in the same breath with the fundamental value rationale that appears in the constitutions of many countries.However,them could be transferred to each other in the venation of meanings,and one could find some transferable meaning space especially when involving the Germanic term "human dignity" which is founded on the philosophical base of "personalism".Basing on this and normative analysis of the normative structure of No.38 of the PRC Constitution,one would draw to a new and more reasonable interpretation scheme,that is,"theory of dual normative meaning for personal dignity clause ".

Abstract:From 1929 till 1931, some members of Xin Association, Hu Shi, Luo Longji, Liang Shiqiu, etc., established Ping Association. With Xin Yue as position, they mobilized famous Rights Activities, attacked Nationalist Party's admonitory politics system, requested human rights of democratic constitutionalism, and published The Collection of Works on Human Rights. In late, weak and compromised Chinese bourgeois liberalist activities, and with the late declaration of human rights, Hu Shi and his friends publicized thoughts on right of freedom from human rights' point of view. In other words, it could be said that it was result of direct connections between Chinese and Western thinkers. However, since Nationalist Party could not accept their thoughts and activities, finally Hu Shi was rebuked by Educational Department. And in 1930, he was removed from position as President of Zhongguo Gongxue by Nationalist Government.
A Systemic Interpretation of Social Rights in the Chinese Constitution

Abstract:Prescribed by the Constitution of the People's Republic of China, social rights provisions cannot be comprehended in isolation, nor can they be interpreted simply by referring to the concepts of positive rights or socio-economic rights in traditional constitutional theory. On the basis of the Constitution, social rights exhibit three interrelated dimensions from the perspective of systemic interpretation: promoting people's wellbeing, promoting democratic politics, and promoting citizens' participation in state-building. In the overall structure and normative intention of the Constitution of China, social rights are not only a kind of socio-economic right, but also a fundamental right with a socialist nature. Specifically, social rights are individuals' right to claim their economic welfare from the state, as well as the basic civil right of realizing a comprehensive social identity. They have a social and economic nature, and to a certain degree a political nature. Correspondingly, the normative structure of social rights, and in particular their functions and orientation toward obligation, are constructed on the basis of this kind of nature. The functions of social rights are most frequently manifested as objective value order, and its specific duty to protect not only points to specific state institutions such as the constitutional review organs and judicial organs, but to the whole national governance system, thus forming a Chinese-style institutional guarantee model of social rights.

Abstract:Chinese elites have celebrated its new Civil Code (2021) as the most important statute in the nation's history, and the 'cornerstone' of its turn toward 'rule of law'. The Code expressly binds all persons, as well as public officials, and is judicially enforceable. The statute enshrines rights to dignity, equality, personal liberty, property, and privacy, among others, and codifies duties to protect the environment and to evolve effective means to combat sexual harassment. Echoing the German Code, the statute also contains 'general clauses' that enable the courts to restrict enumerated rights and entitlements for reasons of 'good morals', 'public order', and the rights of others. While constituting an act of massive delegation to the courts, judges remain prohibited from directly enforcing the PRC's Constitution. The article explores the relationship between the Code and Constitution, through a comparative analysis of: (i) the process of 'constitutionalising' the private law around the globe; (ii) the scholarly discourse on the 'horizontal effect' of rights in China; (iii) the structure of the Code itself; and (iv) the development of 'political' control mechanisms, to be deployed by the Communist Party of China and organs of the state to constrain how judges use their interpretive powers.

Abstract:Abstract This article juxtaposes modern Chinese constitutions and constitutionalism with constitutionalism chiefly developed in the West for clarity on the former’s lineage. As constitution is a concept foreign to China, there is no need for the country to enact any constitution unless it genuinely intends to embrace the true spirit of constitutionalism. A comparison of three signal Chinese constitutions yields an ironic, counterintuitive result, for the Constitution of the Republic of China is a refutation of the Nationalist Basic Law of the Political Tutelage Period (enacted in 1931), whereas the Constitution of the People’s Republic of China, though enacted by the Communists, bears the legacy of the Nationalist Basic Law of the Political Tutelage.
