American Constitutional Ethnography: an Introduction

Abstract:While incarnating universal constitutional values,the American constitution also shows its own features in concrete institutions and constitutional culture.Employing the methodology of constitutional ethnography,this article maps out the external forms and structure of the meanings of American constitutional culture.The supremacy of the Constitution,the importance of judicial review,and the triumph of constitutional nationalism flow from the particular,exceptional historical experience begun by the American Revolution.The Constitution is revered because it is a product of the Revolution;judicial review is respected because it helps build the trans-generational,historical,and political community of the American people;indigenous norms hold sway because they grow in the particular historical ground of the American polity.A constitutional ethnography of the United States can help us understand the American constitution as a whole way of life,which includes,but is not limited to,the American Constitution and American constitutional law.
