The Application of Objective Imputation Theory in Property Crime Cases

Abstract:Presently, the discussion of many Chinese scholars opposing objective imputation theory is still considered relatively crude in various issues, and the argument that objective imputation theory can only be applied in some crimes is not persuasive. Compared with the traditional theory of causality emphasizing factual judgment, objective imputation theory is the normative judgment on the premise of the above causality, which has the effect of restricting the criminal punishment scope. It is more important to recognize the methodology of normative judgment towards objective imputation theory. As to the specific content of the subordinate rules scholars' views are diversified. In fact, these rules of objective imputation theory can be considered from both the positive and the negative aspects. Either in judicial interpretation or in dealing with some difficult cases, the judicial practice does not reject the thinking method of objective imputation theory. In generalized property crimes such as fraud, contract fraud, official embezzlement and corruption, besides conditional causality, objective imputation theory provides the test of the relevance between behavior and result, which can ensure that the convicted conclusion is more appropriate and more reasonable. Based on the above, the misunderstanding that objective imputation theory can only be applied in personal safety crimes or a limited range is eliminated theoretically.
