Abstract:In this paper I discuss some aspects of the relationship of African customary law to the economy. Such a vast topic potentially embraces at least three different themes: the economic context in which African customary law has developed and operates today; the economic consequences and implications of different African customary laws; and the relationship between customary law and the economic aspect of society. These three themes inevitably overlap, but while recognising their interconnections I shall concentrate primarily on the third. My principal aim is to identify some of the linkages between customary law and economic relations, especially those linkages which become manifest during broad social changes.An examination of the relationship between customary law and the economy in Africa almost ineluctably requires an historical perspective. This is so, first, because, as I suggest later, customary law is historically specific: it developed in particular historical circumstances and in close conjunction with the formation of the colonial state. Thus, the foundations of customary law in Africa lie partly in the development of capitalism and its expansion from Europe during the colonial era. These interrelated processes have decisively moulded and subtly shaped the law, legal institutions and legal professions of contemporary Africa.More generally, however, it is essential today to envisage the possibility of new, alternative forms of development and social regulation. The particular forms of legal pluralism which characterise third world countries indicate, in many cases, that the subsumption of African economies within capitalist relations of production and exchange has thus far been merely partial and formal.

Abstract:The chapter discusses the fate of customary land tenure systems in Africa in the face of renewed demands for legal land registration systems. The discussion is premised on an assumption that African customary land systems have both inherent weaknesses and strengths, which can be analysed to come up with more appealing land tenure systems that recognise and protect communal land rights of the Africans, especially the women and minorities. The chapter uses examples form a number of African countries to demonstrate the successes and failures of reforms that have been introduced to modernize African customary land tenure systems. African customary land tenure systems are part and parcel of African customary law, and any government interventions must not ignore such a linkage. A key finding made is that African customary land tenure systems, which are essentially communal in nature, have historically been relied on to conserve the environment. That where attempts to reform such a traditional system have been adopted by African governments paying due regard to its operational mechanisms, the introduced reforms have failed to yielded positive results. The chapter concludes that dysfunctional land legislation that vest ownership in the state but which do not recognize communal tenure administered by customary authorities negate African governments intentions to make interventions in favour of their citizens. The chapter recommends that practical solutions to increase security of communal tenure should be adopted in order to provide a basis for more sustainable management of the commons if the implementation issues can be overcome.

Abstract:IntroductionMany strategies of rural development in Africa propose greater reliance on local institutions (Girard 1963; Seibel and Massing 1974; The World Bank 1975: 33–40; Tall 1976). Sometimes these proposals are primarily political rhetoric (Migot-Adholle 1970; Cliffe 1970); but they may, on the contrary, genuinely take account of rural social organization and history (Hamer 1967; Magid 1972; 1976: 154-69). Despite their merits, such proposals often fail to consider sufficiently the changing social and economic bases of rural institutions. One factor which deserves more emphasis is the dependence of rural dwellers on wider economic forces. As producers of cash crops, purchasers of imported goods, and suppliers of wage labour, rural Africans are integrated into the national and ultimately international economy. Integration and dependence are facilitated and encouraged by numerous government policies. Peasants are increasingly drawn to the cities by the symbiotic, subordinate relation of rural villages to the urban capitalist export sector, whose interests require a supply of cheap labour (Amin 1974a; 1974b; Meillassoux 1975; Seidman 1974) and predominate in the making of policy. The consequent dislocation and disintegration of rural communities limit severely the possibilities of delegating new tasks to existing rural institutions or of using them to decentralize authority, foster mass participation, or promote self-reliance.

Abstract:PROF SCHAPERA'S “Handbook of Tswana Law and Custom” appears opportunely, at a moment when the future of the South African Protectorates is a matter of grave concern. It places before the people of South Africa and Great Britain a comprehensive view of the framework in law and custom of society among the native population of Bechuanaland, and at the same time gives them an opportunity of informing themselves of certain aspects of the conditions with which the administrative system has to cope in relation to native institutions. Moreover, it is significant that the inquiry, of which Prof. Schapera's handbook is the outcome, was undertaken, as Col. Rey, the former Resident Commissioner, points out in his preface, not only at the invitation of the administration, which was desirous that its officers should have for their guidance a carefully tested body of information, based upon scientific methods of inquiry, on native law and institutions, but also with the approval of the natives themselves. The older men of the tribes were disturbed, not only because a younger generation was growing up which was unacquainted with tradition and custom, but also because even among themselves there was much uncertainty as to the law. They, therefore, expressed a strong desire that such a record as this should be made.

Review of African Political Economy

Abstract:Historical materialist studies of law, especially in Africa, are relatively recent. One question they raise concerns the ways in which the subsumption of African peasants within capitalist relations of production has affected legal ideas in formerly precapitalist social formations. Using an example from Senegal, this article examines recent changes in the meaning and significance of a particular legal concept. It shows how the change in the social form of labour power during the colonial period resulted in the transformation of a precapitalist conception of ‘childwealth’ into a material and symbolic equivalent of urban labour power as a commodity. In conclusion, the article outlines four general theses about the transformation of legal forms in rural Africa during the 20th Century.

Abstract:Youth-related violence is a frequent topic of press reports and editorial comment. The most disturbing aspects of the phenomenon are the younger and younger age of delinquents and the greater and greater availability of firearms. While the advocates of an American-style approach of absolute repression clash with those of the educative approach to change aggressive attitudes and young people benefit from their "minor" status, the compelling reality is that all preventive programs have failed flatly. This purpose of this study was twofold. The first aim was to highlight the important contribution of tradition and custom to channeling youthful behavior in African society today and yesterday through signification and transmission of law in familial, social, educative and juridical practices. The second goal was to identify and define the psycho-relational elements that can be considered as factors promoting violent and self-destructive tendencies in minors of African origin tempted by migration in a society in which social representations inhibit parents and prevent them from conveying the limits of the law in their children.
Reconciling Customary Law and Cultural Practices with Human Rights in Uganda

Abstract:Customary law has been part of Ugandan law for many years. Section 2 of the Local Council Courts Act, 2006 defines “customary law” to mean “the rules of conduct established by custom and long usage having the force of law and not forming part of the common law nor formally enacted in any legislation”. Ugandan courts have explained the relationship between customary law and other laws. In 1995, Uganda adopted a constitution that includes, among other things, a bill of rights that prohibits discriminatory and degrading laws and customs. This was informed during the making of the Constitution by the arguments of many Ugandans that discriminatory and degrading customary practices and laws should be abolished by the Constitution. In this article, the author illustrates the steps that have been taken by the drafters of the Constitution, Parliament (through legislation) and courts to outlaw discriminatory and degrading cultural practices. The author recommends ways in which some of these measures could be strengthened.

Abstract:The relationship between Africa and China is certainly gaining traction at the moment, and with this development it becomes imperative to examine the various facets that constitute what may arguably be Africa’s most important relationship of the 21st Century. One facet among the many is that of inter-racialism. China’s largescale direct contact with Blacks is a relatively recent occurrence, certainly not long enough for the Chinese to have formed their own definitive independent opinion of the Black race. However, as a result of China’s increasing exposure to the Western world, this exposure comes with the baggage of centuries of Western denigration of Blacks through various kinds of media – satellite tv, social media, magazines, newspapers, etc. that seek to exclude Blacks from the polity of human civilisations. According to Western measures of civilisation, the trajectory of civilisation has been the progression from pre-modernism (uncivilised), through modernism (Enlightenment), to post-modernism, this last being widely viewed as civilisation’s apogee. A definitive precursor to the post-modern condition, and which also came to define its fervour and texture, is a branch of philosophy called “Existentialism”. Adopting a post-colonial stance, and taking up the West on their offer of the trajectory of human civilisation, though clearly not the only one, what forms the core argument of the paper is that, as demonstrated by analyses of the local lores themselves, since time immemorial, Blacks, generally, and Malawians, in particular, have been capable of achieving such vaunted forms of introspection – and more.

Abstract:In the late nineteenth century, Western Powers launched military campaigns in sub-Saharan Africa resulting in the colonization of vast territories and the spoliation of cultural property. To justify the conquest, they asserted the supremacy of Western culture and disregarded principles of international law in their dealings with African states, communities, and individuals. This article examines colonialist legal justifications such as the denial of statehood of pre-colonial sub-Saharan African societies, the notion that conquest and spoliation were justifiable, and the belief that African legal systems lacked concepts of property. The article details why these arguments contradict well-established nineteenth-century legal principles, particularly state sovereignty and private property, which together form the conceptual basis for the prohibition of spoliation. The universal nature of those principles allows for the nondiscriminatory application and interpretation of historical law and consequently the protection of African pre-colonial states and private as well as public cultural property.

Abstract:This is an interdisciplinary publication located in the discipline of forensic linguistics/ language and law. This handbook includes varying comparative African and global case studies on the use of language(s) in courtroom discourse and higher education institutions: Kenya; Morocco; Nigeria; Australia; Belgium Canada and India. These African and global case studies form the backdrop for the critique of the monolingual English language of record policy for South African courts, the core of this handbook, discussed in relation to case law and the beleaguered legal interpretation profession. This handbook argues that linguistic transformation and decolonisation of South Africa’s legal and higher education systems needs to be undertaken where legal practitioners are linguistically equipped to litigate in a bilingual/ multilingual courtroom that enables access to justice for the majority of African language speaking litigants, enforcing their constitutional language rights.

Abstract:This paper applies the Analytical Conflict Resolution School approach to achieve a deeper understanding of South Africa’s post-apartheid era. It argues that South Africa is an example of ‘protracted social conflict,’ because it displays a fundamental communal aspect, evinces a strong ‘human needs’ element, its pre-settlement condition had resulted in strongly authoritarian government, and it displayed a dependency in its foreign relations. While South Africa transcended traditional conflict resolution methodology with its National Peace Accord and Truth and Reconciliation Commission, neither of these processes was seen through to its end and, as a result, the South African conflict resolution process remains in limbo. This is coupled with a rising internal level of strain expressed in racial tension, violence, migration and economic frustration. A way out of this current malaise is the institutionalization of conflict management through its inclusion in the school curricula, the establishment of conflict management systems to deal with lower-level conflicts, and the building of needs-satisfying institutional arrangements throughout the society, enabling government to be more sensitive to the needs of the people.

Abstract:The study of communication in Africa, much like the continent, has been the subject of controversy and consternation, with widely changing fortunes that wax and wane at different times. Africa’s colonial experience and the imposition of Western communication constructs inform the theoretical and methodological approaches to African communication scholarship. This essay examines the accomplishments of African communication scholarship attained out of a long history of engagement with intellectual debates about de-Westernization. We discuss how African communication scholars can foreground their commitment to maintaining the integrity of African scholarship in advancing African perspectives in communication studies.

Abstract:Literature is now cognizant of the fact that customary land governance structures are changing in most of sub-Saharan Africa. The relevance of land governance is largely dependent on the local institution, even without direct State intervention. In other words, customary areas are no longer sites for unrestrained, selfish and uncivilized competitions resulting in high tenure insecurity. However, a number of issues still remain debatable over these changes: for instance, what is their exact form and what are the “plausible” development outcomes related to these changes? This paper assets that, answers to these questions are often location specific in literature, hence the rationale for this study within the Zambian context. This study compares two customary areas, with different customary rights and administration, i.e. Shimukunami were residents are issued with traditional certificates and Chamuka where they are not. Data was collected through household questionnaires, key informants and focus group discussions. The paper tested a number of parameters which included number of conflict (e.g. on ownership, boundaries, encroachments), agricultural production (labour, crops, etc.) and generally livelihood strategies. We conclude that change in customary land governance has been a reaction to pressures and influences such as rapid population, high demand for customary land and introduction of monetary transactions. Further, institutions are not static but have evolved to meet changing societal demands. Therefore, approaches recommended for effective traditional land governance must be mainstreamed in local structure so as to provide a sustainable solution to tenure security and rural development. However, the appropriate approaches should be chosen taking into account the need of the local communities, traditional institutions and dynamics of land governance of a particular area.
Dewesternising the South African social security law: a leap towards an Afrocentric legal curricular

Abstract:SUMMARY Recent calls to dewesternise the curricular are especially pertinent to the teaching of Social Security Law in South Africa, which has traditionally been dominated by the Eurocentric canon. This article argues that South African Social Security Law is a western-centric phenomenon and dewesternising it is necessary for the decolonisation of legal education. On this score, it provides a critique of the South African Social Security Law in search of pragmatic ideas that can advance the project of decolonising it and creating Third World perspectives. The article unsettles the dominant Eurocentric model on the origin of South Africa Social Security Law which marginalise the role that indigenous knowledge play in the development of this area of law. It argues that placing indigenous knowledge systems on the epicentre of the historiography of teaching South African Social Security Law will lead to some epistemic disruption of the current historic paradigm, a project necessary for the decolonisation of the legal mind and intellectual landscape. The article re-contextualising the orthodox social security theory in the historical scene of colonial and post-era; constructing alternative social security historiography; offering an Africanised dialogue on the origins of the informal strands of social security law; the elaboration of alternative methodologies of actualising the constitutionally protected right to have access to social security. The paper also contends with concepts and ideas such as the deemed trans-colonial importation of social security origins, decolonial philosophy as an epoch of transforming legal education in the context of South African Social Security Law.

Abstract:Abstract The article offers an alternative account of the evolution, formation, and function of customary international law (CIL) from a third world perspective. It argues that there is an intimate link between the rise, consolidation, and expansion of capitalism in Europe since the nineteenth century and the development of CIL that is concealed by the supposed distinction between “formal” and “material” sources of CIL. In fact, both “traditional” and “modern” CIL sustain the short-term and systemic interests of global capitalism. It proposes a “postmodern” conception of CIL that would contribute to the global common good.

Decolonising the Broken Hill Skull: Cultural Loss and a Pathway to Zambian Archaeological Sovereignty

Abstract:For more than ninety years, between 1921 and 2012, our knowledge of the Broken Hill Man phase of human evolution has been provided by scholars who have been able to access the skull in England, where it was taken in 1921. This paper presents findings of the circumstances under which the skull was discovered in Northern Rhodesia and taken to England, its significance to science, and issues relating to its return to Zambia. The study grew out of the disillusionment of Zambians due to the reluctance of the Natural History Museum in London to repatriate the skull to its country of origin. The study has established that despite the existence of a legal framework in Northern Rhodesia to regulate the removal of relics from the territory, which was then under the administration of the British South Africa Company, the Rhodesia Broken Hill Mine Company donated the skull to the British Museum (Natural History) without obtaining an export permit. It is within the context of the findings and arguments advanced by the parties involved in the claim of ownership that this paper advocates for the return of the skull to Zambia.

Abstract:Gender based violence is a socio-historical phenomenon that affected colonial Indigenous and settler societies in Zimbabwe, Tanzania and elsewhere in Africa. Experiences of indigenous societies have been disproportionately studied by scholars. White settlers’ experiences of violence in domestic spaces remain largely silenced. This article fills this lacuna by illuminating one unexplored dimension of white settler women’s history: their lived experiences with gender-based violence in domestic spaces of colonial Zimbabwe. It draws on archival research carried out in court records, in the form of civil, desertion and divorce cases. The paper deploys the concepts of objective and subjective violence as a prism to reconstruct violence. The article argues that despite their privileged status in the colonial state, white women were dually positioned as survivors and perpetrators of violence. It brings up another angle of perceiving colonial society, allowing for greater understanding of intersecting themes of class, gender, and whiteness.

Abstract:Forty years after the adoption of the African Charter on Human and Peoples' Rights, the African architecture for the promotion and protection of human rights in Africa has been enriched both at the normative and institutional levels. This enrichment has led in legal analyses both to the affirmation of the existence of an 'African human rights system', on the one hand and, on the other, to the criticism of an unnecessarily complex and not always efficient mechanism. After highlighting the specific logic of the emerging African system, this article indicates the avenues for institutional and methodological reform that should lead to the construction of a truly coherent, effective and efficient African human rights system.

Abstract:Tinashe Kondo's book, Law and investment in Africa, narrates the efforts of a country to regain the trust [and the love] of foreign investors after several decades of argument and hostility. Encapsulated in the "Zimbabwe is open for business" slogan, these efforts show "how a country can move to regain credibility and commit to global rules despite its recent history".2 This review of Kondo's book concerns the manner in which readers can take advantage of this immensely useful publication. Particularly, this review looks into the book in order to advise law academics on possible strategies to integrate the book into their curricula in Zimbabwe and elsewhere on the continent.
