Abstract:This study explores the effects of patent protection in a distance-to-frontier R&D-based growth model with financial frictions. We find that whether stronger patent protection stimulates or stifles innovation depends on credit constraints faced by R&D entrepreneurs. When credit constraints are non-binding (binding), strengthening patent protection stimulates (stifles) R&D. The overall effect of patent protection on innovation follows an inverted-U pattern. An excessively high level of patent protection prevents a country from converging to the world technology frontier. A higher level of financial development influences credit constraints through two channels: decreasing the interest-rate spread and increasing the default cost. Via the interest-spread (default-cost) channel, patent protection is more likely to have a negative (positive) effect on innovation under a higher level of financial development. We test these results using cross-country regressions and find supportive evidence for the interest-spread channel.

Abstract:It is undeniable that high-tech enterprises are the driving force for the transition of promotion for the economic development in China. However, in reality, on one hand, enterprises own new intellectual property constantly through increasing investment in research and development of new technology. On the other hand, enterprises' intellectual property is in a giant tendency of loss due to subjective reasons; improper use of intellectual property in high-tech enterprises leads to its value derogatory; and the loss also caused by no existing legal protection; and most of high-tech enterprises lose the chance to own the intellectual property right because of mismanagement. On the basis of analyzing the reason of loss, the protection for intellectual property right is intimately bound up with some essential initiatives, namely creating the external environment, improving the transformation system of scientific and technological achievement, formulating security measures of technological innovation stage, selection of the range of patent protection and so on.

Abstract:We analyze the influence of the rampant piracy activities in Chi- na on the efficiency of patent protection.We conclude that although patent protection was prolonged since 1993,the incentive to input resources to R&D and apply a patent in China didn't increase but decrease,it is because increasing the length of patent protection gives the imitator a greater incentive to pirate the patent,the paten- tee then will be harmed more.Imposing same patent lengths and in- fringing costs on all the industries will be contrary to the principles of optimal patent design.With both patent length and breadth as in- struments,the optimal patent policy consists of imposing more pira- cy cost on those industries with high piracy potential and vice versa by constructing kinds of statutes and regulations.We also comment on the issue about the protection of software protection in China and hold the opinion that it is necessary to provide additional protection for this industry.In some cases,it is a necessity to sue the end user of software.In addition,this paper makes some analysis about seven kinds of commodities which belong to three different types of indus- tries with different piracy characters.

Abstract:Knowledge is the core competitiveness of small and micro technology-based enterprises.Protection of intellectual property rights is not only a need to ensure its profitability,but also needs to maintain the competition order and create innovative environment.Innovation is the only way to enhance themselves for small and micro technology-based enterprises.Sunk costs of innovation,coupled with the lack of collateral make it more difficult to obtain credit from banks.Legal restrictions on small and micro technology-based enterprises' public financing should be relaxed.Legal normative work of private financing and venture capital for small and micro technology-based enterprises should be strengthen.

Abstract:Using China's staggered intellectual property pilot and demonstration city (IPPDC) policy and the difference-in-differences method, this study assesses the effect of intellectual property (IP) protection on corporate innovation. The policy significantly stimulates corporate innovation investment and quality due to enhanced IP administrative enforcement after policy implementation. Financial innovation mitigates information asymmetry and negative spillovers, promoting treated firms' technological development. By substituting high-failure-tolerance institutional investors, IP pledge financing helps treated firms to fund innovation activities. This study reveals the IP protection effect on corporate innovation, providing insights for emerging economies to formulate public policies and finance systems to achieve innovation-driven development.

With the rapid development of the digital economy, protecting intellectual property has become particularly crucial. The aim of this article is to analyze the current status and challenges of intellectual property protection in the context of the digital economy and to discuss effective protection strategies and mechanisms. The research employs literature review and case analysis methods, and the main findings include the importance of legal regulations, the application of technical means, and the necessity of international cooperation. The conclusion summarizes the main issues faced today and proposes future development directions and recommendations.

Abstract:This study examines the impact of infringement and counterfeiting on the performance of corporate innovation. We use a quasi-natural experiment to examine the effects of the Chinese government's crackdown on intellectual property rights infringement and counterfeiting. We find that after the implementation, patent counts and citations significantly increased for companies in industries with a high risk of intellectual property violations or imitation by competitors, especially for financially strong and risk-taking firms. The event leads to more R&D investment and firms also prioritize invention patents over utility patents.

Abstract:The common patent management software with simple function, few internet resources and high cost cannot satisfy the domestic enterprise requirement. To fulfill Haier Group's demand, anew method using a platform by integrating patents and knowledge resource on network was proposed to perfect the patent management based on three different models of enterprise patent management: centralized, distributed, matrix. For making the decisions of technology protection strategies, experts should evaluate patents growth economic income of the technological achievement based on the content of the integrated web resources, so enterprise can choose strategies from patent application, technology publicity and technology protection according to different evaluations. Web crawling technology, algorithm of owning patent management and patent applying strategies recommending were analyzed as the key techniques, and a software platform was developed. This platform is being put into practice, which improves the strategy of technology ownership and promotes; the patent management in domestic enterprises.

Abstract:This paper, using a sample of A-share firms in China from 2018 to 2022, demonstrates a positive influence of intellectual property protection on firm innovation and reveals that digital transformation mediates this relationship, amplifying the innovation impetus provided by robust intellectual property regimes. Notably, the positive effect of intellectual property protection on firm innovation is found to be weaker high-tech industries than that in non-high-tech industries. These findings highlight the nuanced role of intellectual property legal frameworks in fostering innovation and the evolving dynamics of digital transformation across different industry contexts.

Abstract:In the era of knowledge economy,science and technology innovation capability exhibits a country's competitiveness,in the process of scientific and technological innovation,disputes of intellectual property rights arise from time to time.How to prevent the risk in implementation of intellectual property has become an issue in scientific and technological innovation.Property insurance is a combination of intellectual property and insurance.By the insurance system,enterprises transplant the risk in the course of business operation.The IP insurance system has been well developed in US and a well-regulated market has been established.In China,Chinese enterprises are also facing the similar problem arising from IP disputes.We shall establish the comprehensive system of IP insurance in China under the current situation,especially giving priority of establishing the system of insurance of patent infringement.To ensure a healthy establishment and development of Chinese insurance market of IP,we shall check the premium rate and avoid the over - complexity of the content of the policy.

Abstract:Using the price and output of computer software as a comparing standard when intellectual property rights are effectively protected,we analyze the enterprise and government behaviors and their consequence in China's intellectual property rights protection.We come to the conclusion that the behavior of violating intellectual property rights not only reduces the output of China's software,raises its price,but also reduces China's software developer's profit in China's market.This is just the main reason why developed countries and our country have friction in the problem of intellectual property right about trade.Thinking about short static interest,zero rate of investigation is the best choice when the government pursues to maximize social welfare.The optimum rate of the pirate investigation of the government is the rate in which they investigate the infringement of the intellectual property rights while the marginal revenue equals to marginal cost.Therefore,it is impossible to stop the pirate phenomenon completely,but it can be controlled to a certain extent and level.

Abstract:In this paper we first analyze the importance of intellectual property (IP) to the integrated circuit IP industry at the industry and firm level. Using detailed data of United States Patent & Trademark Office's (USPTO) database; we find that some countries which own advanced IC technology all have large quantity of IPs, especially invention patents. And successful IC firms in the world mostly benefit massively from IP. In the second section, we trace the history of the world IC industry IP protection, which indicates that the IP and its protection are becoming more and more crucial to the IC industry. Nevertheless, there are fewer independent IPs in China IC industry comparing with some advanced countries; with the development of China IC firms, some overseas firms begin to attack them by patent litigation. China IC industry is now confronted with a troublesome predicament and improvement of the IP is one of the most vital strategic actions for China IC industry. Based on this situation, we propose to establish "Preproduction alliance" for strengthening radical innovation and developing independent IPs of the whole country. Corresponding to different kinds of attacks from oversea firms, we expatiate on several measures to be free or infringements and countermeasures to cope with litigations, which is of great significance for IC firms.

Abstract:Through a questionnaire survey,this study has found that a high percentage of the SMEs at the Tsinghua Science Park own certain kinds of intellectual properties.Taking patent as an example,the enterprises are more likely to own or apply for invention patents,which are at a higher level than other kinds.In addition,many enterprises have paid protection fee for their patents and indeed utilized them in their products.Both the survey and the follow-up interviews suggest that,although the SMEs to some extent expect legal protection of their inventions,they also use internal protection,speeding up R&D process,and enhancing complexity in designing to avoid being pirated.

Abstract:Many studies agree that a weak intellectual property right (IPR) legal system likely reduces innovation or creation; they also predict that increasing intellectual properties (IPs) in developing countries will automatically lead to local needs for stronger formal protection. However, the situation is found to be more complex in China. With a focus on the use of IPs and relevant protection mechanisms in China, this study points out that many companies acquire IPs for purposes that do not depend on their enforcement; many companies have informal ways of protecting their IPs without resorting to court enforcement. Both the alternative functions and the alternative enforcement mechanisms are shaped by industrial characteristics, especially in four aspects: technological features, administrative regulation, market characteristics, and network structure. Based on studies of different industrial sectors in China, this article develops a general framework for analyzing the role of IPRs in industrial practice.

Abstract:Intellectual property rights are becoming increasingly important for the survival and development of hi-tech enterprises. Nowadays, there exist various problems in the protection and management of intellectual property, which lead to numerous losses. Therefore, it is advisable to improve the legal system about the administrative protection of intellectual property rights in hi-tech enterprises, as well as strengthen the intellectual property management system, establish an effective and rigorous system of intellectual property protection. Meanwhile, we should, by employing scientific strategic measures of directing staff to make the most of intellectual property, attaching great importance to patent documents, enhancing innovative ability, implementing patent strategy, as well as forming technology alliance, to protect hi-tech intellectual property rights and make full use of them.

Economics of Transition and Institutional Change

Abstract:To examine the important role of regional intellectual property (IP) protection, we empirically check the impact of infringement disputes on corporate innovation investment persistence. We document that IP protection enforcement can significantly and negatively mitigate the infringer's innovation investment persistence but positively enhance that of the infringed firm. This effect is more pronounced for non‐high‐tech or non‐state‐owned firms. Moreover, IP protection mainly reshapes a firm's perceptions of innovation investment persistence through the efficiency and fairness of law enforcement. Our findings provide insights into optimizing the IP protection environment, especially for emerging economies.

Abstract:Firms rely on patenting and secrecy to protect intellectual property. We study how changes in the tradeoff between patenting and secrecy affect firms' stock liquidity and financing outcomes. We show that implementation of an international trade agreement (TRIPS) that strengthened patent protection led to more patenting, accompanied by improvement in the stock liquidity of firms in exporting industries that are reliant on patents. This in turn enhanced the ability of affected firms to raise equity capital and reduce leverage. Our results suggest that policies that promote greater use of patenting over secrecy can help reduce informational frictions in equity markets.
