Makers of the University Charter and the Related Issues

Abstract:The power to make the university charter,which origins from law under the principle of rule of law,is essentially the very core of university autonomy.The objects who are empowered with the above power by law are the makers.Among the makers,the decision-maker who exercises the power of reviewing,voting and approving the charter is the key player and others who exercise other powers just have secondary influence.The practical situation of university charter makers onshore and offshore demonstrates that the makers are generally the union of stakeholders from all parties in the university.Differentiating the situations before and after the establishment of the university,we hold that in the former situation,the charter-making organization should consist of the university sponsor or its agent/ representative and other stakeholders,and in the later situation,the internal charter-making organization should be composed of the sponsor or its agent/ representative,the representatives of teaching and administrative staff,among whom the university president is the ex officio member,and the representatives of students.We can collectively call the organizations in the above two situations "the Union of Makers' Representatives".
