Abstract:This article explores domestic and international sources of private international law from a comparative law perspective.Domestic sources include national statutory law,case law and customary law;whereas international sources are mainly bilateral and multilateral treaties.To address the question of whether international customs are sources of private international law,the present article differentiates and analyzes international customs and international usages,and points out that on this basis only international customary law rules have the binding force of law,which makes it possible for them to be sources of law.Due to a lack of the binding force of law,it is impossible for general international usages to be sources of law,let alone sources of private international law.
The Necessity Of Codification Of China'S Private International Law And Arguments For A Statute On The Application Of Laws As The Legislative Model

Abstract:Recently, the People's Republic of China embarked on the process of drafting a code of private international law (PIL) for the application of laws to legal relationships in civil and commercial matters involving foreign elements. The article provides historical context for the current discussion on PIL. The article then provides background on the current statutes and judicial opinions, which leads to the article's support for the necessity of codification of PIL.By examining the current legislative initiatives to adopt a PIL code, this article concludes that the Chinese legislature should and is most likely to use a code on the application of laws to legal relationships in civil and commercial matters involving foreign elements, which contains exclusively conflicts rules. The article uses the following arguments to support this conclusion: 1) Conflicts rules and rules on international jurisdiction have historically been governed by separate statutes in China. 2) The Chinese legislature has historically been unwilling to adopt a comprehensive code containing both conflicts rules and international procedural law rules. 3) China is a contracting party of a number of international conventions on international civil procedure including judicial mutual assistance. 4) The Chinese legislature treats PIL as an integral part of the future Chinese civil code, and they are unwilling to be rushed into drafting it all at one time. The author concludes that codification will provide greater legal certainty and predictability on the one hand, and necessary flexibility and adaptability on the other hand.

Abstract:It is very clear that, private law has great impact on the emergence and development of international law. The reason is that, international law regulates the relationship among sovereign states, and sovereign rights equality is the fundamental principle of international law. Thus pri- vate law, derived from Rome, which also emphasizes the equality among private persons, was quickly introduced into the construction of new order of international relationship in modern time. Private law is the earliest source of the theories and systems of international law, and has facilitated the prosperity of international law. However, along with the further development of international relationship, the more and more frequency and complex of international intercourse, and the more and more important positions of international organizations and private persons in international relationship, some kind of ranked and centralized mechanism should be established to adapt to the new reality of international relationship. So it is also necessary to learn from the theories and doctrines of public law. This paper suggests that, there are already some indications of the influence of public law on international law. As far as theories are concerned, constitutionalism in international law has been widely discussed, and global administrative law has spring up. In practice, the element of constitutionalism emerges more and more frequently in determinations of international organizations and rulings and judgments of international court and other agencies to settle international disputes. But such practices are limited. There exist some hindrances for international law to learn from public law, such as the sovereign rights equality principle, democracy in the international society, and so on. These hindrancesshould be paid attention to. The movement that public law has more and more influence on international law has great significance to Chinese theories and practices of international law.

Abstract:The division of public and private law is the basic system of a modern state and China's legal system also follows this legal division. There are both same and difference in the public and private law. The same is a common foundation for civil society, rights and obligations of certain public and private law with the dual attributes, and some of the reasons and object for the law is the same. The main difference is that whether the performance of the dominant position is equal, whether to allow self-government and the equivalent paid. It also exits public and private law norms integrated in the third jurisdiction. In the same field of the public and private law, if no provisions of the public law, it permits private law provisions.

Abstract:This article presents the most recent developments in private international law of the European Community through commentary and analysis of the main contents of the Rome I Regulation on the Law Applicable to Contractual Obligations which was adopted in 2008.It points out that the Rome I Regulation has increased the legal certainty and predictability in determining the law applicable to contractual obligations,and has followed the trend of development of contemporary private international law with respect to legislative techniques.A comparative observation has also been made concerning the conflict rules on the law applicable to contracts in the present statutory law of China.Rome I Regulation may serve as a useful example in improving the conflict rules in contractual matters with regard to the legislative techniques in China and is of reference value to the ongoing codification of Chinese private international law.

Abstract:China has a long tradition of legal codification. In looking at the unification of private law, we need to follow three historical threads: the historicity of law, the rationality of private law and the rules governing the growth of private rights. Following on from and amending the Draft Civil Law of 2002, we can use restorative methods to formulate a nine-part civil code suited to China’s national circumstances. The nine parts comprise the General Principles of Civil Law; Marriage and Family Law; the Law of Succession; Real Rights Law; Intellectual Property Law; Contract Law; Employment Contract Law; Tort Liability Law; and the Law of the Application of Law for Foreign-related Civil Relations. With this goal in mind, we can adopt a four-step legislative process: firstly, integrate the Marriage Law and the Adoption Law to form a unified Marriage and Family Law; secondly, include Employment Contract Law as a separate section of the civil code; thirdly, include Intellectual Property Rights Law as a separate section of the civil code; and fourthly, amend the General Principles of Civil Law so as to integrate Personal Rights, the General Principles of Property Rights (the General Principles of Obligation), the General Principles of Commercial Law, etc. The civil code formed on this basis possesses historicity, flexibility and contemporaneity, and would become an important constituent in the restatement of Chinese civil life and the remolding of the Chinese system of law.

Abstract:The broad concept of private international law prevailing in China has a weak disciplinary basis and can not make its task clear and reasonable. The scope of private international law rests with the social needs. At the present time, the main task of private international law is to deal with the special issues arising from the foreign civil or commercial relations or disputes. Therefore, the rules should be chosen for and attributed to private international law from the perspective of coping with a foreign civil or commercial dispute. In other words, the broad concept of private international law should undergo an adjustment on the basis of the above-mentioned.

Abstract:After a thorough study of 32 definitions of the object of civil law which were put forward by scholars in 19 countries and regions across 4 continents,this paper concludes that they fall into three mainstream doctrines,i.e.,the old-parallel doctrine,the new-parallel doctrine,and the folding-fan doctrine, an additional one being labeled the miscellaneous doctrine.The definition of object of civil law in The General Principles of The Civil Law of The P.R.C belongs to the German variation of the old-parallel doctrine.It is defective because it overlooks the existence of law of personality that is a characteristic of public law in the civil law.Therefore,it is suggested that the object of civil law in our country be defined as follows: the civil law confirms the status of persons and their property and coordinates the relations between the persons,which include relations concerning family members and relatives,succession,ownership of property,intellectual property right,and obligation.

Abstract:To strengthen and promote the international communication of China's legal value systems, this article finds that we should pay attention to China reports in the overseas media, legal translation as well as legal research. On one hand, it is necessary for the government to make efforts to build its national image regarding rule of law, and refine and promote its legal value systems. On the other hand, the situation that current mainstream media of overseas tend to report China's rule of law unfavorablely has to be changed. In addition, China should increase investment to encourage more and more translation copies of legal texts and legal research publications. Finally, it is essential for law schools in China to cooperate with overseas leading universities to create China law centers or institutions.

Abstract:Modern international relations are established on the acceptance of international law as the rules of conduct. But how does this legal order, which originated from European jurisprudence, acquire its universality? How did this legal order in the time of European colonial expansion interact with other systems of law, which formed the socio-political foundation of non-Western powers, such as China? These are the two main problems addressed by this study, which focuses on the translation of Western writings, particularly those by American jurist Henry Wheaton, and legal documents on international law in China from the late 19th century. This article, which takes a legal comparative perspective, argues that the clashes between China and European colonial powers by nature were disputes between the jurisdictions. The clashes reflect the realpolitik struggles between two powers as well as the limitation of 19th-century international law based on the acceptance of a Eurocentric universalism.
