Abstract:Chinese sociologists have made two contributions to the property rights studies of contemporary Chinese society. One contribution is that they have revealed that the property rights contracts of rural collective assets are based on principles of fairness—the principle of survival,the principle of equality to community members, the principle of taking land's boundary as delimitation, and the principle that benefits belongs to investors. The other contribution is that they have discovered that the rules of property rights delimitation are diverse and uncertain in China, and the clients often rely on their own might to choose rules and to advocate their rights. The first contribution can help us understand the logic of social construction of "collective ownership", but lacks logical inference in the end. The other contribution is a challenge to a conclusion of the game theory of evolution—the local confirmity affect of institutional evolution, however, the challenge needs more empirical evidence to be rigorous.

Abstract:The contractual operation right of rural land is a very important civil right with specific Chinese socialist features.The paper considers that the main problems of the contractual operation right are the legal deficiency of its real right system and the real right legal deficiency of its content,force and changes on the basis of the study on the distinctions between the real right standards of the contractual operation right and the credit right standards of that.The author argues that the countermeasure should be the real-rightize of the contractural operation right so that it becomes a new type of benefited real right which has a real right character according to the law.

Abstract:The institutional reform of land property rights is confronted with various challenges from all aspects of the economic and social lives in the current stage.The original property reform theory does not agree with the current practical requirement of land use and management.How to fully reflect the political,social,organizational and juristic nature of land property right in the newly-formed concepts of land property reform and its institutional innovation,and further provide a trajectory for future reforms in China,are the main purposes of our theoretical research.It needs to combine together the theories of economics and sociology to analyze related issues.The four-level-social-analysis framework proposed by Williamson provides a good logic to link property right with resource allocation,sociology with economics.Through such a logic,a comprehensive analysis on the nature and the assessment of Chinese land property can be achieved,which can further provide a theoretical basis for the trajectory choice of the current land property reform.The analysis offers scientific references for the new-round of land property reform in China.

Abstract:With the deepening of the reform in China's rural economy, the system of contracted responsibility linking remuneration to output of whose core lies in the right of management of contracted land has come into being and been perfected. This land contracting management right is a real right in nature, belonging both to the real right over the property of another, and to the usufructuary right over the property of another, or rather, a new type of usufructuary right. Land contracting management right has become one of the very important contents in the enactment of real right law. Real right law (draft) enacted by Legal Committee of SCNCPR has stipulated explicitly the appellation of agriculture land management right as land contracting management right, which is a usufructuary right in the nature. The paper attempts to make an analysis of the following existing imperfections in real right law (draft): undefined concept of land contracting management right; implicit provision of targets; the unscientific design of ways of establishment; unreasonable or inconclusive alterations; substandard withdrawal or adjustment of land contracting form and imperfect variety of termination for land contracting management right. Using tenure right and ususfructus for reference from overseas usufructuary right law and absorbing achievement in relevant domestic theoretical research, the paper systematically puts forward a comprehensive draft suggestion on clause design for land contracting management right. The main contents of the draft covers the concept of land contracting management right, its targets, its involving party, its term, establishment, change, transferring and transferred-contracting and its termination.

Abstract:The purpose of this paper is to probe into the path for the reform of China's land property and its transfer policies.Method employed in this paper is to analyze the evolutional process of land property and its transfer policies in rural and urban areas of China since 1949 through the four-level-analysis framework of Williamson.The results indicate that the evolutions of China's land property and transfer policies are not only the issues of law,but also related to cultural,governance and economic behaviors,etc.Although the evolutions inside rural and urban sectors are separated in terms of time sequence,the common logic within their path-chosen progress could provide referential experiences both ways.

Abstract:Since the third plenary session of the 18th central committee of the CPC,the reform idea from the central government on “the seperation of three rights” of rural land is increasingly clear. The academic circle has conducted discussions and researches from different perspectives. However,currently the problem of“the seperation of three rights”is still in the stage of being without consensus. After sorting out the evolution track of local and central governmental policy of “the seperation of three rights” in recent years and analyzing the main features of the three rights and the contract-management right of the central governmental policy of“the seperation of three rights” by using the text analysis method,the paper further discriminates the consensus and disagreement within the academic circle on the aspect of legal property of the contract right and the management right in “the seperation of three rights”, finding that under the condition of “the seperation of three rights” and the rural land remise, the contract right still belongs to the property right,and is the right owned by collective members based on their specific identity,which is the same as the original land contract-management right under the condition of being without the rural land remise. The operation right belongs to the nature of creditor’s right under the condition of subcontracting,renting and shareholding the land contract-management right,and belongs to the nature of property right under the condition of land remise and mutual exchange. Based on the above analysis,the paper also makes a preliminary exploration onChina’s rural land property reconstruction.

Abstract:There are diversified opinions in the academic field concerning the direction of the property-right reform of state-owned enterprises.The multiple-approach reform is gradually being accepted.On the other hand,there are some viewpoints against the privatization of the property right of SOEs and against the multiple-approach.The causal relations between property-right reform and efficiency are doubted.The existing research has some limitations.The diversified and complex features of SOEs call for the flexible and multiple-approach reform.Other research perspectives have to be introduced.For example,the negative social and economic effects undertaken by the society need to be studied from multi-disciplinary angle.

Abstract:Disaggregating property rights into abstract bundles of rights over the use, control, and alienation of property facilitates the systematic comparison of property regimes across time and space. However, because these analytic distinctions ignore the criteria by which individuals choose among competing claims of ownership, they cannot capture the moral reasoning that ultimately institutionalizes a property regime. Using focus group debates over competing claims of ownership to newly privatized urban real estate, this essay identifies four grounded logics of entitlement by which Shanghai residents determine just claims in one post-socialist property regime: a logic of family justice, a logic of state regulation, a logic of the market, and a logic of the family estate. Of note is that the primary criteria by which individuals decided among different logics of entitlement were the rules of the property regime at the time the dwelling first became the family home rather than differences attributable to societal inequalities tied to distinctions of gender, generation or occupation.

Abstract:There are major differences between state ownership and the ownership in traditional civil law in the aspects of the nature of right,creation of powers and functions,way of exercise and legal protection as it has separated itself from the theoretical framework and legislative structure of traditional real right and ownership.In accordance with the public property law theory,the state-owned property stipulated in the Real Right Law can be categorized into state-owned natural resources,state-owned property for public use,state operated assets and so on,which possess the attributes of state-owned public property and state-owned private property.With a duality of public right and private right,the state ownership is a special mixed legal relationship jointly regulated by public law and private law.The construction of state ownership should surpass the traditional boundary of private law.The prospective Civil Code in China should provide general provisions on property right and take the state ownership to be an important property right stipulated in a specialized chapter or part.

Abstract:China' s Property law will soon be legislated. Legal scholars, nonetheless, haven't reach the consensus concerning whether the Right of Inhabitation should be integrated into the legislation. This article explores the more widely and more important applicable fields of and social demand for the right of inhabitation through the retrospection of worldwide legislations and the analysis of the reality of Chinese society. The author points out that the right of inhabitation does not only include the "right of inhabitation for the social purpose", which can be used for the protection of those disadvantaged group such as divorced women and baby - sitters, but the "the right of inhabitation for the investment purpose", which is seen as more widely useful for modem society. Based on such widened horizon, the function of the right to h'ving is reoriented, converting from the singular right of inhabitation for the social purpose to the Integration of the right for investment purpose. This has made the right of inhabitation more flexible and applicable, thereby could better meet the demand of utilizing individual property with more varied means and more effectively convey the will of the property owner. The author proposes further the concrete scenario for the amelioration of stipulations concerning the right of inhabitation in the draft of China's Property Law at the end of this article.
