Abstract:The greatest political wisdom of Marx was most profoundly reflected in his grasp of the joint between political emancipation and human liberation.By analyzing burgher society from the view of the law philosophy,Marx objectively and rationally discussed the historical merits and significance of political emancipation,expounded how to clear up the religion alienation,political alienation and their entanglement by political emancipation.He realized that political emancipation was not free of contradictions at all,which relentlessly exposed and criticized the historical limit and limitations of political emancipation.Based on profound understanding of the limit and limitations of political emancipation as well as the analysis of burgher society from a perspective of political economics,Marx put forward to transcend the political emancipation,to confront the political force with social force for mankind liberation.Besides,the necessity and the possibility were demonstrated and rigorously analyzed.It is of profound enlightening significance to compare Marx's idea of political emancipation with the practices of Chiness political reform and development.

Abstract:In the Late Qing and the Republic of China,scholars had developed different paths in transforming traditional academics and bridging Sino-Western and old-new in the context of the evolution of Classical Studies and Historiography.Two distinct schools of Confucianism came into being in the Republic of China: one was the historical ″Guwen″ represented by Zhang Taiyan and his students,the other was the philosophic Jinwen represented by Liaoping and his students.With the aggravation of the National Calamity in the 1930s and revival of Confucianism,it was a common practice to promote Chinese culture and national spirits.Thus the transformation and practice of Confucianism became the focus in the discussion between the two different schools.During the dispute Meng Wentong and Li Yuancheng,Liao Ping's students,argued with Zhang Taiyan and Huang Kan constantly about sinology and Neo-Confucianism,″Jinwen″ and ″Guwen,″ and ″Classical Studies″ and ″Historiography″ to clarify the origin and development of Confucian philosophy. After a careful study of Qing's academic history and looking into the relations between Dai Zhen's philosophy and Xun Zi,Zhang Taiyan emphasized the unique significance of Dai Zhen in Qing's Academic history.On the contrary,Meng Wentong and Li Yuancheng resorted to traditional sinology and Confucian theories to question the construction of Dai Zhen's theory.Based on the examination of Examine Goodness,Li Yuancheng criticized Dai Zhen's doctrine of Ethics,Desire and Goodness as a misunderstanding of Mencius.Based on Guwen and centreing around the separation of Confucianism and Buddhism,Zhang Taiyan stressed the reliability of the historical account of the Six Classics to respond to the Skeptical School and illustrated the ideological and cultural tradition of China in the past two thousand years.Li Yuancheng had developed Liao Ping's theory and discussed with Zhang Taiyan the Rites and Spring and Autumn aiming to link ″Jinwen″ and ″Guwen″ and to reiterate the Great Righteousness of Spring and Autumn.Meng Wentong,through his study of the development of Confucian philosophy in Zhou dynasty,Qin dynasty and the two Han dynasties,attempted to find the succession of Confucianism and Mencius's thoughts,to analyze the philosophy of ″humanity and destiny,″ to interpret the controversies over Mencius and Xun Zi,to clarify the origin of sinology,and to challenge Cheng Zhu Confucian Orthodoxy.In short,Liao Ping's students had constructed a Confucian system based on the ″Goodness″ of Mencius,theoretically paving the way for for Jinwen and Confucian historiography. The school of Zhang Taiyan-Huang Kan purported to explore the development of national cultures,focused on the language and history,and advocated the cultivation of mind and behavior.Thus,it had associated moral ethics with political and social pragmaticism and had started the practical academics of Classical Studies and Historiography.In contrast,Liao Ping's students emphasized on constructing an dynamic interaction between the meanings of Classics,institution,and historical facts,carrying forward the ″New Confucianism of Qin and Han,″ and elucidating the revolutionary spirit of Jinwen and system design.Dispute of ″Jinwen″ and ″Guwen″ manifested the core difference of the academic interests between the schools of Zhang Taiyan-Huang Kan and Liao Ping's students.A clarification of their differences and disputes is of importance in interpreting the diversification of modern Confucianism and providing intellectual resources for the building of a nation-state or a civilization-state.
An Intellectual History of the Ancient Chinese Despotism Thesis

Abstract:Since late 19th century, the thesis that the imperial Chinese polity from Qin to Qing was despotic and that Chinese emperors were despots has been popular and influential. Indeed, it has constituted one of the basic theses employed in studies of Chinese history. This paper looks at this thesis from the angle of intellectual history, analyzing its emergence, its spread and its consequences. The paper points out that this thesis was not a result of scientific research, but a Western bias towards the Orient dating to Aristotle that a few Western thinkers began to use in the 18th century to describe China. It was introduced into China via Japan in the late 19th century and was widely accepted by Chinese intellectuals of all standpoints. Through dictionaries and history textbooks, it also seeped nearly unquestioned into the general populace. The despotism thesis has not been sufficiently demonstrated by historical facts, so if we use it without any re-considerations to understand the Chinese ruling mechanism in imperial times, it will only hinder our research.

Abstract:The imperial examination system in history was not so dark as what it is thought of by the modern people. Therefore, it is necessary to reappraise this system because of the incomplete and non-objective understanding and knowledge of it in the past. The prejudice today comes from the negative attitude towards it prevailing in the late Qinng Dynasty. In fact, many famous scholars in history, from the Sui and Tang Dynasties to the Ming and Qing Dynasties, praised this system, and many of them regarded this system as "the most fair" one. To redress this system has already become an ideological trend in the contemporary Chinese academia. A study of this system is beneficial for our better understanding of the characteristics of Chinese society and the destiny of Chinese traditional culture. At the same time, we can draw a historical lesson from it for the present examination reform.

Abstract:This article examines the conceptual differences and similarities in the teachings of Confucius and Lao Tzu regarding the phenomenon of power. The research is based on the analysis of the primary sources: Confucius and Lao Tzu, in order to identify their philosophical views on the nature, function and principles of power in government. The key texts of Confucius and Lao Tzu are analyzed in detail, which allows a deeper understanding of their vision of power and governance. The purpose of the article is a comparative analysis of the doctrine of power in Confucianism and the philosophical justification of despotic power in the ancient Chinese epic-political doctrine «fa jia» (in the Western tradition it is called legalism). The study of the phenomenon of power in the philosophy of ancient China inevitably leads to the consideration of two key figures - Confucius and Lao Tzu. These thinkers offered different but complementary views on the nature of power and the governance of society. Power, according to Confucius, should be based on the moral qualities of the ruler. A wise leader serves as an example for his subjects, establishing stability and harmony. Confucius argued that the moral self-improvement of a leader is the basis for the legitimacy of his authority. The Legists argued that optimal control is achieved through minimal intervention. The ruler should allow natural processes to occur smoothly, avoiding excessive control and coercion. Softness and fluidity are more important than strength and rigidity. Both Confucians and legists alike considered the relationship of man, society and the state. They considered hierarchy to be the principle of this ratio. At its top is the state headed by the ruler, the middle is occupied by society, and at the bottom is a person. A person belongs to society, and both of them belong to the state. The state belongs to the ruler (monarch). Thus, both Confucians and Legists recognized the same form of government as the only correct ones. Both also saw the ideal of a state structure in an exemplary manner. However, the understanding of the methods by which this order is achieved is fundamentally different between Confucians and Legists.

Abstract:The discrepancy of rulers and subjects is fundamental for Confucian study of political ideals.This essay attempts to explore the political views of Confucius,Mencius and Xunzi.Whereas Confucius and Mencius consider it as the state of nature or original status kept in balance by the confrontations between disorder or ethic disturbance and political powers,Xunzi considers it as a great invention of rulers to curb the original fighting status,thus granting the utmost power to the ruler.Despite differences,they all tend to claim the social order from mutual cooperations and self-cultivation.

Abstract:The differences of the various schools of thoughts and their exponents during the period from pre-Qin times to the early years of the Han Dynasty do not lie in their advocacies,for they are all autocracism affirmers;nor do they lie in their historical conditions,for they all regard that autocracism should be conducted under any historical conditions,i.e.they are consistent autocracism supporters beyond history.Their differences lie in the ways of autocracy:should it be a benevolent,open and kind one,or should it be overbearing,wild,and evil? Based on this,autocracism in China can be classified into two kinds:the permanent and open autocracism represented by the Confucian school,and the permanent and evil one presented by the Legalists school.

Abstract:Abstract: Confucianism and Legalism are not only the two most influential ideological schools in pre-Qin China but also the main schools of thought in ancient Chinese intellectual history. This is due to their respective social nature and contrasting political values. In Pre-Qin Confucianism, rooted in the belief in the innate goodness of human nature, there is a strong emphasis on the significance of historical traditions. It promotes values such as benevolence, righteousness, propriety and wisdom, and seeks to redefine “Rite” by incorporating new values. It places great importance on the rule of virtue and aspires to achieve a state of Universal Harmony. Pre-Qin Legalism, driven by the inherent human inclination towards self-interest and personal gain, formulates a governance philosophy grounded in utilitarianism. It prioritizes the present and advocates for profound transformations through the implementation of strict “law” to attain national prosperity and military strength. As a result, ancient China formed different traditions of the rule of virtue and law, laying the foundation for the complementary nature of Confucianism and Legalism. This article analyzes the factors of differentiation and the process of integration in Confucian and legalist political philosophy, aiming to provide insights into the construction of contemporary political philosophical systems.

Abstract:Chinese absolutism should be judged in a lineage by a comprehensive comparison between political regimes of the same type.The Chinese term zhuanzhi(专制) refers to the unlimited power of a monarch and can be understood by the degree of his centralization of power.Furthermore,it contains the identity relationship between a monarch and his ministers,for example,the relationship between personal control and bondage,and the relationship between unconditional rule and loyalty.From the perspective of "whom a monarch rules for",the degree to which a monarch personally monopolies wealth,resources and reputation can be used as a criterion for identification.The Chinese term zhuanzhi came from a number of corresponding Western terms,such as absolutism,despotism,autocracy,and dictatorship.It has become a localized concept and can be looked at from a historical point of view and used as a neutral concept.As it sometimes may cause political disputes,so it might be replaced by "centralized monarchy" as an alternative.

Abstract: The religious dimension of Confucianism has been subject to intense controversy ever since Ricci Matteo, a Jesuit missionary, visited China in the late 16th and early 17th centuries: the late Ming period of China. The radical Chinese intellectuals existing after the May Fourth Movement of 1919 have denied altogether that Confucianism has a religious dimension. In the past several decades, many new Confucian scholars outside of mainland China have done admirable work in an attempt to restore the religious dimension of Confucianism. Drawing heavily on the Lu Xiangshan-Wang Yangming school of neo-Confucianism, which emphasizes the power of the subjective mind and the denial of the objective existence of the transcendent world, these scholars share the view that the Confucian religion does not make a strong distinction between transcendence and immanence.

Abstract:The concept of the rule of/by law is one of the most important political concepts in 20 th century China. From the Constitution-amending movement of late Qing Dynasty in the early 20 th century, to the Reform and Opening in the end of the century,this concept had always played an important role. Like many political concepts in 20 th century China,the meaning of this word was ambiguous,and it had different or opposite meaning in different users. The wide spread of this word in China lately dose not begin with the time of Reform and Opening,but begins with the movement of Examining Confucianism in the late stage of the Cultural Revolution. Inthe context of that time,the concept of rule of/by law was used to refer to the Legilist thought,and was highly praised. With the great influence of Liang Ch’in-ch’ao,it has been widely accepted during the period of the Republic of China that the concept of rule of/by law referred to or was equivalent to the Legilist thought. Although Liang(and Hu Shih,Xiong Shili,Hsiao Kung-chuan,Ho Lin,etc which followed him) made deeper research on the complicated relationship between the modern idea of rule of law and ancient Legilist thought, with the great influence of modern nationalism and historicism,the Legilist thought became the basso continuo of the concept of rule of/by law in China in 20 th century to a great extent.

Abstract:democracy is necessary but not sufficient to a free society.On the one hand,democracy,in its essence,means the politics that the whole citizen takes hold of the supreme power;in reality,the majority of the citizen enjoys it. In consequence,they may abuse what they have,which leads to 'majority tyranny'.On the other hand,tyranny could still be possible even if democracy does not bring about tyranny of the majority over the minority: a type of tyranny violating individual freedom and rights.For the supreme power,in its nature,correlates with unrestricted power,which is prone to evolve into unlimited power.As a result,the supreme power has the possibility of becoming unlimited power and becoming tyrannical whether it is in the hands of the monarch or the common people.
Reformation, Inheritance and the Evolvement of Law: A Cultural Analysis of Confucianization of the Ancient Chinese Laws

Abstract:In the 1940s, Qu Tongzu put forth the proposition of "Confucianization of the ancient Chinese law", producing a great effect on the academia home and aboard. Due to the discovery of new historic materials born on bamboo slips in the Qin and Han dynasties, different views have been proposed since the 1970s. China’s legal system features two basic characteristics—moralism and mixed law—for the entire Chinese history. The Confucian legal thoughts prior to the Qin Dynasty represent the theoretical summary of legal experience and practice in ancient China. Legalism in the Warring States Period and Qin Dynasty dismisses the patriarchal clan system and advocates "rule by law" on the basis of the centralized state power. Meanwhile, legalists partially incorporated li (rites or rules of proper behavior) into law. After the Western Han Dynasty, ancient Chinese laws began the process to be turned into part of Confucianization in a comprehensive way. The Confucianization of law represents the integration of Confucianization and Legalism in terms of academic thoughts, the integration of Confucianization and luxue (the study of law in ancient China) in terms of judicial professional training, the gradual socialization of the mixedlaw in the mode of law, and the transformation of patriarchal clan system into statute law in the criminal legislation.

Abstract:After the middle of Western Han dynasty,the debate between the ancient school and the con- temporary school of Confucian classics is the one among the Confucianists.Most of the ancient school scholars and the contemporary school scholars are intellectuals of middle-class land-owners,and the others are aristocrats.There is nothing more different in their social-political viewpoints,and both of them are a- gainst the governmental control of salt and iron trade.As for the world view,they both talk about strange disasters.Their debate is in essence a struggle for official position,especially for the position of education- al office.Were there any difference between the two schools,it is that the contemporary school is indulged in so-called“sublime words with deep meaning”,i.e.,the idealistic and mystic“correspondence between man and universe”,while the ancient school lays more emphasis on hermeneutics,and less mystic,al- though it also speaks about strange disasters.

Abstract:Scholars have realized that it is difficult, if not impossible, to conduct comparative historical studies between China and the West. Its feasibility and methodology have not been systematically discussed and defined. Unlike comparative law or comparative literature, comparative history as an established discipline has yet to be proven. In using as an example the dispensation of criminals from punishment in legal history, the first part of this essay points out that the so-called comparative study often means making observation of one set of historical facts in contrast with others, an approach that might be helpful in analyzing them. In the second and the third part, the author questions the notion of Despotic Central Government, used almost without discrimination by scholars in this country, and suggests that such misconceptions might be avoided if scholars employ methods of sociology and political science in interpreting political institutions of different societies of the world, another approach in comparative historical studies.

Abstract:The Confucian idea of "people as roots" (minben) does not contain the cream of democratic values,because it does not regard people as the ultimate end whose welfare should be fully respected by the ruler and officials,but mainly as the necessary means whose minimum interests should be concerned in order to secure their autocratic monarchy. As a result,this paradoxical idea has generated a lot of negative effect in real life,going directly against the modern democratic values. Only by regarding people as the ultimate end rather than as the usuful means in the creative transformation could the Confucian idea of "people as roots" play a positive role in the democratization of China.

Abstract:In the Analects,Confucius criticized Guan Zhong for not understanding the observance of ritual propriety,while approving his contributions to the country and the people.However,his controversial discussion became a central clue of the development of Confucian political philosophy.By sorting out interpretations of Guan Zhong from time to time,it can be discovered that Confucian interpreters insisted that "Wang-dao"(benevolent government)should be the direction of development of Confucian politics,while denouncing "Ba-dao"(tyrannical rule),which relies on force.However,the dilemma of Confucian theory occurred when it came to implementing "Wang-dao" in real political practices,i.e.,the designer of political institutions usually lacked the authority to execute them in person,resulting in the failure to realize the ideal political goal of "Wang-dao".

Abstract:At the time of late Ming Dynasty and early Qing Dynasty,some ideologists threw out suggestions of reviving feudalism.With the character of anti-authoritarian,their advocate went be-yond the traditional discussion of feudalism and the system of prefectures and counties.In this period, by restricting and balancing monarchy with aristocracies,England successfully established the consti-tutional governance and entered a new system innovation path.In traditional China with decidedly po-litical unity,reviving feudalism is impossible to be implemented and a breach of Chinese historical transformation still needs to be explored.Since the ideological discussion of'feudalism'has parted away from the reality of Chinese history,it contains little academic value.However,the thought of separa-tion of power and anti - authoritarian underlying the advocate of restoring the genuine feudalism is with great political significance and is worth of further study.
