Abstract:Criminal judges'different understandings of criminal law provisions in trials may result in different verdicts.These differences have direct impacts on consistency and authority of law,and may result in unequal treatment in rights and obligation of litigants. When applying criminal law,criminal judges can adapt to situation only when they have mastered scientific methods and approaches of interpretation.Principles and approaches of interpretation of criminal law are one of the professional skills of criminal judges.From the perspective of the characteristic of rights of criminal law interpretation,the characteristic of fields of criminal law interpretation,and the exercise of judges' discretion,several fundamental rules and ideas of criminal judges' interpretation about criminal law can be abstracted.

Abstract:The judicial interpretation of criminal law should be an application interpretation to individual cases that is guided by judges and participated by the prosecutor and the accused, for which the judicial judgment should be combined with the application of criminal law of specific cases, and the criminal precedents should be as a carrier. The Supreme People’s Court should change from the previous practices of issuing normative and abstract interpretation to the dual approaches of the interpretation of criminal law application through direct creation and indirect acknowledgement.

Abstract:Judge's interpretation of law refers to the understanding,analysis and explanation of legal provisions by the judge.Currently it is held in the West that there will be no application of law without the interpretation of law by the judge.However,the recognition of judges interpretation of law had taken a long time in the western history.Today,while recognizing that the judge should interpret the law when he applies it,people disagree on how the judge should interpret the law.Three academic schools,represented by Dworkin,Posner and Hart,have studied this question from different angles.Their researches are of great significance to the construction of the rule of law in China.

Abstract:The principles of the interpretation of criminal law are the rules which guide and restrict all the activities in the process of interpreting criminal law, and embody the fundamental spirit of the criminal law.The principles of interpreting criminal law should include three principles: the legality, the rationality and the technical guidance.The first principle means that the interpretation must meet the requirement of constitu-tion and law.The second one requests for substantial legitimacy of legal principle.The last one is a neutral media between the legality and the rationality, which aims at drawing a perfect conclusion between different interpretations methods.The example of“relaying defamatory information 500 times going to be sentenced” is a proper case to express the application of these three principles.

Abstract:The interpretation of criminal application plays a significant role during times of lacking criminal provisions. However, it is necessary to clarify the demarcation line between the interpretation criminal application and the application by analogy under the principle of legality in order to supply criminal provisions by using interpretation should the supplement. With respect to this issue, there is still room for improvement although the academic mainstream has aimed at a correct direction. From the perspective of the penalty activism, distinguishing application by analogy and extensive interpretation according to whether the common people can feel "obvious incongruity" on certain interpretation will help criminal law to play a more important role in adjusting social contradictions.

Abstract:In practice, judge ought to think comprehensively about all the factors, including justice, social effects and other factors, in adjudication. This is quite different from the traditional syllogism. To be precise, the judge's interpretation is the process of judge's searching for value-balancing and the key of the interpretation of law. Law-interpreting methods are different from the elements considered in adjudication. They should be clearly separated from each other. While giving full play to judge's initiative, restriction on the judge's right of discretion should be stressed. In this process, legal principles, law interpretation and procedural clauses would play their parts. Determinations of the judicial organs would have influences on the implementation of law in China. So, judges, as real exercisers of law, ought to effectively balance the relationship between law and the reality.

Abstract:Criminal law interpretation in China faces two primary challenges in terms of value judgments. Normative interpretations often fall into circular and inadequate reasoning, while judges, the key figures in applying interpretive principles, frequently lack the necessary value judgment engagement and proficiency. Traditional criminal law interpretation is ensnared in a subjective-objective dichotomy, resulting in a misalignment with the aim of "legitimate and rational" interpretation practices in China. To rectify this, a philosophical shift is required to allow intersubjective value judgments while maintaining subjectivity-objectivity as the prerequisite. Criminal law interpretation ensures the completeness of value judgments through a combination of specialized knowledge and public discourse. This involves the creation of systematic criteria for value judgments and adherence to legal principles. The former necessitates defining the internal and external standards of value judgments, formulating rules for the resolution of conflicting standards, and underlining the practical importance of criminalization under law, or "no crime or punishment without law" (the principle that only the law can define a crime and prescribe a penalty) and "Where no law applies, it is permissible to redefine a crime as non-criminal or minor" (decriminalization). The latter involves three perspectives: logical reasoning and theoretical arguments; positive and negative judgments; and formal and substantive rationality. Moreover, it should be approached from four dimensions: normative orientation, individual case promotion, reverse exclusion, and constitutional guidance.

Abstract:In the field of criminal jurisprudence,there is a viewpoint that according to the provisions about retroactivity,it can be directly inferred that criminal legislative interpretation and judicial interpretation must also follow the principle of old laws and light punishment,or the principle of legally prescribed punishment for a specified crime would be violated.This is not logical.To settle the problem should observe the principle of logic.The application of the principles and rules of criminal law should not be extended to situation in which logic tendency thereof is prostrate.When its logic tendency is strong, it should be respected and not easily be twisted by force.In China,criminal law interpretation,judicial interpretation and precedents are not the sources of criminal law and not limited by the principle of observing old laws and light punishment.On the contrary,criminal law interpretation has the same synchronous time effectiveness with that of the interpretation,i.e.the criminal law.
