Abstract:The Administration publicity for government reform in China has drawn attention to society. There is great progress on the construction of administration publicity in recent years, but there are some problems existed. The paper starts from the situation on administration publicity including its problems and difficulties, through academic analysis, finds the cause of the problem. Based on the findings, the paper suggests that deepen of government reform is the main driven for accelerating the process of administration publicity. Meanwhile, we should change the cognition on administration publicity and understand the importance of transparency on public affairs. By the construction of related mechanism and regulations, it will be effective to improve the standardization and systematic process of administration publicity.

Abstract:The system of replace the fulfillment of the environmental administration originated in Germany and Japan, and aims to solve the problem of insufficient environmental obligations. This system shows the concept of public?private partnership, minimal dam?age and good environmental governance. It helps to ensure the fufillment of environmental obligation, enhance the effectiveness of envi?ronmental enforcement and to maintain the seriousness of it. The"Administrative Enforcement Law" in China was promulgated in 2011, its articles of 50?52 stipulate the system of replace the fulfillment of the environmental administration and its implementation proce?dures, but these terms are contradictory with the relevant provisions of the environmental single laws. The future legislation should detail and clear the scope of application, subject, procedure, charge standard, legal relief, etc., to ensure that the system of replace the ful?fillment of the environmental administration operates in the professional, standard and institutional way.

Abstract:The emergence and rapid development of China's administrative legislation have greatly relieved the serious lack of legislations,effectively promoted the socio-economic development,and stabilized the social order.but in reality it has revealed some disadvantages such as endangering the democratic system,infringing upon civil rights and freedoms,causing conflicts of laws,etc.Such disadvantages are mainly due to low democratic legitimacy of administrative legislation and defects of the systems of supervision and control over administrative legislation.In order to develop the advantages and avoid the disadvantages of administrative legislation,China should,on one hand,strengthen the democracy of administrative legislation,to maintain dynamic value balance between democracy and efficiency;on the other hand,establish and improve the systems of supervision and control over administrative legislation,to realize effectively both functions of prevention and relief.
