On Feasibility of Adopting Cooling-off Rule in Financial Planning Business

Abstract:Financial planning is a new banking business in latest years and few countries have made specific laws on it. Rights and obligations of the parties concerning financial planning are usually defined in contracts. In July 2009, the Bank of East Asia (China) declared it adopted the cooling-off rule in financial planning business, which has been highlighted in the banking industry. Meanwhile, the failure of applying the rule to the transactions in real estate market of Shenzhen challenges the feasibility of cooling-off rule. The statutory cooling-off rule originated from U.S. and is mainly applicable to transactions under asymmetrical information. Owing to different features of transactions, the applicable conditions of cooling-off rule vary widely. As to financial planning business, it can be applied by agreements even though there’s no legislation on it in China.
