Theory of Structure of Mother Right-Child Right and Its Significance

Abstract:Proprietary right is mother-right whereas qualified real rights are child-rights.The concepts of mother-right and child-right demonstrate that proprietary right is the mother who gives the birth to qualified real rights.From different perspectives,the nature of mother right-child right structure can be interpreted into various theories,such as the principle of the separation of proprietary right and its functions,the elasticity of proprietary right,proprietary right as the mother right of qualified real rights.The attribute and its principles of separation of proprietary right and its function focus on the right itself and its functions along with their characteristics to be separated from each other,in contrast,they ignore the problems on the destination of the departure or whether it will result in a right and what right it will be.As the mother right of qualified real rights,proprietary right is not only involved in the destination of its functions but also their directions.What's more,much attention is paid to the relationship of derivation between the proprietary right and qualified real rights.Although the elasticity of proprietary right neglects the fact that the separated functions can develop into qualified real rights,it summarized the phenomenon that the functions can be separated from the proprietary right and it can return to the right as well,which demonstrates the state of wane and plenilune of proprietary right.
