Abstract:This paper is based on the investigation and research for a project — China and Europe Taking Care of Healthcare Solutions and aims to discuss the trading environment of traditional Chinese medicinal product in European Union from the legal aspect including E.U. pharmaceutical law and World Trade Organization rules. It concerns the general knowledge of healthcare issues of WTO law, basic understandings of Chinese and western people concerning Traditional Chinese Medicine and market access provision of E.U. pharmaceutical law, hereinto to discuss the prospect and development difficulties and trend of TCM in E.U., and economic and political concerns are involved. The methodology of qualitative study is used, mainly including literature review, case study, and interview. It concludes that the E.U. law has set up standards to register traditional herbal medicinal products, yet it is very difficult for TCMP producers to reach the standards at this moment due to the lack of scientific data and references. E.U. has recognized the merit of traditional medicine; by comparing with the full acceptance of the efficacy of western conventional medicine, the writers foresee that traditional Chinese medicine will require a more general treatment in law of trade sooner or later.

Abstract:Abstract Chinese herbal medicines (CHMs) have unique advantages in the prevention and treatment of diseases, which are widely recognized in the world. More and more CHMs are becoming increasingly popular in the international markets. However, the quality control of CHMs is a significant issue for their acceptance and recognition in the international market. This review mainly focuses on the quality requirements for CHMs to enter the European Union (EU) market. Both Chinese and European regulations and quality controls are compared. Firstly, the EU medicinal regulatory system and relevant regulations were reviewed. Secondly, the key factors of the quality control of CHMs, including Chinese herbal drugs, extracts and products were compared with those of European herbal medicines in the EU market. Subsequently, three main registration routes for herbal medicinal products including Chinese herbal medicinal products entering the EU were introduced. Furthermore, the legal status of traditional Chinese medicine granules in the EU was also discussed. Through the comparison of the key quality factors for CHMs in China and the EU, the similarities and differences in terms of quality requirements and regulations are addressed, which provides a reference for the development of CHMs into the EU market.

Advancing the Regulation of Traditional and Complementary Medicine Products: A Comparison of Five Regulatory Systems on Traditional Medicines with a Long History of Use

Abstract:Background: An appropriate regulatory system to ensure and promote the quality, safety, and efficacy of the products of traditional medicine (TM) and complementary medicine (CM) is critical to not only public health but also economic growth. The regulatory approach and evaluation standards for TM/CM products featured with a long history of use are yet to be developed. This study aims to investigate and compare the existing regulatory approaches for TM/CM products with a long history of use. Method: A mixed approach of documentary analysis involving official and legal documents from official websites, as well as a scoping review of scholarly work in scientific databases about regulatory systems of TM/CM products in China, Hong Kong, Taiwan, Japan, and Korea, was employed in this study and used for comparison. Results: For registration purposes, all five regulatory systems recognized the history of use as part of the totality of evidence when evaluating the safety and efficacy of TM/CM products with a long history of use. Generally, the list of classic formulas is predefined and bound to the formulas recommended in the prescribed list of ancient medical textbooks. Expedited pathways are usually in place and scientific data of nonclinical and clinical studies may be exempted. At the same time, additional restrictions with the scope of products constitute a comprehensive approach in the regulation. Quality assurance and postmarketing safety surveillance were found to be the major focus across the regulatory schemes investigated in this study. Conclusion: The regulatory systems investigated in this study allow less stringent registration requirements for TM/CM products featured with a long history of use, assuming safety and efficacy to be plausible based on historic use. Considering the safety and efficacy of these products, regulatory standards should emphasize the technical requirements for quality control and postmarket surveillance.

Abstract:BackgroundWith increased consumer demand in Europe for natural and efficacious health products, the use of herbal products in the market is rising. Products of Chinese herbal medicine (CHM) could greatly expand European consumer options; however, only seven herbal medicinal products (HMPs) based on CHM formulae have been registered in the European Union (EU) since 2012.PurposeThis study reviews the ten-year registration status of HMPs based on CHM formulae in Europe and identifies major challenges and possible solutions for pharmaceutical companies seeking market access for new HMPs.MethodsAn overview of relevant EU regulations identifies pathways to market access in EU countries for CHM products. A discussion of successful attempts to register HMPs based on CHM formulae since 2012 highlights specific challenges that applicants can expect to face.ResultsCHM products can enter the EU market as HMPs through the full or well-established use marketing authorization, or through the simplified registration procedure. Alternatively, some CHM products have entered the market as dietary supplements, nutritional foods, and agricultural products; however, under these categories, claims for medicinal use cannot be advertised. Since the registration of the first CHM product, Diao Xin Xue Kang (with the single component of Dioscorea nipponica rhizome), in 2012, only six other HMPs based on CHM formulae have been successfully registered. Among these, four are mono-component products. The remaining two products contain combinations of several herbal ingredients. It is more difficult to register combination products than mono-component products, due to their more complex composition and differences in registration requirements (esp. concerning establishing indications) in China and Europe.ConclusionsTo promote the successful registration of CHM products in Europe, pharmaceutical companies are advised to: demonstrate full control of, and the ability to test, their supply chain and manufacturing procedures following the guidance of European competent authorities; carefully adhere to all steps of the registration process and advices from European competent authorities; take the medication habits and pharmaceutical needs of European market into consideration; and establish collaboration with European local organizations, as appropriate.

Abstract:Globalization of traditional Chinese medicines started around 1996, which was initiated by the Chinese government. However, substantial progress was only achieved in recent years including the adoption of TCM quality monographs in the western pharmacopoeias (United States Pharmacopoeia and European Pharmacopoeia) and registration in main stream drug regulatory agencies such as US Food and Drug Administration (FDA) and European Medicines Agency (EMA). So far, several TCM herbal quality monographs were adopted by the United States Pharmacopoeia including Chinese Salvia, Ganoderma lucidum and Panax notoginseng, etc. Over 45 TCM quality monographs were recorded in the European Pharmacopoeia with 20 more in progress. After the successful registration of the first TCM product named Diao Xin Xue Kang as traditional medicine via the Medicines Evaluation Board of the Netherlands, several other TCM herbal products are in the registration process in several European member states. So far, there has been still not any TCM product authorized as a drug by the FDA regardless of a few TCM products in phase III or phase II clinical trials. This review summarizes the progress made in the globalization of traditional Chinese medicines in recent years and future issues in this regard.

Abstract:ETHNOPHARMACOLOGICAL RELEVANCE: GP-TCM is the first EU-funded Coordination Action consortium dedicated to traditional Chinese medicine (TCM) research. One of the key deliverables of the Work Package 7 in GP-TCM was to investigate information of the existing requirements for registration of TCM products listed by global regulatory bodies. The paper aims to collate data and draw comparison of these regulations. Case studies are also presented to illustrate the problems involved in registering TCM products in different regions worldwide.MATERIALS AND METHODS: A collaborative network task force was established during the early stage of the GP-TCM project and operated through exchanges, teleconferences and focused discussions at annual meetings. The task force involved coordinators, academics who are actively involved with R&D of Chinese herbal medicines, experts on monographic standards of Chinese materia medica, representatives from regulatory agencies, experts from industries in marketing Chinese medicines/herbal medicines and natural products. The co-ordinators took turns to chair teleconferences, led discussions on specific issues at AGM discussion sessions, at joint workshops with other work-packages such as WP1 (quality issues), WP3 (toxicology issues) and WP6 (clinical trial issues). Collectively the authors were responsible for collating discussion outcomes and updating written information.RESULTS: A global overview of regulations on herbal registration has been compiled during the three years of the consortium. The regulatory requirements for registration of herbal products in the EU and China were compared, and this is extended to other regions/countries: Africa, Australia, Brazil, Canada, Japan, Russia, South Korea, Taiwan, and the United States. A wide variation of the regulations for the categories of herbal products exists: food (functional food, novel foods, dietary food for special medical purpose, foods for particular nutritional use, food supplement); cosmetic, traditional herbal medicine products; herbal medicines for human use and veterinary use.CONCLUSION: The regulatory issues for registration of herbal products are complicated among the countries and regions worldwide. The information summarised in the text is for reference only. Some regulations which are presented in this review are still in legislation process and may change in due course. Before taking any regulatory action, readers are advised to consult current official legislation and guidance and/or to seek appropriate professional advice. The lessons learnt from global regulation of TCM will provide valuable insights for regulation of other traditional medicine such as Ayurveda and Unani medicine, as well as other forms of indigenous medicine. The WHO is well placed to co-ordinate a consultation process with the aim of putting forward suggestions for harmonisation to key regulatory agencies.

Abstract:Traditional Chinese medicine (TCM) is one of the unique cultural treasures of Chinese; it represents a significant feature and prominent advantage of the healthcare cause in China. Data in this paper were fromWorld Health Organization, Chinese Bureau of Statistics, China National Knowledge Infrastructure, and PubMed. In recent years, TCM has established a solid foundation in Europe, which made great strides in legislation, education, research, and international exchange, and has enjoyed a vast development space in the continent. Now, TCM is embracing unprecedented development opportunities in Europe. At the same time, the stiff international competition poses a grave threat to China’s TCM industry. With multiple cultural, legal, and institutional challenges, as well as talent shortages in the way, TCM is now facing many difficulties in Europe. To fully prepare and enact active and vigorous steps to seize opportunities, we should have a clear picture about the serious challenges hampering TCM development in Europe. The TCM development at overseas markets has shifted from a spontaneous trade activity into a national strategy spearheaded by the government and participated in by multiple stakeholders. We should make a systematic, comprehensive, and sustainable push in fields such as TCM therapy, healthcare, education, research, culture, and industry development. The ultimate goal is to bring TCMs to the global market and allow them to play a role in safeguarding public health along with modern medicines.

Abstract:The development of traditional Chinese medicine(TCM) has always been highly valued and supported since 1949. However, Chinese medicine industry still faces great challenges in view of the current status of the industry and registration and approval of new products in recent years. Related policies also directly influence the development of the industry. The latest version of the Provisions for Drug Registration and Requirement on Registration Classification and Application Information of Traditional Chinese Medicines have been put into practice since 2020. Registration classification is the core content of the Chinese medicine registration management system, as it is closely related to the research, development, and registration of Chinese medicine and the innovative development of the industry. This article aims to systematically review the historical evolution of the category of Chinese medicine registration and analyze the current status and problems, which is expected to provide a reference for the formulation of supporting documents according to related laws and regulations.

Abstract:Through reviewing the current international market for traditional Chinese medicine (TCM), this paper identified the internationalization challenges for TCM, including unclear therapeutic material basis and mechanism, difficulty of quality control, low preparation level, registration/policy barriers, and shortage of intellectual property. To deal with these challenges, suggestions were given including: (1) product innovation of TCM (study the TCM by using the methods and means of western medicine; innovate the basic theory of TCM; develop TCM health product); (2) standard innovation of TCM; (3) building big data platform of Chinese medicine (big data platform of TCM preparation; big data platform on the quality of TCM).

Abstract:Background: Proprietary Chinese medicine (PCM) is widely used in the Guangdong-Hong Kong-Macau Greater Bay Area (GBA) of China. However, the regulatory frameworks and procedures for PCM registration in the region are not well-established, and there are differences among the three jurisdictions. The study is aimed to compare the legal basis, regulatory guidelines, application requirements, and evaluation criteria in each jurisdiction. Methods: We conducted a comprehensive review of the registration application processes for PCMs in the Chinese mainland, Hong Kong, and Macau based on publicly available information from respective regulators. Results: The study found that the registration application process in the GBA was complex and time-consuming, with differences in requirements and procedures among the three jurisdictions. The study also identified several challenges faced by PCM manufacturers, such as the lack of harmonisation of regulatory requirements and procedures and the requirement of package inserts and labelling for PCM products. The study proposed recommendations for improving the registration process and promoting the development of the PCM industry in the GBA. Conclusion: This study provides a comprehensive understanding of the PCM product license application procedures and requirements in the GBA, coupled with discernment of their similarities and disparities, equips applicants with the knowledge to formulate an appropriate strategy for obtaining product approval. Exploring potential methods for harmonising the regulatory process stands to benefit manufacturers, regulators, and patients by improving efficiency and curtailing costs.
Impact of Chinese Herbal Medicine on American Society and Health Care System: Perspective and Concern

Abstract:Many Americans, not completely satisfied with traditional western medicine, have turned to alternative and complementary medicine which explains the increasing popularity of the herbal products and the Chinese herbal medicine. The lack of government regulations and the increasing advertisements by the manufactures have created an impression to the common public that the natural herbal remedies are inherently safer and cheaper than conventional medicine. The skyrocketing rise of healthcare cost and the adverse reaction and side effects incurred from the prescribed drugs have both reinforced such an impression. Herbs in the USA and in many European countries have been prepared as capsules, tablets, teas, lozenges, juice extracts, tincture, and ointments. Most of the herbs are administered as a single herb in the USA and Europe. However, the traditional Chinese herbal medicine contains multiple active ingredients from various herbs and is prepared as concoctions by simmering them for hours to produce pharma-therapeutic properties useful for the treatment of a particular disease. Those prepared concoctions are taken gingerly with specific treatment purposes. In the USA and some European counties, herbs are distributed and labeled as dietary supplements and are taken by many individuals for a long period of time creating some medical and dental complex problems among them, especially in terms of anesthesia-surgery complications. This paper provides insight into basic differences in how herbs are prepared before administration to the patients in China versus a single unprepared herb sold in the USA and Europe. Also addressed are the interdisciplinary issues with health professionals, the proper regulations for better quality control of imported herbs, and the proper warning on the labels of the herbs.

Abstract:The classification system for drug registration and the review and approval process influence the innovation and development of pharmaceuticals. China's previous classification standards for registration of traditional Chinese medicines (TCMs) overly emphasized the material basis while neglecting the clinical value of TCM. Moreover, the review and approval system did not fully consider the characteristics of new TCM drugs, such as the clinical experience already available for many TCM formulations guided by TCM theories. This resulted in suboptimal quality and quantity in the development of new TCM drugs. Since 2019, China has introduced a series of policies and regulations aimed at reforming the classification system for registration of TCMs and establishing a review system tailored to TCM characteristics. The new classification system for registration of TCMs emphasizes that the development of new TCM drugs should be oriented towards clinical value, focusing on meeting unmet clinical needs. The policies and regulations promote the conversion of prescriptions in ancient classics into new drugs and encourages the conversion of preparations from medical facilities into new TCM drugs. Secondary development of already marketed TCM products is encouraged to enhance the advantages of their clinical use. The new review system places importance on the role of TCM theories and clinical experience in supporting the registration of new TCM drugs. These reform measures have paved a path for registration and review of the characteristics of TCMs and will positively promote the development of new TCMs.
Association CHINESE REGULATION OF TRADITIONAL CHINESE MEDICINE IN THE MODERN WORLD : CAN THE CHINESE EFFECTIVELY PROFIT FROM ONE OF THEIR MOST VALUABLE CULTURAL RESOURCES ?

Abstract:The global demand for traditional Chinese medicine ("TCM") has exploded in the last thirty years. Demand for TCM products increased both domestically in the People's Republic of China ("PRC") and internationally. However, the stigma of "witch doctoring" associated with TCM remains. Several developed nations have established national and local regulation of TCM practitioners to protect their citizens from dangerous treatments. After almost forty years of virtually unregulated endorsement of TCM, China recently began its own standardization of TCM products and practice. The question must be asked, what inspired such a dramatic and rapid change in Chinese policy? The geyser of Chinese TCM regulation can largely be attributed to a growing international demand for alternative medical treatments. China realizes the potential profit of TCM trade, and recognizes comprehensive knowledge of its own medicine creates an obvious advantage over other sources of TCM. However, lack of standardization in products, outlandish advertising campaigns, and apprenticebased training all contribute to many nations' unwillingness to allow the importation of TCM from China. China's new TCM regulations respond directly to foreign countries' concerns and display the PRC's determination to fully enter, and possibly dominate, the global TCM market.

Abstract:OBJECTIVE:To provide reference for further improvement of law and regulation system of health products in China.METHODS:The differences of the concepts and the market supervisions of health products in the China,Japan,USA and EU were compared and analyzed.RESULTS CONCLUSIONS:The concepts of health products in the countries and areas differ from each other.Those countries and areas' opinions are in agreement about health products.The supervision models can be summarized into the approval system(China) and the recording system(USA).Our country lack of strong supervision of listed products,which result in low quality of health products,abuse of label and confuse propaganda behavior,etc.It is suggested to learn from Japan and USA to formulate comprehensive regulation on the production,operation,circulation of health products and their qualities.There are rules to go by in market behavior of enterprise and supervision behavior of government.At the same time,smooth development of market behavior and supervision behavior can be guaranteed by updating related regulations timely and avoiding contradictions and disjointing.

Abstract:Background: If a herbal pharmaceutical is intended to impact the function of the human organism, it is categorized as a medication or a nutritional supplement. According to the FDA, the medicine must be offered under a New Drug Application (NDA). The European Medicine Agency (EMA) has established two methods for registering herbal medicals: Under Directive 2001/83/EC, a full marketing authorization (MA) is obtained by submitting a dossier containing data about the quality, safeness, and effectiveness of pharmaceuticals, which include physical and chemical, biological, or microbiological tests, as well as pharmacological, toxicological, and clinical trial documentation; There is a simplest technique under Directive 2004/24/EC for classical herbals that do not needs professional monitoring and where the indication of long history use of pharmaceuticals exists and appropriate relevant journals to illustrate a very well medicinal usage is not provided. Aim: A study about the regulatory status of herbal drugs/products was conducted in America and Europe to understand the various classes under which the sale of herbal goods is authorized and their premarketing criteria. Materials and Methods: This study has been performed by gathering information from the official websites of the USFDA and EMA. Results: A thorough evaluation was carried out in order to identify the impediments to the harmonization of herbal goods. Conclusion: Aside from the challenges of herb supply and conservation, it has been shown that there is a lack of uniformity in the regulatory standards of herbal supplements globally. These are impeding international commerce and the expansion of the herbal goods market. USFDA classifies botanical items as pharmaceutical, nutrition, or dietary supplement based on the indications or ultimate use.

In recent years, as TCM has developed and it has been accepted around the world, many Chinese patent medicine companies have gained international market access and successfully registered several Chinese patent medicines as over-the-counter (OTC) or prescription drugs in regions and countries that primarily use Western medicine such as the EU, Russia, Canada, Singapore, and Vietnam. Moreover, several Chinese patent medicines have been obtained the US Food and Drug Administration (FDA) approval conducting phase II or III clinical trials in the US. The current work has focused on several Chinese patent medicines that have been successfully registered or that have been submitted for registration abroad. Summarized here are recent advances in the efficacy and molecular mechanisms of these Chinese patent medicines to treat respiratory infectious diseases (Lianhua Qingwen capsules, Jinhua Qinggan granules, and Shufeng Jiedu Capsules), cardiovascular and cerebrovascular diseases (Compound Danshen Dripping Pills, Huatuo Zaizao pills, and Tongxinluo Capsules), cancers (a Kanglaite injection and a Shenqi Fuzheng Injection), and gynecological diseases (Guizhi Fuling Capsules). The hope is that this review will contribute to a better understanding of Chinese patent medicines by people around the world.

Abstract:<p>Owing to modern developments in the traditional medicine industry, more people now acknowledge the efficacy of traditional medicine. As the demand for herbal medicines gradually increases, the focus of the industry will shift to how to increase production while maintaining the high quality of raw materials and final products to promote the international trade in herbal medicines. In the long history of herbal medicine, many countries and regions have formulated relevant standards to regulate the cultivation of local herbs to ensure the safety and reliability of the products. Due to cultural and historical differences, the policies for formulating herbal cultivation standards vary greatly between regions, which hinders the international trade of herbal medicines. This paper collates the guidelines of good agricultural and collection practices of the European Union, China, World Health Organization and the United States, and makes a comprehensive comparison of its contents such as production environments, production area suitability, air, soil, and water standard regulations, <em>inter alia</em>. This article aims to explore the differences in good agriculture and collection practice in herbal medicine in various regions and provides a reference for the development of international guidelines for herbal quality management, which will aid with the development of herbal medicine quality standardization globally and exchange services in the trade of herbal medicines.</p>

Abstract:<h3 class="Heading">Purpose</h3><p class="Para">The aim of this study is to examine how aesthetic devices are defined and managed. Regulation discrepancies between clinical use and home use in four regions are also described.</p><h3 class="Heading">Methods</h3><p class="Para">The official websites and databases of US, European, Chinese, and Taiwanese authorities were used to collect regulation information for aesthetic devices. Moreover, the regulations for eight aesthetic products, four used in clinics by experts and four used at home by lay people, were compared.</p><h3 class="Heading">Results</h3><p class="Para">The results show that the principle of operation and intended use are key points for determining whether an aesthetic device is a medical device (MD). Although the term "aesthetic" is not included in the MD definition, most aesthetic devices are regulated as MDs by the four regional authorities based on the devices' technical specifications and intended use, especially for high-risk devices and high-end products. For home-use aesthetic devices, the control measures also depend on function and intended use, but different authorities have different acceptance ranges. Manufacturers should pay more attention to regulation requirements in difference regions before putting devices on the market.</p><h3 class="Heading">Conclusion</h3><p class="Para">With the fast growth of aesthetic devices, government authorities need to make regulations to keep up with new products. Determining whether an aesthetic product is an MD on the basis of its risk could be a practical option for administrators. This study evaluated the regulation of aesthetic devices as MDs in the US, European Union, China, and Taiwan, and provides important information for further policy and regulation development.</p>
