Abstract:The paper,reviewing the historical reasoning on power check and balance by classic Marxist theorists and other Westerner scholars,reiterates the iron law of all politics:absolute power absolutely leads corruption.The paper also analyzes some unhealthy trends in current media supervision on power,and points out emphasizing and practicing media supervision on the power is the effective way to realize power check and balance.To build a new mechanism of power check and balance,the author suggests that serious measures can be taken in six aspects:further specify the purpose of practicing media supervision on the power;speed up legislation on media supervision;increasing citizen participation in managing the media supervision;heighten the news media and journalists' initiative in the supervision;consolidate citizens' major role in media supervision,and increase the transparency of media supervision.

Abstract:Traditional media are facing a crisis of declining trust, public disengagement, and declining revenue. More and more people are avoiding and rejecting traditional news because of its depressing effect on their feelings. The constructive journalism movement seeks to correct the negative bias of traditional journalism, strengthen the connection between the media industry and its audience, and reestablish the authority and legitimacy of journalism. This new model of journalism can give hope to a life that is "not-yet" and encourage people to move forward to solve social problems with a positive mindset. In the current era of public communications, constructive journalism offers a new option for people to rethink the many possibilities for journalists, the news communication system, and the journalism industry and thus shape their own social roles and positioning.

Abstract:The authors consider that there is a complicated relation of interaction between media supervision and judicial adjudication.Based on the analysis of the relation between media reporting and judicial fairness,we attempt to explore theoretical methods and actual paths matching both Chinese national condition and general judicial rationality by interpreting practical experiences with the maintenance of the judicial fairness and media supervision and relevant statues in UK and comparing the principles and methods to address this kind of problems in judicial practices in China.

Abstract:To satisfy social demand for legal assistance in transformation period,the Supreme People's Court introduced activismthat yielded some results in the practice of people's courts at various levels and also caused extensive concern.In practice,though excessive expansion of judicial power might impair credibility of the judiciary,judicial activism is nonetheless a realistic choice in social transformation period. Abstract:Due to the diversity of information types and socio-professional division of labor,we can not overestimate the role of the mass media whether in environmental monitoring or watchdog function.We can not ignore two facts in analysis of the media functions.First,the media is only a part of the whole social system of information communication and only take part of the functions to disseminate information.Second,the media's capacity is limited which can not show all of the information and also limited in insight,monitoring,collection and analysis of information.By distinguishing between non-media information and media information,media agencies and non-media information agencies,we can objectively observe mass media's social functions.The functions of mass media are as limited as it's effection because restricted by the other social units.So,if there is no other "non-watchdog" mechanism or institution,from the perspective of public opinion,the mass media's influence of watchdog will inevitably be less effective even in the most democratic system.

Abstract:‘Rule by media’ is a translation of the Chinese words ‘ or meizhi’. Although commentators have given different meanings to the expression, in this paper the term means that the media is capable of helping to resolve certain social issues effectively through public exposure. China is in a transitional period of rule of law, which is marked by the unique ‘Chinese characteristics’. Anti-corruption is an important part of rule of law. The Chinese media, which is mainly controlled by the state, has played a very important role in cracking down on corruption in recent years. Can a state-controlled media play an effective role in anti-corruption cases? Can the present Chinese Government and Chinese Communist Part succeed in its pursuit to rule of law through controlled exposure of corruption, while maintaining its present political system? These are the issues to be examined in the paper. The author is of a view that the Chinese Communist Party appears to follow the Confucian philosophy of self-restraint and self-purfication, which claims that a person shall improve himself by cultivating his internal body and spirit as well as nourishing his moral characteristics, in its effort to move to rule of law with ‘Chinese characteristics’. It is yet too early to say whether the rule of law with Chinese characteristics may lead to the creation of a workable political system different from the Western model of rule of law. Cracking down on corruption in any case is always a positive step for China to move to a society based on the rule of law.
