Judicial Application of the Criminal Policy of Temper Justice with Mercy

Abstract:The criminal policy of temper justice with mercy is definite requirement to the procuratorial work from the stature of the build of socialism harmonious society. Three layers of meaning included are: applying the lenity and severity strictly conforming to the criminal law; reasonably distinguish the criminal responsibility of the accused according to concrete circumstances of each case; and employing properly the mercy and severity to keep the equilibrium of punishment application. It should determine to be severe or with mercy considering the articles of criminal law, the category of crime, circumstances and performance after one has committed a crime, thoroughly apply the criminal policy of temper justice with mercy on the condition of strict compliance with the law, and exactly handle the spirit of temper justice with mercy in disposing doubtful cases.
