Sex Offenses Against Minors In China: An Empirical Comparison

Abstract:In recent years, due to a number of notorious sex offense cases against minors, a new punitive public attitude emerged in China and pressed for harsher crackdown and punishment against sex offenders. In particular, an "engagement in prostitution with a minor" law (Article 360 of the Criminal Law) was targeted as "unjust" based on the belief that offenders of such crimes often received "lenient" punishment, and many called for its abolition. In this study, based on 440 adjudicated sex offense cases, we examine potential differences across three sex offenses (including rape, child molestation, and engagement in prostitution with a minor) in the demographics of defendants and victims, offending characteristics, and trials and sentences of convicted offenders. Our empirical inquiry pointed to the unique nature of engagement in prostitution with a minor. Offenders of such crimes seemingly carried a different profile, compared with offenders of the other two sex crimes. Moreover, our data casted some doubt on the "lenient" punishment received by offenders of engagement in prostitution with a minor. Policy implications were also drawn based on our findings.

Abstract:Efforts to classify sexual offending and offenders continued to evolve over the years based on criteria such as offender and victim characteristics, offender-victim relationships, the nature of sexual offenses, and other situational factors. This current study draws up a typology of sexual offending against minors based on 436 adjudicated rape and child molestation cases in China. Specifically, sexual offending against minors is classified into six major categories, including opportunistic offenses, serial offenses, dating couple offenses, educator abuses, gang/party offenses, and incest offenses. Based on this empirical typology, a number of crime prevention measures are suggested. These suggestions aim at involving multiple players and institutions to focus on education, target hardening, and crime investigation. This study makes a significant contribution to comparative studies in this field, and the results could be potentially applied in other cultures.

Abstract:Drawing upon a concept developed by Fei Xiaotong, this article offers a preliminary theory for conceptualizing the regulation of criminal acts in imperial China. Centred upon the concept of a “differential mode of criminalization,” this article argues that the Confucianization of law in traditional China emphasized without ambiguity the implications of the closeness/remoteness in human relationships—the measure of distance conditioned upon the two main loci in everyday life, namely blood and non-blood relationships. This differential mode of criminalization fits into the Confucian imagery of a harmonious society.

Abstract:The Law of Social Order Maintenance in Taiwan,the Law concerning the Violation of Social Order in Germany and the Law of Administrative Punishment over Security in China mainly possess the same regulating scope.The idea of profession preference on the legislation orientation of public security penalty in the former two laws proves the scientificalness in the demarcation of the regulating scope in China's Law of Administrative Punishment over Security.Regarding the subject of delict of public security and the penalty system of public security,China's Law of Administrative Punishment over Security can be improved prominently compared with the former two,such as the legal confirmation for the subject of delict of public security,the legal reference of public security penalty criteria,carrying out the proportionality rule,redemption to the third party on expropriation,paying forfeit by stages and suspending or transferring to other kinds of penalty forms.

Abstract:The degree of punishment hinges on the seriousness of the crime, and the punishment and crime should be matched with each ther-this is a basic principle not only clearly stipulated in the Chinese Criminal Law,1 but also universally acknowledged. However, this does not mean that the balance between crime and punishment is actually fulfilled. If we want to prove if there is any gap between the actuality and the principle and how much big the gap is, we have to find the different “degrees” respectively indicating the gravity of crime and the harshness of punishment.In no case should we use the harshness of punishment to deduce the seriousness of the crime.

Abstract:There are differences in classification of Crimes of endangering national security in Germany and China. In the establishment of the concrete names of offences, Germany's criminal law is much more detailed than China's, especially in the establishment of two offences named ″Crime against peace″ and ″Crime against the state of democracy and rule by law″, from which we can borrow ideas. And the offence of overthrowing the national government in China's criminal law differs from the prescription in Germany's criminal law in whether they constitute offences in nonviolent ways. Conducts such as insulting and slandering the state leaders, the national flag and emblem are treated as common crimes in China's criminal law while in Germany's criminal law, such behaviors are regarded as crimes against national interest, which seems to be more suitable for law evaluation. Speech and writing are seen as conducts of criminal offence both in China's and Germany's criminal laws, which indicates that punishment of speech does not exist exclusively in the socialist countries like China. Each of the two countries' criminal laws has their own strong points in stipulating ″crime of insurrection ″ and ″crime of treason ″.

Abstract:Manchu-Han dual position was one of the distinguishing features of the official system in Qing Dynasty.How did Manchu and Han officials allocate powers and how did it operate in the practice of such a special section as the Board of Punishments? Due to the Qing government's whitewash and concealment from mentioning it,researchers often have regrets at the lack of literature for evidence. The present article used historical materials available,from language and personnel policies perspectives, to make a rough sketch showing how powers moved from Manchu to Han officials on the Board of Punishments in the Qing Dynasty and revealing the great contrast between the Manchu officials virtually monopolizing the Board in the early Qing Dynasty and the appearance of so-called Specialists in Charge of the Board phenomenon in the late Qing Dynasty.The article pointed out that the Qing government had repeatedly affirmed ethnic discrimination policies,such as Mandarin and Mounted Archery,which aimed at increasing the status of the Manchu and lowering the Han to strengthen the ruling ethnic group identity and cohesion.However,with the irresistible ethnic integration and intrinsic trends in the development of system and culture,the tides of pursuing fair trial and requiring specialized judicial personnel in judicial field finally broke the fence of ethics and language.

Abstract:This article discusses about the authority structure of two Miao villages--one is in Guizhou Province,another in Yunnan Proeince--in which I have conducted my fieldwork researches.On the base of previous studies on this subject in ethnology and anthropology,I describe the formation,conitinuity and reality of the authority structure of the two vkooages from historical perspective and give my analysis of this description.This article reveals the two villages with almost same cultural characters could form different authority models under different historical situations.I observed these models didn't change in essence as the time passed by and this opinion is opposite to the idea which supports that the authority models changed as the time passed.

Abstract:With regard to the problem of the theory of substantive illegality playing an important part in crime theory system,an antagonism exists between the consequence without value theory emphasizing "bad consequences" and the(dual) theory of conduct without value emphasizing "‘bad consequences’caused by ‘criminal behaviors’".The study of these two theories,however,has not been well developed in the field of criminal law in China.The theory of reasonable illegality should consider how certain movement of body causes harm to legal interests through violating the code of conduct with a view to establishing a "new conduct without value theory".The(dual) theory of conduct without value in this sense will not extend the scope of penalty or breach human rights;in addition,continuing to hold the standpoint of the theory of objective illegality will not obscure the confines of liability and responsibility.The new conduct without value theory can make crime theory and penalty theory unite harmoniously,confirm the positive aim of general prevention of penalty and agree with the current situation of social development,legislative tendency and judicial practice.

Abstract:Some believe that Chinese traditional justice is “Khadi justice”. Prof. Zhang Weiren from Taiwan, holds that the proposition of “Khadi justice” raised by Webber has no basis, and the Chinese traditional justice does not fall into the category of “Khadi justice”. According to the writer of this thesis, the proposition of “Khadi justice” is correct and Chinese traditional justice basically belongs to the “Khadi justice”. How to comment on the Chinese traditional judicial system and concepts involves both the issues concerning the laws in ancient and modern China and other countries and the fundamental direction of contemporary Chinese rule of law. The contemporary Chinese rule of law should be divided into three dimensions: people's livelihood, democracy, and popular sentiments, which respectively correspond to the economic system, political field and Chinese culture. The first two are mainly about the issue of ancient time and that of modern time, and the main task is to build the modern system. While the third is about the issue concerning China and western countries, mainly restoring the Chinese tradition culture. Nowadays the marketing economy, democratic government, and Chinese tradition and culture are in progress and will be necessary to the modernization of the legality of China and the modernization of China.

Abstract:The authors try to make a empirical study on crimes relevant to freedom of expression in mainland China,and conclude the Criminal Law of mainland China fails to protect this right effectively and lays too many regula- tions on freedom of expression.Firstly,according to my definition,the authors select 47 related crimes from a total 245, use 8 variants to give a precise description,and make correlation analysis by SPSSS.Secondly,try to set the principles to evaluate the statistics above.Principles are a combination of foreign and domestic standards.Thirdly,the author con- cludes China's Criminal Law fails to put spirit in the Constitution modification into practice.

Abstract:Xiaoli and Fazhen were two kinds of special means of punishment of Tang Dynasty.They were the new manifestations of traditional policy which made criminals become soldiers.In Tang Dynasty,as time went by,Xiaoli and Fazhen were becoming formal penalty gradually.In the degree of the penalty intensity,Xiaoli was between imprisonment and banishment.But in nature,it was more similar to banishment.Fazhen was applied as the way of commutation to death penalty in the Mid and Late of the Tang Dynasty.The appearance and popularity of Xiaoli and Fazhen in Tang Dynasty had a more complicated historical background.The most important reason was the problem of inadequacy of troops in the period of the Tang Dynasty.

Abstract:It becomes a tendency to introduce the German and Japanese theory in the structure of crime to restructure that of China. However, Chinese structure of crime is not that poor as criticized, while that of Germany and Japan applauded by reformist also has disadvantages, such as the confliction inside the system, the deviation of actuality and original intention and the only systematic notion, etc. The issues of Chinese structure of crime, e.g. the relationship of the constituents is not clear and the concept of crime deduced from the structure of crime is too simple, can be solved by carrying through the object-preferred step-up notion and setting up the concept of crime with various meanings. Thus, the current structure of crime does not have to be restructured.
