Abstract:The U.S.subprime mortgage crisis has caused a global financial crisis which reflects that there are grave defects in the U.S.financial system and supervision.This paper forcuses on the analysis of legal causes and effects of the crisis.Some suggestions will also be supplied on China's financial system and legal supervision.

Reflection of the Banking Crisis Management in China from a Legal Perspective

Abstract:We can't deny the fact that banks play a key role in our society, while it is impossible to avoid banking crisis even under the strictest supervision. The current legal system in China for banking crisis management is imperfect. It lacks both sufficient means to resort to, and enough protection for individual depositors in case of a crisis. The main practices in foreign developed countries are the lender of last resort (LOLR), the deposit insurance system and Market-withdrawal system. LOLR aims to save the banks which run into payment crisis temporarily. Usually this operation is performed by a country's central bank. The deposit insurance system is designed to divert the risk. Once a bank crisis occurs, the deposit insurance institution will repay the depositors' deposit in certain proportion. In order to make banks adaptable to market competition, we should enact banks market withdrawal legislation.We need to improve our bank crisis management mechanism in following aspects: (a) improving the restructuring mechanism; (b) constructing the emergency measures; (c) improving the merge and bankruptcy system; (d) reforming the lender of last resort system; and (e) establishing the deposit insurance system as soon as possible. We need to enact detail rules to regulate the take-over system, including the definition, precondition, object, terms, limitation and redress of the take-over action. Apart from take-over system, we should form certain short-term contingency plans. Banks tend to merge to improve their competitiveness and some of them can't avoid bankruptcy in market economy, so we should enact relevant laws and regulations. Since abuses of LOLR system will result in disrupting the market competitive system and lead to moral hazard, it is necessary to formulate strict standards in order to apply LOLR system cautiously. The deposit insurance system, which has proven satisfactory in western developed countries for decades, needs to be established in our country as soon as possible.

Abstract:The increasing cases of breach of contract in subprime mortgage in 2007 led to the subprime mortgage crisis in the United States.As the situation is getting worse,the subprime mortgage crisis has evolved into a global financial crisis and the unrest of financial market has trapped the key financial institutions deeply in the scope of world,causing them heavy losses.At present,the financial crisis has affected the real economy,causing the main economies in the world fall into recession.The paper makes a description of the transmission process from subprime mortgage crisis to financial crisis and finally to economic crisis of real economy,probes into some pivotal issues that initiated the emergence and spreading of the crisis,and demonstrates the lessons to be drawn by Chinese financial institutions.

Abstract:The impacts of international financial turmoil,caused by the U.S. "subprime mortgages butterfly" ,on entity economy are beyond the expectation. This paper analyzes the causes and transmission mechanism of the international financial crisis and its effects on global and Chinese economies. We also review the experiences and lessons of this crisis so to propose policy recommendations:to promote effective domestic demand via fiscal and monetary policies; to raise social consumption level with fairer distribution; to advance rural economic growth with focus on such problems as households' and small firms' loan mortgages; to take measures to stabilize real estate market.

Abstract:The mode of the financial holding company in the US is one of the major ways in developing financial mixed operation management. In the subprime lending crisis,the American independent investment banks like Goldman Sachs and Morgan Stanley either reform or being acquired,which led to the era of organizing the important forms of financial holding companies-bank holding company. Financial holding company is one of an important form of financial mixed operation management. The legal system of the American financial holding companies has gone through nearly one hundred years,and Financial Services Modernization Act of 1999 more to the form of financial holding company established in the future as the operation mode of the American financial mixed operation management. The subprime lending crisis will have a significant impact on the development of American financial holding company model and the rule of law ,and have an important impact on China's development of financial holding company.

Abstract:The global financial crisis triggered by American subprime mortgage crisis results from the financial systems,led by Wall Street,of Europe and the United States which violate such three principles of financial industry as being rooted in industry and commerce,strict risk management and control,as well as moderate leverage rate.China's financial industry should prevent such five trends as excessive overlapping policies,increasing enterprises' financing cost,too much privileged consciousness,too high income and weak service consciousness.Crisis-prevention should use such four balances as the gross proportion of loan to GDP 1∶1,gross proportion of securities market value to GDP 1∶1,gross proportion of total real estate value to GDP 1∶1,and gross proportion of national sovereign debt plus social security expenditure to GDP 1∶1.Crisis solution should not only depend on self-circulation of financial industry but rely on scientific and technological progress and tangible economy development.

Abstract:The current U.S.financial crisis was the result of the unlimited expansion of long-term credit over the past 20 years.The main tool of this unlimited expansion of credit is the shadow banking system.Shadow bank is a new financing system creates liquidity in the context of financial globalization.Its essence is to transform market liquidity into bank liquidity by a form of financial products and market arrangements devised by the sponsor in order to circumvent the formal regulatory rules.Its goal is to improve the leverage ratios of financial assets by increasing their liquidity and use excessively of the public financial system,so as to maximize the profits of some financial institutions.This new financing model creates conditions for the liquidity to gather and transform ,it also exists potential danger of a sudden interruption and collapse of the entire financial system.This article is from this perspective to reveal the liquidity transmission mechanism of current U.S.financial crisis.

Abstract:The U.S.subprime mortgage crisis resulted from credit expansion arbitrarily while its housing market boomed.The crisis emerged because of high delinquencies and foreclosures when the borrowers lost solvency under new situation that the interest rose and the housing price dropped.Furthermore,asset securitization passed the crisis from mortgage market to securities market and made the crisis spread more widely,even to other countries.The crisis has made a great impact on U.S.economy: housing price continuing dropping;consumption and investment shrinking;slowdown in manufacturing and bad employment,etc.According to the above-mentioned negative impacts and three times that the FED has continued cutting rates,we can conclude that the crisis has not been over and the prospect is not much optimistic.So,we should analyze the crisis deeply in different aspects,such as risk evading in asset securitization;coordinated development between fictitious economy and real economy;the effectiveness monetary policy to financial crisis and the relationship between internal imbalance and external imbalance,etc.

Abstract:The Subprime Mortgage Crisis in U.S. had transmitted to almost the whole world through many transmission channels just in a few months since 2007, and made most of countries plunge into Finance Crisis. However, the repercussions were discrepant among countries because of the different economic structures and macro-economic policy orientations. Abstract:The current financial tsunami consists of triple crises,i.e.,the sub-prime loan crisis,the structure finance crisis and the crisis of financial globalization. They take place respectively in the normal financial market,the derivatives market and international financial market. The paper argues that three levels of financial crisis have posed different challenges on current legal infrastructure,at both domestic and international levels,relevant to both regulatory regime and commercial/private law regime. It suggests that the law should respond in the following three perspectives,i.e.,the reform of the Bretton Woods system,the improvement of financial regulation,and importantly but unfortunately ignored,the reshuffling of commercial/private law governing financial transactions.

Abstract:The purpose of this paper is to analyse the causes and effects of the global financial crisis and to reveal its common features and unique factors by comparing financial crises in different historical periods. The study shows that excessive leverage, inadequate financial regulation and international capital flows are the main causes of the crisis, while policy failures, external shocks and internal vulnerabilities are the unique background of each crisis. Financial crises had far-reaching macroeconomic, financial market and socio-political impacts, leading to slower economic growth, rising unemployment, collapsing market confidence and social unrest. In order to effectively respond to financial crises, countries should strengthen financial regulation and risk control, improve the international financial system and enhance national economic resilience. Through the implementation of comprehensive policy measures and enhanced international cooperation, the global economy can better respond to the challenges posed by the financial crisis and lay the foundation for long-term prosperity and stability.

Abstract:After the subprime crisis quieted down,major economic giants of global financial system conducted new reform. In the changes,systematic risk management,enhanced control of high-risk financial derivative system came to the key. However,in the supervision,there are several problems,such as financial regulation that impacts the overall capital system in procyclicality,the supervision under mechanism of company govern-ance and compensation incentive system,which form the major contents in the adjustment and improvement of the reform system. Among them,procyclicality of financial supervision,incentive mechanism of financial or-gans and global cooperation draw attentions from supervision regulators of each country.
