Abstract:Mr.Rousseau's concept of ‘General Will' is a moral force with absoluteness and paramountcy.In his work ‘the Social Contract', he demonstrated the origin, establishment, implementation and preservation of general will.The general will originate from people's common demand for unity.To establish the general will is to embody people's common will of unity via concluding a contract.In the process of founding a community, general will is embodied by the form of popular sovereignty, with the moral community set up.In a moral community, the law confirms that the top position of general will actually set to legislate for morality.The implementation of general will come through the exercise of legislative power and executive power.The preservation of general will make it convert to corresponding rights, thus it is usual to establish a firm and stable foundation of legitimacy, so as to preserve the sacredness of general will as a moral force.
