How Crime's Seriousness Is Defined

Abstract:Based on the empirical study of 13,121 independent pairs of crime and penalty in the criminal laws of 50 countries,the author finds that the stringency and values of the criminal law are closely related to a number of non-legal factors such as demography,ethnic heterogeneity,resources per capita,urbanization process and the quality of nationals.Because these factors vary from country to country,the legislators have to find their own ways to deal with the local criminal problems and gain valuable and effective experience in that process.This experience,when combined with people's conscience and common sense of good and evil,forms the scale of severity for crimes in the criminal law.Acknowledgement of the impact of experience on criminal legislation is of great theoretical importance and practical values.
