On Some Problems of Definiteness within Criminal Law

Abstract:The definiteness of criminal law is one of the basic elements of the principle of legality,which is significant for judicial application of this principle. This article makes a thorough inquiry into the problem of definiteness in Chinese criminal law by taking Article 225 Section 4 of Criminal Code as an example. In Chinese criminal law,there are extensive blank clauses,elements of amount and circumstances and bottommost clauses,over which Chinese scholars have much controversies. Since blank clauses are connected with referential clauses,they should not be considered as violating the principle of definiteness. Although the elements of amount and circumstances are general clauses,they are merely the legislative frameworks which should be exercised by the judiciary. Therefore,the elements of amount and circumstances do not violate the principle of definiteness. The bottommost clauses should be analyzed case by case. For those bottommost clauses concerning the means of action,they do not violate the principle of definiteness. For those relative bottommost clauses,or those bottommost clauses concerning the approach of action,cannot be free of the suspicion of violating the principle of definiteness. Stipulating the bottommost clauses through judicial interpretation is a way to definiteness with Chinese characteristics. But the problems with this way are still to be discussed and solved.
