The Scope of Protection of Compilation Works and the Determination of Their Copyright Infringement:A Review of Recent Cases concerning Coaching Materials in China

Abstract:In cases concerning copyright infringement of textbooks, the scope of protection for compilation works and the determination of piracy are two of the key issues. We should firse distinguish the textbook itself as compilation work from the partial content or the structure of the textbook as independent work. This distinction has basic directive function for infringement affirmation and reveals that the scope of protection for these two works are also different. For the determination of compilation works, it is no use to distinguish the compiling methods from the compiled materials, instead, the infringing acts shall be within the sphere of the rights conferred to author and the use should concern the original expression of the compilation itself.
