Abstract:Following a description of the fundamental concepts and terms applicable in maritime risk management (MRM), the various methods by which shipowners might reduce their maritime liability risk are analysed. The advantages and disadvantages of each of the methods are addressed and examples of their potential use are provided. Based upon the premise of rational decision-making, an economic explanation for MRM is deduced from first principles and a distinction is drawn between the choice context of individual shipowners and that of maritime regulatory authorities. By integrating these two contexts, a conceptual approach to the application of cost–benefit analysis in maritime safety regulation is derived. The paper concludes by advocating the adoption of such an approach as a means of ensuring that safety regulation sets optimum targets such that the level of compliance yields maximum economic benefit and that the MRM which shipowners implement is effective in satisfying the regulatory targets that are set.

Abstract:A two-phrase model is established to study the features of bank's risk-behaviors,showing the importance of capital supervision.Then considering the dissymmetry of information, we put forth the concept of supervision errors and analyze their effects on financial risks.Finally,we discuss the functions of capital adequacy requirements in redressing supervision errors and prove that capital adequacy requirements are effective.

Abstract:The fraud rule in the law of letters of credit is still developing and has proven to be very controversial. The current international rules and national laws and decisions by most of the courts in many jurisdictions have taken the position that the fraud rule should be applied in a strict fashion or in cases of ‘material’ fraud. This chapter argues that a bifurcated approach should be adopted. That is, for fraud in the documents, a clear and simple fraud should be able to trigger the application of the rule; for fraud in the transaction, a high standard of fraud should be adopted.

Abstract:Assignment of credit is an important system in the law of obligation, and closely related to jus rerem and the system of unjust enrichment. Under the contract law of China, where parties agree that the credit is unassignable, the agreement shall be observed. Making such affirmativeness concerning the validity of agreement is open to question. It is inconsistent with the trend in foreign countries, and not fit for the need of the economic development. Deepened probe should be made with respect to the issues concerning the concept, constituent requirements, and legal force of the system of assignment of credit.

Abstract:This paper addresses a kind of risk decision-making problem existing widely in public administration and business management, which is characterized by ( 1) occurrence probabilities of states of nature can be estimated by analysing historical observations, but historical observations of different objects are unhomogeneous, ( 2) the relation between observations and occurrence probabilities of states of nature are affected by some qualitative and quantitative indicators, ( 3) it is a real-time decision-making problem, that is, there are many decisions for different objects to be made in a limited time, ( 4) considering decision's execution, impact of resource constrains is an important issue in decision-making process. In this paper, we develop a rule-based approach to address the problem. In the proposed approach, a two-step clustering method is employed to classify objects into categories, and observations in each category can be approximately viewed as homogeneous. For objects in each category, occurrence probabilities of states of nature are estimated by logistic regression, and the decision rule is obtained through solving an optimization model, which is to minimize the total decision risks while satisfying resource constrains. Effect and efficacy of our approach are illustrated through its application to China's customs inspection decision.

Abstract:As a kind of financial innovation,network credit,has great market space and development potential in our country.At present,since no relevant law or regulation is available in our country,there isn't a specific administrative department responsible for the regulation either.Risk can't be avoided in the network credit market.Now,the necessity of building and strengthening government regulation in the network credit field has been a common view shared by all the fields of society.But turn to the regulatory strategy,a final conlusion hasn't been reached.In the market economy environment,the essence of administrative supervision is risk-control,rather than impose restriction on innovation.Therefore,regulatory strategy should be determined on the basis of risk classification,explicit regulatory purpose,and a limited regulatory scope.
