Formation of China’s Economic Law:Trajectory,Events and Features

Abstract:From the perspective of historical development,the formation trajectory of China’s economic law as a legal department is mainly based on the economic legislation,and evolves in the following path gradually: the economic rules and regulations →systematic economic rules and regulations →market economic laws system→ the economic law in the Socialist System of Laws with Chinese Characteristics.The enactment and enforcement of the Law of the People’s Republic of China on Chinese-Foreign Equity Joint Venture in 1979,the General Principles of Civil Law of the People’s Republic of China in 1986,the Amendments to the Constitution of the People’s Republic of China in 1993 impose great impact on the initiation of the legislation of economic law,clarification of its extension and modernization of its connotation,and lay foundation for its recognition as a legal department by the Socialist System of Laws with Chinese Characteristics.The formation of China’s economic law as a legal department moves forward progressively with public expectation and legislative plan,coordinates and keeps pace with the institutional reform,legislative techniques,integrates with other legal departments and rules and regulations systematically,progressively in different levels according to certain standards.
