Abstract:1. For many talented scholars, international law in the last decades has been mainly an intellectual exercise in abstract logic. They indulged in the construction of theoretical systems in which international law operated in a logical way. Others, mainly in English speaking countries, restricted the treatment of international law to the discussion of cases. Both approaches failed to build a solid structure with the realities of international life in which international law is applied. Charles De Visscher does not belong to either group but his approach is a return to sound traditions of earlier periods. International law as a legal discipline is only three or four centuries old, although some of its rules have existed throughout history. Modern international law developed after the collapse of the hierarchic order of the Middle Ages, when the sovereign independent state became the basic unit in international relations. Since the seventeenth century many of the great international lawyers have been practicing diplomats as well. Their writings reflected and influenced the intellectual climate of their age and remained in harmony with the realities of international politics. At the same time, the Christian tradition of natural law played an important role in their thinking. This tradition set up barriers against the omnipotence of the state and made possible imaginative approaches in new situations. It is not by chance that Hugo Grotius' fundamental work, On the Law of War and Peace (1625), and Emmerich Vattel's Law of Nations (1758) became the first best sellers in international relations. While subsequently legal positivism greatly hindered the growth and creative function of international law, numerous authors in the period between the world wars have fallen into the other extreme.
