Abstract:Through a practical analysis on current non-functioning of civil procedure, this essay makes a research on various forces which affects the function of civil procedure and their mutual influences with each other, and points out that the reform of civil procedural law should conforms to the aims of civil procedure and fits the rules of civil litigation and treats judicial experience and judicial interpretation carefully. The author considers the time to revise civil procedural law is not ripe yet.
