Abstract:The U.S.-led war against Iraq in the name of preemption caused a fierce debate on its legitimacy and justice in political, legal and moral dimensions. The high officials in the U.S. administration and intellectuals supporting the war have presented many arguments on its legitimacy. The Iraq War was fought by a U.S.-led coalition against a sovereign state, and so the war can be reviewed under the framework of Just War theory. According to Jus ad bellum, Jus in Bello, and Jus post Bellum criteria, the preemptive war on Iraq was unjust, and those legal and moral justifications put forward by the U.S. before, during and after the war, could not provide sufficient legitimacy and justice for preemption.
