Abstract:Ecological compensation has emerged as a crucial institutional framework for managing the interplay between ecological preservation and economic development in China. This study focuses on the specific case of grassland ecological compensation to investigate the protection of rights and interests of non-governmental subjects. By utilizing data derived from questionnaire responses, this study examines the legal rights, obligations, and responsibilities associated with grassland ecological compensation. Statistical techniques such as Z-distribution, chi-square test, and non-parametric measures of correlation are employed to analyze the collected data, which are presented using tables and graphs. Furthermore, this research evaluates the current state of rights and interests of compensation subjects engaged in ecological compensation practices, aiming to enhance our comprehension and assessment of the extent to which the ecological compensation system safeguards the rights and interests of individuals. The findings show that a substantial number of respondents see current grassland ecological compensation methods in China as reasonable but insufficient, indicating a need for method diversification. There's a clear preference for a shared responsibility model over government-only funding, especially in regions with large grassland areas. This highlights the necessity for adaptable laws and a legal framework that accommodates diverse stakeholder needs. Additionally, the importance of clear property rights is emphasized for sustainable land use. The study suggests legislative reform towards a more equitable and effective approach to grassland conservation, providing valuable recommendations for refining and advancing the ecological compensation system.Author name 1 (Ziqi Liu) mismatch between ms and metadata. What problem does this paper attempt to address?
The main problem that this paper attempts to solve is the protection of the rights and interests of non - government entities in the grassland ecological compensation system. Specifically, the research aims to explore the following aspects:
1. **Are there differences in the degree of support for the legalization of grassland ecological compensation among respondents with different occupational backgrounds?**
- Through questionnaire surveys, the research analyzed the support attitudes of respondents with different occupational backgrounds (such as herdsmen and grassland managers) towards the legalization of grassland ecological compensation to understand the differences in views among different groups.
2. **Do the compensation entities in the research area think that the current ecological compensation methods are reasonable and effective and can meet the needs of grassland protection?**
- By collecting and analyzing questionnaire data, the research evaluated the satisfaction of respondents with the existing grassland ecological compensation methods, especially the effectiveness of these methods in actual operations.
3. **How should the distribution method of grassland ecological compensation funds be optimized? Should the government bear all the responsibilities alone?**
- The research explored the sources and distribution mechanisms of grassland ecological compensation funds, proposed diversified sources of funds and distribution models, and emphasized the importance of shared responsibilities, especially in areas with large grassland areas.
### Background and Current Situation
- **Legal Framework**: China's grassland ecological compensation system mainly revolves around the concept of "ecological civilization" and is regulated by a series of laws and regulations, such as the "Environmental Protection Law of the People's Republic of China", the "Forest Law of the People's Republic of China" and the "Grassland Law of the People's Republic of China", etc. Although these legal documents provide a basis for ecological compensation, there are still some deficiencies in actual operations, especially in terms of rights and interests protection.
- **Existing Problems**: The current grassland ecological compensation system has problems such as a single source of funds, low operating efficiency, and limited participation of compensation entities. In addition, the legal system is insufficient in comprehensively representing and incorporating all relevant stakeholders (such as local communities, ethnic minorities and marginal groups), resulting in uneven distribution of benefits and social inequality.
### Research Methods
- **Sample Survey**: The research team selected Inner Mongolia Autonomous Region, Sichuan Province, Qinghai Province, Gansu Province and Jilin Province as the survey provinces. These provinces rank high in China in terms of grassland area and per capita natural grassland area and are widely representative. The survey objects mainly include herdsmen, grassland managers, etc. A total of 479 questionnaires were distributed and 476 valid questionnaires were recovered.
- **Data Analysis**: The research adopted statistical methods such as Z - distribution, chi - square test and non - parametric correlation measurement to conduct a detailed analysis of the questionnaire data to evaluate the current situation and improvement direction of the grassland ecological compensation system.
### Main Findings
- **Grassland Degradation Situation**: Most family grasslands have different degrees of degradation, among which mild and moderate degradations account for a large proportion, and severe degradation is less.
- **Support for Legalization**: The vast majority of respondents (95.6%) support the legalization of grassland ecological compensation, but there are differences in the degree of support among respondents with different occupational backgrounds.
- **Fund Distribution and Responsibility Sharing**: Respondents generally believe that grassland ecological compensation should not be borne solely by the government, but requires diversified sources of funds and responsibility - sharing mechanisms, especially in areas with large grassland areas.
### Conclusions and Recommendations
- **Legislative Reform**: The research recommends legislative reform to establish a more fair and effective grassland ecological compensation system, clarify the rights and responsibilities of all parties, and enhance the adaptability and flexibility of the law.
- **Diversified Development**: Promote the diversified development of grassland ecological compensation, introduce market mechanisms and the participation of social organizations, and improve compensation efficiency and sustainability.
- **Rights Protection**: Strengthen the protection of the rights of compensation entities, ensure that the rights and interests of all stakeholders are fully represented and protected, and promote social fairness and harmony.
Through these studies, the paper provides valuable references and suggestions for improving and promoting China's grassland ecological compensation system.
