Abstract:Within the past three decades, legal changes have transformed the juvenile court from a nominally rehabilitative social welfare agency into a second-class criminal court for young offenders. The migration of blacks from the rural south to the urban north that began more than three-quarters of a century ago, the structural transformation of cities and the economy over the past quarter of a century, and the current public and political linkages between race and serious youth crime provided the impetus for recent punitive juvenile justice policies. Two competing conceptions of young people - innocence and responsibility - have facilitated the juvenile court's metamorphosis from a welfare into a penal organization as policy makers selectively manipulate these competing social constructs to conduct a form of `criminological triage'. At the `soft end', states have shifted non-criminal status offenders out of the juvenile system into a `hidden system' in the private-sector mental health and chemical dependency industries. At the `hard end', states transfer increasing numbers of youths, disproportionately minority, into the criminal justice system. In the `middle', states' sentencing policies escalate the punishments imposed on those delinquents, again disproportionately minority, who remain in an increasingly criminalized juvenile justice system. These changes in youth sentencing policy reflect both a change in the social construction of adolescence and in strategies of social control. As a result, very little remains of the Progressives' idea of a rehabilitative juvenile court.

Abstract:Within the past three decades, judicial decisions and legal changes have transformed the juvenile court from a nominally rehabilitative social welfare agency into a scaled-down, second-class criminal court that provides young offenders with neither therapy nor justice. The migration of African Americans from the rural South to the urban North that began three-quarters of a century ago, the macrostructural transformation of American cities and the economy over the past quarter of a century, and the current linkages in the popular and political culture between race and serious youth crime provide the impetus for get-tough policies to crack down on juveniles. The procedural and substantive convergence between juvenile and criminal courts has occurred because juvenile courts attempt to combine social welfare and criminal social control in one agency. If states uncouple social welfare from social control, then they can try all of fenders in one integrated criminal justice system. But states must formally recognize youthfulness as a mitigating factor at sentencing. A youth discount—shorter sentences for reduced culpability— provides a practical administrative mechanism to recognize youthfulness as a mitigating factor.

Mental Health Status of Prisoners in an Urban Jail

Abstract:The mental health status of a group of 486 admissions to the Philadelphia Prisons was systematically examined in a carefully controlled study using multiple indices of psychopathology. In addition to measures of psychopathology, demographic information and descriptive personality and intelligence data were collected on all subjects. Subsets of subjects also received individual psychiatric interviews and psychological evaluations. The results indicate that approximately two-thirds of the subjects were identifiable by relatively stringent criteria as being psychiatrically disturbed and in need of specific mental health treatment services, and 34% were identifiable by all indicators of psychopathology used. Furthermore, 11% were in need of immediate inpatient psychiatric hospital care. Implications for treatment planning in correctional service settings are discussed.

Abstract:This paper considers the development of new clinical and medical practices in the early 2000s in France, after the adoption of legal reforms aiming at the prevention of sexual infractions and the protection of minors. The paper explains how the reform led to the creation of a new form of punishment for sexual offenders, l' obligation de soin (therapeutic obligation), which can be described as long-term mandatory therapeutic monitoring. This paper offers an analysis of the implementation of this measure from the standpoint of the specialized mental health care unit which were entrusted the mission of caring for the new group of convicted patients, i.e., patients sentenced to undergo mandatory therapy, after this legal reform. In the new regime these mandatory therapies created, clinicians are tasked to combine their conventional mission of care for the patient in the present, with the judicial mandate of detecting and preventing the patient's relapse qua recidivism in the future. Mobilizing ethnographic examples that evidence the way clinical care comes to encompass a penal mandate of long-term surveillance of convicted patients, I argue that the dual injunction of procuring care while preventing relapse-recidivism constrains the psychodynamic forms of clinical intervention deployed by French clinicians, realigns both psychiatric and clinical interventions along penal lines, and revives interest in some of the diagnostic categories and aims of criminal psychiatry which were important for the development of psychiatry in France.

Administration and Policy in Mental Health and Mental Health Services Research

Abstract:Jails may serve an important public health function by treating individuals with psychiatric problems. However, scholars debate the service qualities that can best achieve this aim. Some suggest the possibility of comprehensive psychiatric services in jails, while others recommend a narrower focus on basic elements of care (assessments, medication management, and crisis intervention). To date, this debate remains uninformed by service recipients. This qualitative study addresses this gap by illuminating patient-inmate perspectives on jail psychiatric services. Patient-inmate experiences indicate that the jail environment is incongruent with the provision of comprehensive psychiatric services. Thus, program administrators would best serve patient-inmates by strengthening basic services and connections to community-based providers who can provide comprehensive and effective care.

[Madness is Conforming to One's Own Norms, and No Others: Psychiatry in Post-war Quebec]

Abstract:In the early 1950s, both the publication of the first Diagnostic and Statistical Manual (DSM-I) and the advent of psychopharmacology - particularly the development of chlorpromazine (Thorazine - RP4650) - set the stage for models of psychiatric thought, research and practice that remain dominant today. It was during this pivotal period, in 1955, that the Département de psychiatrie de l'Université de Montréal was founded by a cohort of young researchers newly arrived from well-known universities in France and the northeastern United States. This influential group quickly became staunch critics of the province's religion-based asylum system and lobbied for a government review that culminated into the 1962 Commission d'étude des hôpitaux psychiatriques (popularly known as the Bédard Report). What followed in Quebec between 1965 and 1975 was the secularization of psychiatric institutions and widespread deinstitutionalization. This paper illuminates cultural changes and intellectual shifts that have been overlooked in historical studies of post-war psychiatry by exploring the expansion of such "anti-psychiatry" schools of thought in Quebec in this period.
Rehabilitating antisocial personalities: treatment through self-governance strategies

Abstract:Offenders with antisocial personality disorder (ASPD) are widely assumed to reject psychotherapeutic intervention. Some commentators, therefore, argue that those with the disorder are better managed in the criminal justice system, where, following the introduction of indeterminate sentences, engagement with psychological treatment is coercively linked to the achievement of parole. By comparison, National Institute of Clinical Excellence guidelines on the management and treatment of ASPD recommend that those who are treatment seeking should be considered for admission to specialist psychiatric hospitals. The rationale is that prison-based interventions are underresourced, and the treatment of ASPD is underprioritised. The justification is that offenders with ASPD can be rehabilitated, if they are motivated. One problem, however, is that little is known about why offenders with ASPD seek treatment or what effect subsequent treatment has on their self-understanding. The aim of this paper is to address these unresolved issues. It draws on the findings of Economic and Social Research Council (ESRC) funded qualitative study examining the experiences of sentenced male offenders admitted to a specialist personality disorder ward within the medium secure estate and the medical practitioners who treat them. The data are analysed with reference to Michel Foucault's work on governmentality and strategy in power relations. Two arguments are advanced: first, offenders with ASPD are motivated by legal coercive pressures to implement a variety of Foucauldian-type strategies to give the false impression of treatment progress. Second, and related, treatment does not result in changes in self-understanding in the resistive client with ASPD. This presupposes that, in respect of this group at least, Foucault was mistaken in his claim that resistive behaviours merely mask the effectiveness of treatment norms over time. Nevertheless, the paper concludes that specialist treatment in the hospital setting can effect changes in the resistive offender's self-understanding, but not if the completion of treatment results, as is commonplace, in his prison readmission.

Abstract:Adolescents in the United States are in the midst of a mental health crisis and the mental health needs of youth in custody exceed that of the general adolescent population, making them some of the highest-need young people in the United States. 1,2,3 Up to 70% of youth in custody have one or more psychiatric conditions, including anxiety, depression, post-traumatic stress disorder, and substance use disorders. 4 Additionally, youth in custody are ten times more likely to exhibit symptoms of psychosis than their non-incarcerated peers. 5 They are also at higher risk of suicide, dying by suicide at a rate 2–3 times higher than peers without histories of legal system involvement. 6 The high prevalence of mental health needs among youth in custody necessitates urgent input, action, and partnership from the pediatric community. Pediatricians are often the first point of contact with healthcare for youth both in custody and upon re-entry into the community. 7,8,9 In the general population, pediatricians treat a vast majority of children and adolescents with depression and anxiety. 7,8 Pediatricians act as first-line providers and provide a safety net, which is crucial for youth from structurally vulnerable populations who may have limited access to care, including youth in custody and upon re-entry. 10 The Accreditation Council for Graduate Medical Education (ACGME) recognizes mental health as an essential aspect of pediatric practice and includes diagnosis and management of mental health issues as a core educational competency. 7 The ACGME identifies pediatricians as advocates for children and underserved populations who seek to eliminate health inequities. 10 It also considers advocacy for social justice and the ability to provide trauma-informed care as core competencies. 10 In spite of the ACGME's documented emphasis on developing pediatric providers with mental health competency and knowledge regarding the needs of underserved populations, there are no training requirements for pediatric trainees involving youth in custody. 11 The current status of clinical exposure and education for pediatric trainees is limited and inadequate, with most trainees having minimal to no clinical exposure to this population. 11 This lack of clinical exposure is incongruent with the clinical needs of underserved pediatric populations, including youth in custody.

Abstract:Medicine, Science and the Law, Ahead of Print. Many legal jurisdictions offer some form of hospital diversion and disposal as an alternative to incarceration in prison for mentally disordered offenders. Such diversion is commonly understood as offering a non-punitive alternative in terms of sentencing decisions. However, complete loss of responsibility with respect to acts of violence is rare and indicative of extreme degrees of mental disorder. This raises challenges for sentencers when considering disposal options. From the perspective of the patient and healthcare providers while hospital may be framed as non-punitive, it still involves marked loss of freedom and rights. In this essay, it is argued that failure to acknowledge the punitive element, inherent in hospital detention, risks its repression, and a false dichotomy being established with prison being seen as solely punitive and hospital as solely therapeutic. It is suggested that this division is unhelpful, even potentially harmful, and that a synthesis as solution to this dialectic opposition may be generative in terms of therapeutic work in hospitals, clarification of the role of hospitals in terms of criminal justice disposal, and greater transparency in relation to multi-agency working and the social circumstances of patients detained in secure hospitals. Further work to understand this process is suggested with a particular emphasis being placed on the experience of specific groups of patients, such as women, who may find themselves in a notably precarious state within secure care.

Creating the Swedish Juvenile Delinquent: criminal policy, science and institutionalization c. 1930–1970

Abstract:This article discusses what I call the creation of the juvenile delinquent in the period from the 1930s to the 1970s. Making use of a theoretical understanding taken from Michel Foucault and David Garland this article shows how several elements and factors contributed to this process of which I concentrate on discussing three: the criminal political context, criminological ideas and administrative changes. These practices, including the discourse production around the young offender, led to the creation of a new category: the juvenile delinquent. What happened is understood and analyzed with the help of Foucault's central concept of governmentality. Special emphasis had been laid on investigating the role in this process of reformatory prisons and the Reformatory Prisons Board. Three of the tentative conclusions that could be drawn from the discussion are that the domination of the administrative logic of order and control over the rehabilitative logic played an important role in the creation of the juvenile delinquent; that the diagnostic practice and the scientific credibility that it was built on created a widening gap between the young offenders and ‘normal’ youths; and that the creation of the juvenile delinquent contributed to a stronger symbiosis between the social, administrative and penal bodies.

Abstract:This article brings attention to cardinal principles to consider when implementing the Therapeutic Jurisprudence multidisciplinary approach with youth who are manifesting sustained coarse sexual improprieties and come to the attention of the judicial system. The obstacles of implementing therapeutic jurisprudence with this population include the persistent reliance of researchers on adult paradigms for risk assessment tools, along with treatment models that are not developmentally and gender sensitive, nor empirically supported for youth. Adherence to the scientific method is essential when constructing risk assessment tools that meet forensic standards. Applying the rich collateral paradigm of therapeutic jurisprudence within the context of valid and reliable measurements of intervention outcomes would immensely benefit those youth entangled with judicial systems who repeatedly are victims of abuse (neglect, maltreatment, physical and/or sexual). Youth who become entangled with the judicial system as dependents, and/or suspected or charged with criminal activity, need additional collateral resources geared toward ongoing developmental needs and specific to gender. Practical considerations and recommendations are made in contemplating expanding Therapeutic Jurisprudence with youth who engage in sustained sexually harmful behaviors to self and others.

[Involuntary hospitalization and treatment: the interface between psychiatry and law]

Abstract:Involuntary or compulsory hospitalization and treatment of mentally ill patients is one of the most distressing societal needs. The decision to hospitalize or treat an individual involuntarily must balance between three ethical issues: the patient's right to receive medical care, the patient's personal rights to liberty and dignity, and the protection of the public. The psychiatrist is concerned with the need for medical treatment, while the courts follow the letter of the law in order to ensure protection of the individual's rights, as well as those of the public. The interaction between the psychiatric (or medical) discipline and the judicial discipline comprises inherent difficulties, due to these differences in focus of concern and due to the differences in the language they use. In the civil compulsory hospitalization, it is the definition and prediction of dangerousness that comprises a potential discourse and misunderstanding between the psychiatric and the judicial system. It seems that both systems, as well as the patients, may benefit if the initial decision to hospitalize involuntarily is taken by the medical representatives (the District Psychiatrist, Hospital Director, three physicians, etc.) as an emergency procedure. The decision to continue the involuntary hospitalization should be taken by a judicial representative (or a committee), based on the psychiatric evaluation, within 72 hours instead of the 14 days as is currently stated in the Mental Health Law. The less restrictive alternative to hospitalization, compulsory outpatient treatment, is still controversial. This is an order "with no bite" and its implementation is determined, in effect, by the patient's goodwill and cooperation. There are no legal or other consequences for patients who do not comply with the outpatient treatment order. This is true for both civil and criminal outpatient orders. Without legal sanctions this model of outpatient treatment is not really "compulsory" and does not achieve its preventive goals.
Involuntary Psychiatric Hospitalization of Minors Due to Court Orders: Effectiveness Assessing Through a Case Series

Abstract:Introduction Involuntary treatments in forensic psychiatry represents a complex intersection of mental health, legal systems and ethics. Judicial authorities may compulsorily refer children to inpatient clinics for receiving necessarily treatment. Despite its importance, there is limited research on the reasons behind and effectiveness of such interventions in minors. Objectives The objectives of this study were to describe the clinical characteristics of minors who have risks of harming themselves and/or others so receiving involuntary treatment due to a court order. It is aimed to assess the effectiveness of involuntary treatment. Methods A follow-up case series was conducted on 9 minors who hospitalized by court orders in a secure inpatient child and adolescent psychiatry clinic, in the year of 2023. Data collected from medical records, including demographic information, clinical presentation, diagnosis and discharge treatment. After one, three and six month of the discharge, interviews made with the patients and their families. Current data collected on treatment regimen, compliance, behavioral outcomes and reoffending rates. All data were anonymized to maintain patient confidentiality. Results The case series consisted of 3 males and 6 females, with a mean age of 16.5 years at the time of admission. The most common reason to hospitalization was homicide risk 88%, followed by substance use 66%. Conduct Disorder was the most common diagnosis with the rate of 88%, followed by Substance Use Disorder(66%) and Attention Deficit and Hiperactivity Disorder(50%). 44% of minors had a history of juvenile delinquency. School dropout rates were 100%. Treatment consisted of a combination of individual and group therapy and medication. Treatment refusal rates were 88% so in terms of treatment, 88% of the minors in this sample treated with depot form antipsychotic medications, with the most common medication being risperidone. Overall all of the sample showed a significant reduction in disruptive behaviors during their hospital stay. Follow-up data collecting is still continue and preliminary statistics show us that relapse rates are low and treatment compliance is relatively high of the sample. Conclusions The findings suggest that involuntary hospitalization can be effective in reducing disruptive behaviors and increasing treatment compliance in minors with conduct disorders, substance abuse disorders and a history of juvenile delinquency. These results underscore the need for comprehensive, multidisciplinary approaches that integrate psychiatric treatment, psychoeducation and social support. Given the relatively small sample size and short-term follow-up, further research is needed to determine the long-term effects of involuntary treatment and to identify factors that predict treatment response. Abstract:Mental health courts developed in the USA in the late 1990s as one means to reduce the involvement of people with mental illness in the criminal justice system. In response to the growth in number of mental health courts, the Council of State Governments led an initiative to identify essential elements of mental health courts to guide their development and implementation. This paper applies these essential elements to a municipal mental health court in a multijurisdictional, suburban county. While this court met most essential elements, they faced a number of challenges. The primary ones included not being able to advance from hearing municipal cases only to state misdemeanor and felonies, not having the resources to expand program capacity for municipal cases, and participants not being able to always access needed mental health treatment, rehabilitation, and support services. The paper concludes with implications for behavioral health administrators and direct service staff in implementing the essential elements of mental health courts.
Adolescents' life between violence and discipline. Medical care in the "Jugendhäuser" juvenile detention centers in East Germany in the 1960s–1980s

Abstract:Background: In 1952–1989, special juvenile detention centers, called Jugendhäuser, were established in the German Democratic Republic. There, juvenile delinquents had to not only complete their sentences, but they were also supposed to be re-educated into conscious socialist personalities through a system of collective education proposed by Soviet pedagogue Anton Makarenko. Among twelve Jugendhäuser in East Germany, the ones in Halle and Dessau were considered to have the most severe conditions due to the praxis of mental and physical violence. For the first time, based on the personal files of former juvenile prisoners and archival documents of medical services, we reconstruct a picture of the health status of prisoners and medical care in both these Jugendhäuser. Methods: We analyzed personal files of juvenile prisoners from the Archive of the Correctional Facility in Halle and unpublished documents from the Saxony-Anhalt State Archive, Magdeburg Department, the State Archive in Leipzig and the Stasi Records Archive in Halle. For the examination of these sources, we implemented the historical-critical method. Results: The Jugendhäuser had a system of outpatient and inpatient treatment. Although the medical services rated the level of health care as good at those detention centers, numerous complaints from juveniles, as well as cases of failure to provide assistance, indicated certain deficiencies. Cases of violence in juvenile prisons were common, especially in the Jugendhaus Halle. Brawls between inmates led to injuries and sometimes even to deaths. Fear of beatings resulted in desperate acts such as self-harm, suicide and escapes from prison. Conclusion: The health status of young prisoners in the Jugendhäuser in Halle and Dessau was negatively affected by violence and often by lack of medical care. The prevalence of violence can be attributed to challenges of the penal system as well as deficiencies of the medical services. Since repressive means were used to overcome the violence, such efforts were not successful. The medical services did not offer specialized care for juveniles with mental and learning disorders or those who required psychological or even psychotherapeutic support. Physical health issues were also often ignored due to the stigmatization of sick juveniles as malingerers.

Prevalence Rates and Evolution of Psychiatric Disorders Among Incarcerated Youths in Comparison With Non-incarcerated Youths

Abstract:Background: Our main objective was to provide estimates of the prevalence rates of psychiatric disorders and comorbidities among youths in a juvenile detention center in Geneva, Switzerland. We also aimed to investigate potential positive effects of intensive psychotherapeutic and educational services this center provides. Finally, we examined psychiatric care prior to and after custody as well as the evolution of the youths' mental health during detention. Methods: We conducted a longitudinal study including a group of incarcerated (n = 86) and a group of non-incarcerated (n = 169) youths (12-18 years old). Measures included diagnoses of psychiatric disorders, cognitive functions, trauma, psychopathic traits and the Youth Self-Report (aggressive behavior, attentional disorders, criminal behavior, social withdrawal, anxiety, depression and somatic complaints) collected at baseline and at discharge for the incarcerated group. Data were analyzed using mixed-effect models. Results: Psychiatric disorders were prevalent in the incarcerated group (82.6, 95% CI: 71.6-90.7%), but young people also often suffered from several disorders simultaneously. Two-thirds of the incarcerated participants had a diagnosis of two or more psychiatric disorders. Regarding health care, most incarcerated participants (79.1%) had psychiatric care prior to detention. The planned care after detention was associated with psychiatric comorbidities, care being more likely planned for those with comorbidities (p = 0.030). Compared to the non-incarcerated group, the incarcerated group had lower scores on cognitive functioning (p < 0.001) and higher scores on trauma (p < 0.021) and psychopathic traits (p < 0.034). The youths' stay in the detention center was associated with a positive change of mental health, with externalized problems being significantly reduced at the end of their stay (p = 0.017). Conclusion: Our findings showed that youths in conflict with the law are characterized by (1) their internal vulnerabilities: a high prevalence of psychiatric disorders and psychiatric comorbidities, lower cognitive functions, externalized problems and psychopathic traits; (2) environmental factors: victims of violence and sexual abuse; and (3) their psychiatric history. Besides, the evolution of the most prevalent issues was favorable over time, which puts into question the usual perspective about the deleterious effect of detention.

Abstract:This article examines the epidemiology of the US juvenile legal system, which disproportionately impacts youth with multiple marginalized identities and exacerbates health inequities. Policy changes that can improve the treatment of children who display disruptive behavior are highlighted, so as to lay out a path forward for supporting children and enhancing health equity while bolstering public safety. Finally, this article concludes that the systemic racism pervasive in the juvenile legal system signals an important role for pediatrics to advance racial equity and transform our approach to childhood.
