Abstract:On January 30, 2024, over 300 researchers filed an amicus brief in FDA v. Alliance for Hippocratic Medicine, a United States (US) Supreme Court case that could have severely impacted access to mifepristone, one of the two drugs commonly used in medication abortion. The researchers summarize the legal challenges to the US Food and Drug Administration's (FDA's) original approval of mifepristone in 2000 and its 2016 and 2021 decisions modifying mifepristone's Risk Evaluation and Mitigation Strategy (REMS) Program and label, the responses from the FDA and drug manufacturer to the challenges, and the potential implications of the Court's decision on access to mifepristone in the US. The researchers detail how the FDA relied on a robust scientific record analyzing tens of thousands of patient experiences that conclusively demonstrated the safety and effectiveness of the changes to the mifepristone REMS Program and label and urge the Supreme Court to rely on the clear scientific record and preserve access to mifepristone without reimposing restrictions. What follows is a reprint of this brief.

Abstract:Since the US Supreme Court overturned Roe v Wade in 2022, eliminating the federal constitutional right to an abortion, the introduction of state laws and policies has made the legal and healthcare landscape more challenging. Twenty states have banned or severely restricted abortion care,1 and recent legislation is restricting access to abortion medication as well as abortion services, with Wyoming becoming the first state explicitly to ban the use of abortion medication.2In response, US abortion rights advocates have pushed to extend federal protections and the federal government has taken important steps to expand and protect access to medication abortion. Abstract:Abstract Objective: To explore the application of mifepristone in the stream of Residual tissue after abortion . Methods: A retrospective study of 1067 women who selected induced abortion in first-trimester pregnancy(gestational age ≤ 70 days) between January 1st，2018 and May 31st，2019 in Chongqing Health Center For Women and Children . Inclusion criteria: the first pregnancy patients, aged 18-30 years, gestational age ≤ 70 days. Test group (mifepristone + misoprostol) 467 cases. Control group(misoprostol) 600 cases. Analyzing the incidence of residual tissue after induced abortion. Evaluating the preventive effect of preoperative oral mifepristone on abortion incompleteness. Results: a total of 9 in test group occur residual tissue in uterine cavity，the incidence is 1.93%. In the controlled group, the number of residual tissue is 25,the incidence is 4.16%(P<0.05)，there was statistic difference between two groups. The uterine residue diameter in the test group(1.1±0.31cm) was lower than that in the control group(1.24±0.64cm)，but there was no statistical difference between the two groups of residue diameter (P>0.05)Conclusion: Oral mifepristone before operation can significantly reduce the incidence of tissue residual after induced abortion.

Abstract:Nowadays, unwanted pregnancy is a major globe tragedy for millions of women, associated with significant direct and indirect costs, no matter for individuals or society. The progesterone receptor antagonist steroid, mifepristone has been widely and effectively using throughout the world for medical abortion, but to a lesser extent for emergency contraception. In this review, we hope to explore the role of mifepristone as a contraceptive, particularly for emergency contraception. Studies of mifepristone have also been expanding to the fields of endometriosis and uterine fibroids. Furthermore, this initially considered reproductive medicine has been investigated in some psychotic diseases and various disorders of hypercortisolism, because of its glucocorticoid receptor antagonism. Mifepristone was approved suitable for patients with hyperglycemia secondary to Cushing's syndrome by the United States Food and Drug Administration (FDA) in 2012. The aim of this article is to review published reports on the anti-progesterone and anti-glucocorticoid properties of mifepristone as a clinical agent. There is a new insight into systematically describing and evaluating the potential efficiency of mifepristone administrated in the field of endocrine and neuroendocrine, not only in obstetrics and gynecology.

Abstract:OBJECTIVE To observe the effctiveness and clinic accept ability of medical abortion of early pregnancy induced by miferprestone accompanied with misoprostol.METHODS 102 women,who had early pregnancies after cesarean section, were compared with 78 women with early pregnancy after natural delivery and 129 women having no birth. Miferprestone and misoprostol were given in the routine way. Several items were recorded: drugs acting time, gestation sac passing out time, vaginal bleeding, side effects of the drugs, remainder in uterus or not and menstruation recovery days. RESULTS Comparison of several key items such as gestation sac passing out time, complete abortion rate, vaginal bleeding and menstruation recovery days, no obvious differences were observed in these three groups.CONCLUSION It is secure to process medical abortion of early pregnancy induced by miferprestone accompanied with misoprostol.

Mifepristone: where do we come from and where are we going? Clinical development over a quarter of a century

Abstract:Administration of mifepristone followed by the prostaglandin, misoprostol, has been used successfully in the medical termination of pregnancy for over 25 years, and the method is registered in 35 countries. Single doses of mifepristone are also effective as an emergency postcoital contraceptive. Mifepristone administered for 3 months or longer to women with uterine leiomyomas, is associated with a reduction in pain and bleeding with improvement in quality of life and decrease in fibroid size. Mifepristone is also effective in decreasing pain in women with endometriosis. In both these conditions, serum estradiol levels are in the range of those in the early follicular phase. A daily dose of at least 2 mg mifepristone blocks ovulation. In contrast, weekly administration of 25 or 50 mg does not consistently block ovulation but has contraceptive potential by delaying endometrial development. Mifepristone in a dose of 200 mg, administered 48 h after the Luteinizing Hormone (LH) surge, also acts as a contraceptive, but this strategy is not practical for widespread use. Administration of mifepristone for 4-6 months or longer may lead to endometrial thickening. Endometrial histology reveals cystic glandular dilation together with admixed estrogen (mitotic) and progestin (secretory) epithelial effects. This histological pattern does not represent endometrial hyperplasia.

Analytical and Comparative Jurisprudence

Abstract:This article examines the latest trends in the US Supreme Court’s jurisprudence on the right to artificial termination of pregnancy (abortion). It is stated that the right to abortion is not an integral part of the text of the US Constitution - it was not provided for in the original text, nor in the Bill of Rights, nor in subsequent amendments. However, the regulation of the right to abortion has been the subject of litigation and a number of decisions of the US Supreme Court. The issue is not only legal, but also political - in particular, the attitude to the regulation of the right to abortion, the question of whether it should be resolved at the federal level or at the level of individual states, what discretion should be given to the states, etc. This issue is a part of the debate, a public discussion, in almost every US election. Main decisions of the US Supreme Court in this area are reviewed, in particular Roe v. Wade, Dobbs v. Jackson Women’s Health Organization, Alliance for Hippocratic Medicine v. FDA. It is concluded that the right to abortion in the United States is not enshrined in the Constitution, and this creates certain problems, since it allows some theorists and practitioners to appeal to the fact that the absence of such constitutional enshrinement indicates an unwillingness to grant this right the status of a fundamental right protected by the Constitution. It is argued that this argument should be disagreed with, since in the US legal tradition a significant number of rights are somehow derived from the text of the Constitution in judicial practice, and therefore the understanding of the right to abortion as such which is grounded in the Fourteenth Amendment to the US Constitution is fully justified. It is pointed out that recent trends, in particular, the cases which have been heard or are pending in 2022-2024, indicate that the stability of legal regulation of the right to abortion in the United States has been shaken. Almost 50 years of Roe v. Wade precedent were not enough to convince some in the community that the right to abortion is truly firmly rooted in American history and tradition. By depriving it of constitutional protection, it allowed for considerable discretion to be given to the states, which could impose various types of regulation, up to and including a complete ban. Food and Drug Administration v. Alliance for Hippocratic Medicine further extended the «attack» on this right, which may also affect the interests of a significant number of women in the United States. To summarize, the recent trends are more political than legal, caused rather by ideological motives, as there were not enough convincing arguments to abandon the previous practice established by Roe v Wade. Enshrining the right to abortion at the level of the US Constitution (through an amendment) could help, but seems unrealistic given the polarization of society.

Abstract:This article aims to acquaint readers with the role and decision-making practice of the (Federal) Supreme Court of the United States of America in the matter of artificial abortion and a woman’s right to abortion in general. Special focus is placed on jurisprudential development in 2022, as a landmark decision was issued in 2022, which significantly interferes with the right to abortion throughout the United States. Abortion and abortion policy is currently widely discussed across the United States. For several decades, it was clear beyond any doubt that abortion is, in essence, a fundamental human right arising from the Constitution itself (Fourteenth Amendment) and that a woman can – while respecting certain set rules – undergo abortion, particularly in the first trimester, at virtually any time, according to her will. However, what was regarded as a certain and fundamental women’s right arising from the Constitution, has been overruled by the U.S. Supreme Court in 2022 for the first time in 50 years. In addition to the description of the current situation in the United States, this article briefly reflects on the possible effects of the current state of jurisprudence in the United States on the continental legal system. This article is created and reflects the legal status as of December 1, 2022.

Abstract:Objective To assess interest in clinician-administered advance provision of abortion pills among potential users in the USA. Methods Using social media advertisements, we recruited people living in the USA who were aged 18–45 years and assigned female at birth, who were not pregnant or planning pregnancy, for an online survey on reproductive health experiences and attitudes. We explored interest in advance provision of abortion pills, participant characteristics, including demographics and pregnancy history, contraceptive use, abortion knowledge and comfort, and healthcare system distrust. We used descriptive statistics to assess interest in advance provision, and ordinal regression modelling to evaluate differences in interest controlling for age, pregnancy history, contraceptive use, familiarity and comfort with medication abortion, and healthcare system distrust, reporting adjusted odds ratios (aORs) and 95% confidence intervals (95% CIs). Results From January-February 2022, we recruited 634 diverse respondents from 48 states, among whom 65% were interested, 12% neutral, and 23% disinterested in advance provision. There were no differences among interest groups by US region, race/ethnicity, or income. In the model, variables associated with interest included being aged 18–24 years (aOR 1.9, 95% CI 1.0 to 3.4) versus 35–45 years, using a tier 1 (permanent or long-acting reversible) or tier 2 (short-acting hormonal) contraceptive method (aOR 2.3, 95% CI 1.2 to 4.1, and aOR 2.2, 95% CI 1.2 to 3.9, respectively) versus no contraception, being familiar or comfortable with the medication abortion process (aOR 4.2, 95% CI 2.8 to 6.2, and aOR 17.1, 95% CI 10.0 to 29.0, respectively), and having high healthcare system distrust (aOR 2.2, 95% CI 1.0 to 4.4) versus low distrust. Conclusion As abortion access becomes more constrained, strategies are needed to ensure timely access. Advance provision is of interest to the majority of those surveyed and warrants further policy and logistical exploration.

Abstract:Hundreds of state-level abortion restrictions were implemented in the US between 2010 and 2020. Medication abortion was being widely adopted during this same period. Understanding the impact of health policies and political climate will improve the delivery of and access to reproductive healthcare in a period of rapid change. To measure the association between state abortion hostility and mifepristone and procedural abortion rates, we conducted a state-level repeated cross-sectional study using 2010-2020 employer-sponsored insurance claims data from Merative MarketScan. The exposure of interest was a 13-point state-level abortion hostility score based on the presence of policies which either reduce or protect access to abortion. Outcomes of interest were annual mifepristone and procedural abortion claims per 100,000 enrollees. We used a linear mixed model adjusting for urbanicity, age group, and year. We assessed whether temporal trends in abortion claims were modified by state abortion hostility by interacting year with two measurements of abortion hostility: baseline score in 2010 and change from baseline score. We found that median state-level mifepristone claims increased from 20 to 37 per 100,000 included enrollees; meanwhile, median procedural abortions claims decreased from 69 to 20 per 100. For mifepristone, every unit increase in a state's baseline abortion hostility score was associated with 7.5 (CI, -12 to -3.6) fewer mifepristone claims per 100,000 in 2010. For states with baseline hostility and change scores of zero, we did not observe a significant time trend over the 11 year study period. For every unit increase in baseline hostility, the time trend changed by 0.5 fewer claims (CI, -0.8 to -0.2) per 100,000 per year. States with higher baseline abortion hostility had fewer overall abortions, less uptake of mifepristone abortions, and slower decline in procedural abortions between 2010 and 2020. Changes in hostility from new restrictions during this time period did not significantly impact claims. Advocates for abortion access must simultaneously attend to individual abortion policies and the overall political climate. Updated research on the relationship between political climate and the evolving clinical landscape of abortion care is needed to inform this work.
