Reflection of the Banking Crisis Management in China from a Legal Perspective

Abstract:We can't deny the fact that banks play a key role in our society, while it is impossible to avoid banking crisis even under the strictest supervision. The current legal system in China for banking crisis management is imperfect. It lacks both sufficient means to resort to, and enough protection for individual depositors in case of a crisis. The main practices in foreign developed countries are the lender of last resort (LOLR), the deposit insurance system and Market-withdrawal system. LOLR aims to save the banks which run into payment crisis temporarily. Usually this operation is performed by a country's central bank. The deposit insurance system is designed to divert the risk. Once a bank crisis occurs, the deposit insurance institution will repay the depositors' deposit in certain proportion. In order to make banks adaptable to market competition, we should enact banks market withdrawal legislation.We need to improve our bank crisis management mechanism in following aspects: (a) improving the restructuring mechanism; (b) constructing the emergency measures; (c) improving the merge and bankruptcy system; (d) reforming the lender of last resort system; and (e) establishing the deposit insurance system as soon as possible. We need to enact detail rules to regulate the take-over system, including the definition, precondition, object, terms, limitation and redress of the take-over action. Apart from take-over system, we should form certain short-term contingency plans. Banks tend to merge to improve their competitiveness and some of them can't avoid bankruptcy in market economy, so we should enact relevant laws and regulations. Since abuses of LOLR system will result in disrupting the market competitive system and lead to moral hazard, it is necessary to formulate strict standards in order to apply LOLR system cautiously. The deposit insurance system, which has proven satisfactory in western developed countries for decades, needs to be established in our country as soon as possible.

Abstract:The development of Internet banks puts forward the new challenges to our present laws. Market access and quitting of Internet banks, the protection to the right of privacy of Internet banks' customers, the conflict of Internet banks and legal system of commercial instrument, supervision about Internet banks, legal effect of electronic signature and the legal responsibility of Internet banks. The safety of Internet banks can be guaranteed by passing the legislation of electronic signature law, strengthening supervision, regulating the behavior of Internet banks and enhancing the practical standard of Internet banks.

Abstract:Shanxi banks,a typical example,in China' s history,for the popular introduction of clannish firms into nonclannish managers(NCM),have an import value in research and practice.We have collected and sorted out a lot of historical literature and 34 biographies of NCM,and made a case study,by the use of the method of the collective biography,on their motives of the entry into banks and the characteristics of the process thereof.By our study,we have found that the positive correlation between the scale of banks and the employment of NCM is not noticeable,that the strategy of regional expansion is the cause for demand for the introduction into NCM,that the system of screening in which the selection or promotion was made mainly from the inner,the system of guarantee given by the third neutral parties,and the strategy of employing mainly the natives,are the main channels of the bank owner to obtaining and keeping employing talented managers.At the different stages of the entry of NCM, the use of the dynamic incentive mix for encouraging NCM to maintain high levels of psychological ownership was the source of bank' s business vitality.However,the lack of the system concerning the internal control made the level of the psychological ownership of NCM too high,which was the important underlying cause of Shanxi banks for their gong downhill,and up to now,this internal cause has been ignored by scholars researching on Shanxi businessmen.

Abstract:A two-phrase model is established to study the features of bank's risk-behaviors,showing the importance of capital supervision.Then considering the dissymmetry of information, we put forth the concept of supervision errors and analyze their effects on financial risks.Finally,we discuss the functions of capital adequacy requirements in redressing supervision errors and prove that capital adequacy requirements are effective.

Abstract:As the most favorable market in the world in terms of scale and liquidity, the United States fixed-income market attracts foreign investors in pursuit of stable returns. After making a comparison between China and other countries in light of the scale, varieties and features of the investment in America’s fixed-income market, the author focuses on domestic commercial banks’ change in open interest of foreign currency bonds as well as the underlying loss incurred due to the subprime crisis. It is also suggested that commercial banks take more prudent investment measures to cut the investment proportion of risk assets.

Abstract:Commercial banks play an important role in financial system of China. This article introduces the culture, structure and strategy of China’s commercial banks. The culture includes two stages of the era of planned economy and the era of market economy. The era of market economy began at the end of the 1970s. In the last forty years, China has established a complete commercial banking system. China’s commercial bank system includes stateowned commercial banks, joint-stock commercial banks, urban commercial banks, rural financial institutions and other types. In this section, this article quotes the latest data from the China Banking Regulatory Commission (CBRC) on banking. The last section is strategy. Specifically, the geographical area and market positioning of all kinds of commercial banks are clear. They have a diversified service channel and a rich variety of products. The development of Internet banking is in the ascendant. Because of the expansion of off balance sheet business, they are facing a high risk in recent years. The government is working to reduce the leverage of commercial banks to control the overall risk level.

Abstract:China has maintained government control over major banks through its holding of controlling shares, leading to concerns about their possible policy burdens. In the case of the Agricultural Bank of China (ABC), the explicit policy mission of serving the rural economy and farmers has been assigned along its public listing in stock markets. Although it has adopted strategies to redefine the scope of rural business and implemented organizational and regulatory reforms to reduce the costs of implementing the policy missions, the contradiction between policy and commercial objectives has not been reconciled.

Abstract:The life expectancy rate of individuals worldwide has risen, and China is not excluded. Combined with an aging population, increasing pressure on the pension fund system, and a lack of savings, it poses a significant challenge to financial security unless measures are taken to improve individuals’ planning and financial well-being in retirement. This study aims to examine the psychological factors that influence individuals' FPR, thereby expanding the explanatory models for retirement savings decisions and behaviors. Using the CWO Model and supported by image Theory and the 3M Model, this research focuses on how the interaction between future time perspective, risk tolerance, retirement goal clarity, subjective financial literacy and objective financial literacy as psychological characteristics influence individuals' FPR. To obtain meaningful results, back translation was used to check the accuracy of the preliminary translation of research instruments. This translation method was also combined with the pretest method of expert reviews and cognitive interviews to increase the validity of the survey questionnaire. A purposive sampling technique will be applied to collect data from adults who are over 23 years old and have a certain income stream in six cities in China. The Structural Equation Modelling software will be used to examine the hypotheses of direct and mediating effects. This study has implications for financial market regulators, policy makers, and consumers.
