Abstract:Nursing Ethics, Ahead of Print. BackgroundProtecting a person's right to privacy and confidentiality is important in healthcare services. As future health professionals, nursing students should bear the same responsibility as qualified health professionals in protecting patient privacy.ObjectivesTo investigate nursing students' practices of patient privacy protection and to identify factors associated with their practices.Research designA cross-sectional study design was adopted. A two-part survey was used to collect two types of data on nursing students: (1) personal characteristics, including demographics, clinical experience and use of information and communication technology and social media and (2) practice of patient privacy protection, collected using the Patient Privacy Scale.Participants and research context:A total of 319 nursing students aged 18 or above, studying pre-registration nursing programmes and who had attended at least one block of clinical placement, were recruited from a university in Hong Kong.Ethical considerationsThe study received ethical approval from the Survey and Behavioural Research Ethics Committee of the Chinese University of Hong Kong. The participants were informed of the study aim and written consent was obtained before completing the survey.Findings:The mean total score on the Patient Privacy Scale was 119.7 out of 135. Nursing students who were regular users of Instagram and those who had never taken photographs with patients and hence did not need to obtain patient consent were associated with better practices of patient privacy protection (higher total scores on the Patient Privacy Scale).ConclusionsThe findings improve our understanding of nursing students' practice of patient privacy protection and the associated factors. This will inform the development and revision of current strategies to enhance nursing students' practice of patient privacy protection, especially their use of social media.

Abstract:Nurse educators frequently know intriguing personal information about students and must decide whether to share such information with colleagues. While sharing with colleagues is sometimes necessary, often it is not. Discussing stories about students may be an effective stress-relieving strategy for faculty, but stress reduction must not be achieved at the expense of ethical behavior. The author explores the fine line between gossip and collegial discourse that focuses on educational goals, considers whether a separate code of ethics for nurse educators is needed, and offers recommendations for action.

Abstract:Availing services provided via the Internet became a widely accepted means in organising one's life. Beside others, eLearning goes with this trend as well. But, while employing Internet service makes life more convenient, at the same time, it raises risks with respect to the protection of the users' privacy. This paper analyses the attitudes of eLearning users towards their privacy by, initially, pointing out terminology and legal issues connected with privacy. Further, the concept and implementation as well as a result analysis of a conducted study is presented, which explores the problem area from different perspectives. The paper will show that eLearning users indeed care for the protection of their personal information when using eLearning services. However, their attitudes and behaviour slightly differ. In conclusion, we provide first approaches of assisting possibilities for users how to resolve the difference of requirements and their actual activities with respect to privacy protection.

Considerations for use of dental photography and electronic media in dental education and clinical practice

Abstract:Photography and electronic media are indispensable tools for dental education and clinical practice. Although previous research has focused on privacy issues and general strategies to protect patient privacy when sharing clinical photographs for educational purposes, there are no published recommendations for developing a functional, privacy-compliant institutional framework for the capture, storage, transfer, and use of clinical photographs and other electronic media. The aims of this study were to research patient rights relating to electronic media and propose a framework for the use of patient media in education and clinical care. After a review of the relevant literature and consultation with the University of Washington's director of privacy and compliance and assistant attorney general, the researchers developed a privacy-compliant framework to ensure appropriate capture, storage, transfer, and use of clinical photography and electronic media. A four-part framework was created to guide the use of patient media that reflects considerations of patient autonomy and privacy, informed consent, capture and storage of media, and its transfer, use, and display. The best practices proposed for capture, storage, transfer, and use of clinical photographs and electronic media adhere to the health care code of ethics (based on patient autonomy, nonmaleficence, beneficence, justice, and veracity), which is most effectively upheld by a practical framework designed to protect patients and limit institutional liability. Educators have the opportunity and duty to convey these principles to students who will become the next generation of dentists, researchers, and educators.

Abstract:The European Learning Analytics Community Exchange (LACE) project is responsible for an ongoing series of workshops on ethics and privacy in learning analytics (EP4LA), which have been responsible for driving and transforming activity in these areas. Some of this activity has been brought together with other work in the papers that make up this special issue. These papers cover the creation and development of ethical frameworks, as well as tools and approaches that can be used to address issues of ethics and privacy. This editorial suggests that it is worth taking time to consider the often intertangled issues of ethics, data protection and privacy separately. The challenges mentioned within the special issue are summarised in a table of 22 challenges that are used to identify the values that underpin work in this area. Nine ethical goals are suggested as the editors’ interpretation of the unstated values that lie behind the challenges raised in this paper.

Abstract:Health and medical data are increasingly being generated, collected, and stored in electronic form in healthcare facilities and administrative agencies. Such data hold a wealth of information vital to effective health policy development and evaluation, as well as to enhanced clinical care through evidence-based practice and safety and quality monitoring. These initiatives are aimed at improving individuals' health and well-being. Nevertheless, analyses of health data archives must be conducted in such a way that individuals' privacy is not compromised. One important aspect of protecting individuals' privacy is protecting the confidentiality of their data. It is the purpose of this paper to provide a review of a number of approaches to reducing disclosure risk when making data available for research, and to present a taxonomy for such approaches. Some of these methods are widely used, whereas others are still in development. It is important to have a range of methods available because there is also a range of data-use scenarios, and it is important to be able to choose between methods suited to differing scenarios. In practice, it is necessary to find a balance between allowing the use of health and medical data for research and protecting confidentiality. This balance is often presented as a trade-off between disclosure risk and data utility, because methods that reduce disclosure risk, in general, also reduce data utility.

Abstract:Education, Big Data, and student privacy are a combustible mix. The improvement of education and the protection of student privacy are key societal values. Big Data and Learning Analytics offer the promise of unlocking insights to improving education through large-scale empirical analysis of data generated from student information and student interactions with educational technology tools. This article explores how learning technologies also create ethical tensions between privacy and the use of Big Data for educational improvement. We argue for the need to demonstrate the efficacy of learning systems while respecting privacy and how to build accountability and oversight into learning technologies. We conclude with policy recommendations to achieve these goals.

Abstract:This article considers Ifenthaler and Schumacher's (in Educ Technol Res Dev 64(5):923–938, 2016) paper entitled "Student perceptions of privacy principles for learning analytics" from a policy perspective. The increasing shift to digital occurring across the education landscape has resulted in greater access to data that can be used to enhance the student learning experience. However, it is essential that appropriate policy be in place to ensure the ethical use of such data, and equally important that the student voice be included in the development of such policy. Ifenthaler and Schumacher's study investigates students' preferences for the types of learning analytics systems they would like to be able to access and willingness to share their data for use in these systems. They find that students would like access to learning analytics systems that provide a broad range of information that can promote metacognitive awareness and provide personalised feedback, but are not entirely comfortable with sharing the full range of data necessary to inform such systems. These findings are important in acknowledging the difficulties in building a shared understanding and vocabulary when speaking to students about the possibilities and ethical implications of learning analytics. Consequently, further consideration is needed to build students' understanding of the purposes and benefits of sharing data as well as awareness of the range of policies that inform a consultative process around systems implementation to ensure transparency and accountability so that learning analytics can play an effective, but safe, role in our increasingly digital education environments.

Abstract:Participants in educational technology research regularly share personal data which carries with it risks. Informing participants of these data sharing risks is often only done so through text contained within a consent form. However, conceptualizations of data sharing risks and knowledge of responsible data management practices among teachers and learners may be impoverished—limiting the effectiveness of a consent form in communicating such risks in a manner that adequately supports participants in making informed decisions about sharing their data. At two high schools participating in an educational research project involving the use of technology in the classroom, we investigate teacher and student conceptions of data sharing risks and knowledge of responsible data management practices; and introduce a communication approach that attempts to better inform educational technology research participants of such risks. Results of this study suggest that most teachers have not received formal training related to responsibly managing data; and both teachers and students see the need for such training as they come to realize that their understanding of responsible data management is underdeveloped. Thus, efforts beyond solely explaining data sharing risks in an informed consent form may be needed in educational technology research to facilitate ethical self‐determination.

Teaching privacy: A flawed strategy for children's online safety

Abstract:Teaching young people about "privacy" has serious defects if the goal is to promote children's online safety. This commentary points out some the key problems to programs and educational modules with this privacy orientation. Privacy is an abstract and complicated concept, whose norms are in flux, making it difficult to impart clear, relevant, consensus-based messages. We also know very little about how privacy concepts develop in childhood and at what age and in what sequence, making it hard to know what to teach and when. Privacy skills are not necessarily the most important ones for preventing most online harms, including the most serious ones, casting doubt on whether they should receive priority over other prevention skills. Research has also not clearly established connections between many privacy practices and reductions in harm. Most privacy messaging has not been evaluated for how well it is learned, applied and what forms of safety it enhances. As an alternative, the promotion of online safety is best organized, not around privacy, but around the specific harms that educators and children themselves are trying to prevent. The highest priority of these are sexual exploitation, peer bullying and harassment. Such educational safety programs are best built from the foundation of evidence-based programs related to parallel offline dangers.
Registered Nurses' personal rights vs. professional responsibility in caring for members of underserved and disenfranchised populations

Abstract:Aims: Health disparities exist and refer to the chasms in health status between the advantaged and disadvantaged. Intense multiculturalism will require different approaches and moral obligations to work with these groups and urgency exists to develop nursing caring strategies when dealing with these populations. Development of nursing curricula which identify prejudicial thinking and intolerance for marginalized groups will help to decrease fears and increase nurses' willingness to provide culturally competent health care for underserved and disenfranchised populations. Background: Caring for members of disenfranchised groups instills fear at some level in nurses who are working with these individuals. This fear may be due, in part, to the potential harm nurses perceive the patient may cause them, or perhaps it is because they feel they could possibly be in the individual's situation at some point in their lives. Prejudice and discrimination continue to exist in society and have adversely affected the health care system and the nursing profession. Discrimination may be based on differences due to age, ability, gender, race, ethnicity, religion, sexual orientation, or any characteristics by which people differ. Relevance to clinical practice: Registered Nurses are accountable for nursing decisions and actions regardless of personal preferences. Due to the rapidly changing healthcare system the nurse faces increasing ethical dilemmas and human rights issues. Nurses are individually accountable for caring for each patient and the right to refuse an assignment should be carefully interpreted to avoid patient abandonment. Nurses' objections can be based on moral, ethical, or religious beliefs not on personal preferences and in an emergency the nurse must provide treatment regardless of any personal objections.

Abstract:The e-learning systems are designed to provide an easy and constant access to educational resources online. Indeed, E-learning systems have capacity to adapt content and learning process according to the learner profile. Adaptation techniques using advanced behavioral analysis mechanisms, called "Learner Modeling" or "Profiling". The latter require continuous tracking of the activities of the learner to identify gaps and strengths in order to tailor content to their specific needs or advise and accompany him during his apprenticeship. However, the disadvantage of these systems is that they cause learners' discouragement, for learners, alone with his screen loses its motivation to improve. Adding social extension to learning, to avoid isolation of learners and boost support and interaction between members of the learning community, was able to increase learner's motivation. However, the tools to facilitate social interactions integrated to E-learning platforms can be used for purposes other than learning. These needs, which can be educational, professional or personal, create a mixture of data from the private life and public life of learners. With the integration of these tools for e-learning systems and the growth of the amount of personal data stored in the databases of these latter, protecting the privacy of students becomes a major concern. Indeed, the exchange of profiles between e-learning systems is done without the permission of their owners. Furthermore, the profiling behavior analysis currently represents a very cost-effective way to generate profits by selling these profiles advertising companies. Today, the right to privacy is threatened from all sides. In addition to the threat from pirates, the source of the most dangerous threats is that from service providers online that users devote a blind trust. Control and centralized data storage and access privileges that have suppliers are responsible for the threat. Our work is limited to the protection of personal data in e-learning systems. We try to answer the question: How can we design a system that protects the privacy of users against threats from the provider while benefiting from all the services, including analysis of behavior? In the absence of solutions that take into account the protection and respect of privacy in e-learning systems that integrate social learning tools, we designed our own solution. Our "ApprAide" system uses a set of protocols based on security techniques to protect users' privacy. In addition, our system incorporates tools that promote social interactions as a social learning network, a chat tool and a virtual table. Abstract:Privacy is a human right. It ensures that individuals are free to engage in discussions, participate in groups, and form relationships online or offline without fear of their data being inappropriately harvested, analyzed, or otherwise used to harm them. Preserving privacy has emerged as a critical factor in research, particularly in the computational social science (CSS), artificial intelligence (AI) and data science domains, given their reliance on individuals' data for novel insights. The increasing use of advanced computational models stands to exacerbate privacy concerns because, if inappropriately used, they can quickly infringe privacy rights and lead to adverse effects for individuals -- especially vulnerable groups -- and society. We have already witnessed a host of privacy issues emerge with the advent of large language models (LLMs), such as ChatGPT, which further demonstrate the importance of embedding privacy from the start. This article contributes to the field by discussing the role of privacy and the issues that researchers working in CSS, AI, data science and related domains are likely to face. It then presents several key considerations for researchers to ensure participant privacy is best preserved in their research design, data collection and use, analysis, and dissemination of research results.

Cultural Differences in Students' Privacy Concerns in Learning Analytics across Germany, South Korea, Spain, Sweden, and the United States

Abstract:Applications of learning analytics (LA) can raise concerns from students about their privacy in higher education contexts. Developing effective privacy-enhancing practices requires a systematic understanding of students' privacy concerns and how they vary across national and cultural dimensions. We conducted a survey study with established instruments to measure privacy concerns and cultural values for university students in five countries (Germany, South Korea, Spain, Sweden, and the United States; N = 762). The results show that students generally trusted institutions with their data and disclosed information as they perceived the risks to be manageable even though they felt somewhat limited in their ability to control their privacy. Across the five countries, German and Swedish students stood out as the most trusting and least concerned, especially compared to US students who reported greater perceived risk and less control. Students in South Korea and Spain responded similarly on all five privacy dimensions (perceived privacy risk, perceived privacy control, privacy concerns, trusting beliefs, and non-self-disclosure behavior), despite their significant cultural differences. Culture measured at the individual level affected the antecedents and outcomes of privacy concerns more than country-level culture. Perceived privacy risk and privacy control increase with power distance. Trusting beliefs increase with a desire for uncertainty avoidance and lower masculinity. Non-self-disclosure behaviors rise with power distance and masculinity, and decrease with more uncertainty avoidance. Thus, cultural values related to trust in institutions, social equality and risk-taking should be considered when developing privacy-enhancing practices and policies in higher education.

Significance of anonymity and privacy in improving inclusivity and diversity in Higher Education Learning Environments

Abstract:Interactions between lecturers and students are the key to learning in the higher education environment. In this paper, the investigation pursues two different contexts to understand these interactions and the impact of anonymity and privacy in different interactions in the Computer Science (CS) department. The first context "different interaction between a lecturer and students" is investigated using phenomenological research approach by interviewing lecturer in CS ($N_a = 5$). The second context "the significance of anonymity and privacy in interactions" is investigated using a quantitative and qualitative questionnaire-based research method using an online student questionnaire ($N_b = 53$). The study finds a large gap between students' perception of preferred communication methods and the use of the same communication method. From the second context study, it is evident that "anonymity and privacy" in online surveys and module evaluations are preferred by all student participants, thus supporting diversity and inclusivity.

Abstract:The field of learning analytics has advanced from infancy stages into a more practical domain, where tangible solutions are being implemented. Nevertheless, the field has encountered numerous privacy and data protection issues that have garnered significant and growing attention. In this systematic review, four databases were searched concerning privacy and data protection issues of learning analytics. A final corpus of 47 papers published in top educational technology journals was selected after running an eligibility check. An analysis of the final corpus was carried out to answer the following three research questions: (1) What are the privacy and data protection issues in learning analytics? (2) What are the similarities and differences between the views of stakeholders from different backgrounds on privacy and data protection issues in learning analytics? (3) How have previous approaches attempted to address privacy and data protection issues? The results of the systematic review show that there are eight distinct, intertwined privacy and data protection issues that cut across the learning analytics cycle. There are both cross‐regional similarities and three sets of differences in stakeholder perceptions towards privacy and data protection in learning analytics. With regard to previous attempts to approach privacy and data protection issues in learning analytics, there is a notable dearth of applied evidence, which impedes the assessment of their effectiveness. The findings of our paper suggest that privacy and data protection issues should not be relaxed at any point in the implementation of learning analytics, as these issues persist throughout the learning analytics development cycle. One key implication of this review suggests that solutions to privacy and data protection issues in learning analytics should be more evidence‐based, thereby increasing the trustworthiness of learning analytics and its usefulness. Practitioner notes What is already known about this topic Research on privacy and data protection in learning analytics has become a recognised challenge that hinders the further expansion of learning analytics. Proposals to counter the privacy and data protection issues in learning analytics are blurry; there is a lack of a summary of previously proposed solutions. What this study contributes Establishment of what privacy and data protection issues exist at different phases of the learning analytics cycle. Identification of how different stakeholders view privacy, similarities and differences, and what factors influence their views. Evaluation and comparison of previously proposed solutions that attempt to address privacy and data protection in learning analytics. Implications for practice and/or policy Privacy and data protection issues need to be viewed in the context of the entire cycle of learning analytics. Stakeholder views on privacy and data protection in learning analytics have commonalities across contexts and differences that can arise within the same context. Before implementing learning analytics, targeted research should be conducted with stakeholders. Abstract:Introduction: Chicago's COVID-19 Rapid Response Team (CRRT) is a decentralized, interprofessional group of nurses, residents, students, and faculty who provide free COVID-19 testing for those living or working in congregate settings (i.e., shelters, long term care facilities, prisons and encampments) due to their increased risk. Individuals within these vulnerable populations regularly experience stigma, a lack of privacy, and healthcare discrimination as they are often in low-income and underserved communities. The CRRT tests in settings that are necessarily large (cafeterias, meeting areas, gymnasiums, recreation rooms), and provide little physical privacy. Regardless of patient circumstances, respecting patient dignity is a professional standard of care, and patient privacy is consistent with that standard. Methods: Guided by trauma-informed care techniques, emancipatory nursing practice, and cultural safety methodology, student members of the CRRT initiated a project focused on expanding physical privacy protection for those undergoing COVID-19 testing. Conclusion: Though the introduction of a portable privacy screen started as an initiative to safeguard the dignity for underserved populations, this call to action implores current and future health care providers to prioritize the ethical treatment of those most vulnerable by advocating for patient dignity and privacy.

Abstract:Purpose: The purpose of this study was to identify factors influencing patient privacy protection behavior among nursing students and examine the relationships between these factors. Methods: Participants in this study were 144 nursing students who have experienced clinical practice. The data were analyzed using descriptive statistics, one-way ANOVA, Scheffe test, Pearson's correlation coefficient, and multiple regression with IBM SPSS Win 23.0 program. Results: Professional self-concept and ethical values were factors influencing patient privacy protection behavior among nursing students. These variables explained 21.9% of the variance for patient privacy protection behavior. A higher level of patient privacy protection behavior was associated with higher levels of professional self-concept and ethical values. Conclusion: The findings demonstrate that strategies for enhancing patient privacy protection behaviors of nursing students should include methods for forming images of positive nurses and firming ethical values.
