Abstract:Abstract This article analyses the scope of the responsibility of the State to ensure access to criminal justice for child victims of parental violence from a children’s and human rights perspective and how this would serve the best interests of the child before, during and after criminal proceedings. The purpose of this article is to establish a human rights framework to promote better understanding of the multi-faceted problems inherent in the combat of parental violence by means of the criminal justice system, articulate obligations imposed upon States and facilitate a holistic approach. The article also explores to what extent the Netherlands, presented as a case study, meets the obligation to provide child victims of parental violence with access to criminal justice and whether there is a need to re-evaluate the role of criminal law in combating parental violence in the Netherlands.

Abstract:BackgroundNo formal child protection system exists in China, and redress can be made only through the legal system. Consequently, all forms of child maltreatment are massively under-reported. This study aimed to investigate the prevalence of child maltreatment in China and attitudes towards physical punishment by exploring the experiences of young adults.MethodsA cross-sectional study was carried out in 1255 college students in three colleges in Zhejiang province. A self-administered questionnaire, based on Conflict Tactics Scale—Parent Child and International Society for the Prevention of Child Abuse and Neglect (ISPCAN) Child Abuse Screening Tool, was developed to measure childhood (younger than 18 years) experience of different forms of maltreatment, including physical maltreatment, psychological aggression, and sexual abuse, and attitudes towards discipline. All participants gave informed consent. The study was approved by Zhejiang University Ethics Board. Data was analysed in SPSS 22.0.FindingsParticipants were aged 17–26 years; 640 (51%) were female, 733 (59%) were from rural areas, and 506 (41%) were from urban areas, with 167 (13%) from self-reported high-income backgrounds, 824 (67%) from middle-income backgrounds, and 246 (20%) from low-income backgrounds (some participants did not provide data for residence and family income background). 1014 (81%) had experienced physical maltreatment, 1026 (82%) psychological aggression, and 170 (14%) sexual abuse. Most common forms of maltreatment by parents were hitting or punching (54%), hitting with implements (29%), threatening to spank without doing it actually (29%), insulting (22%), and forcing to stand or kneel in a humiliating or painful way (19%). 473 (38%) were forced to stand or kneel, and 406 (32%) were insulted by teachers. Among college students who experienced physical maltreatment, 763 (75%) thought that it was necessary for good discipline and thus justified. 364 (43%) of 842 thought hitting and punching were not harmful, with 161 (35%) of 464 saying that the use of implements, 137 (39%) of 350 saying that kicking, and 257 (40%) of 644 reporting that being forced to stand or kneel were not harmful. However, experience of psychological aggression was widely perceived as harmful; 544 (89%) of 614 who were insulted, 60 (78%) of 77 who were told they were not loved, 92 (80%) of 115 who wished they were dead, and 118 (67%) of 177 threatened with abandonment felt that such verbal maltreatment had caused short-term and long-term harm.InterpretationChild maltreatment is common in China. The Predictive Value of Elevation in Specific Serum Enzymes for Subsequent Development of Hypoxic-Ischemic Encephalopathy or Intraventricular Hemorrhage in Full-Term and Premature Asphyxiated Newborns

Abstract:Serum lactate dehydrogenase (LDH), aspartate aminotransferase (ASAT), and hydroxybutyrate dehydrogenase (HBDH) activities are significantly elevated in asphyxiated newborns within the first days of life. The approach of the present study was to evaluate firstly if serum levels of these enzymes correlate with the development of hypoxic-ischemic encephalopathy (HIE) and periventricular-intraventricular hemorrhage (PIVH) in full-term and premature asphyxiated newborns, and secondly if postnatally elevated enzyme activities could be predictive for these disorders. ASAT, LDH and HBDH activities were measured in 98 asphyxiated newborns. Blood samples were taken serially at five fixed times: 0 (cord), 12, 24, 72, and 144 hours post partum. All newborns were examined for the development of HIE and PIVH using standardized scoring systems. Fifty percent of the newborns were full-term and 50% were premature. Ten of the full-term (20.4%) and 21 (42.8%) of the premature newborns developed HIE. Nineteen newborns (19.4%) suffered PIVH (full-term/premature, 7/12). The full-term asphyxiated newborns with HIE or PIVH showed significantly elevated ASAT, LDH, and HBDH activities within the first 72 hours of life. In case of the premature asphyxiated newborns, the enzyme activities did not differ significantly between the study groups. The overall predictive values showed a high sensitivity (HIE/PIVH, 90.0%/71.4%), a high specificity (71.0%/88.1%), an acceptable negative predictive value (44.9%/50.0%), and a high positive predictive value (96.5%/94.9%) for the development of HIE and PIVH in full-term asphyxiated newborns. It is concluded that measurements of ASAT, LDH, and HBDH activities are reliable predictors for the development of HIE and PIVH in full-term asphyxiated newborns.(ABSTRACT TRUNCATED AT 250 WORDS)

Abstract:INTRODUCTION. Evidence in child abuse cases can be scarce and is often centred around the child’s testimony. However, child testimony varies with the child’s development. Here, an overview of suspects, case decisions and court verdicts from a cohort of children is presented, stratified across children aged 0-3, 4-7, 8-11, and 12-15 years. METHODS. Children seen at the Department of Forensic Medicine, Aarhus University, Denmark, in 2001-2013 were analysed, including all case files from the police, courts and healthcare services. RESULTS. A total of 647 cases were presented. The most frequent suspect was the child’s parents. The police referred to the prosecutor in 69% of all cases, and 37% were tried in court. The lowest proportion of cases of tried cases was found among children aged 0-3 years (20%) and the highest among children aged 8-11 years (57%). Across ages, no corroborating evidence, the accused’s refusal of guilt and no case to pursue (insufficient strong evidence) were the most frequent reasons for case closure. Cases relating to children aged 0-3 years were frequently dismissed because the fault could not be placed, whereas cases relating to children aged 12-15 were frequently rejected because of lacking evidence of compulsion (non-consent). CONCLUSION. Results show variations across ages regarding children tried in court and case dismissal. A dedicated child court may be considered to ensure equal access to justice. Questioning during the forensic examination and the use of psychologists may strengthen the available evidence. FUNDING. These materials have received financial support from the Danish Victims Fund. Abstract:Summary The interaction of progesterone and aldosterone with red blood cells was studied in an in vitro system by equilibrium dialysis technique. The uptake of progesterone by the erythrocytes is of the order of 70-85% of the total steroid in contact with the red blood cell, whereas the uptake of aldosterone is insignificant. Considerations of molar ratios of hemoglobin and steroid and calculations of binding affinity of steroid to hemoglobin suggest that the steroid does not enter into the red blood cells, but could be adsorbed at the cells' surface. Studies on the metabolism of progesterone and aldosterone by the red blood cells in vitro show that no metabolites of the two steroids occur.
Sexual education and development after early childhood sexual abuse: A qualitative study of experiences of parents and children

Abstract:Background: In the Amsterdam Sexual Abuse Case (ASAC), infants and toddlers experienced childhood sexual abuse (CSA). The perpetrator was convicted, and psychosocial care was offered to children and families. A research project was established to investigate the impact of CSA at an early age, with this study specifically focusing on sexual education and development. Objective: To investigate parents' and children's experiences with sexual education and development following CSA. Participants and setting: We conducted interviews with 18 parents of 20 children, and with 6 children themselves. On average, the children were 16 months old at the time of the CSA and 16 years old during the interviews. Methods: Qualitative open interviews using an interview guide, followed by thematic analysis. Results: In general, parents and children reported common experiences with sexual education and development. However, some distinctive concerns related to past CSA were mentioned by parents such as added weight to talking about sex, being more cautious, and additional conversations about boundaries and possible influence on sexual experiences. Also, both parents and children expressed uncertainty about the impact of the past sexual abuse on sexual development. Conclusions: Our findings generally align with existing literature on sexual education in a non-abused population. Impact on sexual development as perceived by parents and children was mostly absent, indicating resilience. Nonetheless, distinctive concerns and uncertainties about the impact of early CSA persist. Future research should delve deeper into the long-term consequences of early CSA and the factors contributing to resilience over time.

Abstract:Israel is a “natural laboratory” for studying child abuse due to the low rate of abuse despite high levels of parental stress. This ecological study examined cultural, social and psychological factors in physical abuse. Twenty-five abused Jewish Israeli children aged 1 to 6 years were matched with the same number of non-abused children on age, sex, family size, ethnic background, SES, parent marital status and health. Blind interviews using reliable and valid measures were done separately with mothers and fathers in their homes. Statistical analyses found abusive mothers were twice as depressed as matched mothers (p<.003) on the Beck Depression Inventory.. They provided a less stimulating home environment p<.05) as measured by the HOME, and perceived more stress in their relationship with the target child (p<.056) on the Child Domain of the Parenting Stress Index (PSI). Significant differences were also found on two subscales of the PSI; abusive mothers reported their children as more demanding (p<.026) and less reinforcing (p<.012). No group differences in social support were found on the Interview Schedule for Social Interaction for mothers or fathers. Both groups of parents rejected corporal punishment as a disciplinary method, endorsing, instead, using praise. Thus, although psychological and parent-child interactional factors were found to be similar to those in abusive families in other cultures, Israeli children may be more protected from abuse by the relative lack of social isolation and by cultural norms against corporal punishment.

Cycles of violence in England and Wales: the contribution of childhood abuse to risk of violence revictimisation in adulthood

Abstract:Abstract Background Interpersonal violence is a leading cause of death and disability globally, has immediate and long-term impacts on individuals’ health and wellbeing, and impacts global health care expenditures and national economies. A public health approach to violence prevention is crucial, and addressing risk factors is a key priority. Global research has demonstrated that childhood adversity increases risk of a range of poor outcomes across the lifecourse. This study examined the association between being a victim of child abuse and the risk of physical assault (PA), intimate partner violence (IPV), and sexual violence (SV) victimisation in adulthood. Methods Data from a nationally representative survey of household residents (adults aged 16 to 59 years; n = 21,845) was analysed. Types of child abuse examined included physical, sexual, and psychological abuse and witnessing domestic violence. Logistic regressions examined the independent relationships between child abuse types, experiencing multiple types, and adulthood violence outcomes. Results Most individual types of child abuse were significantly associated with each adulthood violence outcome, after controlling for sociodemographics and other abuse types. Compared to individuals who experienced no abuse in childhood, those who experienced one form of abuse were over twice as likely to experience PA in the past year and three times as likely to have experienced IPV and/or SV since age 16 years, whilst individuals who experienced multiple types were three, six, and seven times more likely to experience PA, IPV, and SV, respectively. After controlling for sociodemographics and multi-type childhood victimisation, the type or combination of types which remained significant differed by violence outcome; child psychological and physical abuse were significantly associated with IPV; psychological and sexual abuse with SV; and psychological abuse with PA. Conclusions Prevention of child abuse is an important goal, and evidence from the current study suggests such efforts will have a downstream effect on preventing interpersonal violence across the lifecourse. With adulthood victimisation likely to compound the already detrimental effects of childhood abuse, and given that many associated outcomes also represent adversities for the next generation, breaking the cycle of violence should be a public health priority.

Abstract:Child physical abuse is often perceived as a crime perpetrated within the family and out of sight. However, recent studies have indicated the presence of others during incidents of physical abuse. The current study was designed to examine the experiences and perceptions of children who were physically abused in their families concerning the presence of others, as conveyed during their forensic interviews. A thematic analysis of 26 forensic interviews was conducted with Israeli children aged 5–13. Three main themes were identified: (1) Patterns, roles, and coping mechanisms: The multifaceted spectrum of familial abuse; (2) The echoes of family reactions: Shaping children's abuse experiences; and (3) Navigating the storm together: Sibling bonds amidst familial abuse. The children's narratives highlighted their distress and pointed to the abusive and chaotic daily routine in which they lived. In spotlighting their encounters with physical abuse, the children focused on their need to be seen and gain certainty in their daily routines. The discussion highlights the unique and elusive dynamics of families in which child physical abuse occurs and challenges the social perception that physical abuse occurs secretly. The characteristics of such abuse highlight the urgent need for policymakers and professionals to treat the phenomenon of physical abuse within the family as a visible phenomenon.

Abstract:Physical punishment is increasingly viewed as a form of violence that harms children. This narrative review summarises the findings of 69 prospective longitudinal studies to inform practitioners and policy makers about physical punishment's outcomes. Our review identified seven key themes. First, physical punishment consistently predicts increases in child behaviour problems over time. Second, physical punishment is not associated with positive outcomes over time. Third, physical punishment increases the risk of involvement with child protective services. Fourth, the only evidence of children eliciting physical punishment is for externalising behaviour. Fifth, physical punishment predicts worsening behaviour over time in quasi-experimental studies. Sixth, associations between physical punishment and detrimental child outcomes are robust across child and parent characteristics. Finally, there is some evidence of a dose-response relationship. The consistency of these findings indicates that physical punishment is harmful to children and that policy remedies are warranted.

Abstract:Background The Amsterdam Sexual Abuse Case (ASAC) presented parents with a dilemma about disclosing preverbal sexual abuse to their child. Advising parents was challenging due to limited knowledge about the consequences of preverbal child sexual abuse (CSA) and the rarity of children having no conscious awareness of their experience. To enhance recommendations and knowledge, we explored parents' experiences over the years. Objective This unique qualitative study introduced "parental disclosure", where non-offending parents disclose CSA to their child, and investigated the decision-making process spanning a decade after the ASAC discovery. Methods Longitudinal qualitative data were collected through yearly interviews. Participants and setting In total, 41 parents participated for 47 children. An additional in-depth interview was conducted with 20 parents in 2015. Results Quantitative data highlighted that over 10 years, parents of more than half of the children disclosed the preverbal CSA. Our analyses revealed that parental disclosure decisions entail dilemmas and unfold as a gradual process. Factors influencing decision-making included fear of stigma, child's emotional readiness, perceived benefits and risks, parental beliefs, values, and CSA circumstances. Conclusion This study underscores the complex nature of parental disclosure and shows that it is an ongoing process rather than a singular event. Parents' choices evolved based on changing circumstances and new information. Outcomes enrich the understanding of parental disclosure decision-making, highlighting the need for tailored support services to aid parents navigating the aftermath of preverbal CSA. Parental disclosure is highly individualized and calls for evidence-based interventions and policies.

Abstract:Journal of Interpersonal Violence, Ahead of Print. Despite recognizing the detrimental impact of parental violence on children's mental and physical health throughout their lives, violence remains an all-too-real part of life for many children around the globe. However, data on the child-reported prevalence of experienced family violence are scarce and primarily based on parental reports. This study aimed to broaden the body of evidence and measure the lifetime prevalence of child-reported experience of violent disciplinary practices perpetrated by parents and to identify its associated sociodemographic and economic factors. We conducted a cross-sectional study using data from 5,281 Generation XXI participants recruited from 2005 to 2006 in Porto, Portugal. Parental disciplinary practices were reported by 7-year-old children using the Parent-Child Conflict Tactics Scale. Pearson's Chi-squared test was used to compare differences in child-reported frequencies of violent disciplinary practices by sociodemographic variables. We observed statistically significant differences in rates of violent disciplinary practices according to the child's and parent's gender. Specifically, fathers exhibited a higher likelihood than mothers to engage in psychological aggression and corporal punishment, while mothers were more prone to engage in severe and very severe physical assault. When fathers were the perpetrators, boys were more inclined than girls to report all forms of violent disciplinary measures, and when mothers were the perpetrators, boys were particularly susceptible to severe and very severe physical assault compared to girls. In our study, children reported being frequently subjected to violent parental disciplinary practices, independently of family socioeconomic background. Children were more likely to experience psychological aggression and corporal punishment if they were born into high-income families, while severe and very severe physical assaults were more common among children whose parents had lower educational levels. National public awareness of the negative effects of violent disciplinary practices is urgently needed, promoting child-friendly and nonviolent approaches to discipline.

Abstract:Domestic violence is the most common welfare issue raised in private law contact proceedings. A wide range of studies has shown that judicial decisions about contact which fail to take safety into account endanger women and children physically and emotionally. Yet a presumption that contact is in the best interests of the child, combined with an increasing focus on fathers' rights, casts long shadows over legal judgments, policy frameworks and individual cases. This article presents research which examined child contact proceedings as a legal process to identify if, how and when domestic violence was factored into judicial decision making. Drawing on in-depth interviews with 34 women who had recently completed, or were currently undergoing, proceedings, the article highlights how two aspects of private law Children Act proceedings diminished women's safety: the absence of special facilities in family courts and gaps in legal representation for both victim-survivors and perpetrators.

Abstract:Childhood maltreatment (CM) is experienced by ∼40% of all children at major personal and societal costs. The divergent associations between emotional, physical, and sexual abuse or neglect in childhood and differences in adult emotional functioning and regulation were examined in terms of daily emotion intensity, variability, instability, inertia, and diversity, reported over 30 days by 290 Dutch aged 19-73. Participants described their abuse/neglect experiences retrospectively using the Childhood Trauma Questionnaire (CTQ). Dissecting CM effects on adult emotion dynamics may inform theories on the ontogenesis and functioning of emotions, on effects of abuse and neglect, to better understand (dys)functional emotional development, and to prevent their adverse sequelae. Structural equation models (SEM) showed that most types of CM were associated with specific patterns of emotion dynamics, and only emotional abuse had no unique effects on the emotional dynamic indices. Emotional neglect was associated with most measures of emotion dynamics (i.e., less intense, variable, unstable, and diverse emotions). Sexual abuse associated with increases and physical neglect decreases in negative affect variability and instability. Physical abuse was associated with inertia but with a small effect size. Social contact frequency did not mediate much of the relationship between CM types and emotion dynamics.

Abstract:Corporal punishment of children has been a part of everyday life for centuries, as it has long been seen as a means of education. However, in the last century many social scientists, psychologists and doctors warned parents about the dangers of punitive discipline. The concept of child abuse has long been recognised in the paediatric literature, with the term “Battered Child Syndrome” being coined by Henry Kemp. Many parents see corporal punishment of their children as an effective, socially acceptable method of child-rearing. Parents hit their children not because they want to do so or because they want to hurt them, but rather because they believe that corporal punishment teaches their children positive patterns of behaviour and protects them from various threats. Parents often know of no other way to express their dissatisfaction with their child or their own helplessness. They seldom think about how their child might feel when he or she gets a beating or is waiting for the inevitable slap. The public opinion is that corporal punishment is a necessary part of discipline and education. It is from spanking and slapping that children learn to respect their parents. To improve the situation of physically abused children, it is necessary to change social attitudes towards such behaviours and to teach parents the negative effects of these behaviours. Another key task is to educate parents about alternative child-rearing methods. Corporal punishment as a means of disciplining children will not immediately disappear from parents' child-rearing repertoires. In fact, as research and expert opinion confirms, constant and consistent educational work will only lead to a gradual change in parents' attitudes and behaviour.
The "Good Old Days" of Courtroom Questioning: Changes in the Format of Child Cross-Examination Questions Over 60 Years

Abstract:Recent decades have seen an explosion of research into children's eyewitness capabilities and resulted in legal reform to render the adversarial trial process more child friendly. Many, however, have been left with the feeling that the most intimidating legal process for child complainants-cross-examination-has not changed meaningfully despite its potential to distort children's evidence. To test this possibility, we compared the cross-examination questioning of Australian child sexual abuse complainants in the 1950s to that used in contemporary cases. We found that the format of cross-examination questions has remained largely consistent over time, with leading questions still making up the bulk of the questions asked. The changes that we did observe, however, are concerning. Cross-examination questions posed to contemporary child complainants were less likely to be open-ended and more likely to be complex, relative to those asked in the 1950s. Crucially, contemporary complainants were asked 3 times as many cross-examination questions as they were 60 years ago. These changes are likely to have detrimental effects on child complainants and their evidence and could reduce the ability of jurors to reach just outcomes in these cases.
The Relative Influence of Family and Neighborhood Factors on Child Maltreatment at Critical Stages of Child Development

Abstract:This study examines the impact of family and neighborhood factors on physical and psychological abuse across three developmental stages of children: early childhood (age 3), young school age (age 5), and middle childhood (age 9). Data from the Fragile Families and Child Wellbeing Study, a longitudinal national cohort study of children from 20 urban U.S. cities, are used. Path analysis is employed to investigate the longitudinal relationships between family and neighborhood context variables and abuse risk, as well as the importance of different factors at key developmental stages. Economic hardship, maternal substance use, intimate partner violence, and exposure to community violence are found to be related to child abuse risk regardless of developmental stage, while maternal depression and neighborhood informal social control are found to have impacts only within certain child development stages. Findings suggest the need for early intervention and prevention strategies that specifically target economic hardship, poverty, intimate partner violence, and exposure to community violence.
