International legal regulation of the right to benefit from scientific progress and its application at the universal level

Abstract:The article analyzes international legal acts (the Universal Declaration of Human Rights, the International Covenant on Economic, Social and Cultural Rights, the Declaration on the Use of Scientific and Technological Progress in the Interests of Peace and for the Benefit of Mankind, the Universal Declaration on the Human Genome and Human Rights, the International Declaration on Human Genetic Data, the Venice Statement on the Right to Enjoy the Benefits of Scientific Progress and its Applications, reports of the Special Rapporteurs of the UN Human Rights Council, UNESCO recommendations, General Comment No. 25 on Science of the UN Committee on Economic, Social and Cultural Rights, etc.), adopted within international intergovernmental organizations at the universal level regarding the right to benefit from scientific progress and its application. The article focuses on the normative content of the studied right, in particular, it reveals the content of the concepts “results of scientific progress”, which means material results of the application of scientific research, and “practical application”, which should be understood as the use of scientific achievements to solve specific problems and meet specific needs of the population. The article also emphasizes the role of soft law instruments and international treaties as tools for reflecting the consensus among states on the need to promote the development of science as a public good available to all, and to integrate human rights norms and principles into the development and advancement of science, technology and related policies. The article serves as a theoretical basis for further research of a unified approach to understanding the right to benefit from scientific progress and its application.
