Abstract:Taxes on goods and services account for about 45% of total tax revenue in Brazil. This tax collection results in a highly complex system, with several taxes, different tax bases, and a multiplicity of rates. Moreover, about 43% of taxes on goods fall on inputs. In this context, the effective tax rates can substantially differ from the legal rates. In this study we estimate the final incidence of indirect taxes in Brazil using the 2015 Brazilian input-output matrix and a method that incorporates the multisector effects of the taxation of inputs.

Abstract:A consolidated research line in Brazil identified the proxies for determining the tax aggressiveness of companies listed on the B3 stock exchange. However, none of these studies identified the instrument used by Brazilian companies to carry out tax aggressiveness. Thus, our research seeks to fill this gap by demonstrating that fiscal aggressiveness results from the Brazilian tax complexity, that providing prerogatives to avoid or delay tax payments. Besides, this study is the first accounting study to demonstrate that special installments reduce the actual value of taxes owed by taxpayers, encouraging them to be tax aggressive. Through the foundations of Game Theory, this research demonstrates the cost-benefit of tax aggressiveness in maximizing the profit of tax avoidance. We examined the best strategic decisions in the tax avoidance game concerning the tax complexity and special installments experienced in Brazil. In this game, the only NASH equilibrium is tax avoidance since it is the only option with a chance of remuneration. Therefore, this research contributes to understanding business behavior concerning the Brazilian tax system and provides subsidies to encourage reform of the current tax complexity.
A new approach to the theory of optimal income tax

Abstract:The Nobel-price winning Mirrlees' theory of optimal taxation inspired a long sequence of research on its refinement and enhancement. However, an issue of concern has been always the fact that, as was shown in many publications, the optimal schedule in Mirrlees' paradigm of maximising the total utility (constructed from individually optimised individual ones) usually did not lead to progressive taxation (contradicting the ethically supported practice in developed economies), and often even assigned minimal tax rates to the higher paid strata of society. The first objective of this paper is to support this conclusion by proving a theorem on optimal tax schedule in (practically most exploited) piecewise-linear environment under a simplest natural utility function. The second objective is to suggest a new paradigm for optimal taxation, where instead of just total average utility maximization one introduces a standard deviation of utility as a second parameter (in some analogy with Marcowitz portfolio optimization). We show that this approach leads to transparent and easy interpreted optimality criteria for income tax.

Case Law Note: The Brazilian Case Law on the Single Tax Principle: A Case of Tax Treaty Override

Abstract:This article analyses the recent decision handed down by the Brazilian High Court of Appeals whereby the single tax principle and the abuse of law principle were applied in order to ultimately deny treaty benefits in the context of double tax conventions that provided for neither the entitlement to benefits clause nor the updated terminology of the title and preamble. Accordingly, since both principles could be deemed as general principles of law (therefore, part of the international law) comparable to double taxation conventions (DTC) provisions, lower level courts were allowed to condition treaty benefits to the demonstration that the taxpayer had complied with those principles. Therefore, in the case of potential hybrid mismatches, the absence of double non taxation for treaty benefits entitlement should be demonstrated. This article contends that this precedent must be reviewed. Firstly, the precedent disregards how international rules are created and how DTCs are interpreted. Secondly, it creates legal uncertainty in the context of DTCs. Ultimately, the precedent shall cause hermeneutic override whereby a state overrides a treaty with the pretext of interpreting treaty provisions. Abstract:This paper develops a theory of optimal taxation with behavioral agents. We use a general framework that encompasses a wide range of biases such as misperceptions and internalities. We revisit the three pillars of optimal taxation: Ramsey (linear commodity taxation to raise revenues and redistribute), Pigou (linear commodity taxation to correct externalities), and Mirrlees (nonlinear income taxation). We show how the canonical optimal tax formulas are modified and lead to novel economic insights. We also show how to incorporate nudges in the optimal taxation framework, and jointly characterize optimal taxes and nudges. (JEL D62, D91, H21)

Abstract:Brazilian tax authorities have traditionally had an adversarial relationship with taxpayers. Recent initiatives, however, show a paradigm shift that may bring taxpayers and tax authorities together. The country has made increasing efforts to reduce tax-related compliance costs over the past years. Additionally, the Brazilian tax administration has gradually improved the services available to taxpayers and treated them as clients rather than just ‘taxpayers’. Moreover, taxpayers have participated in the rulemaking process, notably in respect of tax guidance. The recent implementation of tax settlement agreements may be considered as significantly altering traditional concepts as it broke long-established misconceptions. Other initiatives to further enhance their relationship may be underway, including improving tax rulings and the mutual agreement procedure (MAP), cooperative compliance programs, and arbitration in tax matters. Throughout the analysis, paths for further investigation are highlighted. Abstract:This paper analyzes the redistributive impacts of indirect taxation reforms in Brazil inspired by PEC 45/2019, particularly in the version that led to EC 132/2023. Comparisons are made between the current system and the simulated reforms, considering the distribution of the tax burden among families in different income classes, as well as the impact on poverty and inequality indicators. The simulations are conducted based on the combination of effective tax rates that apply to goods and services consumed by households, using nationally representative microdata from family budgets.

Abstract:This paper is to determine the optimality of taxation based on a comparative analysis of income taxation in developed and developing countries. In our opinion, the main idea of income tax should be the optimal distribution of tax literacy on the basis of a direct definition of income of taxpayers or progressive taxation. The theoretical and methodological basis of the research is the main provisions of the market economy, classical and modern tax theories, legislative and regulatory acts of foreign countries. The main part of the empirical material is from 2002 to 2017. In the process of analysis of the actual material, together with the general scientific method of research, is used: Comparative and systemic analysis, analogy, statistical data monitoring and other methods. The comparative and systemic analysis will give us an opportunity to reveal and evaluate the ways of perfection. Analogy and comparative analysis is based on variables and features, such as the of income taxes structure, withdrawal rules, rates, tax base. Statistic concept tries to explain the named phenomena by the way of fundamental analyzing of the statistic data received resulted multiple statistic observation. Previous analyses of tax rates tend to support the hypothesis that Developed countries emphasize the importance of fairness, while developing countries are mainly focused on mobilizing budget revenues and lesser consideration of fair taxation principles, since the tax system performs a fiscal function more effectively than developing countries. Tax Aggressiveness as a determining factor of Accounting Conservatism in Brazil

Abstract:This paper investigates whether the degree of tax aggressiveness is a determinant of accounting conservatism. The taxable income has a dependent relationship with the accounting income in the Brazilian corporate income tax system. One way to reduce the corporate tax base is to adopt conservative accounting choices. After a conceptual discussion of accounting conservatism, differentiating conditional and unconditional conservativeness, and a thorough literature review on accounting conservatism by Brazilian academia. A literature gap was found since the relationship between a company's degree of tax aggressiveness, and its accounting conservatism behavior has not been investigated. For this research purpose, the Basu model was adopted, adapted with tax aggressiveness controls. The study period was from 2010 to 2019 for Brazilian firms from B3. The findings show a significant relationship between tax avoidance and conditional accounting conservatism. That is, more tax-aggressive firms tend to use more conservative accounting. The results provide insights that firms with higher effective tax rates are less inclined to use conservatism. The choice of a conservative accounting pattern may be in part to avoid the tax burden; therefore, this outcome states evidence that there is a difference between the degree of conservatism depending on the firm's tax aggressiveness profile.

Impact assessment of innovation tax incentives in Brazil

Abstract:Purpose This paper evaluates the effects of tax incentives on business innovation in Brazil that were established by Law 11,196/05 (the “Fiscal Incentives Law”) to test whether they have had a positive impact on beneficiary firms' innovation input and output and on their performance. Design/methodology/approach The policy impacts are estimated using microdata on 13,706 firms available in the 2008 and 2011 editions of the Brazilian Innovation Survey (PINTEC) and by applying propensity score matching with difference-in-differences. Findings The results suggest a positive and statistically significant impact of the policy on research and development (R&D) expenditures (average of approximately US$ 264,000 in 2011), the number of research staff (average of five researchers) and total employment (approximately 5% of the beneficiary firms' mean size). However, no impact was found on the overall spending on innovative activities, the percentage of sales and exports from new products, net revenue or net revenue per employee. Practical implications The findings provide empirical support in favor of tax incentives as a policy tool to boost business innovation in the country. However, the absence of significant effects on innovative activities expenditures and on most indicators of innovation output and firms' performance reveals shortcomings of the policy that need to be addressed. Originality/value The study complements and advances the findings of previous studies by assessing policy impact on total innovative activities expenditures and on innovation output and firm performance.

Abstract:This article looks at the issue of double taxation in order to approach translationfrom two angles: a practical analysis, from the perspective of translation agents, of a particularly opaque document required by the tax authorities of Portugal (the 21-RFI double taxation form), and a reflective examination of the complex translational procedures (in the broader sense) required to make the form intelligible to those agents that require it. The first approach considers the legal and practical difficulties faced by non-Portuguese translators working for Portuguese clients. The second approach helps to expand the traditional linguistic conceptualization of translation as a transfer of texts between two languages to include intralingual, inter-epistemic and even human-machine translation. The final part of the article connects these two approaches, demonstrating how complexity theory offers a productive perspective on translation. The article thus demonstrates how even seemingly mundane documents such as a tax form can provide valuable insights into the complexity of translation and the interactions between human (and non-human) translation agents.

Abstract:This study seeks to undertake a comprehensive analysis and comparison of the corporate income tax systems across select European Union nations, with a specific focus on discerning disparities between the individual income tax (IIT) and corporate income tax (CIT) frameworks prevalent in Portugal, Holland, Belgium, Luxembourg, and Germany. With an institutional theory lens, we applied document analysis to describe the distinctive attributes characterizing each tax regime within the purview of competitive dynamics and fiscal competitiveness. Despite inherent limitations stemming from challenges in accessing tax-related information and potential oversights regarding socio-political determinants, this study underscores the imperative of grasping the intricate interplay between tax imposition levels and broader economic development trajectories. By furnishing valuable insights into prospective reforms pertaining to Portugal’s corporate income tax architecture, this scholarly inquiry significantly enriches our comprehension of tax competitiveness within the overarching framework of the global economic environment.
Monetary incentives to improve tax compliance: A Brazilian case study

Abstract:Motivation To enhance tax education and increase citizen participation in combatting tax evasion, monetary incentives may be used. In December (2021), the state government of Rio Grande do Sul in Brazil launched the Receita Certa project. It aims to encourage new taxpayer habits, by refunding part of the tax collected by retailers on consumption back to citizens, contingent on its performance exceeding inflation rates. Taxpayers add their tax identification to receipts and request redemption every three months. Purpose We analyse the impact of the Receita Certa project on the behaviour of consumers as taxpayers. Methods We evaluate the impacts of Receita Certa using difference‐in‐differences. The response variables are the monthly number and value of electronic receipts issued to beneficiaries. The treatment group consists of citizens eligible for the refund in its introduction month, while the remainder constitute the control group. The database includes receipts issued to 3.4 million taxpayers who added their tax identification to the receipt — spanning 11 months before and 18 months after the initiative, began resulting in 46.7 million records. Findings The Receita Certa proved ineffective, as it led to fewer tax documents issued. Distributing resources widely to many users does not seem the best solution, both in cost and results. Distribution goes first and foremost to people on higher incomes since they got larger prizes: the smaller prizes of people on lower incomes were often not claimed. The programme made tax more regressive. The programme was also costly. Policy implications States that have a large tax gap need to improve their control systems. Initiatives like the Receita Certa that return resources widely to taxpayers to reduce tax evasion are widespread. Given the results shown, Receita Certa needs rethinking.

Abstract:The objective of this research is to discuss tax governance, best practices and technologies applied in the shared services model, discussing the integration of the areas of Governance, Controllership and Taxation, including the relationship between employees and employers in the social security dimension, and how they relate to each other. Check the strategies to meet the demands of the company, market or capital, government and other stakeholders, considering examples of Brazilian companies. This theoretical-practical discussion intends to reinforce the complexity and aspects of governance models in shared service centers in the areas of Governance, Controllership and Taxation, including the relationship between employees and employers in the social security dimension. To this end, theoretical contributions were made on the research topics, divided into subsections, with Brazilian examples from the Global Tax Project of the Vale Group, the Financial Operations Center of Petrobras and the Tributary Revision of the Makro Group, expanding the discussion and connecting elements addressed by the organizations and literature revisited. Interviews with key leaders from the control areas of the companies presented contributed to the understanding of the scenario, as well as the difficulties encountered and actions taken to reduce costs and risks, as well as comply with all legal requirements. Service sharing brings together people, processes and technologies from global trends and increases value delivery for leading companies. Innovation is present in governmental control and inspection mechanisms and also in companies' review, analysis and auditing activities. Emerging technologies are a reality to support compliance with tax obligations perceived in the survey as corporate social responsibility. The scientific contribution lies in reinforcing the challenge of tax management in Brazil, improving the perception of the phenomenon of sharing services, based on transactional processes, expanding the relationship between what is discussed in academia and what happens in the economy.

Abstract:The paper deals with the analysis of the legal aspects of the principal purpose test rule (PPT-Rule) and the general anti-abuse rules contained in the Brazil-Poland Double Tax Convention concluded on 20th September, 2022, in the light of Brazil’s international tax treaty policy and practice. The Authors discuss issues related to the interaction between the PPT-Rule and other treaty specific anti-tax avoidance provisions as well as the objective and subjective elements of the PPT-Rule itself and the possible consequences of its application, especially challenges related to the legal certainty principle.

Abstract:Objective: This study evaluates firms' taxpayer morale or the intrinsic motivation to pay taxes and comply with tax rules through the perception of their accounting professionals, specifically whether there is an influence from i) penalties, ii) tax audit probability, iii) rewards, and iv) tax amnesties. The focus on accountants' perceptions of their clients' tax morale is more reliable than the taxpayers themselves because they are more likely to report accurate perceptions. Method: Tax morale was measured through a self-applied questionnaire applied between accountants' professionals that provide their tax services to firms, disclosing their higher or lower accountants' perception on tax morale of their clients, concerning the four incentives analyzed, captured from 344 Brazilian accountants. Results and Discussion: The research findings indicate that applying punishments and penalties is the most potent instrument for raising tax compliance, along with the perceived likelihood of an audit. In contrast, tax amnesty programs' successive applications may erode tax morale. Contributions: This research deepens the understanding of what legislators and tax administration can do or not do to encourage more excellent tax morale. Dealing with tax morale is an important issue, as crucial as reforming the entire tax system. Preserving tax morale is relevant to motivate the taxpayer to pay his fair share of taxes, contribute to financing public services, and provide relief to those who may need government assistance.

Abstract:By introducing elements of information mining to tax analysis, by means of data mining software and advanced computational concepts of artificial intelligence, the problem of tax evader's crime against public property has been addressed. Through an empirical approach from a hypothetical case of use, induction algorithms, neural networks and bayesian networks are applied to determine the feasibility of its heuristic application by the tax public administrator.
