Abstract:Agreements between commercial developers and local communities are becoming more common in virtually all parts of the world, from inner city America to remote mining regions. The need for such “community development agreements” (CDAs) is especially acute in mining, where environmental and social costs are often borne by communities while project benefits accrue in national capitals and global financial centres, leading to conflict between local people and miners. This article identifies the forces behind the recent spread of CDAs in the mining industry, and provides a sense of some general trends in the nature and impact of CDAs. The article also raises some key issues regarding CDAs in mining, issues that are often equally relevant in other contexts. These include the implications of unequal bargaining relationships between communities and developers; equity in the distribution of benefits generated by CDAs; and the enforceability and implementation of agreements.

Abstract:Current solutions to global challenges place tension between global benefits and local impacts. The result is increasing opposition to implementation of beneficial climate policies. Prioritizing investment in projects with tangible local benefits that also contribute to global climate change can resolve this tension and make local communities' partners instead of antagonists to change; the approach advocated is a new take on "thinking globally, acting locally". This approach is a departure from the usual strategy of focusing resources on solutions perceived to have the largest potential global impact, without regards to local concerns. Reclamation of polluted mine sites by using fast growing bamboo to remove heavy metals provides a case study to show what is possible. Effective implementation of thinking globally while acting locally will require increased coordination between different types of researchers, new educational models, and greater stakeholder participation in problem identification and solution development.

Abstract:Peru has shifted away from centralized mining management to governance among government, companies, and communities. Various mechanisms facilitate community participation, including the mining canon, dialogues, and corporate social responsibility programs. Even with these laws and mechanisms, mining pollution and conflicts continue. In this study, we ask: how do communities perceive and participate in mining governance? And what are some alternative ways, driven by community priorities, to address governance in mining contexts? We collected 53 semi-structured with agricultural actors in two Peruvian districts with mining activity and analyzed those perspectives through the lens of community-centered governance. Our analyses revealed how centering community priorities in data collection and analysis illuminates context-specific factors that shape community attitudes toward mining and highlights community-driven approaches to addressing mining governance. Such community-driven approaches could include integrating understandings of local livelihoods and historical contexts, implementing transparent participatory processes, and improving laws to give communities decision-making power over mining development.

Abstract:The United States is reprioritizing domestic extraction and processing of critical minerals, with billions of dollars of investments. Because of their uses in low-carbon technologies, the mining and processing of these resources falls under the scope of the Justice40 Initiative, the Biden administration's flagship environmental justice policy. Justice40 prioritizes green investments to benefit communities deemed disadvantaged, including all recognized Tribes. This can lead to the siting of "green" mineral projects in disadvantaged communities (DACs), which is problematic if such projects are unwelcome or reproduce environmental injustices. These unintended consequences are our focus. We analyze how DACs are defined and operationalized, before examining whether and under what conditions critical mineral projects could be considered beneficial for local communities. We suggest three ways to better align Justice40's spirit with its (currently problematic) application to critical minerals and other controversial projects – (1) centering free, prior, and informed consent (FPIC) and the transparency and power restructuring needed to achieve it; (2) incentivizing community ownership to strengthen economic benefits and democratize decision making; and (3) bringing currently-exempted critical mineral activities within the purview of Justice40, particularly for the Department of Defense.

Since these officials play a key role in approving new energy projects and negotiating the benefits they bring to communities, aligning local elected officials' perceptions with the public's could improve progress toward just energy transitions.

Abstract:This Special Section explores the interplay between Indigenous peoples, industry, and the state in five proposed and active mining projects in Canada and Sweden. The overall aim is to identify factors shaping the quality of Indigenous community-industry-state interactions in mining and mine development. An ambition underlying the research is to develop knowledge to help manage mining related land-use conflicts in Sweden by drawing on Canadian comparisons and experience. This paper synthesizes the comparative research that has been conducted across jurisdictions in three Canadian provinces and Sweden. It focuses on the interplay between the properties of the governance system, the quality of interaction and governance outcomes. We combine institutional and interactive governance theory and use the concept of governability to assess how and why specific outcomes, such as mutually beneficial interaction, collaboration, or opposition, occurred. The analysis suggests there are measures that can be taken by the Swedish Government to improve the governability of mining related issues, by developing alternative, and more effective, avenues to recognize, and protect, Sámi rights and culture, to broaden the scope and increase the legitimacy and transparency of the EIAs, to raise the quality of interaction and consultation, and to develop tools to actively stimulate and support collaboration and partnerships on equal terms. Generally, we argue that Indigenous community responses to mining must be understood within a larger framework of Indigenous self-determination, in particular the communities' own assessments of their opportunities to achieve their long-term objectives using alternative governing modes and types of interactions.

Abstract:Decarbonization technologies promise to mitigate climate change and reduce greenhouse gas emissions. However, these technologies contain critical minerals, such as nickel, lithium, and cobalt. Minerals mining can have substantial environmental and social impacts. Prospective LCA can be used to project these impacts and compare them among proposed mines, especially in nations like the U.S. that aim to increase domestic minerals production. We therefore conducted a cradle-to-grave LCA on a proposed copper-nickel mine in the United States. Flotation processing was the largest contributor to energy, water, and greenhouse gas burdens. Wastewater treatment and closure also have sizeable energy and water demands. We also estimate that it takes decades or centuries to restore the carbon stock loss from land clearing from reclamation efforts. This analysis highlights the importance of often-neglected elements of a mine’s life cycle in LCA such as land clearing, wastewater treatment, reclamation, and closure.

Abstract:The growing importance of cobalt to the US economy has led to its categorisation as a critical mineral. Cobalt demand is increasing due to its requirement in lithium-ion batteries, which will significantly contribute to the energy transition. Supply is threatened for various reasons, primarily regarding supply chain concentrations, with the majority of the world's cobalt originating in terrestrial deposits in the Democratic Republic of the Congo, and being refined in China. There remain environmental and ethical concerns over the present supply chain. Previous discussions around reducing cobalt's criticality have suggested diversifying processing locations to reduce geographical and jurisdictional reliance where possible. This study assesses the viability of extracting cobalt from polymetallic nodules (PMNs) located on the deep-seabed in the Area, as an alternative strategy to reduce cobalt's criticality. Assessments are made of the viability of PMN extraction considering ongoing barriers to introduction, contrasted with current arguments supporting PMN extraction. PMN mining offers a more stable and decentralised alternative to current cobalt supply. There exist impediments to its introduction, notably potential environmental impacts, which remain poorly understood. Technical and political restrictions must also be overcome. It is argued that the wider environmental benefits of increased cobalt supply from PMN mining may offset its detrimental environmental impacts. It is suggested that PMN mining be used in a wider strategy to improve supply security of cobalt to US markets.

Abstract:The contribution of mining to the Ghanaian economy has been substantial. The mining sector is currently a major foreign exchange earner and contributes to long-term capital formation and fiscal payment to the state. However, the industry continues to have adverse consequences on the lives of local community dwellers, most of whom are often unprepared to deal with these impacts. Often, new mining exploration takes place on land that provides land-based livelihood to many rural people. Ironically, compensation payments seem to worsen poverty in the mining communities and bring about the social conflicts. Hence, whilst communities are highly welcoming of mining companies during exploration, they become resentful during operation of the mine. Using two communities in the Asutifi District of Ghana as case studies, this paper presents a candid assessment of the changes that occur in respondents’ perception of mining during, before and after the inception of mining. It also examines the gender dimensions of the impacts of mining activities as well as the communities’ sources of information. Since public participation is an integral part of the environmental assessment process in Ghana, the paper concludes by recommending among others, precise channels of communication and dialogue before mining begins and during the operation of the mine, to increase awareness among community members.

Abstract:Vastly increased quantities of minerals and metals are needed to scale up renewable energy technologies. Indigenous peoples globally are voicing concerns about how this will affect the speed and scale of mining and renewable energy development on their lands and territories. In this paper, we delineate areas of Australia where Indigenous peoples' interests in land are formally recognised under legislation. These areas are overlayed with critical minerals project information to calculate intersections across 14 commodities. Our results show that 57.8 % of critical minerals projects are located where Indigenous peoples have a right to negotiate. Including native title claims, these rights are available for 79.2 % of critical minerals projects. We argue that critical minerals policies must consider Indigenous peoples' rights and interests in land upfront – not as an afterthought. To date, Indigenous peoples have not shared equitably in the wealth generated by mining Australia's mineral endowment. Inequitable outcomes will continue without major policy reform.

Abstract:To address climate change, the United States is offering consumers incentives to purchase electric vehicles containing domestically derived lithium batteries. New extraction facilities required to supply this lithium may have environmental impacts, including impacts on biodiversity. To reveal potential impacts, we mapped 72 proposed lithium extraction sites across the contiguous United States and overlaid these with data for species occurrences, conservation value, habitat, and land management designations. We found that potential impacts vary by site. The abundance of lithium resources in the United States, combined with large differences in potential impacts among sites, suggests that decision-makers may be able to guide lithium extraction to the least impactful sites first. To aid this process, we recommend field-based reconnaissance of proposed lithium extraction sites, and a cumulative analysis of potential impacts on biodiversity in order to contextualize this activity within the larger scope of land use and climate change.

Abstract:Demand for critical minerals, battery metals, and the nearshoring of electric vehicle (EV) manufacturing have implications for all trading partners of the updated North American Free Trade Agreement, now called the United States-Mexico-Canada Agreement (USMCA). North American EV manufacturing is driven by initiatives such as the battery belt in the US and Canada’s commitment to clean technology. Mexico, as a major auto-component manufacturer and producer of critical minerals, holds a significant role in supporting the regional supply chain. However, recent developments in Mexican natural resource policy, including the nationalization of lithium deposits and exploration moratoriums, present challenges for foreign miners operating in Mexico, including the risk of future limited participation in the mining sector. Canadian miners hold a dominant role in Mexican mineral exploration, and Mexico is Canada’s third-largest trading partner. The political landscape in Mexico, with the ruling Morena party controlling both the national government and majority of state governments, further complicates the situation. Policy changes in 2023 to the mining sector’s regulatory requirements are the most significant reforms to the sector since the early 1990s. The reforms are in response to prominent, long-standing grievances from various non-industry stakeholders and seek to mitigate against future negative social and environmental impacts of mining. The reforms include shorter mining concession permits, stricter environmental impact assessments, and new permitting procedures on water use.

Abstract:Significance Although low commodity prices deterred investment in recent years, this is changing as the market rallies. The creation of a regional electric vehicle (EV) supply chain straddling the Canada-US border has the potential to transform the Canadian mining sector while loosening China’s grip on the minerals used in high-performance batteries. Impacts Canada is the world’s eighth-largest cobalt producer and has significant copper, graphite and rare earth deposits. Fortune Minerals, which is developing a cobalt mine in Northwest Territories, has held funding talks with the US Export/Import Bank. First Cobalt is building North America’s only cobalt refinery to give battery makers an alternative source to the DRC. Several of the country’s mines are using cutting-edge technologies to reduce their carbon emissions.

Abstract:Minerals are the primary resources of economic and social development. But the nature of mining and mineral development is such that various adverse impacts upon the local communities are usually inevitable. Consequently, the process of mining-led economic and social development is often associated with tensions among corporate mining objectives, recipient community needs, and governmental policy goals for regional development. This paper aims to identify the issues and problems with the sustainability and social responsibility in mining communities and address policy implications and potential actions to promote the implementation of social responsibility and the achievement of development sustainability in Chinese mining communities. It is concluded that the prevailing issues and problems identified are mineral exhaustion, environmental degradation, mine safety noncompliance, bureaucratic impediments, and lack of social responsibility, and the major implications and actions revealed include enhancing research and development, improving economic instruments, and promoting institutional reforms.

Abstract:Compound ecosystem restoration in mining area is regarded as pre-arrangement for the future ecosystem spatial structure and functions.The benefit evolution of the ecosystem is greatly affected by the nature,society and economy.From the two aspects of resources economy and the eco-economy,this paper discusses the concept and meaning of the three benefits in land reclamation and ecosystem rehabilitation and analyzes the effect of ecosystem evolution,the goal of ecosystem restoration,the types of ecosystem restoration,the ecosystem restoration technique,and mineral resources' comprehensive utilization in mining area on the economic,ecological and social benefits.In the case of the dynamic evolution of the structure of land resource utilization in the process of land reclamation and ecological restoration in Antaibao opencast coal mine in Shanxi Province of China covering the period of1985-2015,the effective allocation and integra-tion of the economic,environmental and social benefits is set forth.This provides the theoretical basis for the structural optimization of land resource utilization and setting up an index system for benefits evaluation of compound ecosystem restoration in mining area.

Abstract:Concern is growing that new mineral demand pressures associated with transport electrification will exacerbate existing supply chain sustainability and resiliency risks and escalate global environmental injustices. In response, private and public actors in the extractive sector have signaled that they are retooling mineral production, sourcing and stewardship governance systems, practices, and processes to meet the sustainability demands of the electric vehicle (EV) transition. Currently, however, the specific components of many of these initiatives remain less well known, with little scholarly review of their potential to address the longstanding systemic deficiencies in mineral supply chains. Instead, research and policy conversations are oriented largely towards what can be described as a demand-reduction approach , focused on minimizing the intensity of metal mining as a strategy for ensuring the sustainability imperatives of the transition. This Perspective argues that 1) the EV transition offers a critical impetus for tackling head-on longstanding systemic deficiencies in responsible global mineral production, sourcing, and stewardship 2) addressing the deficiencies will also better position mineral demand-reduction measures to yield their intended sustainability outcomes and 3) historically, new initiatives introduced to reform the extractive sector rarely address the root problems that first gave impetus to the initiatives. Accordingly, questions about retooling existing mineral procurement governance systems, practices and processes should be an integral part of EV transition research. It recommends moving research, policy, action, and investment towards prioritizing addressing persisting systemic deficiencies in global mineral supply chains as part of strategies for ensuring ethical transport decarbonization.

Abstract:<p>Mining companies are expected to return land to a stable, productive and self‐sustaining condition by rehabilitating degraded areas to also deliver social benefits, an essential dimension of sustainable land management. This research aimed to develop a framework for mine rehabilitation planning based on an integrated analysis of the social‐ecological system provided by the ecosystem services concept to facilitate community engagement and the delivery of social benefits. An Ecosystem Services Assessment for Rehabilitation (ESAR) framework was tested at two bauxite mines undergoing ecological restoration. The mines are operated by the same company in two countries. Key results showed that the framework can help companies, regulators and community members alike identify whether biophysical restoration efforts translate into key human benefits. Overall the framework provides a means for enhancing community engagement to explicitly address social benefits that, with a business as usual focus on ecological goals, may not be delivered. The ecosystem services concept provides a practical approach to link ecological and social outcomes of mine restoration.</p><p>This article is protected by copyright. All rights reserved.</p>

Uncharted risk measures for the management of sustainable mining

Abstract:Governments commit to ensuring the welfare of their citizens by drafting and enforcing regulations that ultimately ensure the sustainability of mining. This study contributes to improving the sustainability of mining throughout the mine's lifecycle until the final destination of the mining products. We propose recommendations that address the sustainability of mining from a global perspective, framed around the United Nations Sustainable Development Goals (SDGs), following waste hierarchy with Common Agricultural Policies, and policies from the Green Deal on climate, energy, transport, and taxation. Tailings are the most significant source of environmental impact in mining operations and, therefore, must comply with controlling regulations through Tailings Management Facilities (TMFs). However, there have been several mining accidents involving TMFs worldwide. The recommendations begin during planning, preconstruction, and construction with practices such as fair consultations, tax revenue fairness, and mandatory insurance. The operation and management support parallel industries to mining and supporting health and education. Emergency planning involves the surrounding communities in mock drills and environmental monitoring. In the closure and rehabilitation, remediation technologies such as phytoremediation, carbon sequestration incentives, and biomass valorization are recommended. Finally, supporting a circular economy by prioritizing ethical consumption, resource reduction, material recovery, and replacing toxic minerals and materials from the start with "benign by design" is recommended. The strategies involve stakeholders directly or indirectly related to the mining companies' contamination and demonstrate a commitment to the SDGs, offering a holistic perspective on scientific, social, and regulatory issues. Abstract:This special section of The Leading Edge focuses on the issue of critical minerals from the perspective of recent progress in mining exploration and anticipated future needs as the global energy economy transitions to higher use of, and reliance on, renewables. The definition of a “critical mineral” is itself context dependent. For example, minerals such as lithium, nickel, cobalt, manganese, and graphite each are essential to the development of modern, high-efficiency lithium-ion batteries, and any disruptions to these minerals — whether through supply chain issues or raw, geologic access — ultimately impacts the future of this now-pervasive, and increasingly necessary, energy storage technology. Similarly, rare earth elements (REEs) have long been central to the manufacture of permanent magnets, which themselves are key components of wind turbines and electric vehicles, the latter of which account for 14% of global passenger car sales in 2022, up from 9% in the previous year. In the United States alone, the market forecast for electric vehicles is expected to grow to roughly US$137 billion in 2028, up from $24 billion in 2020. Lastly, the more “common” but still “critical” minerals copper and aluminum are the backbone of the rapidly expanding global energy distribution systems upon which our modern society is built.
