Abstract:Copyright and computer science continue to intersect and clash, but they can coexist. The advent of new technologies such as digitization of visual and aural creations, sharing technologies, search engines, social media offerings, and more challenge copyright-based industries and reopen questions about the reach of copyright law. Breakthroughs in artificial intelligence research, especially Large Language Models that leverage copyrighted material as part of training models, are the latest examples of the ongoing tension between copyright and computer science. The exuberance, rush-to-market, and edge problem cases created by a few misguided companies now raises challenges to core legal doctrines and may shift Open Internet practices for the worse. That result does not have to be, and should not be, the outcome. This Article shows that, contrary to some scholars' views, fair use law does not bless all ways that someone can gain access to copyrighted material even when the purpose is fair use. Nonetheless, the scientific need for more data to advance AI research means access to large book corpora and the Open Internet is vital for the future of that research. The copyright industry claims, however, that almost all uses of copyrighted material must be compensated, even for non-expressive uses. The Article's solution accepts that both sides need to change. It is one that forces the computer science world to discipline its behaviors and, in some cases, pay for copyrighted material. It also requires the copyright industry to abandon its belief that all uses must be compensated or restricted to uses sanctioned by the copyright industry. As part of this re-balancing, the Article addresses a problem that has grown out of this clash and under theorized.

Abstract:Economic efficiency has been the dominant justification for copyright protection in the United States. Challenging that narrow perspective, this study argues that cultural democracy provides a broader, more encompassing framework for reforming copyright laws in support of users’ access to and use of creative works. The study demonstrates how the normative values promoted by cultural democracy are synonymous with the socially beneficial effects of the first sale doctrine. Additionally, the study contextualizes and further elaborates the notion of cultural democracy by providing more concrete examples of how cultural democracy plays out in practice. In doing so, this study focuses on individuals’ use of ebooks and the role of public libraries in the digital age.

Abstract:Vannevar Bush envisioned a machine that would assist humanity in the creative work of writing. Doug Engelbart imagined the collaborative sharing and enhancement of knowledge. Digital media today—text, drawings, photos, audio, and video—surpass the visions of their pioneers. These media may be copied, shared, and modified in ways that challenge the legal system, because unrestricted content sharing without suitable payment to creators runs counter to intellectual property (IP) traditions and laws. Writers, musicians, artists, and inventors have long relied upon IP protection to enable them to control the use of their creations and inventions. Copyright infringement, that is, copying in violation of copyright, threatens the income that they could receive from their creations. The concept of fair use is a critical issue in such discussions, as it allows certain exceptions to copyright. One area that has received a great deal of attention is the digital copying and sharing of music; we shall examine the interplay between conventional behaviour, ethics, technical interventions to limit or block copying, laws and legal battles, and product and pricing innovation. Next, we shall look at similar issues in the domain of motion pictures. There are effective and legal streaming services, yet there are still concerns about copyright infringement. Copyright holders now automatically produce takedown notices to insist that websites remove illegally or improperly sourced material. Such notices include many errors, causing additional complications for video creators. One interesting challenge to the concept and laws of copyright occurs in the creation of mash-ups. Artists use fragments from existing musical or visual performances as well as their own material to create audio-visual works that combine multiple content sources. Artists, lawyers, and businesspeople debate the extent to which such mash-ups violate reasonable copyright protection. Copyright is also significant for academic articles and textbooks. There are two especially interesting cases to discuss. One is the widespread copying of textbooks by students due to the high price of texts. The other is the fair pricing of the publication of research results that have been funded by government grants. This issue has provided one of several stimuli to the creation of open access publications.

Abstract:This paper is included in the First Monday Special Issue: Music and the Internet, published in July 2005. Special Issue editor David Beer asked authors to submit additional comments regarding their articles. Since this paper was first published in 2002 there has been a constant stream of litigation surrounding P2P in the US and in other jurisdictions. In the United States, the District Court and the Court of Appeals controversially held that Grokster was not liable for contributory and vicarious copyright infringement. Justice Thomas of the Federal Circuit observed: "We live in a quicksilver technological environment with courts ill-suited to fix the flow of internet innovation." The United States Supreme Court is due to hear an appeal by copyright owners against the Grokster decision in 2005. In Australia, litigation was initiated against Sharman License Holdings, LEF Interactive and Brilliant Digital Entertainment, as the controllers of the peer to peer network Kazaa. Again, media owners have emphasized that the network is a pirate bazaar. Global legal forum shopping is one of the intriguing aspects of P2P. We see the arguments of both sides, originally developed specifically for US deliberation manifest across the globe. The Media naively ask whether there is any point in the Australian court considering these issues, given the litigation ongoing in the US. Here the US is seen as the world leader for legal ideas surrounding P2P, with the currency in ideas about technology, innovation and growing the global information economy clouding appreciation of national sovereignty and the distinctiveness of local jurisprudence. This context makes an appreciation of the cultural uniqueness of the US views all the more important. Rip, Mix, Burn: The Politics of Peer to Peer and Copyright Law by Kathy Bowrey and Matthew Rimmer Whereas Lessig's recent work engages with questions of culture and creativity in society, this paper looks at the role of culture and creativity in the law. The paper evaluates the Napster, DeCSS, Felten and Sklyarov litigation in terms of the new social, legal, economic and cultural relations being produced. This involves a deep discussion of law's economic relations, and the implications of this for litigation strategy. The paper concludes with a critique of recent attempts to define copyright law in terms of first amendment rights and communicative freedom.

Abstract:The rapid recent expansion of copyright law worldwide has sparked efforts to defend the 'public domain' of non-propertized information, often on the ground that an expansive public domain is a condition of a 'free culture'. Yet questions remain about why the public domain is worth defending, what exactly a free culture is, and what role (if any) authors' rights might play in relation to it. From the standard liberal perspective shared by many critics of copyright expansionism, the protection of individual expression by means of marketable property rights in authors' works serves as an engine of progress towards a fully competitive 'marketplace of ideas' – though only if balanced by an extensive public domain from which users may draw in the exercise of their own expressivity. This article shows that a significantly different, and arguably richer, conception of what a free culture is and how authors' rights underpin it emerges from a direct engagement with the philosophy of Immanuel Kant. For Kant, progress towards a fully emancipated (i.e. a 'mature' or 'enlightened') culture can only be achieved through the critical intellectual activity that public communication demands: individual expressive freedom is only a condition, not constitutive, of this 'freedom to make public use of one's reason in all matters'. The main thesis defended in this article is that when Kant's writings on publicity (critical public debate) are read in relation to his writings on the legal organization of publishing, a necessary connection emerges between authors' rights – as distinct from copyrights – and what Jürgen Habermas and others have named the public sphere. I conclude that it is the public sphere, and not the public domain as such, that should serve as the key reference point in any evaluation of copyright law's role in relation to the possibility of a free culture.

Abstract:The current information environment presents opportunities for sharing information and enhancing the public domain of creative resources for education, research and the public good. Because the sharing paradigm for digital resources is fundamentally different from any we experienced in the analog world, practices of non-profit cultural heritage collecting institutions should be re-examined and re-evaluated with respect to aligning mission with new opportunities. One practice that deserves attention, particularly in this new environment, is the continued assertion of intellectual property rights in images of creative works that are themselves in the public domain.

Abstract:In Part I of this Note, I’ll explain how internet creators, ordinary users, companies, and social media influencers operate under the current system of formal copyright law and informal norms. What they appear to want out of an attendant legal regime looks more like personal brand protection, specifically in so far as it encompasses the attribution right and the ability to monetize their whole oeuvre rather than specific content. In Part II, I’ll discuss privately ordered methods of enforcing the rights that creators seem to want, before explaining that these methods are insufficient to meet creators’ needs. Finally, in Part III, I’ll outline a path to greater protection of attribution and integrity rights by way of promising judicial developments, which would provide more robust protection than current norms.

Abstract:Under a regime of limited economic incentive for creativity and confined commodification of information, humanity produced the greatest portion of human knowledge. To mention some, the Bible, the Qur'an, the Mahābhārata, the Iliad and Odyssey, the Aeneid, the Scandinavian Sagas, the German Lay of the Nibelungs, the Celtic legends of Arthur, the Romances and Chanson De Geste all came to life well before strong economic rights were attached to creativity. Later, Petrarch declaimed the Dolce Stil Novo, Dante wrote the Divina Commedia, Chaucer fathered English literature, Ludovico Ariosto chanted Orlando Furioso, Cervantes unleashed his Don Quixote de la Mancha against windmills and earlier epic literature, and Shakespeare gave immortal life to the love of Romeo and Juliet. Emulation, imitation, plagiarism, borrowing, remixing and recombination had a constant demiurgic power in the history of creativity. However, modern policies have largely forgotten the cumulative and collaborative nature of creativity. In this article, I highlight shortcomings of the copyright principle of exclusivity by rereading the history of aesthetics at the dawn of the networked age.

Abstract:In recent years, it has become common knowledge that culture is the main component for people’s creative communication as well as for the elimination of social differences and political contradictions, the encounter for people of different racial, ethnic, religious hues in a common place, leading thus to the achievement of world peace.Furthermore, the field of culture under proper management, can contribute substantially to improving the economic conditions of different countries, considering the multiple fields of production and dissemination potential of diverse cultural products which, combined with the explosive and rapid growth of telecommunications and the internet, create a considerable number of new jobs.As a result: the growing interest in this sector. However, the legal framework in which the digitization and management of cultural heritage should develop is not always clear enough or, even when it is clear, it is overturned by modern trends, which, for the sake of technology, become massive.It is therefore important to know basic relevant notions and principles for navigating and acting in a politically correct way in the vast and diverse universe of civilization: the present study constitutes an attempt both to specify the notions of cultural heritage and copyright, as well as to detect the possibilities and limitations of digitization and management of cultural heritage as defined by the current legal framework.The aim is the succinct quote of the afore-mentioned, in order that this project will serve as a concise manual easily understood and useful mainly to people not specialized in law.

Abstract:We build on the well-established critique, primarily in the US literature, of the following assumptions: (1) copyright protections serve to incentivise creativity; (2) copyright is designed with such incentivisation as its primary purpose; and (3) a standardized set of copyright protections should ideally be applicable to all forms of cultural production, across all situations in all countries. These assumptions lead to two fundamental conceptual flaws in much current copyright policy discourse: (1) it conflates concepts such as incentive, reward, and recognition; (2) it is nomothetic in character insofar as the existing structural and procedural diversity of the different cultural industries that it governs is inadequately acknowledged. Our critique in this article is not, therefore, a general one, but is limited to a specific theory of copyright, which pretends that copyright is an incentive to creativity while the evidence indicates that it is not. We highlight the importance of taking account of the whole ‘creativity value chain’ in the different industries with their various components – the creator, the copyright holder, the distributor, and the market. Drawing on case studies of three creative industries: literary writing, film, and fashion, we demonstrate that not only is there currently considerable heterogeneity among these industries, but that there has also been heterogeneity within each industry at different periods and in different contexts. We argue that this flexibility is a beneficial characteristic of the current functioning of copyright that should be defended against pressures in favour of harmonization.

Abstract:This study investigates copyright discourses on YouTube. Through a qualitative content analysis of 144 YouTube videos, we explore how YouTube creators understand copyright law, how they minimize risks posed by copyright infringement, and how they navigate a highly technical and dynamic copyright enforcement ecosystem. Our findings offer insights into how digitally situated cultural producers are impacted by and respond to automated content moderation. This is important because increasingly lawmakers around the world are asking digital platforms to implement efficient systems for content moderation, and yet there is a lack of good information about the stakeholders most directly impacted by these practices. In this study, we present a systematic analysis of copyright gossip, building on the concept of algorithmic gossip, which comprises the opinions, theories, and strategies of creators who are affected by YouTube’s copyright enforcement systems.

Abstract:Technology, particularly recording technology, has for more than a century threatened the copyrights of composers, publishers and performers. Users armed with this technology have been given the means to record, copy and distribute the works of others. The response of rights holders has been to advocate the reiteration and expansion of their copyrights. The increased copyright regimes while going someway to protect the rights of composers, publishers and performers has also swept material from the public domain, so making it unavailable to other artists and follow-on creators. This process is referred to by Lessig as the locking down and appropriation of culture, a process that some argue will lead to a lack of diversity and choice. The folk song The Legend of Tom Dula (Dooley) is one of the best known examples of this appropriation. This song had been freely available to generations of folk singers until it was captured in a recording. The recording was transcribed and copyright was claimed, the song was no longer in the public domain. Whereas technology provides the reason to expand copyright, information technology and particularly the internet has spurned a number of initiatives that may lead to the freeing of content. The open source movement has been very successful in freeing and generating content; this movement has itself led to other related initiatives. One of these, the Creative Commons, provides a broad based solution which through a series of alternative licensing contracts allows rights holders to lessen their control on their content making it more available for others to use. This paper considers the interplay of music, technology and intellectual property. It considers how developments in information technology can now be used to offset the expansion of copyright. After reviewing some of these developments, particularly the Creative Commons, and considering evidence now analysed from a European wide survey of musicians and publishers completed in 2008, the paper concludes that these fixes, rooted in intellectual property, unfortunately offer little by way of solution. However technological solutions not so closely tied to intellectual property may offer more appropriate and workable solutions.

Abstract:Abstract Copyright can be a major obstacle for cultural institutions regarding digitization and online accessibility, which ultimately leads to the under-exploitation of collections at the expense of society and to a need to support cultural heritage institutions with legislative and/or policy changes or at least clarifications. This contribution is a policy paper that aims to clarify the copyright law principles applicable to museum professionals dealing with digital cultural heritage worldwide, and to formulate policies to facilitate their digital activities. An initial version of this policy paper was published on a dedicated website and led to an international conference held in 2020 in Geneva. Although it is primarily addressed to museums, this policy paper may also serve as guidance to stakeholders in other areas dealing with digital cultural heritage, in particular Galleries, Libraries, Archives and Museums (GLAM). Part I proposes policies directed towards national and international policymakers. Parts II and III are directed towards cultural institutions, and set out a code of conduct that cultural institutions may follow when pursuing digitization and dissemination activities in order to comply with the actual state of the law and minimize the risks associated with these activities (Part II), and an alternative dispute resolution (ADR) procedure to help cultural institutions and rights holders identify issues and reach satisfactory solutions in disputes around digital activities (Part III).***

Abstract:Intellectual property rights are fundamental to how economies organize innovation and steer the diffusion of knowledge. Copyright law, in particular, has developed constantly to keep up with emerging technologies and the interests of creators, consumers, and intermediaries of the different creative industries. We provide a synthesis of the literature on the law and economics of copyright in the digital age, with a particular focus on the available empirical evidence. First, we discuss the legal foundations of the copyright system and developments of length and scope throughout the era of digitization. Second, we review the literature on technological change with its opportunities and challenges for the stakeholders involved. We give special attention to empirical evidence on online copyright enforcement, changes in the supply of works due to digital technology, and the importance of creative re‐use and new licensing and business models. We then set out avenues for further research identifying critical gaps in the literature regarding the scope of empirical copyright research, the effects of technology that enables algorithmic licensing, and copyright issues related to software, data and artificial intelligence.

Abstract:This article explores the impacts of Chinese culture on users' attitudes and intentions about software copyright and piracy. The findings reject the pervasive position that Chinese culture resists software copyright and encourages piracy behaviors. Instead, the study reports that Chinese culture has no significant impact on users' intentions to use pirated software programs. Meanwhile, collectivistic and individualistic cultural components are found to coexist in the Chinese value system. The users with higher scores in the collectivistic component have more negative attitudes towards software companies, while the users with higher scores in the individualistic component have less negative attitudes towards software products. The coexistence of individualistic and collectivistic components prevents software users from falling into either direction of supporting or opposing software copyright and calls for a balanced account between software owners and users.

Abstract:Copyright in the cultural sphere can act as a barrier to the dissemination of high-quality information. On the other hand it protects works of art that might not be made available otherwise. This dichotomy makes the area of copyright difficult, especially when it applies to the digital arena of the web where copying is so easy and natural. Here we present a snapshot of the issues for online copyright, with particular emphasis on the relevance to cultural institutions. We concentrate on Europe and the US; as an example we include a special section dedicated to the situation in Italy.

Abstract:Intelligent or generative writing tools rely on large language models that recognize, summarize, translate, and predict content. This position paper probes the copyright interests of open data sets used to train large language models (LLMs). Our paper asks, how do LLMs trained on open data sets circumvent the copyright interests of the used data? We start by defining software copyright and tracing its history. We rely on GitHub Copilot as a modern case study challenging software copyright. Our conclusion outlines obstacles that generative writing assistants create for copyright, and offers a practical road map for copyright analysis for developers, software law experts, and general users to consider in the context of intelligent LLM-powered writing tools.
