Abstract:The purpose of this paper is to discuss whether Art. 114 TFEU was the correct legal basis for the Digital Markets Act, the EU Regulation aimed at regulating the gatekeepers in the digital economy. In recent years, increasing digitalisation and the enormous increase in data power have created a need for more far-reaching digital regulation. The EU legislator proposed a New Competition Tool in the summer of 2020 after many member states had already proposed or implemented legislation on the subject. However, when it was implemented at the end of 2022, this instrument was no longer recorded as competition legislation, but as internal market regulation under Art. 114 TFEU. This paper compares the objectives and regulatory mechanisms of traditional competition law with those of the DMA and tries to determine which legal area the DMA belongs to. Since the objectives are the same as those of competition law, it is then analysed whether Art. 114 TFEU can still be considered as a proper legal basis. In this case, however, two different competence norms come into consideration whose legislative procedures cannot be reconciled with each other (Art. 114 and Art. 352 TFEU). According to the established case law of the European Court of Justice, the Commission would have had to choose a legal basis, whereas this thesis argues that, in accordance with the ostensible motives, the legal basis of Art. 352 TFEU should have been chosen. The concluding chapter will suggest how the revolutionary approach of the DMA could still be saved by the Commission. The Commission has the possibility to amend the European Treaties according to Art. 48 TEU or to actually present a new competition instrument based on the correct legal basis, namely Art. 103 in conjunction with 114 TFEU or only Art. 352 TFEU. This will have the added benefit of improving the integration of secondary legislation into the existing system.
