Abstract:The work is devoted to the study of the problems of forming a criminalistics characteristic of terrorism, its structure and content. The author examines the genesis of the concept of "forensic characteristic", its structure, content and the corresponding correlation between its elements. Taking into account the following main elements of the criminalistics characterization of terrorism: method of crime (which includes the method of preparation, method of commission and method of concealment of crime); object of criminal offence; place, time and setting of crime (conditions of crime); tools and means of crime; identity of the offender; identity of the victim (victim), the author proposes to include such an element as the purpose and motive of terrorism. From the point of view of the idea of the scientific work, the inclusion of such an element as "purpose and motive for committing terrorism" in the structure of the criminalistics characteristic is due to the fact that the purpose and motive are the main identifying features of this type of crime, which has a material composition in accordance with the disposition of Article 258 of the Criminal Code of Ukraine and the Law of Ukraine "On Combating Terrorism". The author examines the psychological component of the concepts of "purpose" and "motive" of committing terrorism and provides an extended interpretation of these concepts. Thus, the goal is seen as, on the one hand, a conscious image of the intended result, which the action is aimed at achieving. The goal is formed as a result of the awareness of motives, when it becomes clear what exactly will satisfy the need. A goal is formed when the direct realisation of a motive is impossible.From another scientific point of view, a goal is a psychosocial quality that stems from a sense of initiative, thanks to which a person's ability to behave purposefully gradually increases. Further, the author argues that from the point of view of the general provisions of psychology, intentional criminal offences (which include, first of all, terrorism) are considered as a complex volitional act, which is characterised by the fact that the action (in the sense of a criminal act) is preceded by consideration of consequences, awareness of motives, decision-making, etc. Volitional acts are performed in accordance with certain motives. A motive is considered as a certain mental experience that prompts and recognises a person's choice of a certain system of actions. The article emphasises that the criminalistics characterisation of terrorism should be considered as an information model, which contains qualitative and quantitative retrospective indicators of typical features (method of commission, typical trace pattern, identity of the perpetrator, identity of the victim) inherent in terrorism, and specific features (purpose and motive of commission) that allow it to be separated from other types of crimes.
