Abstract:The “green principle” is adjudicative and can play a substantial role in the outcome of a case as a norm of adjudication. The content reflects the high reducibility of the factual elements, the methodological adaptation to the legal argumentative model, and the function to compensate for the limitations of the legal rules become the basis for the judicial application of the “green principle”. However, it should be recognized that, as a legal principle, the judicial application of the “ green principle” is subject to a high risk of misconduct, which may endanger the practice of private autonomy and undermine the stability of the law.The judicial application of the “ green principle” should be based on the basic concept of modesty, the contextual requirement of “prohibition of escape to the general provisions”, the method of application by typology, and exclude the following legal consequences: determining the validity of the contract, determining whether the contract can be rescinded, and drawing public law liability.

Abstract:Writing the"Green Principle"into the general civil law is a way in which the Civil Code makes a ra-tional response to the environmental problems and ecological crisis.However,as a principle outside the inher-ent value system of the Civil Code,the"Green Principle"may be"suspended"or"separated out"in the Civil Code.To prevent such a tendency and maintain the consistency between"Green Principle"and Civil Code is a key topic in the construction and application of the"Green Principle".Regarding approaches,"Green Principle"has more advantages over"Green Regulations"in terms of regulation scale,effectiveness,operational logic and conceptual reconciliation.Taking the balance of all kinds of interests as a starting point,the"Green Principle"set an environmental boundary for civil affairs so that environmental interests w ould be part of the Civil Code. To be specific,the"Green Principle"in the Civil Code does not mean that all environmental obligations will be-come part of the Civil Code.On the contrary,this paper proposes that environmental law be integrated into the Civil Code on the basis of rationality and moderation principles.

Abstract:Environmental protection is mainly the focus of environmental law in China, but as China has started to pursue ecological civilization, its civil law has begun to respond to environmental problems as well, which is called the "greening of civil law". As a result, the newly passed General Provisions of Civil Law adopted a "Green Principle" requiring private actors to contribute to resources conservation and environmental protection in civil activities. Through normative and comparative analysis, this article explores the establishment of the "Green Principle", the rationales for civil law's response to environmental problems in China, the progress already made, and the further efforts that are needed. It argues that the major challenge for the greening of China's civil law at present is the modification of the subsequent sections of the forthcoming civil code. Despite the progress that has already been made, further efforts are needed regarding the following aspects: environmental and resources protection should be taken into account in contract rules concerning the validity, performance, and interpretation of contracts, and rules on emission trading contracts should be added; the property section should stipulate the unified exercise of state ownership over natural resources; and the "personality rights" section should stipulate environmental rights so as to clarify the right that is violated in environmental public interest litigation.

Abstract:The ecology of the basic principles of civil law is an essential part of civil law ecology.Whether ecology should be contended in the basic principles of civil law involves in understanding of values in the civil law,while whether ecology could be contended in the basic principles of civil law involves in explaining the technical problems in the civil law.The ecology of the basic principles of civil law should include the ecology which is in the principle of equality,voluntary,fairness,honesty,good morals and the principle of no rights abusing.The values and basic spirits of Green Environmental Protection Principle can be divided into the basic principles of civil law,and it is unnecessary to separate and add this principle as the basic principles of civil law.Therefore,it will not only maintain the stability of the basic principles of civil law in the form part,but can also bring the environmental protection temperament to the basic principles of civil law on the content.To sum up,the expanding decentralized,appropriate explanation is the best way to express the value of ecology in the basic principles of civil law,while the expanding explanation on the judicial level is the best generalization for the technical path of ecology in the basic principles of civil law.

Abstract:Although the emergence of sustainability development in civil law has triggered substantial discussion, scarce literature is available in English on the introduction of ecological norms to the newly promulgated Chinese Civil Code, which came into force at the beginning of 2021. This article intends to fill the gap by providing an overview of the structure and significance of the principles and rules designed to render the Civil Code more adaptable to the global urgency of sustainable development. The ecological principle added to the Civil Code is designed to promote public interests rather than individual liberty. Unlike other civil law principles, the ecological principle needs to be scientifically justified, which no longer depends only on judicial discretion. Regarded as a continuation of the movement for socialization, the ecological principle contributes to the global trend of questioning anthropocentrism in law and manifests itself in a new understanding of human activity. Ecologizing the Civil Code entails a methodological agenda that incorporates more pragmatic, coherent, and policy-oriented argumentation in judicial practice. Moreover, it entails an ontological agenda, still in formation, that urges us to recognize the inevitable connections between human and nonhuman worlds on the ontological side. Within the scope of this principle, the section of the Civil Code on property law imposes the duty to act in accordance with the necessity of resource conservation and environmental protection. It is also predictable that stricter limitations will be imposed on property rights, in the name of good neighborliness. State intervention by courts due to ecological considerations will become more frequent in contractual disputes. Finally, the Code introduces the notions of punitive liability and pure environmental harm, which diverge from the classical continental tradition of understanding civil liability. Despite the theoretical novelties, the question of to what extent civil adjudication can achieve a comprehensive ecological transformation still needs to be scrutinized.

Abstract:On March 15, 2017, the fifth session of the National People's Congress of the people's Republic of China approved the "General Rules of Civil Law", which marked the first step of the codification of civil law in China.The author experienced the whole process of the new China drafting of the civil code.This paper introduces in detail the history of the first four civil codification activities, and on the basis of which an overall review of "The General Principles of Civil Law" is conducted.The article points out that both the structure and main contents of "The General Principles of Civil Law" accurately follow "The General Provisions of Chinese Civil Law".Of course, it has also a lot of innovations in the aspects of natural person, legal person, civil rights, prescription and so on.However, the article also points out that the General Principles still needs further improvement both in terms of the specific content of civil rights and in the legislative technology innovation.

Abstract:The principle of public order and good morals, which consists of two parts: "public order" and "good customs", is enshrined in article 8 of China's Civil Code. In modern civil law, the principle of public order and good morals permeates all fields of civil law, and has become the value concept of maintaining legal order, which does not negate the autonomy of private law, but delimits the boundaries of the autonomy of private law. However, the uncertainty of its connotation and application conditions makes the application of the principle of public order and good morals will inevitably produce the contradiction between the stability of the law and the justice of individual cases. Therefore, in the judicial application of the principle of public order and good morals, the definition of the concept of public order and good morals and the conditions of judicial application should be clarified to prevent the confusion of public order and good morals with other concepts, to prevent different judgments in the same case and to prevent the escape to the general provisions, so as to realize the balance between the stability of the law and the justice of individual cases.

Abstract:The general principles of civil law serve as the benchmark of dispute analysis and resolution in the domain of civil law. These principles embody the nature and basic values of Chinese civil laws, corresponding to the fundamental demands of the civ-il society and the market economy in China.Namely, they are, by stipulation of General Principles of Chinese Civil Law, the principles of equality, autonomy, fairness, good faith, and public order and social morals.As the ground principle, the princi-ple of equality treating the like alike is the foundational premise of the principle of autonomy, while the principle of autonomy is the essence of civil law reflecting the basic ideas of civil law.Nonetheless, the principle of fairness aims at maintaining necessa-ry balances of individual interests during, especially, their autonomous transactions.The principle of good faith and the principle of public order and social morals set the boundaries of individual autonomy.

Abstract:In 2006,China has experienced flourishing development in every aspect of civil law jurisprudence.Especially the issues of real right legislation and relevant theories have been broadly discussed,such as constitutionalism of real right law,real right principle of legal prescription,equal protection of ownership,and registration system.In addition,new theoretical ideas have appeared in the areas of jurisprudence methodology,civil code system and general rules,personality right law,contract law,tort law and so on.Especially in the area of tort law,as legislation advances,lots of academic works have come forth emphasizing on legislation patterns,responsibility principles and specific tort forms.Moreover,appearance of large numbers of young jurists also reflects gradual prosperity of civil law jurisprudence in China.However,there is still some mark of fickleness in some academic works.

Abstract:The theory of juristic acts is the core content of The General Principles of Civil Law, and the perfection of the legal norms is one of the main tasks of The General Principles of Civil Law of P.R.China.Based on the theory of juristic acts, this paper gives a detailed review of all the legal norms of juristic acts in the new General Principles of Civil Law.The author believes that the General Principles of Civil Law has made great progress in the definition of juristic act, the basic values behind it, the implementation and effectiveness of the declaration of intention, and the validity system of juristic acts.At the same time, the article also points out that this General Principles of Civil Law still requires improvement and perfection in these fields including the selection of terminology, the effect of persons with limited capacity of juristic acts, the rules about the error in the declaration of intention, the adoption of rules about unilateral false declaration of intention, the optimization of the validity system of invalid juristic acts etc.This paper puts forward a series of concrete and practical perfection plans, looking forward to further improvement of the General Principles and the codification of other parts of the civil law.

Abstract:Basic principles in civil law used to be deemed as a basic legal thinking to fulfill the certain duty and function of civil law,not rules for judgments.However,in the civil law codes of the continental law countries after German Civil Law,it has been clearly legislated and even been more abstract and comprehensive compared to the three principles summarized by scholars in French Civil Law.The draft of Civil Law by legislators and the advice to Civil Law by scholars,based on the basic principles in Chinese General Rules of Civil Law,have expressed differently in terms of the basic principles.But it is appropriate to establish the principles of equality,voluntaries,honest and credibility,public order and good habits,prohibition of civil right abuse as the basic principles of China's Civil Law.
The Review and Reflection of the Fair Principle in Civil Law

Abstract:There are some obviously unreasonable views on the fair principle in Chinese civil law, which present as definition tautology, lack of system in types, regarding fair principle as result fairness, considering fair principle as enabling clause or completely denying its authorization function, and believing that fair principle applies only in partial fields of civil law. This article indicated that fair principle was definited as that the idea of "suum cuique" should be realized in civil activities field at utmost. Fair principle presents as commutative fairness, attributive fairness, corrective fairness and distributive fairness. Among them, the first three live in the general status, but corrective fairness lives in exception, while in the judgment standard of commutative fairness, subject standard is general, but object standard is in exception. This analysis enhanced the system of fair principle. Fair principle performs as procedural fairness or formal fairness, and its function of authorizing judges to be engaged in active judicial behaviors only applies in exception. The principle universally applies in all fields of civil law, and it should be recognized as the basic principle of civil law.

Abstract:As far as legal principles are concerned, it is more vital to explore their apllications in judicial trials than to define them. In general, there exist four situations in which legal principles are applied in judicial practices.Firstly, the principle will act as the basis and guidance of the rule when a legal principle is in accord with a legal rule. Secondly, a legal principle will be applied for dealing with the legal loophole when a legal rule is missed. Thirdly, a legal principle will be used for making an exception of a legal rule when the principle conflicts with the rule. Finally, the situation in which legal principles are conflicted is especially complicated. These four situations may be structurally intercrossed and overlapping. And the first situation of the application of principles has been well known, but the other situations, especially the third and fourth situations are in need of more research .From the deep perspective of normative jurisprudential methodology, this article attempts to investigate the logical structure of the judicial application of legal principles.

Abstract:In 2010, the case guidance system was formally established in Chin a, which is a great-leap-forward development of the orientation and application of previous cases in our judicial practice. After the establishment of the system, the Supreme People’s Court (hereinafter referred to as SPC) made it clear that judges should refer to or apply the guiding cases when deciding similar cases. This clarifies that the guiding cases is actually binding. By December 31, 2017, SPC has issued a total of 92 guiding cases. These cases have not only been published in batches, but also been uploaded to official website by SPC. The case guidance system meets the need of judicial practice in our country and also complies with the trend of the gradual merge of the two major legal systems. In this paper, 118 civil and commercial cases involving in guiding cases in 2017 are selected as the object of analysis, and the judicial practice of guiding cases is studied from both macro and micro perspectives. The macro perspective mainly concentrates on the application of guiding cases in Local People’s Court at all levels across the country. The micro perspective focuses on the study of specific judgment documents. From real and concrete data, we can find out the characteristics of the judgment documents, and analyze the problems in the operation of the case guidance system, and put forward feasible suggestions to improve the system.

Abstract:The principles of civil enforcement law can be divided into basic principles and concrete principles according to the different scopes of their functions. Basic principles refer to norms that are macroscopic, fundamental and directional in the whole process and in all aspects of civil enforcement, while concrete principles refer to important norms that are macroscopic, fundamental and directional in one or several processes and aspects. The principle of civil enforcement law is the legislative standard in the process of law formulation and the code of conduct in the process of law implementation. The basic principles of civil enforcement law include the principle of enforcement in accordance with the law, the principle of efficient enforcement, the principle of combining compulsory enforcement with promotion, the principle of good faith, the principle of equal protection of the lawful rights and interests of the executing party and the third party, the principle of good faith and peaceful enforcement. The concrete principles include the principle that the people’s court independently exercises the power of civil enforcement according to law,the principle of decentralization of enforcement, the principle of limited enforcement object, the principle of making full use of modern information technology, the principle of enforcement with assistance and the principle of procuratorial supervision on civil enforcement.

However, in wake of the ongoing judicial reforms, some defects involved with the basic principles begin to show up themselves. Abstract:Although General Principles of Civil Law is not suitable to adopt a linear listing of regula?tions of property ownership right, rights related to the former such as property right, creditor ’s rights, intellectual property, right of inheritance, it can not transfer completely all the civil right regu?lation to the compilation of each individual principle but sets up a general regulation of civil right, whose regulation range should be restricted by the system and the content of each chapter, by the content regulated by the civil code and by the idea and guiding thought pursued by the civil code. Civil code should not only require the establishment and implementation of civil right not be against the public order and good custom, follow principle of being honest and trustworthy, but also set up regulations about the composition, types and efficacy of expectation right and debate right. Even if General Principles of Civil Law or civil code can not include all the civil rights, they cannot advo?cate blindly“Everything is permitted, which is not forbidden by law”.
