Abstract:There are many pressures that militate against work colleagues "blowing the whistle" or "ringing the bell" on each other in respect of research misconduct. These pressures result in a significant proportion of such conduct not coming to light at all or coming to light later or less straightforwardly than is desirable. There need to be meaningful incentives for colleagues to draw to the attention of authorities concerns that they have about adherence by others to their obligations in relation to research integrity. The United States has a distinctive process under the False Claims Act which provides significant financial encouragement to such persons, known as "relators" under the qui tam scheme, including in the context of proven research misconduct. This editorial reviews prominent occasions on which qui tam actions have been taken and considers the ramifications of a US$112.5 million settlement arrived at in 2019 involving research misconduct at Duke University. It discusses the advantages and disadvantages of the incentives that lie at the heart of the United States False Claims Act and canvasses whether it should be emulated in other countries.

Abstract:Against this backdrop, whistleblowers complement the limited human and financial resources of regulatory authorities. Numerous cases of environmental crimes have been revealed through whistleblowing. For instance, in 2016, Princess Cruise Lines Ltd agreed to pay a US $40 million fine to US authorities for intentional ocean pollution and its cover-up — the largest criminal penalty for vessel pollution at that time. Whistleblowing by the company's engineer led to the detection of this incident. Crimes on ships — which are often known only to a limited number of employees, such as engineers — are increasingly being detected through whistleblowing in the USA.

Abstract:When technology enters applications and processes with a long tradition of controversial societal debate, multi-faceted new ethical and legal questions arise. This paper focusses on the process of whistleblowing, an activity with large impacts on democracy and business. Computer science can, for the first time in history, provide for truly anonymous communication. We investigate this in relation to the values and rights of accountability, fairness and data protection, focusing on opportunities and limitations of the anonymity that can be provided computationally; possible consequences of outsourcing whistleblowing support; and challenges for the interpretation and use of some relevant laws. We conclude that to address these questions, whistleblowing and anonymous whistleblowing must rest on three pillars, forming a 'triangle of whistleblowing protection and incentivisation' that combines anonymity in a formal and technical sense; whistleblower protection through laws; and other norms and practices including organisational error culture.

Abstract:Why do people become whistleblowers? Why do most people not become whistleblowers? What becomes of whistleblowers? These are three of the questions that Carl Elliott, a professor of bioethics at the University of Minnesota, sets out to answer in the context of medical research in his beautifully written book The Occasional Human Sacrifice: Medical Experimentation and the Price of Saying No. (I suspect that the publisher rather than Elliott chose the title.)Elliott was inspired to try and answer these questions by his experience as a whistleblower against his own university. In June 2008 he read a newspaper account of the death by suicide of Dan Markingson. Markingson had been a participant in a clinical trial of an antipsychotic drug, Seroquel, funded by AstraZeneca. Abstract:Whistleblower laws protect individuals who inform the public or an authority about governmental or corporate misconduct. Despite these laws, whistleblowers frequently risk reprisals and sites such as WikiLeaks emerged to provide a level of anonymity to these individuals. However, as countries increase their level of network surveillance and Internet protocol data retention, the mere act of using anonymizing software such as Tor, or accessing a whistleblowing website through an SSL channel might be incriminating enough to lead to investigations and repercussions. As an alternative submission system we propose an online advertising network called AdLeaks. AdLeaks leverages the ubiquity of unsolicited online advertising to provide complete sender unobservability when submitting disclosures. AdLeaks ads compute a random function in a browser and submit the outcome to the AdLeaks infrastructure. Such a whistleblower's browser replaces the output with encrypted information so that the transmission is indistinguishable from that of a regular browser. Its back-end design assures that AdLeaks must process only a fraction of the resulting traffic in order to receive disclosures with high probability. We describe the design of AdLeaks and evaluate its performance through analysis and experimentation.

Abstract:An accommodating and supportive environment is essential to conducting scientific research. Yet, in almost every country, researchers can experience harassment, threats, prosecution, or even violence for opinions they express or for their work in relation to high-profile issues. Although many international and regional reports on this issue are patchy in terms of comprehensiveness and representation, they reveal clear and worrying trends—namely, that researchers working in politically charged fields such as public health, climate, and sexual and reproductive rights are prone to threats to their safety. The scientific community must heighten awareness and catalyze change if science is to remain a bedrock of societal well-being.

Abstract:We report on two studies undertaken to establish the factors that affect funders’ trust and likelihood to invest in crowdfunding campaigns online. Findings from an initial small-scale qualitative study are reported and subsequently triangulated in a larger quantitative survey. Across these studies, we demonstrate the importance of social information within the peer economy, with a strong reliance on other users across the course of the investment decision-making process. Decision making on whether to invest is informed not only by the content of the crowdfunding campaign page but also by social influence factors that are present (e.g., liking of the campaigner, reciprocity). It is further shaped by due diligence checks focused on the progression of the prototype for which funding is sought, and by assurances from outside the campaign page—namely on social media. Such assurances center around the importance of social proof, garnered through opinions of previous customers or other funders. The risk here is that much of this information is content that can be faked, and as such a reliance on this may leave potential funders vulnerable. Meanwhile, a genuine lack of prior experience and customer base means that some legitimate campaigners struggle to gain trust from potential investors who are reliant on such social information. Our findings present an empirical grounding to develop future security solutions that (1) protect existing funders and (2) increase potential funders’ level of trust, to encourage their engagement with legitimate crowdfunding campaigns.

Abstract:As a legal aid union president in New Haven, laboring within shouting distance of a different large research university, I recall how our membership rolled our eyes when Professors Greiner, Pattanayak, and Hennesy of Harvard published their study providing evidence, through a randomized control trial, that law clinic housing work made no difference for clients. 1 Representing, as I was, "lawyers, secretaries, and paralegals who have dedicated their careers to serving poor clients in crisis," 2 the authors' conclusion generated first shock, then denial, and then an anxious realization that somebody's job was to research and disseminate such conclusions. In a 2013 United States where there was one legal aid lawyer for every 8,893 people who qualified, 3 where federal Legal Services Corporation funding had dropped 40% over ten years in real dollars, 4 and in an America that spends as much on Halloween costumes for its pets as it does legal aid for the poor, 5 the inquiry felt like a pile-on. It made no more sense to us than asking if a teacher is "good for students," a nurse "good for the sick," or a chef "good for the hungry." 6

Abstract:The historical partnership between whistleblowers and journalists has produced some of the most consequential news stories of the 20th and 21st centuries. However, this partnership has also experienced deep ruptures, most notably after the attacks on 9/11 that reordered the fourth estate's (the press) approach to publishing stories on national intelligence and politically powerful figures. While sensational developments in information accessibility such as WikiLeaks and online document repositories have meaningfully changed the activity of newsgathering and how stories are published, this article instead looks to the more delicate activity of whistleblower rhetoric and its role in recalibrating the place of the fourth estate in a liberal democracy. What follows is an analysis of how a small, vulnerable, and otherwise heterogeneous group uses a rhetoric of praise and blame to achieve a vision of the fourth estate's essential role in the world.

Abstract:Abstract This article explores whether the human right to science can support the public interest as a legal basis to use and disclose confidential information. The contextual focus is scientific research; the jurisdictional focus is England. The human right to science, as reflected in the Universal Declaration of Human Rights (Article 27) and the International Covenant on Economic, Social and Cultural Rights (Article 15), hitherto has not been invoked in support of a public interest basis for lawful disclosure, but the argument is made herein that there may be scope to develop this jurisprudentially. On grounds of both law and policy, and in line with the underlying rationale of recent UK Government deployment of ‘COPI Notices’ for lawful use of confidential patient information in the course of the COVID-19 pandemic, I contend that the human right to science may well serve as a valuable juridical buttress to an overriding public interest justification to lawfully share confidential information. However, this could occur only in restricted circumstances where the public interest is clearly manifest, namely studies researching serious, imminent health threats to the general population that rely on confidential information accessed outside of existing statutory gateways, and not more routine scientific endeavors.

Abstract:Money laundering has become of increasing concern to law makers in recent years, principally because of its associations with terrorism. Recent legislative changes in the United Kingdom mean that auditors risk becoming state law enforcement agents in the private sector. We examine this legislation from the perspective of the changing nature of the relationship between auditors and the state, and the surveillant assemblage within which this is located. Auditors are statutorily obliged to file Suspicious Activity Reports (SARs) into an online database, ELMER, but without much guidance regarding how suspicion is determined. Criminal rather than civil or regulatory sanctions apply to auditors’ instances of non-compliance. This paper evaluates the surveillance implications of the legislation for auditors through lenses developed in the accounting and sociological literature by Brivot and Gendron, Neu and Heincke, Deleuze and Guattari, and Haggerty and Ericson. It finds that auditors are generating information flows which are subsequently reassembled into discrete and virtual ‘data doubles’ to be captured and utilised by authorised third parties for unknown purposes. The paper proposes that the surveillant assemblage has extended into the space of the auditor-client relationship, but this extension remains inhibited as a result of auditors’ relatively weak level of engagement in providing SARs, thereby pointing to a degree of resistance in professional service firms regarding the deployment of regulation that compromises the foundations of this relationship.

Abstract:Nonprofit and Voluntary Sector Quarterly, Ahead of Print. Even the most conscientious nonprofit organizations can fall victim to fraud. We examine how a nonprofit organization's Form 990 disclosures and media coverage about an asset diversion influence subsequent donor support. Consistent with a loss in trust, we observe a decrease in donations following a diversion. This decrease is amplified when the diversion is reported in the news. We also find that donations decline more when organizations do not provide transparent disclosures and when losses are higher but only if the diversion receives media coverage. Finally, our results indicate that donors punish organizations less when they report higher recoveries and governance improvements. This study describes mechanisms though which news coverage enhances donor oversight. The media can: (a) directly inform some donors, (b) prompt some donors to obtain further information, and (c) motivate organizations to provide higher-quality disclosure.

Abstract:This study critically reviews scholarly debates on state aid for independent, professional news journalism in the public interest, its funding models and principles, the market failure paradigm, and policy efficacy. State aid is handed out by government agencies which believe that their support can help independent, professional journalism thrive in the digital, mobile, and platform-dominated future. Government support mainly comes as direct financial grants or indirect tax offsets. It aims at engendering economic opportunity and prosperity, while safeguarding journalistic independence and quality of output. Ideally, this shall foster the production, distribution and consumption of original and high-quality news in the public interest, which, in turn, shall keep people informed, facilitate public debate, and hold power to account. Still, this study finds arguments that government funding models for independent journalism in the public interest are limited by several critical challenges that endanger their principles, do not avert failure in the news media market and prevent effective policy governance. These deficits may even be exacerbated in the digital era.

Abstract:Scientific misconduct is an issue rife with controversy, from its forms and definitions to the policies that guide how allegations are handled. A survey published nearly 15 years ago reported that 2% of researchers said they had fabricated or falsified data in their published work. This is not just an academic issue. Fake data promote ineffective or even dangerous treatments, for example, and thwart the discovery of real solutions for society. In the United States, the Office of Research Integrity (ORI) is tasked with rooting out misconduct in research funded by the National Institutes of Health (NIH). Last October, ORI proposed changes to how it functions. The agency's recommendations—the first since 2005—have evoked mixed reactions, but the real problem is that ORI is underfunded and lacks the resources and authority needed to make a difference. Unless its charter is revised by Congress, the ORI can sadly do little more than tinker at the edges of scientific fraud.
