Abstract:Background: Despite representing 4% of the global population, the United States has the 5th highest number of intentional homicides in the world. Peripartum people represent a unique and vulnerable subset of homicide victims. This study aims to understand the risk factors for peripartum homicide. Study Design: We used data from the 2018-2020 National Violent Death Reporting System to compare homicide rates of peripartum and non-peripartum people capable of becoming pregnant (12-50 years of age). Peripartum was defined as currently pregnant or within one year postpartum. We additionally compared state-level peripartum homicide rates between states categorized as restrictive, neutral, or protective of abortion. Pearson’s chi-squared and Wilcoxon rank-sum tests were used. Results: There were 496 peripartum compared to 8,644 non-peripartum homicide victims. The peripartum group was younger (27.4 ± 71 vs 33.0 ± 9.6, p<0.001). Intimate partner violence (IPV) causing the homicide was more common in the peripartum group (39.9% vs. 26.4%, p<0.001). Firearms were used in 63.4% of homicides among the peripartum group compared to 49.5% in the comparison (p<0.001). There was a significant difference in peripartum homicide between states based on policies regarding abortion access (protective 0.37, neutral 0.45, restrictive 0.64; p<0.01); the same trend was not seen with male homicides. Conclusion: Compared to non-peripartum peers, peripartum people are at increased risk for homicide due to IPV, specifically due to firearm violence. Increasing rates of peripartum homicide occur in states with policies that are restrictive to abortion access. There is a dire need for universal screening and interventions for peripartum patients. Research and policies to reduce of violence against pregnant people must also consider the important role that abortion access plays in protecting safety.

Abstract:Purpose To determine the impact of abortion legislation on mental health during pregnancy and postpartum and assess whether pregnancy intention mediates associations. Methods We quantified associations between restrictive abortion laws and stress, depression symptoms during and after pregnancy, and depression diagnoses after pregnancy using longitudinal data from Nurses' Health Study 3 in 2010–2017 (4,091 participants, 4,988 pregnancies) using structural equation models with repeated measures, controlling for sociodemographics, prior depression, state economic and sociopolitical measures (unemployment rate, gender wage gap, Gini index, percentage of state legislatures who are women, Democratic governor). Results Restrictive abortion legislation was associated with unintended pregnancies (β=0.127, p=0.02). These were, in turn, associated with increased risks of stress and depression symptoms during pregnancy (total indirect effects β=0.035, p=0.03; β=0.029, p=0.03, respectively, corresponding <1% increase in probability), but not after pregnancy. Conclusions Abortion restrictions are associated with higher proportions of unintended pregnancies, which are associated with increased risks of stress and depression during pregnancy.

Pregnancy-related maternal mortality in the state of Georgia: Timing and causes of death

Abstract:Background: The maternal mortality rate in the United States is high and disparities among non-Hispanic White and non-Hispanic Black women remain. In the State of Georgia, the pregnancy-related death rate is among the worst in the nation. Objective: To examine current pregnancy-related deaths in the State of Georgia using measures of timing and cause-specific mortality across maternal sociodemographic characteristics. Design: This cross-sectional study of pregnancy-related deaths in Georgia was based on 2016-2019 maternal mortality data obtained from the Georgia Department of Public Health. Methods: Our study analysis involved complete-case data of maternal deaths identified as pregnancy-related deaths (n = 129). Statistical analyses included two distinct population-level measures: (a) timing (i.e. during pregnancy, 0 to 60 days, 61 to 180 days, and 181 to 365 days postpartum) and (b) cause-specific deaths patterned by sociodemographic groups of women and by rural and urban county of residence. Categorical variables were compared using the Chi square or Fisher's exact test and presented as numbers and percentages. A post hoc power analysis was conducted to inform whether there was sufficient power to detect statistically significant effects given available sample sizes. Results: Among a total of 129 pregnancy-related deaths, 30 (23.3%) deaths occurred during pregnancy and 63 (48.8%) deaths occurred within the first 60 days postpartum. Pregnancy-related deaths were disproportionally common among non-Hispanic Black, 25 to 34 years old, and poorly educated women. Three leading underlying causes, cardiomyopathy (22.7%), hemorrhage (21.6%), and cardiovascular or coronary disease (20.4%), accounted for about 65% of all pregnancy-related deaths. Mental health conditions were common causes of death among non-Hispanic White women during pregnancy and in late postpartum. Conclusion: Continued monitoring, collecting and analyzing reliable data will help identify root causes and find ways to eliminate the disproportionate burden of pregnancy-related deaths in the State of Georgia.

Abstract:Psychological Science, Ahead of Print. Abortion policy is conventionally viewed as a political matter with religious overtones. This article offers a different view. From the perspective of evolutionary biology, abortion at a young age can represent prioritization of long-term development over immediate reproduction, a pattern established in other animal species as resulting from stable ecologies with low mortality risk. We examine whether laws and moral beliefs about abortions are linked to local mortality rates. Data from 50 U.S. states, 202 world societies, 2,596 adult individuals in 363 U.S. counties, and 147,260 respondents across the globe suggest that lower levels of mortality risk are associated with more permissive laws and attitudes toward abortion. Those associations were observed when we controlled for religiosity, political ideology, wealth, education, and industrialization. Integrating evolutionary and cultural perspectives offers an explanation as to why moral beliefs and legal norms about reproduction may be sensitive to levels of ecological adversity.

Abstract:Abortion has been a hotly contested political issue since the mid 1960s, when states began liberalizing their abortion laws. Recent Supreme Court rulings, such as Rust vs. Sullivan, the retirement of two liberal Supreme Court justices and the battle over Louisiana's abortion legislation have created new fervor on both fronts of the battle. All health care providers who care for women need to be cognizant of the current abortion laws and the factors that influence the abortion decision. These factors include the different levels of health risk and financial implications posed by continued pregnancy or abortion. Historically, numerous court cases have influenced women's health care, and reviews of several significant cases are provided. The Webster vs. Reproductive Health Services decision was the first case that directly challenged the Roe vs. Wade decision. The Webster decision enables states to have greater authority in writing their own abortion laws. Individual state laws can vary greatly, so it is vitally important for providers to know and understand the laws of their state.
Post- Dobbs Abortion Restrictions and the Families They Leave Behind

Abstract:The June 24, 2022 US Supreme Court decision in Dobbs v Jackson Women's Health Organization resulted in an expansive restriction on abortion access that had been constitutionally guaranteed for nearly half a century. Currently, 14 states have implemented complete bans on abortion with very limited exceptions, and an additional 7 states have implemented abortion bans at 6 to 18 weeks' gestation. It has been well demonstrated that restrictive policies disproportionately limit abortion access for minoritized people and people of low socioeconomic status; the financial and geographic barriers of these post-Dobbs restrictions will only exacerbate this disparity. Proponents of abortion restrictions, who identify as pro-life, assert that these policies are essential to protect children, women, and families. We examine whether the protection of these groups extends past conception by evaluating the association between state abortion legislation and state-based policies and programs designed to provide medical and social support for children, women, and families. We found that states with the most restrictive post-Dobbs abortion policies in fact have the least comprehensive and inclusive public infrastructure to support these groups. Abstract:Objective Rates of death due to homicide, suicide and overdose during pregnancy and the first year postpartum have increased substantially in the USA in recent years. The aims of this study were to use 2018–2019 data on deaths identified for review by the North Carolina Maternal Mortality Review Committee (NC-MMRC), data from the North Carolina Violent Death Reporting System (NC-VDRS) and data from the Statewide Unintentional Drug Overdose Reporting System (NC-SUDORS) to examine homicide, suicide and unintentional opioid-involved overdose deaths during pregnancy and the first year postpartum. Methods We linked data from the 2018–2019 NC-MMRC to suicide and homicide deaths among women ages 10–50 years from the 2018–2019 NC-VDRS and to unintentional opioid-involved overdose deaths among women ages 10–50 years from the 2018–2019 NC-SUDORS. We conducted descriptive analyses to examine the prevalence of demographic characteristics and the circumstances surrounding each cause of death. Results From 2018 to 2019 in North Carolina, there were 23 homicides, nine suicides and 36 unintentional opioid-involved overdose deaths (9.7, 3.8 and 15.1 per 100 000 live births, respectively) during pregnancy and the first year postpartum. Most homicide deaths (87.0%) were by firearm, and more than half (52.5%) were related to intimate partner violence. More than two-thirds of women who died by suicide had a current mental health problem (77.8%). Less than one-fourth (22.2%) of those who died by unintentional opioid-involved overdose had a known history of substance use disorder treatment. Conclusion Our approach to quantifying and describing these causes of pregnancy-associated death can serve as a framework for other states to inform data-driven prevention.

Abstract:A large body of scholarship has debated the constitutionality of criminalizing travel to seek abortions – an issue with new salience in the wake of the Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization overruling Roe v. Wade. Increasingly, however, anti-abortion activists are turning to civil remedies as a supplement or alternative to criminal prosecution in cases involving out-of-state abortions, an issue that has received far less scholarly attention. In contrast to criminal jurisdiction, where the outer bounds of states’ authority to punish out-of-state conduct is highly uncertain, the extraterritorial application of state law in civil litigation is a common, routine effect of choice-of-law analysis that is unlikely to raise constitutional difficulties. As a result, it is reasonable to expect that courts in anti-abortion states may give broad geographical effect to abortion-restrictive law and policies in at least some civil litigation. The resulting decisions are likely to create substantial friction between states, as abortion-permissive states try to protect their own citizens from liability even as the Full Faith and Credit Clause demands recognition of foreign-state judgments that courts may be reluctant to give. To be sure, state policies have clashed (or threatened to) in civil litigation before, and this Article explores the outcomes of such conflicts in the areas of divorce liberalization, cannabis legalization, and the enforceability of noncompete clauses. At the same time, abortion is likely to give rise to broader and more intractable strife between states than any other issue courts have confronted in the recent past. Although individual judges can reduce occasions for interstate friction by applying restrained, conduct-focused conflicts principles, the states’ fundamental disunity on the underlying issue of abortion may prove to be a problem that our choice-of-law system is simply not well equipped to resolve.
Marriage and Divorce Decline During the COVID-19 Pandemic: A Case Study of Five States

Abstract:The decline in marriage and divorce was evident prior to the pandemic, but it remains unknown whether these patterns have persisted during the pandemic. We compared monthly marriage and divorce counts for two years prior to the pandemic (2018 and 2019), and during the pandemic for the five states that published monthly vital statistics data for 2020 (Arizona, Florida, Missouri, New Hampshire, Oregon). All five states witnessed an initial dip in marriage. Counts of marriages in Arizona and New Hampshire rebounded. In contrast, a marriage shortfall occurred in Florida, Missouri, and Oregon. In the early pandemic months divorces initially declined in all five states and rebounded in Arizona. In the remaining four states a divorce shortfall has occurred. Based on these results we provide national estimates of the marriage and divorce response to the pandemic. As more data become available it will be important to acknowledge these state variations in response to the pandemic.

Abstract:The public policy chaos fueled by the June 2022 Dobbs v Jackson Women's Health Organization Supreme Court decision has created a critical need for objective and high-quality abortion policy evaluation research. Stevenson and Root 1 rose to this challenge by conducting a convincing analysis of recent trends in maternal mortality, motivated in part by pro-life advocate claims that the recent observed decline in pregnancy-related death is the counterintuitive result of more restrictive abortion policies post– Dobbs v Jackson Women's Health . Using 5.75 years of monthly national maternal mortality data from January 2018 through September 2023, their decomposition approach considered spikes in mortality from COVID-19 and potential seasonal fluctuations in maternal deaths. The findings clearly demonstrate that the observed decline in maternal mortality after the 2022 Dobbs v Jackson Women's Health ruling is the result of a resolution of the COVID-19 mortality shock, not because of new restrictive abortion laws being passed by state legislatures. This work is among the first published analyses of the potential effects of restrictive state abortion policies in the post– Dobbs v Jackson Women's Health aftermath. Additional research on a wide array of potential outcomes needs to be conducted to fully understand the range and magnitude of the outcomes of state-level abortion policies. Based on a plethora of prior research regarding unintended pregnancy and abortion, reduced access to abortion care is thought to decrease the incidence of abortion but also increase the risk and incidence of myriad adverse maternal and infant health outcomes. 2 Restrictive abortion policies are also expected to increase child poverty, increase the number of families that experience serious financial instability or hardship, and put additional pressures on underresourced social welfare systems. 2 In addition, there is great concern that restrictive abortion laws will negatively impact physician choice regarding where to train or practice and the availability of obstetric care across states. 3 After major public policy reforms, it is common for stakeholders—proponents and opponents alike—to look for positive and negative policy effects immediately. While easy to conduct, armchair policy impact pontification is fraught with error and false conclusions. Identifying the impact of public policy change is not a simple task. Besides the obvious cautionary chant that correlation is not causation, evaluating the degree to which public policy shifts are having both intended and unintended consequences requires sound approaches to methods, timely access to quality data, and sophisticated statistical analyses that control for underlying trends and confounding factors. 4 Furthermore, there is often discussion and debate among researchers themselves regarding how to investigate the effects of important public health, medical, and health care interventions and policies. The convening of expert panels or working groups to provide guidance regarding research priorities and best approaches to research design, data or measurement, and analyses on specific topics is long-standing. It can provide essential scientific direction to emerging issues, including ones fraught with political controversy. For example, the National Academy of Medicine has convened many methods-focused committees in challenging areas of research, including reports such as Priorities for Research to Reduce the Threat of Firearm-Related Violence (2013) and A Framework for Assessing Mortality and Morbidity After Large-Scale Disasters (2020). There is a crucial need for investment in scientific discourse regarding how best to investigate the wide range of potential medical, public health, and social welfare effects of public policy related to abortion care. 5 An organization with authority and resources, such as the Department of Health and Human Services, the National Academy of Science, Engineering, and Medicine, or a foundation with a health-related mission, should quickly convene an ad hoc panel of experts to produce a nonpartisan, nonideological consensus document that provides guidance for objective public policy evaluation research associated with state-level restrictive abortion care policies. Such a panel could help create a priority research agenda for funders and provide guidance regarding data or measurement, research designs, statistical analyses approaches, and other methodology issues. This includes guidance for taking advantage of state differences in policy design, timing, and state contextual factors (eg, state Medicaid policy) and for subpopulation analyses since restrictive abortion laws are likely to have differential effects based on race or ethnicity, age, socioeconomic status, and geography. Perspectives on Sexual and Reproductive Health

Abstract:Introduction In the era of Dobbs, legality of abortion care in the United States depends upon state law. Even before Dobbs, while abortion remained legal mounting restrictions and debate surrounding legal abortion could have led to confusion about abortion legality and discouraged patients from accessing legal abortion. We hypothesized an association between believing abortion is illegal or uncertainty about legality with later timing of abortion care. Methods We surveyed patients seeking abortion care in Ohio, West Virginia, and Kentucky from April 2020 to April 2021. We asked about their understanding of abortion legality at the time they were first deciding to have an abortion. Using unconditional logistic regression models, we examined associations between beliefs about abortion legality (measured as belief that abortion is legal or sometimes legal versus. illegal or unsure) and timing of abortion care (measured as trimester of abortion). Results Over half (57%) of the 1,479 patients who met eligibility criteria and completed the survey believed abortion was always legal, 21% thought abortion was sometimes legal, 12% believed abortion was illegal, and 10% did not know. Most (92%) had a first trimester abortion (<14 weeks gestation). Belief that abortion was illegal, or uncertainty about abortion legality, was not significantly associated with second trimester abortion care (unadjusted odds ratio [uOR]: 0.78, 95% confidence interval [CI]: 0.50–1.20). This association did not change meaningfully after adjusting for demographic and clinical variables (adjusted OR [aOR]: 0.83, 95% CI: 0.51–1.33). Discussion More than one in five patients presenting for abortion care in three abortion‐restrictive states prior to Dobbs erroneously believed that abortion was illegal or were unsure. Understanding of legality was not significantly associated with timing of abortion care. These misunderstandings could escalate under Dobbs.

Abstract:Restrictive abortion laws have impacts reaching far beyond the immediate sphere of reproductive health, with cascading effects on clinical and ethical aspects of neonatal care, as well as perinatal palliative care. These laws have the potential to alter how families and clinicians navigate prenatal and postnatal medical decisions after a complex fetal diagnosis is made. We present a hypothetical case to explore the nexus of abortion care and perinatal care of fetuses and infants with life-limiting conditions. We will highlight the potential impacts of limited abortion access on families anticipating the birth of these infants. We will also examine the legally and morally fraught gray zone of gestational viability where both abortion and resuscitation of live-born infants can potentially occur, per parental discretion. These scenarios are inexorably impacted by the rapidly changing legal landscape in the U.S., and highlight difficult ethical dilemmas which clinicians may increasingly need to navigate.

Abstract:Objective: For decades, research has supported linkages among reproductive health factors and interpersonal violence, including sexual violence and intimate partner violence. However, much of this research occurred before June 2022, when the U.S. Supreme Court reversed almost 50 years of federally legal abortion in the United States in their landmark decision of the Dobbs v. Jackson Women's Health Organization case. Given the relative recency of this decision, it is unclear how the previously demonstrated intersections of violence and reproductive health may be influenced by this momentous change in reproductive rights and access to care. Method: In this perspective, I consider the current empirical evidence regarding the intersections of reproductive health and interpersonal violence, with particular emphasis on future research needed in this area due to the changes in reproductive health legislation across the United States. Results: Several potential research directions were identified, including (a) the impact of unacknowledged rape, rape myths, stigma, victim credibility, and legal gray areas on the utilization of "rape exceptions" to abortion bans; (b) elevated risks during pregnancy such as recovery from trauma and intimate partner violence; (c) reproductive coercion issues; and (d) potential new forms of perpetrator abuse. Conclusions: Because interpersonal violence and reproductive health are inextricably linked, future violence research conducted in the United States would benefit from consideration of the nation's changing reproductive health care landscape in order to inform prevention efforts, clinical considerations, and policy decisions. Abstract:Abortion restrictions affect access to reproductive health care. Research has demonstrated that abortion restrictions (policies that restrict access to abortion services or cause abortion clinics to close) result in reductions of and delays in abortions. We leverage two population-based datasets to investigate the effects of mandatory waiting periods (MWPs), a restrictive state abortion policy, on the prevalence of intimate partner violence (IPV), one of the most common types of crime and a highly prevalent and costly public health problem, using data from the National Incident-Based Reporting System and Uniform Crime Report - Supplemental Homicide Reports. We hypothesize that MWPs increase the prevalence of IPV through changes in financial strains, negative health consequences, and intra-household power dynamics. Using difference-in-differences, event study, and methods accounting for staggered treatment timing, we find that MWPs are associated with increases in IPV. Our findings are valuable for policymakers in today's post- Dobbs environment.

Longitudinal Impact of Dobbs v Jackson Women's Health Organization on Abortion Service Delivery in Ohio, 2022‒2023

Abstract:Objectives. To assess the impact of Ohio's abortion policy changes on abortion provision following Dobbs v Jackson Women's Health Organization. Methods. We analyzed quantitative and write-in responses from an ongoing survey of 6 abortion facilities in Ohio for 3 time periods: January‒June 2022 (pre-Dobbs), July‒September 2022 (6-week ban in effect), and October 2022‒June 2023 (post-Dobbs, ban blocked). We disaggregated counts by method, gestation, and state of residence. Results. Following Dobbs, Ohio banned abortions after detection of embryonic cardiac activity, and monthly abortion provision decreased 56%. Several months after the ban was lifted, monthly abortion means exceeded pre-Dobbs means. The percentage of patients from out of state increased over time. Conclusions. The post-Dobbs enactment of a restrictive abortion ban drastically reduced availability of reproductive health care in Ohio. Nevertheless, Ohio remained an important destination for patients from surrounding states with abortion restrictions. Public Health Implications. Gestational bans decrease access to necessary health care; instead, states like Ohio should work to eliminate barriers to abortion care to support the health and well-being of people in their own and surrounding states. Abstract:Domestic violence imposes a large cost on society. The authors exploit state variation in timing to examine the impact of three types of law on intimate partner homicides. These laws restrict access to firearms by individuals who are subject to a restraining order or have been convicted of a domestic violence misdemeanor or allow law enforcement officers to confiscate firearms at a domestic violence scene. The authors find that female intimate partner homicide rates decline 7% after a state passes a restraining order law. They find no effect from the domestic violence misdemeanor or confiscation laws.
Association Between Restricted Abortion Access and Child Entries Into the Foster Care System

Abstract:Importance: The 2022 US Supreme Court decision Dobbs v Jackson Women's Health Organization overturned federal protections to abortion care, allowing many states to severely restrict or ban access to abortion. Given the implications of the Dobbs ruling, there is a need to understand the full consequences of restricted abortion access. Before 2022, many states restricted access to safe and legal abortions through Targeted Regulation of Abortion Providers (TRAP) laws, which provide a historical mode for estimating the consequences of abortion restrictions. Objective: To use TRAP law enactment as a natural experiment to quantify the association between restricted abortion access and foster care entries. Design, setting, and participants: In this cohort study, data on the enactment of TRAP laws and case-level data on foster care entries were used to estimate the association between restricted abortion access and foster care entries in each of the 50 US states and the District of Columbia. The sample included children conceived between January 1, 1990, and December 31, 2011, who were placed into foster care at any point between January 1, 2000, and December 31, 2020. Data analysis was performed from January 2023 to July 2023. Exposures: Restricted abortion access due to state-level TRAP laws during pregnancy. Main outcomes and measures: The main outcome was the number of children entering foster care in each state, measured by year of child conception. The analysis was performed using a generalized difference-in-differences design, comparing entries into foster care in states with TRAP laws to states without TRAP laws, before and after their implementation. Results: This study included 4 179 701 children who were placed into foster care during the study period, with 11 016 561 entries. More than half of the children were male (51.4%), and the mean (SD) age was 7.4 (5.2) years. There was an 11% increase in foster care placement after abortion access was restricted in states with TRAP laws, relative to states without TRAP laws (incidence rate ratio [IRR], 1.11 [95% CI, 1.01-1.23]). These laws had significant consequences for Black children (IRR, 1.15 [95% CI, 1.05-1.28]) and racial and ethnic minority children (IRR, 1.15 [95% CI, 1.02-1.30]). The increase in entries due to TRAP laws was particularly attributable to housing inadequacy (IRR, 1.21 [95% CI, 1.11-1.32]). Conclusions and relevance: Restricted abortion access can have numerous consequences, and these findings reveal a heightened strain on the US foster care system, particularly affecting marginalized racial and ethnic communities and financially vulnerable families. These placements have been shown to have lifelong consequences for children and substantial costs for both states and the federal government. To further examine the widespread implications of the overturning of Roe v Wade, future studies should forecast the expected increase in foster care entries and estimate the expenditure needed to support these children.

Abstract:This study aimed to determine whether punitive state alcohol policies targeting pregnant women who drink alcohol are associated with decreased alcohol consumption among pregnant women over time. This study used data from the Pregnancy Risk Assessment Monitoring System (15 states) between 1990 and 2015. A difference-in-difference (DiD) approach was employed to determine whether passage of state laws changed alcohol consumption rates among pregnant women, while controlling for state and time fixed effects. The study specifically examined punitive state alcohol policies that clarify the admissibility of evidence in child welfare proceedings related to prenatal alcohol exposure, focusing on allegations of child abuse, child neglect, child deprivation, or child dependence, as well as proceedings seeking termination of parental rights. Punitive state alcohol policies were not significantly associated with decreased rates of alcohol consumption among pregnant women (+ 1.54%, 95% CI, -1.47-4.55), within 3 years of implementation. State alcohol policies that adopted a punitive stance toward pregnant women who drink alcohol did not result in the reduction of drinking during pregnancy. Given that punitive policies may not effectively reduce alcohol consumption during pregnancy, our findings highlight the need for reevaluation and potential reform to better address maternal/child health outcomes.
