Abstract:We are said to face a crisis of over-criminalization: our criminal law has become chaotic, unprincipled, and over-expansive. This book proposes a normative theory of criminal law, and of criminalization, that shows how criminal law could be ordered, principled, and restrained. The theory is based on an account of criminal law as a distinctive legal practice that functions to define a set of public wrongs, and to call to formal public account those who commit such wrongs; an account of the role that such a practice can play in a democratic republic of free and equal citizens; and an account of the central features of such a political community, and of the way in which it constitutes its civil order. Criminal law plays an important, but limited, role in such a political community in protecting, but also partly constituting, its civil order. On the basis of this account, we can see how such a political community will decide what kinds of conduct should be criminalized—not by applying one or more of the substantive master principles that theorists have offered, but by considering which kinds of conduct fall within its public realm (as distinct from the private realms that are not the polity’s business), and which kinds of wrong within that realm require this distinctive kind of response (rather than one of the other kinds of available response). The outcome of such a deliberative process will probably be a more limited, and a more rational and principled, criminal law.

Abstract:Modern Chinese criminal law and legal theory cannot be separated from the historical, cultural and political context in which they developed. This article begins with a four-part periodization of the development of Chinese criminal law: (1) Late Qing reform, Republican legislation and the dawn of the modernization of Chinese criminal law from the 1911 Revolution until 1949; (2) the blank period of criminal law from the establishment of the PRC in 1949 until 1979; (3) the 1979 Criminal Law and the special Criminal Law era from 1980 until 1997; (4) the 1997 Criminal Law and the amendment era from 1997 to the present. This article next traces the development of Chinese legal scholarship alongside shifts in the criminal law. Prior to 1949 the academic field of Chinese criminal legal studies engaged with criminal justice systems and philosophies from Germany, Japan and other civil law jurisdictions as they were being introduced into China. After the establishment of the PRC, Chinese criminal law turned away from modeling Germany and Japan and thoroughly adopted Soviet criminal theory, transforming Chinese criminal jurisprudence into socialist criminal jurisprudence. In the 1960s and 70s, with the rising tides of legal nihilism and legal anarchism, research into criminal theory stagnated and was suspended for two decades. Following the promulgation of the 1979 Criminal Law, research into criminal legal theory was reinvigorated. Since the mid-1990s research into theory has flourished as a result of theoretical debates and legislative deliberation around the revision to the Criminal Law in 1997. At the turn of the 21st century Chinese criminal legal theory once again incorporated Germany and Japanese criminal law discourse and knowledge, producing systemic reconstruction in a process of standardization.

Abstract:The article entitled "The fundamental institutions of criminal law" presents a particularly generous and important theme. I will present the three fundamental institutions from a theoretical point of view and by exemplifying them practically through cases. These fundamental institutions are the main pillars of criminal law, around them gravitate all the other specialized institutions that form criminal law as a branch of law. Criminal law provides, as a consequence of committing crimes, specific criminal law sanctions that are applied to criminals through the most severe (legal) form of legal liability, criminal liability. Thus, in the synthesis of the essential features most often indicated by doctrine within the definition of criminal law, it can be appreciated as representing a branch of law that aims to ensure social defence (social order and discipline), carrying out a control of an individual’s conduct and behaviour from society to the highest degree undesirable, through the action of preventing and combating the criminal phenomenon, establishing and regulating: the categories of acts that are assessed, at a given moment, as crimes, the corresponding (legal) liability for committing them; the specific sanctions in which this legal-criminal liability is to be realized.

Abstract:The 425 pieces of crime stipulated in the Special Provisions of China's Criminal Law embodied all the theory, rule and policy underlying its General Provisions. Meanwhile, the application of Special Provisions fed back the General Provisions and their evolution process with the follows: the diversity and levity of crimes committed in real world, as well as the endogenetic limitation of the rule and theory.Starting from six basic concepts such as abstract accusation and further reviewing the main theoretic issues therewith,this article addressed one antique yet frontier problem - the conflict between and among standards of criminal law interpretation.

Abstract:"Criminal law, like other branches of law, is subject to the same moral principles, however, it is in criminal cases that a judge often resorts to ethical categories, since the type of punishment imposed may affect not only the restriction of the accused’s fundamental rights and freedoms, but also the future security of society. The purpose of the Article is to analyse the phenomena of morality and law as related categories in the administration of justice in criminal cases, and the importance of maintaining a balance between them when assessing evidence and imposing punishment in order to render a fair and impartial court decision. Given the peculiarities of the goal, the author has chosen a systematic approach based on general scientific and special scientific research methods, including systemic and structural, formal legal, comparative legal and other methods. Based on the legal analysis of current Ukrainian case law, the author identifies the real ethical challenges, which a judge faces when considering criminal cases and how to overcome them, resulting in a moral and fair decision supported by the law. The author also focusses on the insufficient coverage of numerous moral challenges in criminal cases among Ukrainian judges and provides suggestions on possible measures to improve educational activities in this area. Abstract:The theory of crime constitution in the criminology of China has not properly dealt with the following relationships between the five pairs of opposite categories: form and substance, prosecution and defense, objectiveness and subjectiveness, experience and norm, static state and process. The theory cannot self-support and must be reasonably improved. There might be a lot of ways to settle the limitations in the theory of crime constitution. One of the ways worth considering is to make judgment about the crime establishment in different “hierarchy” according to the doctrine of criterion violation, but not the doctrine of legal interest violation. At different stages of evaluation, the issues such as “criterion expectation”,“criterion destruction”, and “criterion re-construction”.

Abstract:The legal method of criminal law is related to the specific issues and therefore falls into the scope of the criminal law studies. However, the methodology of criminal law is related to the Weltanschauung and therefore only belongs to the field of general jurisprudence studies. In criminal law studies, every kind of method has its own function and its limitation as well. It is impossible to complete any criminal law study only by one method. In constructing modern criminal law theory, the method of comparative study is the one our Chinese scholars shall pay special attention to; while the systematic method is the most important method. And the ideal of criminal law is of the fundamental guidance for choosing the legal method of criminal law. Based upon these understandings, the author holds that a comprehensive method should be the best method for criminal law.

Abstract:Despite the exquisite appearance of the theories of criminal law, there is a wide gap between the theory and common sense. Whatever the structure of criminal law goes, it is necessary to reconsider the importance of common sense. Two aspects should be emphasized for criminal law going back to common sense. The first is the social benefit or function of criminal law; and the second is possibility of criminal law to return to common sense. If this is possible, then what is the starting point? The common sense perspective of criminal law pays special attention to European continental criminal law researches since it stresses the trans-cultural assimilation of criminal law and the importance of protecting normal social relationships through criminal law.

Abstract:The interpretation of the law in judicial activity, as well as the search for specific features of the interpretation of the criminal law, belong to the category of topics whose relevance in modern conditions is increasing much. The contradiction between the growing criminalization and the increasing concern about the observance of human rights and freedoms actualize the status of interpretation as one of the most important aspects of legal activity, directly ensuring the rule of law in criminal law relations. In any law-making text, there are always a lot of subjective meanings, only one of which can objectively be the basis of a judicial decision. Based on the generalization of the existing approaches to understanding the interpretation of the law, two of its basic models are distinguished - the model of the presentation of the parliamentary meaning and the model of the presentation of the judicial meaning of the law. It is proved that law enforcement is determined precisely by the judicial meaning of the law, the establishment of which in the process of interpretation is a significant component of judicial legal policy. Understanding the meaning of the criminal law has a specificity being predetermined by the public nature of the branch of criminal law, this impresses the course of action of the court within the framework of the implementation of the principle of separation of powers. However, this specificity cannot consist of, as it is commonly considered to be in science, in limiting the methods of interpretation used by the court or establishing a rigid hierarchical sequence in the application of methods of interpretation. The specificity of the interpretation of the criminal law should be determined not by the methods of interpretation, but by the principles of criminal law. Their content, in turn, should be revealed through an appeal to the goals of criminal law regulation. According to the results of the study, the general approach to the interpretation of the criminal law, which being literal as a matter of priority, should combine a restrictive understanding of any legal restrictions and a broad understanding of any defenses against a charge of a crime.

Abstract:What is the criminal law for? At its most elemental, criminal law secures the possibility of a shared life under stable and just public institutions. In the age of the administrative state, criminal law performs this task by stabilizing cooperation across a wide range of contexts, from backstopping compliance with tax law to protecting the integrity of a nation’s fisheries. How should we decide when this is a legitimate use of the criminal law? The “public law” conception sketched in this book suggests that because the criminal law is a public institution, it should be evaluated by the very same values that we structure our evaluation of public institutions generally. In contrast to familiar forms of retributivism, the public law conception starts from the political morality of public institutions, rather than the interpersonal morality of private relationships. In a society with democratic and egalitarian aspirations, the legitimacy of the criminal law depends in part upon the democratic and egalitarian character of the institutions it supports, and in part upon its supporting those institutions by means that are themselves consistent with democratic and egalitarian principles. The particular account of those principles sketched in this book is democratic, egalitarian without being equalizing, and focused on a form of freedom—effective access to central capability—as its currency of evaluation. This approach provides a distinctive and illuminating framework for assessing a wide range of problems in criminal law and policy, from mass incarceration, to over-criminalization and the allocation of procedural rights.

Abstract:This article is devoted to identifying the correlation of such categories of conceptuality as the concept, conceptual scheme, conceptual system, conceptual analysis, concept and conceptualization in relation to criminal law. It is noted that in classical science the concept is understood as a preliminary organization of theoretical material, and in criminal law the concept is often identified with theory. The article shows that the development of scientific thought goes through three stages of development: from a concept (initial idea) to a conceptual scheme (a detailed idea), then to a conceptual system (a complete scientific theory). In this context, competing criminal law theories are considered: the concept of the stages of a crime (a contradictory conceptual system) and the concept of types of unfinished crime (a conceptual scheme). The authors introduce the notion of “concept” into the scientific language of criminal law to denote the mental units of criminal law knowledge, which are widely used by the doctrine, as well as enshrined in the criminal legislation. Legislative concepts are the means of constructing criminal law, institutions and other normative blocks. Doctrinal concepts appear in criminal law as a means of interpreting criminal law regulations or are used to formulate new concepts. Concepts of this type function as elements of criminal law in the mode of understanding and explanation. In the process of conceptualization, the mental images of objects that have a criminal legal significance are first objectified as doctrinal concepts, and then enshrined in criminal law as legal concepts. In conclusion, the authors note that inexperienced postgraduate students rarely use the categories of conceptuality and its parameters fixed in the regulatory material of the Criminal Code in their studies. As a result, such studies constitute a compilation review of the views of others, which unreasonably stands out as new (derivative) knowledge in the absence of a detailed author’s concept.

Abstract:As a crucial topic in criminal law, illegality is an important attribute of crime. The criminal law under the continental law system and U.S.S.R criminal law take complete different approaches towards this aspect, viz. the former treats the illegality as a part of the requirements of the establishment of crime in crime theory system, and the latter discusses the criminal illegality in the conception of crime, therefore, for the shading of the notion of social detriment, the theory of illegality is scarcely expounded under U.S.S.R criminal law. Based on the comparison of the theory of illegality in the two legal systems, this article explains the content of illegality, and states that the illegality should be included in the system of crime constitution, in order to correct the theory of illegality.

Abstract:This Note analyzes the learning objectives, casebook readings, and supplemental sources that thirteen criminal law professors assigned over fifteen years and argues that the current approach to teaching criminal law is complicit in perpetuating the injustices of the American criminal legal system because it fails to adequately interrogate the carceral state and does not prepare students to become ethical practitioners or policymakers of criminal law. This paper calls for a fundamental rethinking of the purpose of teaching criminal law and recommends a reform orientation, which could be implemented through a variety of course structures.
