To shed light on such developments, this special issue sets out to explore how the phenomenon of cannabis, and related policies and subjectivities, are currently made, unmade, and transformed in multiple ways through discourses, practices, and materiality, and with different consequences.
"Bounded Equity: The Limits of Economic Models of Social Justice in Cannabis Legislation"

Abstract:Social equity provisions in cannabis legislation are premised on the hope that the profit generated around adult-use cannabis can be leveraged to ameliorate the damage done by racially biased enforcement of prohibition in black and brown communities. As such, they encapsulate an attempt to reconcile the history of racism in the enforcement of cannabis law through its new future as a profit generating commodity. These programs are gaining traction, but with minimal empirical examination. The development and implementation of these programs raises a number of questions in need of study that we outline in this paper. We argue that Creary's concept of bounded justice-which critiques the inherent limitations of social justice projects that ignore structural forms of social exclusion-can provide a framework for critical understanding of the limitations of such programs, ethnographically grounded empirical research, and a framework for evaluating the justice impacts of legislation. Specifically, we argue that in order to interrogate the possibilities for social justice projects around cannabis, we must address equity at a deeper level by working with communities to investigate hyper-localized and historical factors that have influenced systems and structures.
Racial, ethnic, and neighborhood socioeconomic disparities in local cannabis retail policy in California

Abstract:Background: Policies governing legal cannabis commerce can vary widely within a U.S. state when local control exists. Disproportionate distribution of policies allowing retail sale, protecting public health, or promoting equity in licensing may contribute to differences in health and economic outcomes between sociodemographic subgroups. This cross-sectional study jointly examined racial, ethnic, and neighborhood socioeconomic characteristics of Californians subject to specific local cannabis policies to identify such disparities. Methods: Local laws in effect January 1, 2020, governing retail cannabis sales (bans, expanding buffers from youth-serving sites, restricting advertising, promoting equity in licensing, and capping outlets) were determined for California's 539 jurisdictions. The number of Asian, Black, Latinx, and white residents in socioeconomic advantaged versus disadvantaged neighborhoods (Census block groups) was determined using 2015-2019 American Community Survey data. We estimated proportions of the sociodemographic subpopulations covered by specific policies based on the block group's jurisdiction. To ascertain disparities in coverage proportions were compared across subgroups using Z-tests with the Bonferroni correction. Results: Residents of socioeconomically advantaged neighborhoods were more likely to live in jurisdictions allowing retail cannabis commerce than those in disadvantaged neighborhoods (61.7 % versus 54.8 %). Black residents in advantaged neighborhoods were most likely to live where retailing was allowed (69 %), and white residents in disadvantaged neighborhoods least likely (49 %). Latinx and Black populations from disadvantaged neighborhoods were most likely to live in jurisdictions with stronger advertising restrictions (66 %). Equity in licensing policy was more prevalent for Black residents living in advantaged neighborhoods (57 %) than disadvantaged neighborhoods (49 %). Conclusions: Local cannabis policies potentially protecting public health and social equity are unequally distributed across race, ethnicity, and socioeconomic characteristics in California. Research examining whether differential policy exposure reduces, creates, or perpetuates cannabis-related health and socioeconomic disparities is needed.
"Should I Buy or Should I Grow?" How drug policy institutions and drug market transaction costs shape the decision to self-supply with cannabis in the Netherlands and the Czech Republic

Abstract:Background: This paper uses the framework of institutional economics to assess the impact of formal and informal institutions that influence the transaction costs on the cannabis market, and users' decisions to self-supply in the Czech Republic and the Netherlands, two countries with seemingly identical policies towards cannabis cultivation. Methods: A comparative analysis was conducted using secondary qualitative and quantitative data in four areas that were identified as relevant to the decision to cultivate cannabis: (i) the rules of the game - cannabis cultivation policy; (ii) "playing the game" - implementation of cannabis cultivation policy, (iii) informal institutions - cannabis cultivation culture, and (iv) the transaction costs of the cannabis market - availability, quality, and relative cannabis prices adjusted by purchasing power parity. Results: Although the two policies are similar, their implementation differs substantially. In the Czech Republic, law enforcement has focused almost exclusively on large-scale cultivation. This has resulted in a competitive small-scale cultivation market, built upon a history of cannabis self-supply, which is pushing cannabis prices down. In the Netherlands, the costs of establishing one's own self-supply have historically outweighed the costs associated with buying in coffee shops. Additionally, law enforcement has recently pushed small-scale growers away from the market, and a large-scale cannabis supply, partly controlled by organised criminal groups, has been established that is driving prices up. The Czech cannabis prices have become relatively lower than the Dutch prices only recently, and the decision to buy on the market or to self-supply will be further shaped by the transactions costs on both markets, by policy implementation and by the local culture. Conclusions: The ability to learn from the impacts of cannabis cultivation policies conducted within the framework of UN drug treaties is particularly important at a time when increasing numbers of countries are seeking more radical reforms of their cannabis policy.
CANNABINOID CONUNDRUM:: A STUDY OF MARIJUANA AND HEMP LEGALITY IN THE UNITED STATES

Abstract:Marijuana is the most commonly used, cultivated, and trafficked illicit drug worldwide. In the United States, the use and acceptance of marijuana is evolving rapidly as indicated by the volume of new state cannabis legislation. However, marijuana is still a Schedule I drug under the federal Controlled Substances Act (CSA). Further complicating the matter, the 2018 Farm Bill removed hemp from the list of controlled substances under the CSA, resulting in a market flooded with cannabidiol (CBD) products that have not been approved by the Food and Drug Administration (FDA). Many of the changes in state laws have occurred without significant input from medical or scientific communities. The status of marijuana and, until recently, hemp as Schedule I drugs under the CSA creates numerous restrictions which ultimately impact the industry as a whole. The central issues facing marijuana legality in the U.S. are: convoluted state and federal law, adverse health effects of cannabis use, research restrictions that produce knowledge gaps, and inconsistency between the U.S. Food and Drug Administration (FDA) and the U.S. Environmental Protection Agency (EPA) regulations. Marijuana policy must evolve to protect and inform both the general public and individuals involved in the cannabis industry. Potential reform options include: federal exemptions following state compliance, rescheduling marijuana, or complete removal from the CSA. The most vital step in the federal legalization process needs to be less restrictive research opportunities for marijuana.
Alignment in local approaches to alcohol and cannabis control policy: A case study of California cities and counties

Abstract:Background: Public health experts have urged governments around the world to regulate newly legalized cannabis as they do alcohol to effectively and efficiently protect health. However, research evaluating the alignment of alcohol and cannabis policies is sparse. We assessed similarities and differences in local alcohol and cannabis control policies across California, and characterized localities adopting distinct policy approaches. Methods: Using standard legal epidemiologic techniques, we collected and coded local alcohol and cannabis control policies relevant to public health for 12 California counties and all incorporated cities within them (N=241). We assessed whether localities were equally stringent on alcohol and cannabis policies by comparing overall restrictiveness (summed policy scores) and 9 specific provisions that applied to both substances. We captured distinct local alcohol-cannabis policy approaches using latent class analysis, and examined this classification in relation to local demographic, socioeconomic, political, and retail market characteristics. Results: All 241 localities permitted alcohol sales, while 71% banned cannabis sales. Among those that did not ban cannabis sales, more stringent alcohol policy scores were associated with more stringent cannabis policy scores (linear regression coefficient: 0.16 [95% CI: 0.07, 0.25]). Local governments rarely adopted the same provisions for alcohol and cannabis (e.g., limits on hours of sale, advertising restrictions), and only two regulated the co-location of cannabis and alcohol outlets. Localities that were restrictive on alcohol yet permissive on cannabis (12%) were more urban, politically progressive, and had more low-income and racial/ethnic minority residents. Localities that were more permissive on alcohol and restrictive on cannabis (51%) were more socioeconomically advantaged. Conclusion: We found few similarities between local alcohol and cannabis control policies. California's experience suggests that, as governments around the world legalize cannabis, lessons learned from regulating alcohol are not routinely applied to cannabis, particularly in communities distinguished by high social and economic advantages.

Abstract:Research methodology This case was developed using a mixture of publicly available documents created by the partner community, general information from public sources like the First Nations Finance Authority (FNFA) website and Government of Canada websites, and personal and first-hand experience of the indigenous coauthor, Storm Gould. Case overview/synopsis Wisikk is a Mi'kmaq sovereign reserve territory located in Mi'kmaq'ki in the place that settler governments call Nova Scotia. The community has existed in its location since time immemorial and has been recognized by the settler government since the early 19th century. An opportunity for community-run business has arisen for Wisikk based on the legalization of cannabis throughout Canada in 2018. This case's protagonist is the community's Vice-President for Business Development, Andrew Googoo, as he considers bringing a proposal for a cannabis retailing venture to the Chief and Council. Cannabis legalization in Canada left sales policies to the provinces and was silent as to the rules governing cannabis sales by indigenous communities on their sovereign territory. Considering both potential negative impacts to the community, as well as the potential financial benefits from a successful reserve-based cannabis dispensary, Andrew must soon present his initial findings to the Chief and Council for their deliberation and decision. Any venture undertaken by the reserve would require a loan from the FNFA, so Andrew must also consider the projections and reports that the FNFA would require to support their lending decision. Complexity academic level The case is appropriate for mid-level or capstone undergraduate and graduate business courses, especially those focused on entrepreneurship, business ownership or indigenous ownership. The case was originally developed for the accounting division of an international undergraduate case competition. In addition to accounting concepts like pro forma/budgeted income statements and decision analysis, it is intended to showcase some legal and cultural features of community-led indigenous business ventures. The idea is for students to explore concepts of sovereignty, community involvement and broader stakeholder impact, as well as more technical accounting and financial concepts.

Abstract:This article surveys the dramatic sea change in the legal status of both the domestic and international cannabis trade over the past decade and asks whether legalization challenges or complements racial capitalism. As the changing status of prohibited drugs not only seeks to correct a historical wrong but also gives rise to a new, highly profitable cross-border commodities market, I analyse whether the variety of policies that are currently being implemented alongside cannabis legalization—from import restrictions to social equity licences—is sufficient to appease the demand for reparations by the communities who suffered the most through the past century of the 'War on Drugs'. This 'War on Drugs' was both historically and structurally weighted towards the reinforcement of racial hierarchies. As it enters into its twilight, I find that an overview of both the international and domestic laws that are being passed in order to introduce a new age of legal, commercial cannabis threatens to lock in the racial inequalities of our global economy, rather than serve as a tool for the advancement of reparative racial justice.

Abstract:Commons governance theory is central to identifying and managing conflicts arising from natural and cultural resources traps. Scholars - using game theory and economic analysis of law - have proposed alternative models, consisting of a set of mitigated scenarios, multiple players, and new equilibria in commons governance. Likewise, novel legal innovations of the commons have also been designed. Reinterpreting the commons in light of political economy, ecology, and pluralistic approaches, a critical review of existing scholarship, economic analysis of law, and case study investigations are performed. Examining an array of views - including governance of water in Ecuador, Bolivia, and Italy - a research and policy agenda is put forward to offer original interpretations and novel holistic perspectives. Germane environmental policy implications deriving from SDGs, resilient governance, and polycentric perspectives are thus extrapolated. Finally, pluralistic frameworks drafted by mitigation and adaptation are measured by improved sustainable development performance in commons, resource, and water governance.
The impacts of cannabis legalization on organized crime in Ontario and British Columbia

Abstract:This article presents a qualitative study of the impacts of cannabis legalization on organized crime in two of Canada’s largest provinces – Ontario and British Columbia. Utilizing a modified snowball sampling methodology, we conducted semi-structured interviews with 23 subject matter experts in law enforcement, journalism, law, public service, and the private sector. Our findings are complex and reflect a sophisticated, rational response by organized crime to a key legislative event. First, Health Canada’s personal/designated production registrations remain in place, which since 2001 have played a crucial role for allowing some patients access to medical cannabis. However, according to nearly every law enforcement officer interviewed, criminal entities continue to abuse this unique system by obtaining licences under false premises and diverting surplus product into the illicit market. Second, while the domestic market for illicit cannabis has likely declined, many interviewees claimed that organized crime groups adjusted operations by maintaining production levels and diverting shipments into the United States, and also by exploiting relationships with some Indigenous communities. This has contributed to deteriorating public health and safety outcomes within some Indigenous communities. Finally, we registered the belief of many interviewees that the most sophisticated criminal groups have begun shifting attention toward opiate production and distribution – potentially in response to both a smaller domestic market for cannabis, and also the skyrocketing demand for opioids. Our results reflect the unique character of Canadian geography, institutions and electoral politics, notably close proximity to the United States, federal-provincial division of powers, the evolving legacy of colonialism, and a unique series of legal precedents.

A "not-for-profit" regulatory model for legal recreational cannabis: Insights from the regulation of gaming machine gambling in New Zealand

Abstract:A dozen or more regulatory frameworks have been proposed for legal cannabis but many of the "not-for-profit" options have yet to be developed in any detail, reducing the likelihood they will be seriously considered by policy makers. New Zealand's innovative "not-for-profit" regulatory regime for gaming machine gambling (i.e. "slot machines") has reversed the previous increase in gambling expenditure, empowered local councils to cap the number of gambling venues, and is unique in requiring the societies operating gaming machines to distribution 40% of the gross expenditure from machines (i.e. $NZ 262 million in 2015) to community purposes (e.g. sports). However, the regime has been criticised for not addressing the concentration of gaming outlets in poorer communities, and not requiring grants to be allocated in the disadvantaged communities where outlets are located. There have also been cases of gaming societies providing community grants in exchange for direct or indirect benefits. In this paper we adapt this regulatory approach to a legal cannabis market. Under the proposed regime, licensed "not-for-profit" cannabis societies will be required to distribute 20% of cannabis sales to drug treatment and 20% to community purposes, including drug prevention. Grants must be allocated in the regions where cannabis sales are made and grant committees must be independent from cannabis societies. A 20% levy will be used to cover the wider health costs of cannabis use. A further 10% levy will be used to fund the regulator and evaluate the new regime. Local councils will have the power to decide how many, and where, cannabis retail outlets are located. Other important elements include a minimum price for cannabis, effective taxation of cannabis products, regulating CBD in cannabis products, higher taxation of traditional smoking products, advertising restricted to place-of-sale, no internet sales, and restrictions on industry involvement in regulation making and research.
Crafting effective regulatory policies for psychedelics: What can be learned from the case of cannabis?

Abstract:The turn of the century brought a resurgence of interest in psychedelics as a treatment for addiction and other psychiatric conditions, accompanied by extensive positive media attention and private equity investment. Government regulatory bodies in Australia, Israel, Canada and the United States now permit use of psychedelics for medical purposes. In the United States, citizen action and corporate financing have led to petitions and ballot initiatives to legalize psilocybin and other psychedelics for medical and recreational use. Given this momentum, policymakers must grapple with important questions that define whether and how psychedelics are made available to the public, as well as how companies produce and promote them. The current push to broaden the production, sale, and use of psychedelics bears many parallels to the movement to legalize cannabis in the United States and other nations—most notably, the use of poorly‐evidenced therapeutic claims to create a de facto recreational market via the health care system. Experience with cannabis highlights the value of debating the question of legalization for nonmedical use as such rather than misrepresenting it as a medical issue. The lessons of cannabis policy also suggest a need to challenge hyping of psychedelic research findings; to promote rigorous clinical research on dosing and potency; to minimize the influence of for‐profit industry in shaping policies to their economic advantage; and to coordinate federal, state, and local governments to regulate the manufacture, sale and distribution of psychedelic drugs (regardless of whether they are legalized for medical and/or recreational use).

Collaborative Governance at Scale: Examining the Regimes, Platforms, and System in the State of Oregon

Abstract:The American Review of Public Administration, Ahead of Print. This article takes a first step toward analyzing the characteristics of a cross-policy, state-wide collaborative system. Specifically, using data from the Atlas of Collaboration project, we offer a big-picture analysis of how over 200 externally directed collaborative governance regimes (CGRs) are operationalized in a state-level collaborative system consisting of 13 collaborative platforms operating across five policy areas (economic development, education, health, natural resources, public safety) in Oregon. We focus on three attributes—geographic scope, collaborative size, and collaborative characteristics—aggregated at the system level across CGRs, as well as across collaborative platforms and policy areas. The descriptive findings reveal that collaborative efforts are geographically dispersed across the state, involve thousands of participants representing organizations from the public, private, and nonprofit sectors, and vary across multiple characteristics, such as organizational form, lead organization, funding model, structural roles, staffing, and extent of face-to-face dialogue. These findings lay the groundwork for future theoretical development and empirical research.

Abstract:Background In recent years, the cannabis industry has evolved from a world defined by the simplicity and ubiquity of illegality of recreational drug cannabis to a world marked by the legal and geographic complexity of ongoing depenalisation, decriminalisation, and legalisation processes. Within this landscape where drug Cannabis plants and their many derivatives see their legal status change, Cannabis cultigens and end products are increasingly likely to becoming subject to protection by intellectual property rights. This article delves into the implications of these changes for traditional Cannabis farmers, particularly in the Global South, as they face economic and legal threats amidst global legalisation efforts. It examines the potential role of appellations of origin in protecting local Cannabis cultigens and end products, focusing on Moroccan Cannabis and hashish as a case study. Methods The text resorts to the treaties and agreements regulating international property rights and plant variety protection, but also to the concepts of terroir and landrace and their definitions, in order to determine, by way of treaty interpretation and conceptual analysis, what type of legal and economic protections can apply to Cannabis landraces and terroir products. The analysis is also based on previous empirical research published by the author. Results The text argues that appellations of origin are the best intellectual property protections possible for landraces and terroir products because what needs to be protected is not innovation and individual ownership, but tradition and collective ownership, and because appellations of origin are suitable collective intellectual property rights. It shows that appellations of origin are best suited to protect terroir products and landraces because their originality and distinctiveness are place-based originality and distinctiveness. Conclusion The text concludes that appellations or origin offer the only existing intellectual property protection for preserving the distinctiveness of terroir cannabis products, and for landrace conservation. It acknowledges that neither appellations of origin nor existing plant variety protection laws can be legal forms of control of third parties' uses of landraces but that appellations of origin can help protect terroir products and landraces by way of their associated agro-ecosystems.

"To smoke feels gender": Exploring the transformative and emancipatory capacities of cannabis among transgender, non-binary and gender non-conforming (TGNC) youth

Abstract:Background: Transgender, non-binary and gender non-conforming (herein, "TGNC") youth (15-24 years old) face overlapping minority stressors (e.g., gender discrimination, lack of access to gender-affirming care, rejection, violence) that contribute to mental health inequities. TGNC youth also use substances at higher rates when compared to cisgender youth, including some of the highest rates of cannabis use in Canada. Methods: This community-based participatory research study provides an in-depth qualitative, photovoice-based analysis examining how cannabis use features within the gender experiences of a sample of TGNC youth in British Columbia (BC). We conducted in-depth, semi-structured interviews with 27 TGNC youth (15-24 years old) from across British Columbia. Interviews were designed to elicit discussions about the photos youth had taken as well as various gender and mental health experiences related to their cannabis use. Analysis and identification of emergent themes was guided by social constructivist grounded theory as well as queer and trans theorizing and informed by community-based research approaches through regular meetings with our team's Substance Use Beyond the Binary Youth Action Committee comprised of TGNC youth who use substances. Results: Three overarching themes pertaining to cannabis use and gender experiences amongst TGNC youth in our study were generated. First, participants used cannabis purposefully and strategically to enact diverse gender expressions and embodiments. Second, participants leveraged cannabis to support introspection whilst mobilizing identity discovery and development. Finally, participants mobilized cannabis as a vehicle for accessing moments of gender euphoria and affirmation. Conclusions: These findings identify how some TGNC youth use cannabis to purposefully and strategically facilitate their mental health, well-being, identity development and self-expression. This research reveals critically important experiential and embodied dimensions of cannabis use that have not historically been considered in cannabis-related policy and the provision of care, including mental health and substance use-related care.

Abstract:The Cannabis industry is currently one of the fastest growing industries in the United States. Given the changing legal status of the plant, and the rapidly advancing research, updated information on the advancement of Cannabis genomics is needed. This versatile plant is used as medicine and for food, fiber, and bioremediation. Insights from modern, high-throughput genomic technology are revolutionizing our understanding of the plant and are providing new tools to further improve our knowledge and utilization of this unique species. This review quantifies and evaluates the currently available genomic resources for Cannabis research, including six whole-genome assemblies, two transcriptomes, and 393 other substantial genomic resources, as well as other smaller publicly available genetic and genomic resources. The open-source approaches followed by many leading scientists in the field promote collaboration and facilitate these rapid advances.

The Polycentric Governance of Innovation Systems

Abstract:The governance of innovation systems reflects upon how decisions are made, the rules that govern who makes decisions are formed, institutions are established and interactions occur. Governance strongly affects how innovation systems emerge and yet has received limited attention. Many actors fulfill certain functions, indicating that the emergence of innovation systems is likely to transpire in many different spaces at the same time. We expect governance to occur in multiple centers of an innovation system and in differing ways. Therefore, a polycentric governance lens can be a powerful means to evaluate the patchwork of decision-making centers, which we apply to offshore renewable energies. We observe that the system is governed polycentrically and identify five decision-making centers: legislative, market, industry, research & development and demonstration. Each center is unique and operates under different institutional conditions. We suggest that all innovation systems have a distinct polycentric composition.
Local Governance, Ecological Knowledge, and Spatial Models: Assessing Resource Access in a Forest Commons

Abstract:Local ecological knowledge informs how natural resource patches are identified and valued across a landscape by communities that rely on them. However, local knowledge is not always considered in quantitative models evaluating resource access and quality. Based on ethnographic fieldwork in southwest China, I integrate ecological, economic, and cultural factors to model non-timber forest product distribution and resource access in a community-based forest governance system. Observations over four mushroom harvesting seasons suggest that the distribution of harvesters relative to available resources follows the expected distribution under an ideal free distribution (IFD). An emergent ideal free distribution is significant as it may offer evidence of sustainable and equitable resource management. Moreover, this case offers an extension of the IFD by basing model parameters on locally-determined forest values and knowledge rather than predominantly environmental variables. Finally, results reaffirm that local forest management systems with adaptive property rights and redistributive norms offer multiple benefits for addressing resource governance challenges.
