Abstract:Abstract Background Respect for patients’ autonomy is usually considered to be an important ethical principle in Western countries; privacy is one of the implications of such respect. Healthcare professionals frequently encounter ethical dilemmas during their practice. The past few decades have seen an increased use of courts to resolve intractable ethical dilemmas across both the developed and the developing world. However, Chinese and American bioethics differ largely due to the influence of Chinese Confucianism and Western religions, respectively, and there is a dearth of comparative studies that explore cases of ethical dilemmas between China and the United States. Methods This paper discusses four typical cases with significant social impact. First, it compares two cases concerning patient privacy: the “Shihezi University Hospital Case”, in which a patient was used as a clinical teaching object without her permission, and the “New York-Presbyterian Hospital Case”, in which the hospital allowed the filming of a patient’s treatment without his consent. Second, it compares two cases regarding patient autonomy and potentially life-saving medical procedures: the “Case of Ms. L”, concerning a cohabitant’s refusal to sign a consent form for a pregnant woman’s caesarean, and the “Case of Mrs. V”, concerning a hospital’s insistence upon a blood transfusion for a dissenting patient. This paper introduces the supporting and opposing views for each case and discusses their social impact. It then compares and analyses the differences between China and the United States from cultural and legislative perspectives. Conclusions Ethical dilemmas have often occurred in China due to the late development of bioethics. However, the presence of bioethics earlier in the US than in China has not spared the US of ethical dilemmas. This paper highlights lessons and inspiration from the cases for healthcare professionals and introduces readers to the role and weight of privacy and autonomy in China and in the US from the perspectives of different cultures, religions and laws.

Overcoming personal information protection challenges involving real-world data to support public health efforts in China

Abstract:In the information age, real-world data-based evidence can help extrapolate and supplement data from randomized controlled trials, which can benefit clinical trials and drug development and improve public health decision-making. However, the legitimate use of real-world data in China is limited due to concerns over patient confidentiality. The use of personal information is a core element of data governance in public health. In China’s public health data governance, practical problems exist, such as balancing personal information protection and public value conflict. In 2021, China adopted the Personal Information Protection Law (PIPL) to provide a consistent legal framework for protecting personal information, including sensitive medical health data. Despite the PIPL offering critical legal safeguards for processing health data, further clarification is needed regarding specific issues, including the meaning of “separate consent,” cross-border data transfer requirements, and exceptions for scientific research. A shift in the law and regulatory framework is necessary to advance public health research further and realize the potential benefits of combining real-world evidence and digital health while respecting privacy in the technological and demographic change era.

Abstract:Because of the development of society, public awareness of rights is constantly being activated, and the citizen no longer merely plays the role of obedience, and the action of protecting rights is becoming more and more conscious. Most notably in terms of health care, the media has reported a large number of cases that patients bring a suit with privacy violations as a matter of recourse to the Court for compensation in recent years .They reflect that the dispute caused by privacy has intensified the conflict between doctors and patients . Therefore, the research on the protection of patients ' right of privacy is of great significance to the protection of personality rights and the solution of existing doctor-patient contradictions. This article is divided into three parts: the cut-in point is the concept of patient privacy, the contents and features. And combined with the present situation of protection and the knotty problems in our country, solutions are put forward. When a complete and systematic protection system is established, the legal protection of patients ' privacy will not be an armchair theory any more.

Abstract:In the current social environment, the generation and application of medical big data is closely related to the personal information security of every citizen. With the continuous development of medical technology, the application of medical big data has become increasingly widespread. On one hand, it can promote the development of medical technology, including drug development, personalized medicine, and precision treatment. On the other hand, medical big data also concerns the private information of citizens, which is a crucial part of personal information protection. However, in practice, there often exists a contradiction between medical big data and the protection of citizens' personal information rights. From the perspective of medical big data, there are overlaps and differences among citizens' personal information, privacy information, medical health information, and medical big data information. Relying solely on the “informed consent” rule for personal information cannot effectively protect personal information comprehensively or guarantee the application and development of medical big data. This article analyzes the issues surrounding Chinese medical big data in terms of personal information from a legal perspective, and proposes corresponding solutions to these issues. It is hoped that this research can contribute to advancing the legalization of medical data openness, re-examining patients' personal information in the context of medical big data, and balancing the conflicts between individual privacy interests, public interests, and economic benefits of medical data, thus better protecting individuals' personal information interests under social and private benefits.
A Sociosemiotic Exploration of Personal Information Legislation in the United States and China

Abstract:Personal information security has become a critical concern in the digital era, so it is imperative to clearly delimit and define personal information. This study examines personal information legislation from a sociosemiotic perspective to identify the similarities and differences between legislation in the United States and China. It reviews the evolution of personal information in both countries, and explores their differences in the definition of privacy, the status quo of personal information legislation, the definition of personal information and cross-border personal information flow. The findings indicate that (1) personal information, noted as a social sign, has context-sensitive characteristics, i.e., spatiality and temporality; (2) the meaning-making process of personal information is a continuum; and (3) there exists an intersemiotic operation between language, law and society. Such a sociosemiotic exploration can shed light on relevant studies in the sociosemiotic analysis of legal discourse in particular as well as other context-sensitive discourses in general.

Abstract:The medical data processed and analyzed in clinical research often contain a large number of personal information. Therefore, researchers should pay attention to the safety management of medical data during clinical research. The Data Security Law of People's Republic of China and the Personal Information Protection Law of People's Republic of China implemented on 1 st September and 1 st November 2021 respectively establish legal basis for data security and personal information protection and point out the direction for medical data security, which indicate that data governance has entered the 'strong regulatory era'. In the process of medical data collection and application of clinical research, respecting and protecting the privacy and safety of patients, ensuring the quality of medical data, safely managing medical data and carrying out high-quality clinical research will be an important test for the collection and application of clinical scientific research data under the new legal background.

Abstract:During the process of transformation of social information,China still faces the sever legal environment.At present,how to formulate personal information protection law is a realistic problem in front of us.Thus,it isn’t easy to formulate the law,which not only accords with China’s reality,but also joins international track.In America,self-regulation mechanism is the basic mechanism to protect personal information,and it plays good social function.But it doesn’t fit for China.The basic experience of EU’s personal data protection system tells us,personal information should be protected by legislation,because this relates to human rights.China can draw lessons from safe habor model to formulate personal information protection law actively,and advocate industries actively adopt self-discipline methods to protect personal information.Taiwan area’s data law is an attempt of compromise between Orient and West,and its successful experience can be used as a reference for China mainland’s legislation.

Abstract:Personal information protection and privacy interact in diverse ways, especially in the contemporary information age. Although books and articles have focused on this topic, the new tendencies of worldwide legislation and judicial practice bring challenges, as the legal construction of personal information protection and privacy differs from culture to culture and time to time. In 2017, the General Provisions of the Civil Law of the People's Republic of China ("the General Provisions of the Chinese Civil Code" hereafter)<a class="workspace-trigger" href="#cit_1">1</a> (expired) addresses the legal concepts of personal information protection and the right to privacy simultaneously, to which this article refers as the dual model, differing from the one-dimensional mode of privacy protection before. Subsequently, the "The Right to Privacy and the Protection of Personal Information," a chapter of the newly issued Civil Code of the People's Republic of China's ("the Chinese Civil Code" hereafter), ascertains the dual model and details related provisions. It has been dubbed a landmark ruling of China's personal information protection, greatly boosting the modernization of China's civil system.Despite the many articles that discuss approaches to China's civil protections, little attention has been given to the fundamental question concerning what exactly encompasses the personal information protection and privacy to which these laws refer. Based on the regulations and applicability of the General Provisions of the Chinese Civil Code and the Chinese Civil Code, this paper explores the legal construction of personal information protection and privacy under Chinese legal orders, including the differences, similarities, and interplay between the two rights. By distinguishing the legal value, contents and remedial approaches, this paper concludes that the two rights are distinct but overlap. On one side, personal information protection is elevated to the status of a separate civil right in the legal context of China, rather than part of privacy. On the other side, tailored regulations should be establish according to the criteria of the nature of information, the extent of information processing, and the elements of damage when confronted with overlaps in the two rights in judicial practice. Thus, this paper provides a perspective from which to clarify the approaches to civil protection of personal information and privacy in China and a reference model for enactment of the Chinese Personal Information Protection Law in the the future.

Abstract:Advanced artificial intelligence (AI) technologies are now widely employed in China's medical and healthcare fields. Enormous amounts of personal data are collected from various sources and inserted into AI algorithms for medical purposes, producing challenges to patient's privacy. This is a comparative study of Chinese, United States, and European Union operational rules for healthcare data that is collected and then used in AI functions, particularly focusing on legal differences and deficiencies. The conceptual boundaries of privacy and personal information, the influence of technological development on the informed consent model, and conflicts between freedom and security in rules of cross-border data flow were found to be key issues requiring consideration when regulating healthcare data used for AI purposes. Furthermore, the results indicate that the appropriate balance between privacy protections and technological development, between individual and group interests, and between corporate profits and the public interest should be identified and observed. In terms of specific rule-making, it was found that China should establish special regulations protecting healthcare information, provide clear definitions and classification schemas for different types of healthcare information, and enact stricter accountability mechanisms. Examining and contrasting operational rules for AI in health care promotes informed privacy governance and improved privacy legislation.

Abstract:The purpose of this essay is to investigate the privacy concerns of Chinese, and to develop relevant protective measures. The groups are divided into two parts by gender and six parts by ages to analyze the different gender and different age groups of privacy concerns. The significance of this study is protecting personal data property. The data of personal information after finishing processing have economic value. These data once disclosed, will be not reversible, so it is important to study the personal privacy in the era of big data and to initiate and enforce legal and regulatory protection measures. Results show that Chinese’s privacy in public places for Internet records, friends dynamic and age’s awareness is insufficient; most people especially female lack privacy protection skills. Educators need to improve the relevant laws and regulations, promote privacy protection skills and strengthen the conception of privacy.

Abstract:In recent years, personal information matter that treat people's daily life frequently happens, many studies have been done to deal with it from perspectives of legislation at national level. This paper identifies legal requirements for personal information protection under perspectives of information resources management at organizational level. 29 Chinese laws are identified that have legal requirements for personal information protection for Chinese public services. Studies show that there is an increasing number of legal requirements for personal information protection for key areas of public services. However, there is no independent and comprehensive law for personal information protection along life of information that covers entire processes of information resources management in Chinese legislation. There is a demand for developing comprehensive regime for personal information protection for Chinese public services. This paper suggests three aspects for consideration for the development of a comprehensive regime for personal information protection through information resources management for public services in China. Such suggestions can take the advantages of existed legal requirements for personal information protection as a complementary new whole for an effective regime to overcome existing barriers towards the development of a comprehensive regime for the protection of personal information for the Chinese public services.

China’s draft Personal Information Protection Law

Abstract:In October 2020, China published a draft of the Personal Information Protection Law of the People’s Republic of China (PRC) for public comment. The draft law is intended to be the first consolidated and comprehensive law targeting the protection of personal information in China. If enacted in its current form, the law would introduce a suite of obligations that apply to organisations in both the private and public sectors and individuals that process Chinese residents’ personal information. The scope, structure and substance of the draft law not only resemble that of the European Union (EU) General Data Protection Regulation (GDPR) in a number of key ways but also diverge from the GDPR in many respects. The draft Chinese law also has some similarities with various US privacy laws, although the United States has not enacted a comprehensive federal privacy law that applies across the country. Despite the variations among the regimes of China, the EU and the United States, organisations that do business in these geographies can leverage the privacy compliance programmes they may have established for the United States and EU to prepare for the implementation of the draft Chinese Personal Information Protection Law. This paper summarizes the key requirements of the draft Chinese law and provides high-level observations regarding its similarities to and differences from the GDPR and key US privacy laws.

Abstract:In the era of rapid development of big data, the problem of personal information leakage is widely concerned by the society. Among them, sensitive personal information related to the human dignity of natural persons or basic rights such as personal and property is more important. China introduced the Personal Information Protection Law in 2021 to improve the legal system of personal information protection in China, but due to the short development time of the relevant system for the protection of sensitive personal information, resulting in the legal protection of sensitive personal information faces serious challenges in practice, so it is especially important to improve the legal protection of sensitive personal information in China. Based on this, this paper firstly explains the concept and characteristics of sensitive personal information, then analyzes the shortcomings of the legal protection of sensitive personal information, and finally puts forward suggestions for improvement from different perspectives, including improving the principle of "informed consent", strengthening the supervision of industry self-regulation and improving the principle of imputation.

Exploring Barriers and Ethical Challenges to Medical Data Sharing: Perspectives from Chinese Researchers

Abstract:The impetus for policies promoting medical data sharing in China has gained significant traction. Nonetheless, the present legal and ethical framework governing the research use of medical data in China, is characterized by a more restrictive rather than permissive approach. The proportion of Chinese medical data being leveraged for scientific research still has room for improvement at present, indicating a significant untapped potential for advancing medical knowledge and improving healthcare outcomes. Building upon this research, we aim to delve deeper into the challenges researchers encounter in the sharing of medical data through focus group interviews. We conducted two focus group interviews study with researchers representing diverse disciplines to explore their perspectives on 21 June 2021 and 28 July 2021. A total of seventeen researchers willingly participated in this study, representing various professional backgrounds. Similar codes were merged. Research team discussions were also utilized to select interviewees’ statements that were regarded as typical or representative. The respondents demonstrated a strong understanding that medical data should not be disseminated arbitrarily, recognizing the importance of sharing data in compliance with laws. Through the interview, we found that although respondents stressed the importance of careful consideration regarding if and when this information can be responsibly released, none of the respondents raised the issue of necessitating consent from data subjects for the research use of medical data. This observation sharply contrasts with the stringent separate consent provisions for secondary data use outlined in the PIPL. The findings from the focus group studies shed light on researchers’ barriers and ethical challenges towards medical data sharing for scientific research, highlighting their deep concern for data security and cautious approach to sharing. The key objectives aimed at facilitating and enabling the reuse of medical data encompass enhancing interoperability, harmonizing data standards, improving data quality, safeguarding privacy, ensuring informed consent, incentivizing patients, and establishing explicit regulations pertaining to data access and utilization.

Abstract:The Personal Information Protection Law, as the frst law on personal information protection in China, hits the people’s most concerned, realistic and direct privacy and information security issues, and plays an extremely important role in promoting the development of the digital economy, the legalization of socialism with Chinese characteristics and social public security, and marks a new historical development stage in the protection of personal information in China. However, the awareness of privacy protection and privacy protection behavior of the public in personal information privacy protection is weak. Based on the literature review and in-depth understanding of current legal regulations, this study integrates the relevant literature and theoretical knowledge of the Personal Protection Law to construct a conceptual model of “privacy information protection willingness—privacy information protection behavior”. Taking the residents of Foshan City as an example, this paper conducts a questionnaire survey on their attitudes toward the Personal Protection Law, analyzes the factors infuencing their willingness to protect their privacy and their behaviors, and explores the mechanisms of their infuencing variables, to provide advice and suggestions for promoting the protection of privacy information and building a security barrier for the high-quality development of public information security.

Abstract:The legal protection of biometric data is becoming an increasingly important issue in the information society. China attaches importance to the legal protection of biometric data. Over the past decades, the rapid development of digital technology has profoundly influenced Chinese information society. However, digital technology may also trigger substantial risks. In this article, we provide an in-depth examination of existing Chinese laws protecting biometric data. We explore general laws and facial recognition laws, administrative regulations, sector-based rules, judicial interpretations, regulatory documents, policy documents, and (draft) national standards. We find gaps in laws in China. Building on this analysis, we elaborate on five principles for the legal protection of biometric data: (1) legality, propriety, and necessity; (2) integrity; (3) purpose; (4) minimization; and (5) controllability. We provide three policy recommendations for the legal protection of biometric data: (1) sufficiently considering the purpose of the collection of biometric data, (2) creating controllable mechanisms, and (3) implementing regulatory compliance programs.
