Abstract:This paper explores the effect of land titling on agricultural productivity in Vietnam and the productivity effects of single versus joint titling for husband and wife. Using a plot-fixed-effects approach our results show that obtaining a land title is associated with higher yields, for both individually and jointly held titles. We conclude that there is no tradeoff between joint titling and productivity, and so joint titles are potentially an effective way to improve women’s bargaining power within the household with no associated efficiency losses. An Empirical Study of Land Rights of Rural Women in China

Abstract:Most women in China got the equal land rights in the i nitial distribution of land in the second round of contract. However, women ofte n lose their land rights when they migrate somewhere else due to marriage or som e other reasons. It is usually caused by the following four reasons. First, ther e is a conflict between the related legislations on the unchangeable contract ri ghts for 30 years for the sake of protection and stability of the contract right s of farm households and Chinese custom that married rural women live in their h usbands' villages, which leads to a fact that women married within the contract term can neither get land in their husbands' villages nor take their contracted land away from their native villages and consequently the loss of their land rig hts. Second, the instability and inconsistence of land policies affect the conti nuity of the rural women's land contract rights. When local governments in many regions are adjusting land contract rights, they are deeply influenced by variou s informal constraints such as ethics and customs, which usually lead to the los s of land rights of migrated married women. Third, some migrated married women c annot get the land contract rights for the time being due to the limited land su pply in some administrative villages. Lack or small quantity of reserved land ma ke immigrated married women cannot get their land contract rights on time. They can only get the land after some villagers return their lands due to further edu cation, death or marriage. In some villages with small land supply and big popul ation, it will take a long time to get the land. Fourth, some divorced women can not get the land contract rights due to the inequality between men and women. Th e contracted lands and the distributed profits from the rural collective lands a re usually registered in the name of male head of the households. Once a family breaks, a rural woman is usually in a very disadvantaged position when distribut ing the household property such as household contracted land, land for house bui lding and its attachment, and collective dividend. To solve the problems on the land rights of rural women, the Government should first affirm the land rights a s real rights; quicken the reform of the land property right system; define the legal purview of some disposition rights including use right transfer, subcontra ct, lease, conversion into shares, joint operation, mortgage, and inheriting; ad opt a marketalized mechanism to realize the dynamic land contract rights of marr ied women, for example, distributing and transferring land real rights among fam ily members or establishing cooperation within the family; conduct the sharehold ing reform of land operation rights and benefit rights in the villages with high er levels of industrialization and urbanization and protect the land rights of r ural women by the reform of the land property right system. The Government shoul d also strengthen the legal protection and assure the long-term land use right of the farmers particularly the rural women. The related laws such as ″Law of R ural Land Contract″ should be strictly implemented and the existing village cus tom and regulations which are contradictory to the related laws should be abolis hed.

Abstract:This paper gives a detailed evolution of the land tenure in Vietnam from the time of its recorded history up to its division in 1954. It attempts to complement the various studies on land tenure in this country, focusing particularly on the need for redistribution and the issue of efficiency vs. equity in land reform. This study of the Vietnamese experience shows that land reform is a recurring theme throughout the history of land tenure in Vietnam and that major political and economic events may be interpreted in this light.

Abstract:Many policy makers and academics striving for more gender equality consider joint property rights as preferable over sole rights, since the latter often discriminate against women. Several governments in low-, middle- and high-income countries have therefore imposed joint rights through modifications of statutory law or mandatory joint property registration. We first discuss a general theoretical framework of determinants of property rights with a focus on jointness and the interplay between statutory law, customary law and religious norms, as well as the importance of gendered customs, norms and perceptions around household, family and community arrangements. We then also relate this specifically to the case of Myanmar—based on literature and original qualitative data collected with men and women across all four agro-ecological zones in rural Myanmar. We find equal customary and statutory joint property rights regime upon marriage where inheritance rights are not different for men and women, but only one name is generally recorded on land use certificates. A strong sense of “togetherness”, including a custom of income pooling and rare occurrence of divorce, limits the rationale of marital partners to exercise rights solely rather than jointly. Nevertheless, which household members’ name is on a document is important for accessing credit or engaging with officials and government authorities, and strong patriarchal norms guide official and administrative procedures. Whereas short-term impacts of sole land titling seem limited, the extent to which sole or joint titling might affect gender equality in the longer term remains a topic of future research.

Abstract:Land-titling programs, land and forest allocation programs, and projects on state-allocated land for development and investment in Laos have been key drivers of change in land tenure. These have triggered major shifts in land use rights, from customary, to temporary, and then to permanent land use rights. This article explores how government programs to grant land use rights to individual households have affected the way people have been able to acquire and secure land tenure. For our case study, we selected the village of Napo, the target of many land tenure changes in the past four decades. We collected data from district offices, group discussions with village organizations, and interviews with selected households. The study shows how land use rights shifted over time and reveals that households obtained most of their agricultural land and forestland through a claim process. Original households were mainly land claimers, while migrants were land buyers. The process of formalization and allocation of tenure triggered inequality among households. Attention is needed in future land governance and tenure reforms in order to safeguard the land use rights of local people in an equitable manner.

Abstract:This article extends the debate on gender and property rights that has previously focused on agricultural land in rural areas to housing in urban areas. Specifically, it explores the impact of joint titling of houses on women's empowerment in urban informal settlements in Chandigarh, India. Property rights increase women's participation in decision making, access to knowledge and information about public matters, sense of security, self-esteem, and the respect that they receive from their spouses. Women display a higher attachment to their houses than men, especially after getting joint titles, because houses play a valuable role in fulfilling women's practical and strategic gender needs. This increased attachment to the house helps reduce property turnover in regularized settlements, hence assisting the government in attaining its goals and making joint titling a win-win policy.

Abstract:The libertarian case for legal titling is that formalization of the economic (de facto) rights of those who own land and buildings improves prospects for capitalism and, ultimately, development. Although all rich countries have private property rights, we argue that the success of legal titling depends on a certain kind of state — what we call a property-protecting state — that is often missing in developing countries. We use insights from Austrian economics, public choice, and institutional economics to clarify the political basis for legal titling to improve land tenure security. Evidence from Afghanistan shows that legal titling has not worked because the country does not have a property-protecting state. We suggest focusing on improving political institutions before investing in legal titling. In the meantime, it makes more sense to register land ownership at the community level, without the state.
Forest Tales? Unravelling Divergent Land Use and Land Cover Change (LULCC) Maps and State Narratives in Vietnam's Northern Uplands

Abstract:The Vietnamese state has advocated for the sedentarization and market integration of upland northern farmers over the past thirty years, leading to both agrarian and forest transitions. This article presents a comprehensive land use and land cover change (LULCC) analysis of two adjacent upland borderland districts, Phong Thổ and Bát Xát, in northern Vietnam, spanning two neighboring inland provinces, Lai Châu and Lào Cai. These districts are primarily home to ethnic minority farmers who are encouraged by Vietnamese state officials to not only protect forests but to also transition toward cash crop cultivation from less intensive semi-subsistence agriculture. Our LULCC maps, covering the period from 1990 to 2020, revealed a reduction in the speed by which closed-canopy forests were disappearing. During interviews, state officials were confident that this was due to a range of state policies and state-sponsored initiatives, including the promotion of tree crops and payments for forest environmental services. Our own fieldwork in the region suggests other factors are also supporting this decline in deforestation rates, rooted in ethnic minority farmer livelihood decision making. Some state officials were also able to point to factors hindering a more positive result regarding forest cover, including population pressure and new infrastructure. Interestingly, despite our positive findings on Land use and land cover change (LULCC) related to forest cover, one-third of state officials, upon reviewing our LULCC maps, firmly maintained that errors had occurred. Some even proposed that there was an actual rise in forest cover. Our study shows that these discrepancies raise compelling questions about officials' political motivations and ongoing pressures to uphold the central state's reforestation and agrarian transition discourses.

Abstract:The lack of transfer rights for collectively owned land has led to inefficient land use and rising urban–rural income inequality in China, which calls for property rights reform in the rural area. This article studies the land titling experiment in Chengdu since 2008. Based on field surveys and analysis of data on land transactions, we find that rural residents' income and wealth increased significantly after achieving transfer rights on collectively owned land. The implied land price is found to be correlated with the strength of property rights. With land titling, the market for rural construction land is growing in Chengdu. We argue that a property rights reform that changes the primary role of rural land from welfare to property will provide China with an opportunity to achieve urban–rural harmony and land-use efficiency while maintaining its fast urbanization process.

Abstract:Urban Quality of Life (UQoL) is the main objective of sustainable development in the urban context. It is now widely recognised as a multidimensional concept. The satisfaction provided by the elements related to accommodation, such as housing and land, greatly contributes to the satisfaction with quality of life. Meanwhile, the UQoL also contributes to housing and land prices in cities. Our review shows that most current studies on this interrelationship are limited to several dimensions of UQoL and their impact on housing or land prices. This article will fill the gap by using the land price as an input for calculating a UQoL index from the viewpoint of the Status-Quality Trade-Off theory and ecosystem services. A case study was conducted in Cau Giay District, Hanoi, Vietnam, to create a map of the UQoL index and investigate the interrelationship UQoL – land price. In an ideal condition, this interrelationship should be positive (high/low UQoL index – high/low land price). However, this research revealed two other negative scenarios: “high UQoL index – low land price”, and “low UQoL index – high land price”. These negative scenarios can bring many business opportunities and therefore be interesting for stakeholders in the real estate market.

The Distribution of Residual Controls and Risk Sharing: A Case Study of Farmland Transfer in China

Abstract:Structuring contracts to share interest and risk is the central premise of farmland transfer, yet the contract framework and its determinants have rarely been empirically tested based on micro-level data. In this study, we aim to examine factors underlying the balanced distribution of residual controls and risk sharing on contract framework by using field surveyed data of 353 individual farmland transfer contracts. Our evidence shows that the policy of farmland property rights registration has a significant effect on the contract framework and supports the implication of enforcement costs exerted by the effects of the scale ratio and the contract form, contract duration, conversion way, and long-lived assets input. Although our findings fail to support the typical implication of risk sharing as an explanation of contract framework of farmland transfer, given the symmetric positions of two contracted parties of rural farmer households, it is proved that right confirmation and contract duration are two important factors underlying contract options.

Abstract:This paper uses cross-sectional agricultural and household surveys conducted in 2008 and 2009 to examine the impact of land titles on agricultural outcomes combining the use of a theory-based approach and a propensity score matching. The results of the analysis reveal no significant impact of land titles on agricultural production, agricultural investments and long-term maximisation agricultural behaviour once differences in covariates between households and plots with and without land titles are taken into account. In fact, there is no indication of relevant impacts of land titles on access to credit and on perceived tenure security either, pointing to a break at an early stage in the causal chain of impact. The results are overall robust to the selection of the matching method and to different specifications of the matching equation. Finally, the study discusses some aspects of the institutional context that could help to explain why land titling in Tanzania has failed to bring about the expected changes in agricultural outcomes.

Abstract:The carbon emission rights market effectively controls emissions activities and develops the economy. The market's stability will depend on determining the legal nature of the objects allowed to circulate in that market. However, carbon trading markets worldwide have yet to reach a consensus in determining the legal nature of carbon emission rights. The article shows that national laws have different approaches to the legal nature of carbon emission rights in one of the following cases: (i) Just an administrative tool; (ii) Is an object of ownership, which is divided into goods or financial instruments; (iii) Is subject to ownership rights but is limited; (iv) Determined flexibly. The article reviews international experience in determining the legal nature of emission rights. Based on that, the article explores the factors determining the legal nature of carbon emission rights. Specifically, the paper determines that the right to emit carbon qualifies as an asset and should be classified as an intangible asset.
Financial incentives for sanitation take-up: A randomized control trial in rural Vietnam

Abstract:This study assesses the impact of financial incentives on hygienic latrine ownership by poor/near-poor households in Vietnam. Rural communes were randomly assigned to a control group and three treatment arm groups: (T1) a rebate for households that installed a hygienic latrine; (T2) a financial reward for commune governments if the proportion of hygienic latrines in their commune increased by 30 percentage points; (T3) both a household rebate and a commune reward. We find a strong and positive effect from the household rebate (treatment arms 1 and 3) but an insignificant effect from the commune reward (treatment arm 2) on household ownership of a septic tank latrine. Our analysis provides suggestive evidence that microcredit is a channel through which a rebate encourages the installation of septic tank latrines. We also find that treatment arm 3 increases people's knowledge regarding sanitation and the availability of water and soap for handwashing within households.

Abstract:Based on modern property law theories, this paper analyzes the relations between the land use right and housing ownership, revealing the restriction on the integrity of housing ownership by certain Chinese law about the term of land use right. Under the restriction, the free transfer of housing ownership will be influenced. Finally, The authors propose some suggestions on how to improve the land use right re-leasing application system and the integrity of housing ownership at the expiration of the term of land use right.
Capitalization of Legal Title: Evidence from Small-Property-rights Houses in Beijing

Abstract:Small-property-rights housing is one of informal ways of providing housing units in Chinese cities. Yet, there are still relatively few studies of informal settlements in China. This paper addresses that gap in the literature by tracing the source of informality in the context of the property rights system in China and empirically investigating the value of a legal title in urban China. It uses housing project data collected in Beijing and spatial econometric models to estimate the value of a legal title. The findings show that a legal title adds value to properties. Housing price falls by 45–60% if housing property does not have a legal title, after the physical and locational characteristics of the housing properties are controlled. It also finds that the value of a legal title tends to change across space and across housing physical characteristics.
Assessing Co-Titling Desirability in Matrimonial Properties in Urban Land Ownership in Tanzania

Abstract:Laws in Tanzania allow married couples joint ownership of land but in practice single land titling in the husband’s name only is most common. The ability to co-title was expected to attract couples to own their matrimonial properties jointly; however, the rate at which spouses are adopting co-titling remains low. This paper assesses the desirability of co-titling in land ownership among spouses using key informant interviews and a survey of couples. It is based on a case study of Makongo Juu settlement in Dar es Salaam City where a regularisation programme was implemented. The paper reveals a number of benefits as well as constraints of co-titling for married couples. Findings show that a majority of female spouses had little awareness of the existence of co-titling arrangements. Whereas a majority of female spouses showed interest in co-titling of their matrimonial properties, male spouses were hesitant and, in some cases, they even denied their spouses rights to matrimonial land ownership. Traces of social norms, customs and traditions that generally do not favour co-ownership of matrimonial properties were noted to influence the couple’s decisions. By looking into co-titling as a dimension of enhancing women’s matrimonial property rights, this paper contributes to a wide discussion on women’s land rights in the course of economic empowerment. The findings can be used in the formulation of gender mainstreaming policies and programmes in developing countries.

Abstract:This study uses individual-level survey data from women and men in Uganda and South Africa to examine coupled women's joint ownership of land and housing. It compares women's control over and benefits from jointly held land and housing with those of coupled women not owning land or housing at all and coupled women owning them solely. The lack of a clear and consistent advantage of joint ownership potentially arises from frequent disagreement within couples about whether the land or house is jointly owned. The study serves as a reminder of the complexities of joint ownership in practice, particularly within families, that need to be considered in order for coupled women to benefit from joint asset ownership. Efforts promoting joint ownership, for example, joint titling and marital property laws supporting joint ownership, should not only consider these complexities but also establish and communicate clear and enforceable rules for joint ownership.
